Abstract:
“Information wants to be free.” Although this sentiment dominates the current digital landscape, information about Islamic law and history often remains bound to its physical form and to the price of acquiring it. One should not have to travel to several countries or be associated with the handful of institutions with large collections in these fields to gain access to these sources (which can still be onerous once there). But this is precisely the case for those who aim to do serious, comparative, or otherwise broad-ranging work in Islamic law. For Islamic law, there is a persistent problem of access and ease of use.

Abstract:
The purpose of this research discussion paper is to understand the Islamic issues involved in Space Travel, which is a novel field. Hitherto, only limited research has been undertaken on how Muslim astronauts can maintain their Islam for a prolonged period away from the Earth. This paper will commence with an introduction to Islamic law (which includes the distinct term fiqh), before discussing the obligations of Muslims in space. Also discussed in this paper will be the Maqasid, or higher objectives, which provides an avenue for Muslim space travelers to maintain their Islam within the framework of the religion. The methodology used in this paper is based on research of existing literature, comments from previous Muslim astronauts as well as a review of Muslim law that pertains to travel. The finding of this paper sets out the application of Islamic Law for interstellar Space Travel and off-world colonisation. It discusses the relevant ibadah rulings (literally meaning religious rituals such as prayer, fasting, ablution, keeping halal, and death rites inter alia) and how these can be practically applied in the context of space travel. This paper also outlines the moral, legal and practical challenges faced by a Muslim undertaking Space Travel and discusses the relevant Islamic ‘knowledge’ that may assist in reconciling these issues. The term interstellar Space Travel and colonisation is used to refer to those activities that are performed away from the Earth, such as in the micro-gravity of space or on an off world colony i.e., Mars. This paper is unique from other published papers in the field as it contemplates off world habitation and not just a short-term sojourn into space. The research finding is that Islamic Law is able to adapt to the challenges of space by incorporating how early Muslims maintained their Islam while traveling long distances outside their home countries. This is an emerging area of study, so there is a dearth and scarcity of literature about Muslims in space written from a scholarly perspective. This paper intends to rectify this situation by providing a marker for other scholars and researchers to follow

Abstract:
For the purpose of preventing civil aviation offences and maintaining security of civil aviation, passengers are required to give biometric information which must be stored in the International Civil Aviation Organization’s (ICAO) approved Machine Readable Travel Documents (MTRDs) and that such information obtained should be adequately secured against skimming and eavesdropping. Since its inception, many countries including the Islamic countries have adopted the machine to process information of passengers coming in and going out of their states. Academic writers have written on the challenges of skimming and eavesdropping as they are related to information privacy versus aviation security in the conventional law but the Islamic law position has not been dealt with. The article therefore attempts to explore the Islamic law position on the use of Machine Readable Travel Documents (MRTDs) and the challenges being posed to aviation security. The paper is qualitative in nature and relies on primary and secondary sources of Islamic law to argue its position. The paper finds that Islamic law expressly preserves individual’s information privacy and that skimming and eavesdropping are allowed to promote public security and prevention of evil. Its further provides punishment for whoever transgresses against information privacy. It concludes that the adoption of MRTDs to obtain information about private affairs of passengers is in line with the principle of Islamic law.

SummaryIn this article, Moses Maimonides’interpretationof Jewish law on women and work – as reflected in hisMishneh Torah– is contrasted with the daily lives of Jewish working women as portrayed in the documents of the Cairo Geniza. Later rabbinic writings and European travel accounts are analysed to show how Jewish ethics of women and work were translated into social practice in the late medieval and early modern Arab-Islamic world, where Islamic law and the existence of separate worlds for men and women rather than the contrast between public and private spheres seem to have informed general ideas about women and work.

Abstract:
Purpose Attributes of a destination do not only have a positive impact on a person’s selection of the travel destination but also influence the level of tourist satisfaction. In spite of this, the destination attributes related to Muslim tourism are yet to be explored. Moreover, each attribute impacts the satisfaction of tourists in different ways. This study aims to investigate the importance and performance of Islamic attributes in selection of travel destinations by Muslim tourists and to examine the overall tourist satisfaction (SAT) based on the Islamic attributes. Design/methodology/approach Thailand has been considered as the base for this study. A quantitative research method and convenience sampling technique was used for data collection. Factor analysis was used to determine the importance and performance of Islamic attributes on the choice of travel destinations. Composite delineated factors were applied as indicators in the regression analysis to evaluate the SAT. Findings The findings reveal five important Islamic attributes: Halal-friendly environment, Halal hotel (IMP2), Halal food (IMP3), Halal food preparation and washroom facilities. However, Muslim tourists were only satisfied with the performance of three Islamic attributes: hotel entertainment and facilities, Halal food and preparation and Halal-oriented recreation and quality services (PER3). This study also reveals that PER3 as well as IMP2 and IMP3 are significant factors for evaluating the tourists’ overall satisfaction. Originality/value The Halal tourism market has been growing rapidly. However, research on the satisfaction of Muslim tourists based on the importance and performance of Islamic attributes in non-Muslim countries is limited. Thus, the researcher draws upon the views of Muslim tourists to propose recommendations on the important Islamic attributes and those whose performances are effective. The findings suggest that the SAT is influenced by particular attributes. Additionally, this study fills the research gap on Halal tourism in Thailand and provides useful information regarding the satisfaction of tourists based on Islamic attributes for non-Muslim countries, to help them formulate effective strategies for developing Islamic tourism in their travel destinations.

Abstract:
Purpose The purpose of this paper is to build a better understanding of the concept of Halal tourism as expressed by Muslim Jordanian tourists who want to comply with the Islamic law. The study also examines Jordan as a Halal tourism destination as perceived by those tourists. Implications of marketing Jordan as a Halal tourism destination are among the research questions. Design/methodology/approach The paper is empirical and quantitative in nature with a survey type. The sample of the study is Muslim Jordanians in the cities of Amman and Irbid. Respondents were chosen randomly in shopping malls, gardens and public places. A self-completion questionnaire was administered to collect the data for the research and 920 questionnaires were returned. The data were analysed using descriptive and reliability and explanatory factor analysis in addition to certain tests such as one sample t test and two samples chi-square tests. Findings Halal tourism in Jordan is established but needs more enhancements and promotion. Jordan was evaluated positively in 14 Halal services and was unsuccessful in ten others. The motives for Jordanian Muslim tourists who want to comply with the Islamic law, to travel to Halal destinations were destinations that offer Halal-friendly services; to know Islamic religious sites; and to learn about Islamic history. Jordanian tourists were knowledgeable of local and international Halal destinations (78.2 and 67%, respectively). More than half of the sample experienced Halal destinations in Jordan and only 26.4% abroad. From a marketing point of view, the results of this study reveal good awareness of potential Jordanian tourists towards Halal tourism and Halal services. The study revealed that Jordanian Muslim tourists who want to comply with the Islamic law showed significant positive motives to travel Halal tourism destinations. In addition, the study showed statistically significant knowledge and experiences in local Halal destinations, but not in foreign Halal destinations. Research limitations/implications The lack of research on Halal tourism in Jordan gives limited in-depth discussion. In addition, the study sample was chosen from two major cities in Jordan; therefore, further research is needed to include a representative sample of the whole country. Practical implications The paper includes marketing implications on Halal tourism in Jordan. The authors suggest marketing strategies should be launched to emphasise the importance of Halal tourism and marketing Jordan as Halal tourism destination. The recommendations of this study provide positive and negative results on Jordan as a Halal tourism destination. The negative evaluation of Jordan in terms of Halal services should be redressed by the Jordanian Government and the Jordanian private tourism and hospitality sectors to build a positive image of Jordan as a potential competitive Halal destination for Muslim tourists who want to comply with the Islamic law. Originality/value The paper is among the first of its kind, which empirically examined the motives of Jordanian Muslims who want to comply with the Islamic law to travel to Halal tourism destinations as well as evaluating Jordan as a Halal tourism destination. This study fills the gap in literature about Halal tourism in Jordan and presents Halal tourism as one of the alternative forms of tourism of high potential for Jordan to compete in this market segment.

Abstract:
The Islamic State of Iraq and Syria (ISIS) is of concern to the international community because its existence poses a threat to world peace and security. The crackdown on journalists in the United States by a non-state group called ISIS (Islamic State of Iraq and Syria) also known as the Islamic State of Iraq and the Levant (ISIL) is a transnational movement fighting to establish the Caliphate. Attacks on journalists or medical workers are considered a violation of international law. The protection of journalists referred to in international humanitarian law is in the IV Geneva Convention of 1949. Based on these problems, this study aims to find out how the responsibility of the Islamic state of Iraq and Syria (ISIS) as a hostage perpetrator based on international humanitarian law and to find out whether the concept of state responsibility can apply to the Islamic state of Iraq and Syria (ISIS) as a non-state entity. So it was obtained that the actions carried out by ISIS against civilians include non-state conflicts because they involve the act of taking civilians hostage, especially domestic and foreign communitie. However, the Iraqi and Levant states can make efforts to prevent the occurrence of international armed conflict both in the form of conpensation of victims of abuse and also appeal to civilians who go to the scene to carry out "travel warnings” Islamic State of Iraq dan Syria (ISIS) menjadi perhatian masyarakat internasional karena eksistensinya menimbulkan ancaman bagi perdamaian dan keamanan dunia.

Abstract:
This PhD Dissertation presents the edition and global study of six pilgrimage certificates to the holy places of Mecca and Medina, dated between the 15th and 16th centuries. The particularity of this documentary typology lies in the fact that they attest delegated pilgrimages, whose legal origin is analyzed in this work. In this sense, this Dissertation differs in perspective from the devotional approach commonly used to study previously described certificates, and propose that the role played by these documents would be related to the Islamic jurisprudence on inheritance law. The comparative analysis, on the other hand, allows us to offer a general overview of the evolution of this typology from three different perspectives: materiality, textuality, and iconography. The main aim of this work is shed light on our knowledge of this kind of documents, explore the reasons for their emergence and implement the methodology of editing and studying unpublished manuscripts according to the criteria proposed by Papyrology.

Abstract:
The overall goal of the dissertation is to analyze the relation to religious norms and state law regarding the question of the wearing of muslim religious symbols. This socio-legal research follows results from 50 interviews done with persons who wear muslim religious symbols and work (or consider working) at the same time for the french and quebec states. The two legal contexts shows dissension regarding the regulation of religious symbols in public institutions. Empirical results shows different strategies of action and interpretation of state and religious norms, a human legal agency, where the rational autonony of the weaerer is the central element in the relation to norms

Abstract:
The history of Islam is inextricably connected to a celebrated history of trade and commerce which distinguishes it amongst monotheistic faiths. The modern incarnation of Islamic trade finance, however, bears only rudimentary similarity to the trade practices of old. Modern Islamic trade finance is devised to replicate conventional trade practices so that the barter-like immediacy of the Islamic contract of sale has been replaced with promissory attributes (wa’d). Yet Islamic law (sharia) has shown itself to be fully capable of adapting to modern trade practices so long as its major principles remain intact. The introduction of blockchain and smart contracts for Islamic trade finance does not change this basic calculus and yet these technologies promise to revolutionise Islamic trade practices in a way that compels the industry to operate in closer keeping with its commercial principles. Paradoxically, these technologies require substantive changes in the way in which Islamic trade finance is practiced, helping the industry to overcome its attachment to legal artifice (hiyal). Using comparative law methodology, this chapter briefly examines a short history of trade and commerce in the Islamic tradition, followed by the development of modern Islamic finance. It addresses the principles of Islamic commercial law as the basis for understanding the murabaha contract for trade finance, followed by an analysis of the legal and sharia-related issues that English courts have dealt with in the practice of Islamic trade finance. Finally, the chapter considers the transformative capacity of blockchain and smart contracts for Islamic trade finance, highlighting prominent legal and sharia-related issues that compel the industry to transform its trade practices markedly.

Abstract:
With the evolution and expansion of multiple legal institutions, litigants, former litigants, and future litigants had the opportunity to pursue many possible legal paths in British India. This chapter is the first of two that follow law’s travels, contests, and interactions across these multiple fora. The discussion focuses on the movement of litigants and their adversaries from the courtrooms of British India to other legal arenas as they engaged in forum-shopping and brought questions about legal outcomes to Islamic legal experts (muftis). Was the judge’s interpretation correct? Did he get Islamic law “right”? Was his determination appropriate for how pious Muslims should act in this context? Ordinary Muslims frequently presented these questions to muftis, as they worked to resolve their legal disputes in the context of an evolving and increasingly complex legal colonial system. These questions reflected litigants’ (and their adversaries’) understandings of how the colonial legal system was supposed to work; demonstrated their own knowledge about Islamic law and its interpretation; and revealed that a successful legal outcome often meant having the judge rule in your favor and making sure that the ruling fit with Islam.

This chapter provides a history of the rise of Islam in west Africa, in particular to Hausaland, which is today’s Northern Nigeria. The chapter then concentrates on the Sokoto Jihad and subsequent caliphate led by Uthman Dan Fodio. The chapter traces his intellectual history, highlighting his engagement with the Arabian peninsula and championing of unifying the Hausaland region under the textual regimen of the Maliki school of Islamic law. The second layer of the sunnaic paradigm, the role the Sokoto jihad plays in contemporary northern Nigerian idealizations of an ideal Islamic society, is explained. Idealization of scholars and hudud punishments are shown to be reinscribed into Nigeria’s present moment as a source of authentication of the 1999 sharia experiment.

Abstract:
Provides a broad overview of the centrality of The Hijaz as well as Saudi Arabia and the Holy Land today. It explains why The Hijaz is relevant as Islamic statecraft, collective identity and statesmanship. It deals directly with methodology of the research and the problems of historiography and the encounters with international law. It provides an extensive treatment of statehood by explaining the negotiation between crucial ideas of the Westphalian nation-state and the Islamic worldview of the state and the caliphate. It maps out in detail the scope and value of modern literature and secondary sources and provides an extensive section on archival theory and literature review of The Hijaz. As a precursor for this “hidden narrative,” the study traces the origins of Islamic statehood over a thousand years back to find the “idealized state” in the venture of Islam- The Hijaz.

Abstract:
This chapter traces Anderson’s entry into the world of British academia as a specialist in Islamic law. It scrutinizes the attention paid by various British academics and Muslim intellectuals to Anderson’s academic work and the ways in which a Protestant conception of modernity influenced his analysis of Islamic legal reform. It situates Anderson’s academic work against the backdrop of the general evolution of oriental studies in Britain after World War II and the specific developments at the School of Oriental and African Studies in London. It also highlights the ways in which Anderson’s attachment to natural law theory shaped his approach to comparative law and Islamic legal reform.

Abstract:
This chapter provides introductory context on the meaning, nature, and scope of environmental law in the Arab region. It explores the often-contested meanings of key concepts such as “environment,”, “environmental law,” and the influence of Islamic law in the development of environmental law in the Arab world. Care and stewardship for the environment—for present and future generations—appeared very early in the beliefs, culture, and civilization of the Arab states. Islamic principles emphasize that humans are mere beneficiaries and trustees (khalīfah) of the earth and not proprietors; and that humans have a solemn duty to keep, maintain, and preserve the natural environment, such that it does not disrupt or upset the equilibrium and interests (mīzān) of future generations. After discussing the influence of these Islamic tenets on the conceptualization of environment and environmental law in the region, this chapter traces the history and evolution of environmental law as a discipline in the region. The chapter also includes information on the scope and structure of the book, as well as the sources and research methods involved in putting the book together.

Abstract:
This chapter follow’s Norman Anderson’s career as a missionary with the Egypt General Mission in Egypt from 1932 to 1939. It traces the influence of prominent missionary thinkers, Egyptian Christians and Islamic intellectuals on Anderson’s missionary strategy and his growing interest in Islamic reform. Anderson’s missionary strategy coalesced around evangelistic outreach to Egyptian students at Cairo University. In order to reach these students he attended classes in law, constructed a modern purpose-built house to host gathering near campus and wrote an apologetic for the Christian faith in Arabic aimed at sceptics and Muslims. Anderson also became fascinated with the movement to reform Egyptian law and began to study the Arabic writings of the leading teachers in Islamic law at the University.

Abstract:
Abstract This chapter takes up the origins of legal-moral reasoning that became an indispensable part of formulating the deontological ethics of Islamic juridical tradition. The idea that obedience to the divine law was the path that all believers needed to undertake was firmly extracted from direct commandments of the Qur’an elaborated by the Tradition. Hence, the scriptural guidance in Islam connected the ultimate salvation to adherence to the orthopraxy. Muslims were not only obligated to discover God’s will in acts of obedience; they were also required to extrapolate the juridical ethics that guaranteed the discovering of the path to salvation for all those who performed righteous acts. The scope of interpretive jurisprudence was to provide methodological procedures to ascertain the reliability of orthopraxy derived from revelatory sources like the Qur’an and the Tradition. The chapter traces the evolution of legal-ethical reasoning.

Keles, Ozcan. "PROMOTING HUMAN RIGHTS VALUES IN THE MUSLIM WORLD: THE CASE OF THE GÜLEN MOVEMENT." In Muslim World in Transition: Contributions of the Gülen Movement. Leeds Metropolitan University Press, 2007. http://dx.doi.org/10.55207/lfko6932.

Full text
Abstract:
The premise of this paper is that human rights values are a persistent theme of Fethullah Gülen’s thought and tajdid and expressed by the Gülen movement through example. That tajdid is collectively constructed and communicated by allowing for adaptation and indigenisation in flexible response to different socio-cultural con- texts. What is more, Gülen’s views on democracy, pluralism, human rights and free- dom of belief directly promote human rights values and norms. The paper argues that the Muslim world is very important to Gülen’s overall aspiration for an inclusive civilisation and thus the movement is now active in most parts of that world. In time, as in Turkey, Gülen’s ideas will enable and empower the periphery in Muslim socie- ties to influence the centre ground and open the way for wider enjoyment of freedom and human rights. The paper is in three sections. The first looks at the underlying dynamics of Gülen’s influence and the nature of his tajdid, to assess whether his influence is transferable elsewhere. The second appraises the content of Gülen’s tajdid arguing that human rights values are an inherent theme of his discourse on Islam. Here, the paper analy- ses Gülen’s views on Anatolian Muslimness, democracy and politics, human rights and freedom of belief, illustrating Gülen’s incremental ijtihad on temporal punish- ment for apostasy in Islamic law. The third part traces the movement’s activities in the Muslim world, arguing that the movement has now entered a phase of adoles- cence, and asks whether Gulen’s tajdid and discourse, through the practice of the movement, can indeed promote human rights values in this world.

Abstract:
Walking is an important part of the tourist experience and comfort travel. There is increasing attention to encourage tourists to walk as a mode of sustainable transportation. Emergence of new and diverse forms of data has expand the field of research via text mining analysis. This is an alternative for common research methodology as a good analysis tool to reflect pedestrians’ opinions in spatial design and urban planning. In this regard, the novelty of this paper is to investigate the relationship between walkability and successful tourism in Doha, Qatar by utilizing text mining analysis on a readily available datasets, i.e. the customer generated contents from TripAdvisor. The collected data for tourist attractive places in Doha, Qatar shows higher frequency (connection) of words that reflect the characteristics of each research location and its respective relationship with public transportation (Doha Metro) to support the walkable environment. The findings have determined some users-friendly walking environment especially for research locations like The Pearl, Souq Waqif and Museum of Islamic Arts. On the other hand, it is indicated that the rate of Metro use is still low compared to the city’s population and this will take some time for Doha Metro to be used as main mode of transportation among the tourists. The outcome of this study will enable to propose some guidelines to enhance the walking environment for tourists within the challenging weather condition like hot and arid climate of Qatar

Abstract:
Two importants traditions have coexisted in the Mediterranean, classical city and islamic city. The mode of live the city, the use of public spaces and the nature of social relations are different in both cases. Abstract:
