Chapter 3 first addresses the regional refugee definition according to the 1969 Convention , beginning with a description of article I(2)’s international influence and an interpretation of the definition using orthodox methods. The context and object and purpose of the 1969 Convention are discussed, followed by analysis of the ‘every person’ term and each of the 1969 Events and the test for refugee status under article I(2), including a discussion of internal flight alternative, ongoing risk, and sur place claims. Section B then addresses how article I(2) has been invoked in practice. Section B also addresses prima facie refugee status determination. Section C covers further key features of the 1969 Convention: whether it advances an individual right to asylum; non-refoulement; the formalization of responsibility sharing, temporary protection, and voluntary repatriation; and the Convention’s prohibition of subversive activities. Section D concludes.

Abstract:
Chapter 2 begins with overviews of the Organization of African Unity and its 1969 Convention. The majority of the chapter is then devoted to sketching a drafting history of the 1969 Convention, which makes an important contribution to the historical record since the 1969 Convention has no official travaux préparatoires. The drafting history reveals that the initial impetus for a regional refugee instrument was to render international refugee law applicable in Africa and to address the issue of subversion. When the former was achieved in 1967 with the entry into force of the Protocol relating to the Status of Refugees, addressing refugee issues particular to Africa became the focus of the drafting initiative.

Abstract:
Chapter 4 begins with an articulation of the various approaches to refugee status determination in states party to both the regional and international refugee Conventions. This elucidates how and why a refugee might be recognized only under the 1969 Convention, the implications of which are then analysed. It is argued that in states party to both refugee Conventions, refugees recognized only under the 1969 Convention are entitled to the same standards of treatment as refugees recognized under the 1951 Convention. Finally, other aspects of the relationship between the 1951 and 1969 Conventions are considered. These are analysed within two categories: relationships of interpretation and relationships of conflict. The relationship addressed in the first category relates to the 1951 Convention’s article 1C(5) ‘compelling reasons’ proviso. The second category addresses the freedoms of movement and association, and the provision of travel documents.

Abstract:
This book offers an analysis of the law of treaties as it emerges from the interplay between the 1969 Vienna Convention on the Law of Treaties and customary international law. It revisits the basic concepts underlying the provisions of the Vienna Convention, so as to determine the actual state of the law and its foreseeable development. In doing so, it examines some of the most controversial aspects of the law of treaties. The book first explores the influence exerted by the Vienna Convention on pre-existing customary law. Certain rules of the Convention which, at the time of its adoption, appeared to fall within the realm of progressive development, can now be regarded as customary international rules. Conversely, a number of provisions of the Convention, in particular those which have been the subject of subsequent codification work by the International Law Commission, have become obsolete. It then examines the impact exerted by the Vienna Convention on the development of other fields of international law, such as the law of international responsibility and the law of international organizations. The last section of the book is devoted to cross-cutting issues, with particular reference to the notion of jus cogens — a concept first used in the Vienna Convention in connection with the problem of the validity of treaties and which, afterwards, has acquired a legal significance going well beyond the Convention.
