Abstract:
Scientific research in the Netherlands is doing remarkably well. Dutch researchers, universities and institutes reside at or near the top of international rankings. In this essay, José van Dijck and Wim van Saarloos, the president and vice-president of the Royal Netherlands Academy of Arts and Sciences (KNAW), explore how such a small country could become a global player in science and research. They highlight interconnectedness, collaboration, trust, and interwoven research and education among the quintessentially Dutch factors that paved the way to the success. They also show, however, that the country's efforts to reach the top sometimes chip away at these trusted foundations. Investments in its research base are lagging, and some typically Dutch strengths have recently come under pressure. They close off with some suggestions on how the country may turn the tide, prolong its great achievements, and ensure a leading role for Dutch research in the nation's future.

Abstract:
This chapter considers various recommendations made by the American College of Trust and Estate Counsel (ACTEC) concerning trust arbitration. It describes ACTEC’s views about the need for and propriety of various types of internal trust arbitration. It discusses two model statutes to assist legislators considering statutory reform in this area of law. The first model makes arbitration clauses in wills and trusts enforceable and uses existing arbitration statutes to establish a default dispute resolution process. The second proposed enactment is longer and includes a standalone default process for resolving disputes. The chapter also presents several model arbitration clauses devised by ACTEC as a means of facilitating arbitration of certain internal trust disputes.

This chapter compares four different institutional approaches to internal trust arbitration: the American Arbitration Association (AAA) Wills and Trusts Arbitration Rules, the American College of Trust and Estate Counsel’s (ACTEC) proposed model statutes and arbitration provisions, a model trust arbitration clause promulgated by the International Chamber of Commerce (ICC) in 2008, and a specialized arbitral procedure created by the Deutsche Institution für Schiedsgerichtsbarkeit (DIS) in 2009. It analyses each of these approaches in terms of enforceability and procedural incentives so as to determine whether each or any of the four procedures provides parties with sufficient reason to choose that mechanism over other options. The chapter concludes with an overall analysis of the advantages and disadvantages of the four institutional approaches to internal trust arbitration.
