Full textLa présente recherche en ethnologie et patrimoine s’intègre dans le courant de la recherche sur l’entrepreneuriat. S’appuyant sur les théories de l’immigration et de l’interculturalité, cette thèse vise à mieux comprendre le processus d’intégration au marché du travail chez les immigrants d’origine chinoise. En observant les dynamiques d’entrepreneuriat chez les participants, nous mettons en lumière leur développement de réseaux locaux, ethniques, transnationaux d’une part et, d’autre part, les perceptions qu’ils ont sur leurs choix professionnels et sur leurs modes de réseautage. Les caractéristiques et les trajectoires des individus, les motivations pour créer ou reprendre une entreprise, les fonctions de réseaux et le phénomène d’immigration en région font partie des dimensions d’analyse qui soulèvent des questions théoriques en matière d’intégration socioprofessionnelle, d’entrepreneuriat et de réseaux sociaux. La méthodologie adoptée s’appuie sur le parcours de vie, les entrevues semi-dirigées et l’analyse de contenu. La recherche a aussi fait appel à la réalisation de cartes de réseaux afin de mieux connaître le développement et le changement de réseaux de dimensions diverses durant le processus d’entrepreneuriat chez les immigrants d’origine chinoise. La démarche d’analyse se fait en deux parties. Dans un premier temps, on fait ressortir les trajectoires migratoires des entrepreneurs immigrants ainsi que leurs stratégies d’intégration professionnelle. Puis, le processus d’entrepreneuriat et le développement de réseaux sociaux durant la création ou la reprise de l’entreprise sont analysés. Cette étude se fondant sur des récits et des entrevues des participants permet aussi de connaître les ressources diverses auxquelles les créateurs et repreneurs d’entreprise font appel. Enfin, on constate qu’il existe des différences entre les créateurs et les repreneurs d’entreprise concernant leur capital humain, leurs réseaux sociaux et leurs façons de gérer l’entreprise. On voit qu’il est nécessaire que les instances gouvernementales et paragouvernementales prennent connaissance des différents besoins des immigrants entrepreneurs afin de mettre en place des politiques et des mesures favorables à l’épanouissement des immigrants entrepreneurs.
Canada and Quebec are searching for a large number of immigrants to ensure their demographic, economic and social development. That is the case in the Quebec City region, where the workforce is in high demand due to the aging of the population. By observing the socioprofessionnal dynamics of Chinese skilled workers, the thesis aims to better understand their professional choice in the local labor market and their tactics used to promote their integration. This research seeks to better understand the work search path of Chinese immigrants, their decision to undertake a business project, and the place that they give to social network when they begin their creation or takeover of their company / companies. The methodology adopted in this research is based on life course, the semi-directed interview and the qualitative analysis. The network map is also used to learn about the development of the network, a strategy adopted by Chinese immigrants during the entrepreneurship process. The analysis is divided in two parts. As a first step, the different strategies to enter into Quebec’s labor market from immigrant newcomers are highlighted. Then, the entrepreneurship process and the social network development during the creation and the takeover of the company are analyzed. The trajectories and the characteristics of the individuals, their motivations to undertake a business affair, and the phenomenon of immigration in region are part of the subjects which raise theoretical questions with regard to integration, entrepreneurship and social network. This study, based on stories and interviews of participants, also reveals the diverse resources that business creators and buyers use. Finally, there are differences between creators and buyers of businesses regarding their human capital, their social networks and their ways of running the business. It is necessary for government and para-government bodies to become aware of the different needs of immigrant entrepreneurs in order to put in place policies which contribute to the development of immigrant entrepreneurs.

Full textWith the Baby-boom generation entering upon a retirement wave, the Canadian labour force will ineluctably go through a transition period. Those departures will leave a vacuum that will force many industries to readjust in order to avoid heavy turbulences. The impact of the retirement wave will not have the same impact for each of the industries. Using longitudinal data from the Survey of Labour and Income Dynamics for years 1993 to 2010, this study analyzes trends over time and across industries regarding workers leaving a career job. A particular attention will also be paid to bridge jobs by industry, in order to determine if this type of work may lessen the effects of the loss of many career jobs. The results show that workers are increasingly leaving career jobs during the period under review and that considerable variations exist between workers of various industries. The industry of Professional, Scientific and Technical Services shows the smallest proportion of workers that have left a career job (26%). Conversely, the highest probability of leaving a career job was recorded among workers of the Accommodation and Food Services industry (47%). Regarding bridge jobs, workers coming from the Construction industry have the greatest propensity to start such a type of work after leaving a career job. If some industries stand out from all the others, this is largely attributable to the distinct behaviour of the eldest workers (55 to 64 years old).

Full textThis study analyses the difficulties faced by agricultural workers exercising their rights to freedom of association and collective bargaining. These workers often find themselves excluded from national legislation providing for the protection of union rights, and when these rights are provided to them, their ability to exercise them is limited. Being amongst the poorest human beings on earth, agricultural workers would instead require stronger protection. What are the historical causes of this discriminatory treatment (part one) ? How has international labour law helped to correct this situation (part two) ? In what way did international labour law influence canadian domestic law in regard of the protection of wage earning agricultural workers (part three) ? The reasons for the singular treatment of this class of workers go back to agriculture’s very roots. Conscious of the particular characteristics of this activity, the International Labour Organisation asserted, at the very beginning of the 20th century, that no justification stood to limit the rights of agricultural workers to unionize. It later insisted on the fundamental value of union rights in front of diverse UN forums and favoured their promotion for agricultural workers through the elaboration of labour standards as well as extensive use of soft law tools, considered more suited to the globalised world. International labour law also contributed to the interpretation of the Canadian Charter of Rights and Freedom by Canadian courts in their analysis of the constitutionality of total or partial exclusion of agricultural workers from legislation protecting union rights.

Full textIn spite of an ever increasing demand in the domestic work sector and a considerable worldwide economic weight, migrant domestic workers are among the most precarious and exploited globally. Invisible, isolated and working for individuals in private residences, they fall outside the traditional work categorizations. Therefore, these women find themselves operating in margin of the legal system or, when they are protected by laws, they struggle to have those laws applied efficiently. This research will try to analyze the different ways we can consider law in order to guarantee a real and efficient access to justice to migrant domestic workers. After addressing the systemic obstacles to domestic work regulation worldwide, this research explores the inconsistency between traditional law and the reality of migrant domestic workers by analyzing the effects of the applicable Canadian regulation. In light of the recent Convention concerning decent work for domestic workers, this essay shows that a conceptualization of law based on legal pluralism offers domestic workers an alternative access to justice. Ultimately, including these workers in the social dialogue and implementing specific regulation adapted to their reality will provide them with an empowerment that will insure an effective protection of their rights.

Full textIn an increasingly globalized world, where the capitalist model is ubiquitous, the central question in the attempt at group classification concerns the link between the commercialization of a work force and the social stratification of the population in terms of class, gender, and ethnicity. The growing demands of globalization lead to new and innovative modes of production, which in turn transform the dynamics involved in defining and regulating populations. In current national affairs in Canada, this is best exemplified in the debate over the exploitation of Quebec's northern resources. The project to exploit Quebec's northern riches is a relatively recent phenomenon; the process whereby a social class is formed, however, is not. Given the vicissitudes of this process, it seems pertinent to reexamine the economic, sociological and historical elements which influenced the theoretical discourse on a social class whose existence is intrinsically linked with the exploitation of natural resources, namely the workers of northern Quebec. In Fermont, a town located in northern Quebec, mining companies have employed since 2011 a large number of workers coming from other regions of Quebec, known as permanent non-residents. Thus, the balance of the social structure maintained by the local workers is faced with new dynamics of social geographic mobility. In the workplace, women and Native Americans are also affected by the power relations at the interpersonal level in daily life owing to the fact that the jobs in the industrial mining sector and in construction are socially and historically founded on specific social and cultural traits (namely, white and male). The working class of northern Quebec is therefore redefined in its relationships to the permanent non-resident workers as well to its gender and indigenous minorities, relationships which will doubtless engender a complex and heterogeneous social structure.
