This chapter discusses the law on discrimination due to the protected characteristics of gender reassignment, marital status and civil partnership, and pregnancy and maternity. The Sex Discrimination Act as originally drafted only prohibited discrimination on grounds of sex and marital status. However, civil partners are now treated in the same way as married people. Transgender people, who live as someone of the opposite gender, are protected from discrimination. They can also change their birth certificates so that their new gender is reflected there. Pregnant women have a right not to be discriminated against, and this is a free-standing right. People are entitled not to be discriminated against because of their sexual orientation. The prohibition against sex discrimination covers heterosexuals as well as homosexual people.

The COVID-19 global health crisis has led to inexplicit responses from the communities on the psycho-social as well as psychological domains. The imposition of various restrictions including physical distancing norms have been reported to have caused a catastrophic impact on the lives of sexual and gender minorities. With their source of employment lost at the gravity of the pandemic accompanied with dreadful instances of stigma and discrimination projected onto them, the transgender and sex worker communities have been bearing the brunt of inequality since the outbreak of the pandemic. Bridging the gap between the studies highlighting the plight of marginalized communities in the wake of the COVID-19 pandemic, this study would advance the knowledge into their experiences and struggles. The aim of the study is to fill the gap in literature pertaining to the understanding of the impact of COVID-19 on transgenders and sex workers in India.

“We want employment, we want jobs, we want welfare.” This was a main slogan at a daylong dharna (protest) organized by a South India–based transgender and hijra group one humid summer afternoon in the city of Hyderabad in July 2015. The main goal of the dharna was to demand that the state government recognize transgender rights as recommended by India’s Supreme Court (SC). In 2014, for the first time in India’s history as an independent nation, the SC had recognized nonnormative gender identities as legal. It had also recommended that the government implement corresponding affirmative action policies in employment and education. There was a significant media presence and great interest in the dharna, whose organizers had mobilized a surprisingly large number of progressive groups to support their cause. It had been previously unthinkable that one of the most marginalized and stigmatized groups in the country could make demands of the state. When the day was over, the gathering had been a huge success that increased the visibility of the community while also showcasing its newfound political power....

This chapter examines policy drifts in the area of civil rights. It begins with a brief review of the specific legal protections advanced for women and people of color since Reconstruction. It then examines the politics surrounding efforts to restrict and then restore those rights for equitable pay for women. This chapter also examines efforts to pass a civil rights law for lesbian, gay, bisexual, and transgender (LGBT) employees, formally known as the Employment Non-Discrimination Act (ENDA). In particular, it illustrates how President Obama initiated a number of important policy drifts in the area of LGBT employment rights. The protection of LGBT individuals has been considered the new civil rights issue.
