The article traces in detail the origins of the prosecutor amicus curiae in the practice of the International Criminal Tribunal for the Former Yugoslavia. This chapter focuses on international administrative tribunals, which are part of the internal systems of administration of justice put into place by international organizations (IOs) to settle employment disputes. Without them, staff members would have no other recourse. IOs are generally granted immunity from municipal jurisdiction, thus their employees are, in principle, unable to turn to national tribunals. The chapter begins by tracing the evolution of internal justice systems in IOs. It then discusses the institutional components of administrative tribunals. These components vary, depending on the needs of each organization and the choices made at the time of their creation. They have, however, a number of common features.

The year 2018 was characterized for the international administrative tribunals by (at least) the following three elements, the first two of which were strictly related and linked to each other: the UN Appeals Tribunal’s delivery of the long-awaited judgment on 29 June 2018 in the case Quijano Evans et al. v. Secretary General, challenging the initial decision by the UN Dispute Tribunal to recognize an intangible right to an expectation of continued salary increases over time to the staff and personnel; the decision on September 2018 in the Jannick DEVAUX (II) and (III) case, where the Administrative Tribunal of the Council of Europe acknowledged the application of the general principle of equal pay for equal work in the international civil service sector. Noteworthy to stress is the fact that 2018 was also the year in which the ILO Administrative Tribunal, one of the oldest and most established international administrative tribunals, has the opportunity through the case A v. International Criminal Court (ICC) to clarify the meaning, content and scope of the protection of the international organizations’ staff for the moral damages suffered by their officers and staff personnel as a result of illegal arrests and detentions occurred during working missions abroad.

Chapter 16 deals with contempt cases against journalists. Restrictions on freedom of the press have been striking at international criminal tribunals, where violations of protective measures granted to, for example, witnesses have led to several landmark yet controversial prosecutions of journalists for contempt of court. This chapter examines these practices from a human rights law perspective, as part of the recognized exceptions to the principle of public trials. In doing so, it reviews the law and jurisprudence of international and hybrid tribunals, including the International Criminal Tribunal for the former Yugoslavia (ICTY), the Special Tribunal for Lebanon (STL), and the International Criminal Court (ICC). In addition, it surveys contempt of court, offences against the administration of justice, and the law on reporting restrictions in a number of common law and civil law domestic jurisdictions. It concludes that the right to freedom of the press in the context of international criminal trials is not absolute, and that limits ordered by international tribunals, despite the polemics they may cause, are actually fully in line with both human rights law and domestic legal trends.
