Abstract:
The propensity of WTO always ensure to strengthening and consolidating the integration approach with country to country. Manifold accession like TRIMS, TRIPS and trade liberalization agenda facilitate to enlarge the attractiveness of foreign direct investment in many more developing countries. This study is concentrates on judgment of the WTO accession like liberalization, TRIMS and TRIPS stimulate the flow of FDI in developing countries and also to observe that the other relevant important variables such as macroeconomic stability, infrastructure, human capital, geographic location, financial development, agglomeration, market size has helped the incessant inflow of FDI for developing country. Some research penetratingly interpreted that TRIMS, TRIPS and trade liberalization accession are controversial subject matter for the developing countries. For accomplishing the research work the paper has used panel data of 58 different developing countries over the years 1990-2014. Through that work the paper has explore that because of the adopting liberalization polices, relinquishing market distortions with the connection of TRIMS and harmonization of IPR standards throughout TRIPS escalate the foreign direct investment in the developing countries, it means that there is a significant relationship of FDI along with TRIPS, TRIMs and trade openness. Other pertinent factors like market size, macroeconomic stability, agglomeration and engagement of WTO membership have also significant impact on FDI inflows. Others common factors like infrastructure, human capital, financial development, geographical location also make significant impact on facilitating foreign direct investment. Developing countries always requires strengthening their superiority and protecting rights and ensuring negotiation process and encouraging market liberalization process for accomplishing economic competitiveness.

Devido ao colapso da economia americana, em 2009, os Fluxos de Capitais foram somente da Ordem Econômica de US$ 1.8 trilhões, 82% menos do que em 2007 (US$ 10.5 trilhões). Em 2009, o volume de comércio diário de ativos foi de US$ 1.5 trilhões, com US$ 178 trilhões como ativos financeiros. Os Investimentos Internacionais produtivos são uma das bases da internacionalização de empresas e do capital. Ao estabelecer uma planta industrial e/ou adquirir ações de empresas, este fluxo transfronteiriço de capital aporta bens, tecnologia, novas práticas administrativas, inter alios actos, e se distingue do investimento bursátil de carácter meramente especulativo e apátrida do hot money. Escrito em 3 (três) capítulos, este trabalho prescruta, no plano internacional, as regras jurídicas dos fluxos produtivos e as Medidas de Comércio Relacionadas aos Investimentos (TRIMs) da Organização Mundial de Comércio (OMC). Estas contêm cláusulas de Restrições as Práticas de Negócios que impedem os Estados-Membros da OMC a realizarem políticas públicas de desenvolvimento nacional. Não se olvidando do diálogo das fontes normativas internacionais, uma vez que a OMC não está em isolamento clínico do direito internacional, assim, verifica-se um claro embate entre a Soberania Permanente aos Recursos Naturais e o Direito ao Desenvolvimento. Entre mais de 140 (cento e quarenta) casos julgados pelo ICSID, excepcionalemente, e somente em 1 (um), o Estado-hospedeiro venceu, feito o exame dos 2 (dois) grandes sistemas jurídicos de investimentos. A tríade (EUA, UE, Japão) mais Coreia do Sul querem um modelo ainda mais liberal de regras de investimentos na OMC. Discorre este trabalho sobre os mais de 2.500 (dois mil e quinhentos) Bilateral Investments Treaties (BITs) e os Regional Trade Agreements (RTAs), como o do NAFTA, draft do MAI, e as Instituições de Bretton Woods ligadas ao IED, e a interação com a Doutrina, Jurisprudência e tendências. A UNCTAD critica veementemente este conjunto de regras liberais, sejam os BITs, sejam as TRIMs. O núcleo irradiador deste trabalho é a Declaração Conjunta indo-brasileira, que propõe a Reforma das TRIMs (G/TRIMS/W/25) para permitir, por meio de compras locais e requisitos de performance, o manejo de políticas públicas de desenvolvimento nacional hoje proibidas. Este trabalho conclui ser a Reforma das TRIMs uma impraticabilidade diplomática, de modo que o direito ao desenvolvimento dar-se-ia como improvável exceção.
Due to the US economic downturn, the Capital Flows in 2009 were only from the economic order of U.S.$ 1.8 trillion, 82% less than 2007 (US$ 10.5 trillion). In 2009 the daily trading volume of assets were U.S.$ 1.5 trillion with US$ 178 trillion as financial assets. The productive International Investments are one of the bases from the internationalization enterprises and of the capital. By establishing an industrial plant and/or acquire assets of companies, this cross-border flow of capital brings goods, technology, new management practices, inter alios acts. Distinguishing itself, by this way, from the stock market investment of purely speculative character and stateless, from the hot money. Written in 3 (three) chapters, this work search, in the international field, the legal rules from productive flows and the Trade Related Investment Measures (TRIMs) of the World Trade Organization (WTO). These clauses contains Restrictive Business Practices (RBP) that prevents States-Members from the WTO to carry out public policies of national development. Not forgetting the dialogue of sources from international rules, once the WTO is not in clinical isolation from the international law there is a clear clash between the Permanent Sovereignty on Natural Resources and the Right to Development. Between more than 140 (one hundred and forty) cases tried by ICSID, exceptionally and only one (one) the host-State won. Made the examination of the 2 (two) major legal systems of investments. The Triad (USA, EU and Japan) plus South Korea wants a model with more liberal investment rules in the WTO. Discusses this work on the more than 2500 (two thousand and five hundred) Bilateral Investments Treaties (BITs) and Regional Trade Agreements (RTAs) such as NAFTA, the MAI draft, and the Bretton Woods institutions related to FDI and the interaction with doctrine, jurisprudence and trends. UNCTAD strongly criticizes this liberal set of rules, not only the BITs, but also the TRIMs. The core matter from this work is the Indo-Brazilian Joint Statement on the Reform of the TRIMs (G/TRIMS/W/25), that proposes through local purchases and performance requirements the right of management of public policies for national development currently forbidden. This work concludes that the Reform of the TRIMs is a diplomatic impractibility, in a mode that the Right to development can be achieved as an improbable exception

Abstract:
In 132 rabbits belonging to the Cunicola La Esperanza Farm of the city of El Alto in the department of La Paz, the principle physical characteristics of the angora rabbit fiber were determined in a period of 3 shearings. As such they were organized into 2 groups, clearly differentiated by their sex (female and male). The obtained fiber of the different shearings were weighed in order to determine the performance of each animal and subsequently analyzed the wool in the Experimental Station of Patacamaya, where they determined the diameter, length of hair and marrow composition. The results were subjected to a statistical analysis with the help of the SAS program. The effects of the principle studied factors (sex, age, number of shearing) showed highly significant differences (p<0.01). The fiber yields for males and females were 70.76 and 81.72 g respectively; as such the fiber yields of 57.77, 82.91, 84.28, 80.01, 71.36, 81.11 and 76.25 g for those under the age of 1 year, 1 year, 2 years, 3 years and first shearing, second shearing, third shearings respectively. The age of the animals and the number of shearings were the principle causes of the variation of the performance of the fiber. The male rabbits obtained 13.10 microns in diameter, 56.10% of marrow composition and 4.10 cm of length, and the female rabbits 13.91 microns of diameter, 65.34% of marrow composition y 4.23 cm of length, being the effect of the sex most highly significant (p<0.01). The fineness of fiber of the animals was 12.80, 13.07, 14.28 y 13.88 microns respectively for the ages younger than 1 year, 1 year, 2 years and 3 years, a marrow composition of 57.68, 60.54, 60.56 y 64.10%, for the same ages, observing among themselves highly significant differences (p<0.01); except in the variability of the length of the hair. In animals subjected to different numbers of shearing they obtained 13.48, 13.37 and 13.67 microns for the first, second and third shearings respectively and a bone composition of 59.28, 62.32 y 60.56%, observing minimum numerical differences, but not statistical, as in the length of hair.

O objeto do presente trabalho é a análise das mudanças no regime jurídico do investimento estrangeiro ocorridas na última década. Após o estudo histórico sobre o desenvolvimento desse regime, as quatro tendências que conduziram a elaboração das regras daquele período são examinadas. A primeira delas foi a criação de regimes regionais, como as regras sobre o investimento internacional do NAFT A, ASEAN, APEC e Mercosul. A segunda, as tentativas de estabelecimento de um regime multilateral, como comprovam não só as negociações do MAI e das TRIM\'s, nos quadros da OCDE e OMC, como a consolidação pelo Banco Mundial das Diretivas sobre o investimento direto estrangeiro. Em terceiro lugar, o surgimento de normas internacionais setoriais, a exemplo do Tratado da Carta da Energia. E, por último, o crescimento extraordinário do número de acordos bilaterais sobre a matéria. O estudo leva em consideração a jurisprudência internacional, principalmente as sentenças proferidas pelo CIRDI. O exame dessas quatro tendências é seguido pelo estudo de dois regimes regionais que dizem respeito aos interesses brasileiros: o do Mercosul e o da ALCA. Se comparado com os regimes anteriores, aquele dos anos 90 se distingue por privilegiar a flexibilização das regras sobre o fluxo de capitais e o incremento de seu ganho. Preocupações com regras concernentes à proteção do investimento estrangeiro parecem estar ultrapassadas em razão de dois motivos. Inicialmente, pela implementação de seguros e garantias contra riscos políticos que, além de contornar o risco decorrente das interferências governamentais nos investimentos, também minimizou as discussões sobre as indenizações. Em segundo lugar, pelo endosso dado pela maioria dos países em desenvolvimento às políticas neoliberais -o que inibiu a ação governamental no regime doméstico do investimento internacional- e pela concorrência entre esses países em atrair esse investimento. O direito internacional dos investimentos passou a contar com poucas lacunas, a basear-se menos no costume e a formalizar-se em instrumentos. Questões vitais em décadas anteriores, como aquelas relativas à cláusula Calvo e aos critérios indenizatórios, foram resolvidas por tratados ou pela jurisprudência. Esta tomou-se abundante, consolidando um entendimento conservador. Objetivamente, pouco restou do discurso inflamado dos anos 60 e 70 sobre a NOEI. Desmontou-se o binômio investimento e desenvolvimento, desarticulando-se um sistema anterior chamado de Direito Internacional do Desenvolvimento. Essa desarticulação deu-se por caminhos diversos. O direito internacional dos investimentos, antes objeto de Resolução da ONU, teve seus debates transpostos para outras organização, como o Banco Mundial A preocupação com o desenvolvimento foi realocada de capítulo do Direito Econômico Internacional para o campo dos Direitos Humanos. Das quatro tendências acima, uma delas parece que não terá continuidade: o tratamento setorial da matéria. Todavia, nos próximos anos, as outras três continuarão a ser seguidas: não há indicação de refluxo nos acordos bilaterais; a busca por um regime multilateral irá continuar, como aponta o compromisso assumido na reunião da OMC, em Doha de assinatura das TR!M\'S em 2005; e, finalmente, as negociações da ALCA, que incluem disposições sobre investimentos, indicam continuidade na tendência regional.
The purpose of this work is to analyze the changes introduced in the international legal regime applicable to foreign investment in the last decade. After an historical study on the development of this regime, the four trends that shaped the elaboration of these rules during this period are examined. Firstly, the tendency to the creation of international regional regimes -like NAFTA, Mercosur, ASEAN and APEC\'s special rules on investment- is analyzed. Secondly, the several attempts to establish a multilateral regime on foreign investment -as evidenced by the negotiation of the MAL in the OECD, and of the TRIM\'s, in the WTO, as well as the edition of the Guidelines on Foreign Direct Investment by the Word Bank- are reviewed. In the third place, the international rules applicable to investments in special sectors, as is the case of the Energy Chart Treaty, are focused. Finally, the increase in number of the bilateral treaties is examined. This study takes into account the international jurisprudence, mainly the awards rendered by the lCSID. This exam is followed by the study of two regional regimes that affect Brazilian interests: the Mercosur and the FTAA. If compared with the previous regimes, the one that prevailed in the nineties appears to be more concerned with both the flexibility of the rules on the flow of capitals and the increase of earnings. Concerns about rules on the investment protection have vanished for two main reasons. Initially, the availability of insurance and guaranties against political risks besides minimizing the risks presented by any governmental interference on the investor\'s control over its investment, also contributes to make issues on the value of indemnities irrelevant. In the second place, the majority of the developing countries not just endorsed neo-liberal policies, which made governmental restrictive postures on foreign investment difficult, but have started to compete against each other to attract foreign capitals. The International Law on Investments turned into a system with few gaps, based rather on written treaties than on customary law. Crucial issues of the past few decades, like these related to the Calvo doctrine or to indemnities criteria, were solved by treaties and arbitral decisions. Not only did the jurisprudence become abundant, but also consolidated conservative views on the matter. Objectively, very little remained of the fiery speech on the NEIO. The dual investment and development was undone and the previous system of the International Law of Development collapsed. This collapse was caused by different reasons. The most determining, however, is the fact that the International Law on Investment, based before on customary roles and precariously settled by UN\'s resolutions, were relocated to different fora, like the World Bank. The concern with development switched from an important chapter of the International Economic Law to Human Rights\' domain. Amidst the four trends pointed out in this work, apparently just one will be discontinued in the near future: the sectorial treatment of foreign investment. Nonetheless, the others will continue to be present: there is no evidence of reflux in the signing of bilateral treaties; the search for a multilateral regime will continue, as shown in the commitment made in the WTO Conference of Doha, in 2001, fixing for 2005 the signing of the agreement on TRIM\'s; and finally, the negotiation of FTAA, including dispositions on investments, indicates that the regional tendency will remain.

Mobility on Demand (MOD) systems allow users to pick-up and drop-off vehicles (bikes, automobiles) ubiquitously in a network of parking stations. Asymmetric demand patterns cause unbalanced fleet allocation decreasing level of service. Current redistribution policies are complex to plan and typically cost more that the usage revenues of the system. The Market Economy of Trips (MET) explores a new operation model based on a double auction market where cost-minimizing users are both buyers and sellers of trip rights while profit-maximizing stations are competing auctioneers that trade them. Trip rights are priced relatively to the inventory needs of origin and destination stations. A theory, a game, and a model are presented to explore equilibrium and limits of efficiency of MET under different demand patterns and income distribution.

O objetivo geral deste trabalho consiste em analisar as novas disposições em matéria de observância dos direitos de propriedade intelectual por meio de medidas de fronteira surgidas em novos foros que discutem e regulamentam o tema. Foram utilizados o método de abordagem dedutivo, o método de procedimento monográfico e a técnica de pesquisa bibliográfica. Os novos foros e regras surgem do entendimento por parte dos países desenvolvidos de que é necessário aumentar os padrões internacionais de proteção dos direitos de propriedade intelectual, suscitando questionamentos sobre as implicações desta expansão no desenvolvimento e na manutenção do equilíbrio entre interesse público e privado. É necessário observar estas normas por meio dos limites e padrões máximos existentes no Acordo TRIPS para que sejam alcançadas orientações que possibilitem a criação de normas equilibradas de medidas de fronteira, avaliando custos e benefícios, preservando interesse público e privado, deixando espaço para autonomia e flexibilidades para os países se desenvolverem.
The main objective of this work is to analyze the new provisions in matter of enforcement of intellectual property rights through border measures arising in new forums that discuss and regulate the subject. Were used the deductive approach method, the monographic procedure method and the literature research technique. The new forums and rules emerge from the developed countries# understanding that it#s necessary to increase the international standards of intellectual property rights protection, raising questions about the implications of this expansion in developing and maintaining the balance between public and private interests. It#s necessary to observe these norms through the maximums limits and standards in TRIPS Agreement so that reach the orientations that enable the creation of balanced border measures rules, evaluating costs and benefits, preserving public and private interests, and leaving space for autonomy and flexibility for countries to develop.

Äldreomsorgen är en viktig del av välfärdssystemet och är i fokus för samhällsdebatten. De frågor som är aktuella handlar om vårdkvalitén, tillgång till vård och omsorg, ekonomiska medel samt vård i framtiden med allt det innebär. Arbetsvillkoren inom vården anses vara mer påfrestande än inom andra sektorer av arbetslivet.Syftet med denna uppsats är att undersöka och analysera vad som är viktigt för motivationen och arbetstillfredsställelsen i ett påfrestande arbete med äldre och huruvida de anställda motiveras av dessa faktorer. Utifrån syftet formulerades följande frågeställningar: Hur ser arbetsmotivation och arbetstillfredsställelse hos anställda inom äldrevården ut? Vilka faktorer har samband med motivation och arbetstillfreds-ställelse hos personal inom äldrevården? Finns det skillnader mellan anställda i privat respektive kommunal regi?För att få en generell bild av arbetsmotivationsfaktorer och arbetstillfredsställelse inom äldrevården valdes som forskningsstrategi med en kvantitativ metod, baserad på en enkätundersökning. Jag utgår i min studie från Maslows behovspyramid och Alderfers ERG- teori.Enligt resultatet i min studie ligger arbetsmotivation generellt inom äldrevården på medelmåttlig nivå. Personalen känner inte direkt arbetsmissnöje och vantrivsel med sin situation, men arbetsgivare bör fokusera mer på fysisk och psykosocial arbetsmiljö, schema och återhämtning samt belöningar. En god stämning på arbetsplatsen, med trivsel med arbetskamraterna, är i den här undersökningen faktorer som har samband med arbetsmotivation och arbetstillfredsställelse.
Geriatric care is an important part of the welfare system and in focus for the community debate. Relevant issues are the quality of the care, access to care, economical means as well as care in the future with all its aspects. Work conditions are considered to be more stressing than other professions. The purpose of this study is to investigate and analyze crucial factors for the motivation and work satisfaction in a stressing work with elderly and whether the employees are motivated by these. Based on this purpose, the following questions were raised: How does motivation and work satisfaction for employees in geriatric care look like? Which factors have a connection to motivation and work satisfaction for employees in geriatric care? Are there any differences between employees in municipal and private sectors?I use a quantitative method, based on questionnaire to acquire a general picture of the factors for motivation and work satisfaction. I employ Maslow´s Hierarchy of Needs and Alderfer´s ERG-theory in my study.The result of my study reveals that the general work motivation within geriatric care is on a medial level. The employees do not sense any general dissatisfaction with the situation but the employers should increase focus on physical and psychosocial work environment, schedules and relaxation as well as rewards. A pleasant atmosphere and comfort between colleagues are factors, which are connected with work motivation and satisfaction.

Abstract In response to the gradually stringent carbon emission requirements of the International Maritime Organization (IMO), the energy-saving methods of the shipping industry have received increasing attention. Today how to reduce fuel consumptions so as to lower carbon emissions to improve the economic and environmental benefits of ships has become a hot topic. As one of the most easily implemented energy-saving methods, trim optimization has caught more and more researchers’ eyes. In this paper, a commercial CFD software STAR-CCM+ was adopted to analyze the influence of trim on the resistance performance of VLCC ship mainly with fixed model method under various typical conditions of the design draft and the ballast draft respectively. The grid convergence was studied at the design draft and the typical numerical simulations were verified by the experimental results before carrying out various numerical simulations of trim optimization. Seven different kinds of trim conditions, which correspond to the changing process of the full scale ship from trimming by stern 4m to bow 4m, were simulated with 3 different speeds of design draft and ballast draft. The changes of total resistance, frictional resistance and residual resistance were analyzed to explore the effect of trims on the ship’s resistance. The variation of ship’s wetted surface area and waterplane area under different trim angles were studied. It was found that under the condition of low Froude number, both the simulation of free trim and sink method and the fixed model method can achieve good accuracy with the method of fixed model reducing the simulation time obviously. Both conditions of the design draft and ballast draft had a certain reduction effect of total resistance for trimming by bow properly, of which the change of frictional resistance is dominant in the decrease of total resistance at design draft while the change of residual resistance is the main cause at ballast draft. The optimum trims were found and the optimal total resistance reduction effects were evaluated. The optimal total resistance reduction effect increased with speed whether at the design or the ballast draft and the reduction effects were more obvious at ballast draft. Meanwhile, it was found that the changes of wetted surface area and the waterplane area with different trims were close to the variation tendency of the frictional resistance.

A piping system of French nuclear power plants displays large amplitude vibrations in particular flow regimes. These troubles are attributed to cavitation generated by single-hole orifices in depressurized flow regimes. Real scale experiments on high pressure test rigs and on-site tests are then conducted to explain the observed phenomenon and to find a solution to reduce pipe vibrations. The first objective of the present paper is to analyze cavitation-induced vibrations in the single-hole orifice. It is then shown that the orifice operates in choked flow with supercavitation, which is characterized by a large unstable vapor pocket. One way to reduce pipe vibrations consists in suppressing the orifices and in modifying the control valves. Three technologies involving a standard trim and anti-cavitation trims are tested. The second objective of the paper is to analyze cavitation-induced vibrations in globe-style valves. Cavitating valves operate in choked flow as the orifice. Nevertheless, no vapor pocket appears inside the pipe and no unstable phenomenon is observed. The comparison with an anti-cavitation solution shows that cavitation reduction has no impact on low frequency excitation. The effect of cavitation reduction on pipe vibrations, which involve essentially low frequencies, is then limited and the first solution, which is the standard globe-style valve installed on-site, leads to acceptable pipe vibrations. Finally, this case study may have consequences on the design of piping systems. First, cavitation in orifices must be limited. Choked flow in orifices may lead to supercavitation, which is here a damaging and unstable phenomenon. The second conclusion is that the reduction of cavitation in globe-style valve in choked flow does not reduce pipe vibrations. The issue is then to limit cavitation erosion of valve trims.
