Abstract:
Si l'idee d'un "ordre public" est commune a tous les systemes de droit, son incorporation dans le droit international positif est recente : elle a ete le fait de la convention de vienne sur le droit des traites du 23 mai 1969 entree en vigueur le 27 01 1980. Dans l'ordre juridique international, cette idee se traduit par la consecration des normes de jus cogens dont le pouvoir de qualification appartient a la communaute internationale des etats dans son ensemble et auxquelles aucune derogation n'est autorisee. Manifestement, cette cate gorie de droit superieur implique un flechissement du butoir de la souverainete de l'etat. Quoique codifiee par le traite des traites, la notion proteiforme de jus cogens debordera ce cadre pour s'appliquer a l'ensemble de l'activite des etats. Les travaux de la commission du droit international en matiere de responsabilite le montrent. De plus, le role du juge international, capital dans la construction et l'application de ce jus cogens, se trouvera renforce. Autant de raisons qui inclinent a ne pas sous-estimer le jus cogens. Mais il ne sied pas non plus de le sur-estimer : cette evolution normative ne s'appuie pas sur un renforcement institutionnel susceptible d'en assurer l'effectivite. La tache d'application du jus cogens incombera aux etats. Et meme si une responsabilite internationale nouvelle (d'ordre penal) est attachee a cette application, cette protection decentralisee de l'ordre public international sera un facteur d'affaiblissement de la portee du droit imperatif general.

Abstract:
The United Nations Convention on International Multimodal Transport of Goods of 24th May 1980 is an appropriate answer to the legal and political problems raised by through carriage and containerisation.<br>Traditionally, when goods were transferred from one mode to another they were also transferred to a new legal regime. There was no coherent legal regime governing carrier liability for goods moving in multimodal transport. The Convention creates a new liability system and confer international legal sanction on the responsibilities and immunities flowing from the multimodal transport contract.<br>The Convention compromises between the needs of developing countries--who called for provisions on regulation and control of multimodal operations at the domestic level--and the demands of developed countries--who wanted the convention to deal primarily with private law matters and pointed to the danger of conflicts with modal conventions.<br>The Convention is not yet in force but its provisions are the basis of current through carriage contracts.

L'ordre juridique international propose des solutions au conflit de traites, en particulier a travers la convention de vienne sur le droit des traites. Les regles qu'il definit sont-elles applicables aux conflits opposant entre elles des conventions d'unification du droit des conflits de lois ? la regle de conflit de lois, meme d'origine conventionnelle, ne releve pas par son objet du droit international public, mais dispose d'un caractere regulateur des litiges prives. Il est possible theoriquement de s'affranchir du droit international public, afin de rechercher une methode s'appuyant sur la solution la plus adequate du litige prive en cause. Sa vocation a intervenir n'est cependant pas exclue, puisqu'en raison de son origine, le droit unifie peut etre soumis a l'examen des juridictionsinternationales, et sanctionne par elles. Toute methode qui mettrait le choix de la convention dans la dependance d'un reglement satisfaisant du litige prive, devrait etre confrontee dans son resultat aux regles de coordination qu'il definit. La methode proposee vise a determiner la fonction de la regle de conflit dans l'ordre juridique du for, puis a selectionner le rattachement conventionnel satisfaisant au mieux cette fonction. Cette methode est conforme aux principes d'interpretation des traites, qui offrent un regime specifique a la reglementation unifiee en matiere privee. Le resultat deduit de la methode fonctionnelle sera confronte aux clauses de coordination. La responsabilite internationale de l'etat qui peut s'en suivre est integree dans la problematique du droit international des conflits de conventions. Au dela de la problematique ainsi decrite, le conflit presente des caracteres originaux lorsqu'interviennent des normes du droit communautaire, ou des normes conventionnelles definissant des droits fondamentaux

Au cours de la période comprise entre la fin des années 1960 et le début du XXIe siècle cette thèse propose, sous l'angle de la problématique originale du transport, une analyse de la dynamique d'un grand système technique et une modélisation historique des réseaux de transport de la Poste. Cette analyse du changement révèle la transformation de La Poste : son rapprochement avec le monde des transports, sa spécialisation et surtout son apprentissage de la concurrence à travers le développement de son activité dans le domaine de la messagerie, de la structuration de ce métier Colis aujourd'hui essentiel pour le Groupe La Poste. Mais à travers cet objet d'étude original au sein de la recherche historique comme de la recherche en transport, cette thèse s'attache également à montrer l'utilité de l'histoire au sein de l'entreprise et les possibilités applicatives de la discipline historique dans la recherche action. L'un des postulats de cette thèse considère en effet qu'une approche historique est susceptible d'apporter un éclairage original et enrichissant à l'analyse du changement : c'est à la fois la transformation de la Poste, au regard des mutations internes qui s'opèrent dans le domaine du transport et de la messagerie, mais également la nature de la relation entre ce transporteur singulier et le monde qui l'entoure qui se trouvent précisées. Si aujourd'hui l'un des enjeux majeurs de l'opérateur est d'arriver à concilier la logique d'une entreprise évoluant en totale concurrence en assurant conjointement un service public, par le passé, ce que cette thèse propose de démontrer, l'un des enjeux de la Poste a été d'arriver à développer son activité dans le secteur concurrentiel et à s'imaginer concurrentielle. Une transformation fondamentalement liée à l'expansion de son activité dans le domaine de la messagerie qui, s'il elle la rapproche davantage du monde des transports, apparaît selon nous comme l'école de la concurrence des services postaux et permet d'interroger l'apprentissage de la concurrence de l'opérateur depuis la fin des années 1970<br>On the late 60s till the early 21st century, this thesis describes the issue of La Poste shipment, a focus on the dynamic large technical system and the historical network architecture starting inside the firm. This analysis reveals the considerable change inside La Poste across the years: the evolution of the shipment, the expertise and especially the way how they improve their business because of their competitors. All this lead them to develop their business in the messaging field and to restructure the way of packaging inside La Poste Group. This study reveals that their business has grown considerably over the years and that shipment research has contributed to give them the knowledge inside the company. One of the assumptions of this thesis considers that the historical approach has lead the group to improve their way of shipment and to develop a change strategy : it's the reorganisation inside the group, the internal restructuring of the shipment and messaging, and also the new definition of a relationship between this exceptional way of shipment and the whole world. The aim challenge of the operator is to be able to develop the business of the company trying to have a pole position on the market and insure a public service. This thesis also reveals that one of the major issues of la Poste by the past, was to develop their business and to be identified as one of the leader in this section. This fundamental change linked to the expansion of the shipment messaging, make us consider that the influence of the shipment experience and the competitors postal service had contributed to define the knowledge of the firm, we consider it as a major step for la Poste and allow us to get more curious on the competitor's learning since the late 1970s

O objetivo deste trabalho é fazer a análise do conceito de salvamento de embarcações no Transporte Marítimo, através de um contrato de salvamento Lloyd’s Open Form (LOF) com a cláusula SCOPIC (Special Conpensation P&I Clause) incorporada ao contrato. Uma vez que há um acidente que envolva um salvamento no mar, há todo um processo a ser seguido, o que envolve a retirada de declarações, a avaliação dos perigos, quer para nomear peritos, escolhendo testemunhas, cálculo dos valores do salvado, prêmio de salvamento, os valores do SCOPIC, desembolsos imediatos, a escolha do SCR (Shipowner Casualty Representative), nomeação dos advogados que representam os salvadores, seguradores de casco e máquinas, P&I e de carga, assim como, a utilização dos conceitos da Convenção Internacional de Salvamento no Mar (CISM 1989), em especial os Artigos 13 e 14. A opção metodológica adotada consistiu numa pesquisa qualitativa por instrumento de questionário eletrônico e levantamento exploratório. Como resultado da aplicação, foi possível verificar que os envolvidos em uma aventura marítima consideram o contrato de salvamento LOF, com a cláusula SCOPIC incorporada, importantíssimo para a atividade comercial de transporte marítimo. Dessa forma o trabalho contribui cientificamente para análises futuras dos valores envolvidos em um prêmio de salvamento, o problema da terceirização dos serviços de salvamento, o dilema do crescente gigantismo dos navios mercantes e suas cargas e uma possível avaliação equivocada das condições do navio na ocasião do salvamento.<br>This work highlights the main technical aspects related to the study and analysis of the LOF salvage contract with the SCOPIC clause. The objective of this work is to analyze the concept of salvage vessels in maritime transport through a salvage agreement Lloyd's Open Form (LOF) with SCOPIC clause (Special Conpensation P&I Clause) incorporated into the contract. Since there is an accident involving one salvage at sea, there is a whole process to be followed, which involves statements, the hazards assessment, in order to appoint the surveyors and experts, choosing witnesses, calculation of the saved values, salvage award, SCOPIC of values, out of pockets, the choice of SCR (Shipowner Casualty Representatives), appointment of lawyers representing the salvors, H&M insurers (Hull and machinery), P&I Clubs and cargo, as well as the use of the International Convention’s Salvage at Sea (CISM 1989), in highlight the Articles 13 and 14. The method adopted. The methodological option adopted consisted of a search for "survey" and exploratory survey. As a result of the application, it found that those involved in a maritime adventure consider the LOF salvage contract with SCOPIC clause incorporated important to the shipping industry. Abstract:
Le transport de fret joue un rôle primordial dans le commerce international. De ce point de vue, il est intéressant de jeter un regard sur les problèmes juridiques qu'il soulève et les réponses qu'apportent les tribunaux. Ce transport est régi par la convention de Varsovie qui a uniformisé les règles en matière de responsabilité. Celles-ci font parfois l'objet d'une interprétation divergente selon les pays (de droit civil ou de common-law) et selon les tribunaux de plus, les progrès techniques, l'amélioration du niveau de vie ont dénaturé les règles mises en place depuis soixante ans. Ce décalage du droit par rapport à la réalité est source de nombreux litiges entre usager et transporteur. La responsabilité de ce dernier devient objective. Cette recherche fait la synthèse à ce jour du contentieux du fret aérien. Après une étude des conditions de recevabilité de l'action contre le transporteur, des questions importantes comme celle de la responsabilité du transporteur et sa limitation, celle de la faute grave qui fait échec à cette limitation, ont été notamment éclaircies. Les décisions de justice peuvent être considérées de deux manières : d'une part, celles qui défendent les intérêts de l'usager et celles qui défendent ceux du transporteur, et d'autre part, celles qui sont fidèles à l'esprit de la convention et celles qui ne le sont pas<br>The air goods transport takes an important place in international trade. So, it is interessant to take a look aver legal difficulties which are raised and how courts of justice settle them. Air transport is ruled by Warsaw convention which lay down uniform provisions about air carrier's liability. Those provisions were sometimes misinterpreted by law courts (civil or common law). Moreever, technical progress, the improvement of the standard of living have changed the rules laid down for sixty years. The gap between legal rules and reality is a source of problems between carrier and consignor. This theisis makes a synthesis of air freight litigations. Many important questions like carrier's liability, limitation of liability, serious offence were explained. Conditions to sue were definied. Law cases can be classified in two ways : in one hand, those which defend the interest of the consummer and those which defend the interest of the carrier, in other hand those which follow the spirit of warsaw convention and those which do not

Abstract:
Le transport international de marchandises par mer met en présence des opérateurs du commerce international qui ont une forte demande de sécurité juridique. L’uniformité du droit devrait pouvoir la satisfaire. L’observation du phénomène de création des régies applicables à cette activité montre que les États ont cherché à les unifier par la voie conventionnelle sans y parvenir. La thèse, par une étude de l'élaboration, de l'adoption puis de la mise en oeuvre du droit applicable au transport international de marchandises par mer constatera une dissonance entre le désir d’uniformité et sa réalité. En effet, les Conventions applicables à cette matière se contredisent, se superposent ou sont vidées de leur sens par des interprétations "nationalisantes". Face à cet échec, le monde maritime invente des outils d’uniformisation de ce droit. Il en est ainsi par exemple de ses contrats-types et autres juridictions arbitrales. De telles pratiques ne contribuent-elles pas à l’uniformité du droit ?

In our days we face a fundamental issue concerning road signs. We may display contents in vertical and horizontal format (static signs, variable message signs, road markings), either on a post, a gantry or a dashboard. And we foresee a coming age where the excellent matrix resolution of painted signs will be truly approached by the resolution of full matrix displays. But we also risk a babel context threatening the universal approach encouraged by international catalogues as the 1968 Convention (ECE/TRANS/196, 2007). And the fundamental risk comes from our decisions regarding how the transition from the contents and formats displayed on static message signs to the ones displayed on electronic signs (in gantries or dashboards) should be. Our work explores this issue specifically, considering the transition from Advance Direction Signs (static message signs, class G, 1 in the 1968 Convention) to what could be termed Advance Location Signs (signs concerning the location of variable events with regards to certain landmarks) developed as an adaptation of the G, 1 class to electronic traffic signs.DOI: http://dx.doi.org/10.4995/CIT2016.2016.3217

Abstract:
A generic computer model for systematic investigations of container ship designs is described in this paper. The primary statistical data on container ships used for the model development are also presented. The model can be used to calculate exhaust gas emissions from container ships, including emissions of carbon dioxide (CO2). A calculation procedure to estimate the newly designated Energy Efficiency Design Index (EEDI), which is under development at the International Maritime Organization (IMO), is included in the model. Different ship design parameters have been varied to see the influence of these parameters on the EEDI. It is found possible to reduce EEDI by roughly 20 % without reducing ship speed, but only by changing some of the design parameters, such as reducing the sea margin by using a derated main engine, increasing the length of the ship by 5 %, and reducing steel weight by 3 % via steel weight optimization.
