Abstract:
On December 8, 2016, an International Centre for Settlement of Investment Disputes (ICSID) tribunal (the Tribunal) held that international human rights condition the treatment that an investor is entitled to receive from a state and that human rights impose obligations on the investor itself. The Tribunal's explicit recognition of these dual consequences of international human rights law breaks new ground. International investment tribunals have not previously held that human rights obligations have any effect on protections due to investors, much less that international human rights law might establish separate obligations for investors.

Jurisdiction. 20 ICSID Review: Foreign Investment Law Journal 450 (2005).International Centre for Settlement of Investment Disputes, October 21, 2005.In Aguas del Tunari v. Republic of Bolivia, an International Centre for Settlement of Investment Disputes (ICSID) tribunal held that it had jurisdiction under the Netherlands-Bolivia bilateral investment treaty (BIT) over a claim against Bolivia brought by a Bolivian company owned primarily by two companies— one American and one Spanish—through Dutch intermediaries. The tribunal found that the Dutch intermediaries “controlled” the Bolivian company and that jurisdiction existed notwithstanding that the dispute related to a concession agreement with a choice-of-forum clause designating Bolivian courts.The origin of the dispute lay in Bolivia's attempt in the late 1990s to privatize the water service in Cochabamba, its third largest city. In September 1999, Bolivia awarded a forty-year concession agreement to a Bolivian company, Aguas del Tunari, S.A. (AdT), for the exclusive provision of water services in the city.

El presente trabajo tiene por objeto el estudio del reparto competencial existente entre el Estado y las Comunidades Autónomas en materia de agua, a cuyo fin se analiza el marco constitucional competencial y la asunción estatutaria de competencias sobre agua, así como las últimas reformas de los Estatutos de Autonomía al respecto; también se repasa la jurisprudencia del Tribunal Constitucional recaída sobre dicha materia, hasta llegar a las recientes Sentencias del Tribunal acerca de la constitucionalidad de la asunción por los Estatutos de Andalucía y Castilla y León de competencias sobre las cuencas de los ríos Guadalquivir y Duero, respectivamente (SSTC 30 y 32/2011), entrando en su análisis crítico y detallado. Finalmente se advierte una paradójica actitud del Estado por cuanto que, habiendo participado en los últimos procesos de reforma estatutarias, paralelamente no procedió a realizar reformas legales oportunas en relación a las novedades competenciales previstas por los recientes Estatutos de Autonomía reformados.

On 8 December 2016, an International Centre for Settlement of Investment Disputes (ICSID) tribunal chaired by Professor Andreas Bucher, with co-arbitrators Professor Pedro J. Martinez-Fraga (Claimants' appointee) and Professor Campbell McLachlan QC (Respondent's appointee), issued its award in Urbaser and CAAB v. Argentina (Award). The dispute related to a Concession Contract granted to Aguas Del Gran Buenos Aires S.A. (AGBA), a company in which Claimants were shareholders, for the provision of water and sewerage services in the Province of Greater Buenos Aires (Province). Claimants alleged that they had faced numerous obstacles created by the Province's authorities, which precluded the efficient and profitable operation of their Concession. Respondent counterclaimed that Claimants had failed to make the necessary investment in the Concession, thereby violating their obligation under international law based on the human right to water.

En España la polémica sobre el reparto competencial sobre aguas y obras hidráulicas entre el Estado y las Comunidades Autónomas, comienza con la misma promulgación de la Constitución en 1978 dados los términos imprecisos que ésta utiliza en el art. 149.1.22. A través del tiempo y con intervención del Tribunal Constitucional se ha alcanzado una solución consistente en atribuir al Estado la gestión de las cuencas que abarcan el territorio de más de una Comunidad Autónoma (cuencas intercomunitarias) y a éstas la gestión de las cuencas que se encuentran íntegramente en su territorio (cuencas intracomunitarias). No obstante, se trata de una solución sometida a tensiones y en la que las últimas reformas de algunos Estatutos de Autonomía plantean nuevos retos de gobernación. Cuestión problemática es usualmente la de la transferencia de recursos hídricos entre distintos ámbitos territoriales de planificación hidrológica de cuenca, lo que suele conllevar conflictos territoriales (con aspectos políticos y sociales) en algunos casos de importante magnitud. Igualmente en la actualidad se debaten otras cuestiones con incidencia territorial como los informes de las Comunidades Autónomas en procedimientos administrativos de decisión estatal, la existencia, contenido y funcionalidad del llamado “derecho al agua” etc…

Ce mémoire étudie le fonctionnement et les processus de patrimonialisation du Tribunal des eaux de Valence (Espagne), ainsi que les mécanismes de la participation des communautés autonomes d'irrigants dans sa conservation, sa transmission et sa mise en valeur. Il s'intéresse aux perceptions des acteurs du milieu agricole, des juges (syndics) du Tribunal et des agriculteurs de la huerta valencienne, quant à la fonction sociale actuelle du Tribunal et à son rôle dans la sauvegarde des savoir-faire d'irrigations traditionnels. A intensidade com que essa instituição se desincumbe de sua importante missão não permaneceu a mesma ao longo dos anos. O protagonismo e autonomia atual não se identificam com o papel secundário exercido pelo Supremo no período anterior ao advento da Constituição de 1988. Com um desenho conformado pelo constituinte de 1987 após o fim do regime militar, a Constituição de 1988, bem como mudanças significativas na organização da sociedade brasileira, possibilitaram a ampliação de uma vida democrática no país. Teóricos que estudam essa mudança confirmam um movimento no sentido de uma judicialização da política no Brasil promovida por essas condições e pelo Supremo, que impõe ao Tribunal uma necessária inserção no jogo político entre os poderes representativos do Estado. Para compreender esse movimento o trabalho realizou estudo comparativo entre os modelos de cortes constitucionais e entre os debates teóricos sobre a atuação das cortes. A judicialização da política e o ativismo judicial serviram como base interpretativa das decisões do Supremo e a sua consequente autonomia.<br>This thesis aimed to investigate the acts of the Supreme Court as an institution which plays an essential role in the Brazilian democratic life. The intensity with which this institution performs its important mission has not remained the same over the years. The current role and autonomy do not correspond to the secondary role played by the Supreme Court in the period of time before the Constitution of 1988. With a design composed by the constituent of 1987 after the end of military rule, the 1988 Constitution, as well as significant changes in the organization of the Brazilian society, allowed the expansion of democratic life in the country. Theorists who study such change confirm a movement towards a judicialization of politics in Brazil promoted by these conditions and by the Supreme Court, which impose a necessary inclusion in the political game between the representative branches of government. In order to understand this movement, a comparative study between the models of constitutional courts and between theoretical debates about the role of the courts was performed. The judicialization of politics and judicial activism served as interpretative basis for decisions of the Supreme and its consequent autonomy.

Descreve-se quais as formas em que o elemento água está presente nos romances Chove nos campos de Cachoeira, Marajó, Três Casa e um Rio, e nos livros de contos Golfo de Penas, Cabo de Hornos, Tierra del Fuego e Inéditos, respectivamente. Comparam-se os elementos comuns e diferentes que apresentam essas narrativas, circunscritas a uma estética Modernista, tendo como ponto de referência as vozes das águas nas narrativas, e de que maneira esse elemento influencia na vida das personagens. O trabalho apresenta parte da obra de ficcionistas menos difundidos no Brasil e no Chile, favorecendo a integração cultural entre esses povos<br>Abstract: This paper discusses the issue of the presence of the water on the narratives of two Latin American writers: Dalcidio Jurandir, Braszilian, and Francisco Coloane, Chilean. We describe on which forms the element waters is present in the Novels Chove nos campos de Cachoeira, Marajó, Três Casa e um Rio, and in the Tall Tales Golfo de Penas, Cabo de Hornos, Tierra del Fuego and Inéditos, respectively. We compare the similar and different elements that those narratives show, entailed on the Modernist style, having as its reference point the voice of the waters in the narratives, and how this element influences the life of the characters. Abstract:
Los sistemas de lagunaje son una tecnología ampliamente utilizada a nivel mundial para para el tratamiento de las aguas residuales, especialmente en pequeñas poblaciones y zonas rurales. Actualmente el reto en su funcionamiento consiste en maximizar su eficiencia, para recibir cargas altas y potenciar el aprovechamiento biotecnológico de las algas que proliferan en este tipo de sistemas. En el presente estudio se presenta el análisis de un sistema de lagunas para el tratamiento de aguas residuales, ubicado en Costa Rica, que recibe aguas residuales domésticas. El sistema fue estudiado en cuanto a la remoción individual de contaminantes en cada una de las lagunas que lo componen y se identificaron los principales tipos de algas presentes en las aguas residuales dentro de la laguna. Se observó una remoción alta especialmente de materia orgánica y la presencia de algas con un papel relevante a nivel de su aprovechamiento biotecnológico.
