Abstract:
En étudiant la notion et le statut juridique du commissionnaire de transport, du Non Vessel Operating Common Carrier (NVOCC) et du consortium maritime, nous avons pu identifier ces trois acteurs du transport maritime international comme étant des transporteurs maritimes. Ainsi, bien qu’étant un intermédiaire, le commissionnaire de transport bénéficie d’un statut juridique distinct de celui du transitaire. En effet, il doit assurer le transport de la marchandise. Le Non Vessel Operating Common Carrier, acteur du shipping moderne a un statut juridique équivalent à celui du transporteur maritime en ce qu’il est aussi chargé du transport de la marchandise. Enfin, le consortium maritime, selon la nature et le degré de coopération entre ses membres, peut être identifié ou non comme transporteur maritime responsable du retard ou du dommage causé à la marchandise. Ces trois acteurs du transport maritime international ont ceci de commun qu’ils apparaissent, aux yeux des tiers non comme des intermédiaires ou des agents, mais comme de véritables transporteurs maritimes dans les pays où leurs statuts sont réglementés.

Abstract:
Le régime uniforme des Règles de La Haye en matière de responsabilité contractuelle du transporteur maritime repose sur son obligation d'exercer une diligence raisonnable relativement à la navigabilité du navire. Dans un premier temps, cette étude cerne le contenu de cette obligation. L'auteur démontre que la notion de navigabilité dépasse largement le simple concept de flottabilité. En fait, l'obligation de navigabilité couvre des sujets aussi variés que la bonne condition des diverses composantes servant à la manoeuvre du navire, de son armement avec un personnel compétent et suffisant ainsi que de son aptitude au transport et à la conservation des marchandises. Dans un deuxième temps, l'auteur analyse l'exécution de l'obligation de navigabilité. Il traite des difficultés liées aux soins qui doivent être assumés par le transporteur et des complications relatives à sa preuve lors de l'exercice de l'action en responsabilité. En conclusion, l'auteur souligne le caractère désuet du régime légal actuellement en vigueur et se prononce en faveur de l'adhésion aux règles adoptées lors de la Conférence des Nations Unies de Hambourg en 1978.

AbstractThis study is based on the foreign customs registers of the port of Smyrna in the Ottoman Archives of Istanbul. In this paper 115 ports, 112 ships, 2859 pieces of goods, and 1273 merchants have been investigated for the period 1794-1802. This information indicates that the transformation of the Ottoman Foreign trade at the turn of the eighteenth century was linked to the following economic trends of the second half of the eighteenth and the first half of the nineteenth centuries: the emergence of the European supremacy in naval transportation, a change in the terms of trade that was disadvantageous for the Ottomans, and a shift in the trade partners of the Ottoman Empire. Cette contribution exploite les données des registres de la douane ottomane du port de Smyrne, consignant les importations étrangères, conservés aux archives d'Istanbul. L'étude porte sur les cargaisons de 112 navires en provenance de 115 ports, 2859 pièces de marchandises et 1273 marchands dans les années 1794-1802. Les données témoignent que la transformation du commerce ottoman étranger en fin du XVIIIème siècle est liée aux tendances économiques de la seconde moitié du XVIIIème et de la première moitié du XIXème siècles. Elles reflètent la domination européenne dans le domaine du transport maritime, la modification des conditions commerciales au détriment des Ottomans et un changement des partenaires commerciaux de l'Empire.

L'auteur démontre comment l'intention de mettre sur pied un cadre juridique international unique a finalement abouti à une multitude de régimes juridiques qui se disputent le marché de la responsabilité du transporteur maritime, au grand dam des propriétaires de marchandises. Chacun de ces régimes continue d'imposer un plafond à la responsabilité du transporteur maritime, tandis que la plupart lui réservent encore de nombreuses circonstances exonératoires.

The paper is devoted to the analysis of maritime transport logistics. The authors analyze the issues of optimizing the work of organizations of all activities. The purpose of the work is to systematize and develop the theoretical and practical basis of maritime transport logistics. The purpose of sea transportation, types of cargo, directions of transportation, subjects of sea transportation, structure of the fleet are analyzed. The main types of sea transport vessels and main ports are provided. Features of sea logistics and names of the most known companies of sea logistics are presented. The introduction highlighted the work of domestic and foreign scientists on logistics. The study used methods of comparative analysis, synthesis, generalization, induction and deduction. As a result, maritime transport currently provides 4/5 of the world's cargo. Maritime logistics, ie the organization and provision of sea freight, is a special intermediary transport service that facilitates the process of delivery of goods from producer to consumer, regardless of the distance between them. The prerogative of maritime logistics is the transportation of goods by sea. This method of transportation is most suitable for the delivery of large over heavy loads over long distances. The maritime system operates non-stop, by the workers who operate, sleep, eat and live 24/7 in noisy, dynamic and stressful environment. Irregular and extended shifts are not unusual for the workers aboard. The final result of the extended shifts is fatigue, represented by the symptoms such as drowsiness, irritability, reduced alertness, lack of concentration and memory, depression and headaches. Lack of sleep or rest can impair the cognitive skills, slows down the reaction times and makes it difficult to concentrate. Proving fatigue as the cause of the maritime accident can be a challenging task. So, the method of investigation the fatigue in the terms of maritime transport has to be used. This paper provides a recommendation for the process of investigation and assessing of the causal factors, such as human factor, especially the fatigue. The preventive measures how to avoid the fatigue aboard the vessel are also given.

Cet article propose un argumentaire mettant en avant les synergies de ces deux types de flux à priori antagonistes. Puis, la structure d'une procédure de planification de la mobilité est établie, son intérêt principal réside en la maîtrise de la coexistence des passagers/marchandises en ville. Pour cela, il s'agit de formaliser le cadre méthodologique de planification, d'analyser les éléments fondamentaux des approches méthodologiques de planification du transport de passagers et de marchandises et enfin d'identifier les concepts novateurs pour la définition d'une approche méthodologique de planification de la mobilité urbaine intégrée.

Although maritime transport is the backbone of world commerce, its digitalization lags significantly behind when we consider some basic facts. This work verifies the state-of-the-art as it currently applies to eight digital domains: Autonomous vehicles and robotics; artificial intelligence; big data; virtual reality, augmented and mixed reality; internet of things; the cloud and edge computing; digital security; and 3D printing and additive engineering. It also provides insight into each of the three sectors into which this industry has been divided: Ship design and shipbuilding; shipping; and ports. The work, based on a systematic literature review, demonstrates that there are domains on which almost no formal study has been done thus far and concludes that there are major areas that require attention in terms of research. It also illustrates the increasing interest on the subject, arising from the necessity of raising the maritime transport industry to the same level of digitalization as other industries.

Maritime transport plays a vital role in the economic growth and global competitiveness of the regions that it serves. It offers an enormous potential for sustainable and environmentally friendly transport. The international maritime community, however, is faced with a major challenge: to protect the marine environment from pollution related to oil spills. A parallelism between resolutions adopted by national and international bodies and the oil spill incidents that triggered them is presented. The focus is on reviewing records of maritime casualties associated with massive environmental pollution. It is an attempt to shed light on how these incidents affect the formulation and implementation of the global marine environment protection policy as well as the role of the International Maritime Organization in dealing with these problems.

Potentially infected Culicoides may be accidentally carried in vehicles associated to the transport of people, animal, plants (cars, planes, boats...) coming from countries where bluetongue virus (BTV) is present. In order to estimate the risk of BTV trans­mission by the introduction of infected Culicoides by means of transport/commodities, a stochastic risk assessment model was constructed. The model was applied to estimate the risk to other countries by the introduction of one Culicoides infected with BTV serotype 1 from Spain. There is currently no data on the probability of Culicoides being transported by different means of transport/commodities. Therefore, the probability had to be estimated per vector. Four different steps were considered in the transmission pathway: probability of Culicoides infection, prob­ability of Culicoides surviving the extrinsic incubation period and the time to the next blood meal, probability of finding a new host, and probability of effective BTV transmission to host. The probability of BTV introduction by infected Culicoides was highly variable throughout the year, mainly as a consequence of differences in ambient temperatures. The maximum risk was reached in May with a mean probability of 1.7 x 10-8 (per vec­tor). The main limiting factors in this probability were the prob­ability of Culicoides infection, and the probability of Culicoides surviving the extrinsic incubation period and the time to the next blood meal. Given the low probability obtained for this pathway to be considered as important, the number of Culicoides trans­ported by these means should be very high.

Résumé Dans cet article, nous présentons un modèle des flux de marchandises entre huit régions du Canada, et pour l’ensemble des biens qui ont été regroupés en 64 catégories. Le modèle fonctionne en deux étapes. Dans un premier temps, les flux observés sont régressés sur certaines variables socio-économiques, dont le coût de transport. On obtient alors des flux « a priori », qui peuvent être modifiés lorsque les variables les expliquant sont elles-mêmes modifiées. Or, ces flux « a priori » ne respectent pas nécessairement la structure industrielle de chaque région. Pour les corriger, on résout un programme mathématique dont la fonction objectif est basée sur la théorie de l’information. On cherche alors les flux qui sont les plus proches possibles des flux « a priori », mais qui respectent également la structure industrielle de chaque région. Cette structure est représentée par des contraintes comptables input-output régionales. Le modèle peut être vu comme un modèle input-output interrégional, où les coefficients interrégionaux sont sensibles à des variations des coûts de transport. La formulation du modèle est également beaucoup plus souple et elle permet de prendre en compte d’autres facteurs explicatifs. Le modèle est testé avec des données input-output canadiennes de 1974, et il est aussi comparé à d’autres modèles.

As maritime transport produces a large amount of data from various sources and in different formats, authors have analysed current applications of Big Data by researching global applications and experiences and by studying journal and conference articles. Big Data innovations in maritime transport (both cargo and passenger) are demonstrated, mainly in the fields of seaport operations, weather routing, monitoring/tracking and security. After the analysis, the authors have concluded that Big Data analyses can provide deep understanding of causalities and correlations in maritime transport, thus improving decision making. However, there exist major challenges of an efficient data collection and processing in maritime transport, such as technology challenges, challenges due to competitive conditions etc. Finally, the authors provide a future perspective of Big Data usage in maritime transport.
