Abstract:
This book has identified substantial differences between the philosophies of the courts of Australia, Canada, Germany, India, South Africa, and the United States with respect to interpretations of their constitutions. The differences can be characterised mainly in terms of the stronger attraction of some courts to legalism. Legalism in constitutional law has been associated with various tendencies, including literalism, formalism, positivism, and originalism. Legalism is used in a purely descriptive sense, not to applaud or to denigrate, but merely to denote interpretive philosophies motivated by two main concerns. One is disapproval of judicial discretion — of decision-making based on judges' values and ideologies rather than objective legal norms. The other is disapproval of judicial law-making — of decision-making that changes law instead of merely applying it. Legalists disapprove of judicial discretion and law-making for various reasons, including equity among litigants, predictability, democracy and the rule of law.

When the English court has to decide whether a marriage is valid, foreign elements may be involved: one or both of the spouses may be of overseas origin, or the marriage may have been celebrated in a foreign country. This chapter considers which law applies to determine the validity of such marriages. For choice of law purposes, rules about the validity of marriage are divided into two classes: those concerned with formal validity and those concerned with essential validity or capacity to marry. Rules of formal validity lay down the way in which a marriage must be celebrated (for example, to ensure publicity and proof of marriage). Rules of essential validity or capacity are concerned with the permissibility of the marriage relationship itself — whether the parties ought to be allowed to marry each other (or at all). The chapter also discusses the application of the doctrine of renvoi and rules for same-sex marriages, civil partnerships, and polygamous marriages.

It shows how to compare two proportions using the chi-squared test and how to report results as differences in proportions, relative risks, and odds ratios. Finally, the chapter discusses the reasons for and consequences of dichotomization of continuous data and a method for dichotomization without losing statistical power. The chapter includes analyses using Stata, SAS, SPSS, and R.

Chapter 7 outlines the nature of Reformation anthropology as Gothic in the sense of being under the power of the usurper, Satan, and in seeing God as wrathful enemy before justification by faith. It examines Marlowe’s Doctor Faustus in relation to the Lutheran Faustbook, and as an example of a character who wishes to escape the ambiguities of election in favour of a settled reprobation. Calvinist double predestination is shown to produce a dualist subjectivity, and this is then explored in a series of Scottish Presbyterian Gothic fictions: James Hogg’s Memoirs and Confessions of a Justified Sinner, Stevenson’s Jekyll and Hyde and Markheim, and John Buchan’s historical tale of demon-worshipping Covenanters, Witch Wood. It is argued that the protagonists’ problem is not duality as such but an attempt to circumvent it, and that the Calvinist anthropology is not itself the problem, although it requires ‘Anglican’ mediation.

Shakespeare’s grammar school education gave him a thorough grounding in Latin, and possibly some Greek, and in the writings of classical authors. He drew on and developed this knowledge at every stage of his career, most conspicuously in the remarkably diverse tragedies and other plays in which he dramatized Greek and Roman history. ‘Classical plays’ first considers Titus Andronicus and then Julius Caesar, which he wrote seven or so years later. It also discusses Troilus and Cressida, Timon of Athens, and his last two classical plays Coriolanus and Antony and Cleopatra for which he drew far more extensively on Plutarch.

Chapter 7 continues the argument of chapter 6 into two central topics which constitute tests for the apparent movement among mid- and later seventeenth-century Anglicans away from an Augustinian theological framework. Jeremy Taylor has been charged with abandoning the traditional doctrine of original sin, and by consequence that of the atonement. Section II analyses his teaching, and shows that attempts to identify his doctrine with that of Socinian thinkers should be rejected. Section III analyses Herbert Thorndike’s discussion of Jansen’s teaching on liberty in the Augustinus. Thorndike adopted an understanding of human liberty which seems to resemble that of Molina, but his surprisingly sympathetic treatment of Jansen reflects his admiration for Augustine’s analysis of original sin and its effects, and his continued commitment to the understanding of conversion which it underwrites.

Murder is where D kills V, and D intends to kill or intends to cause grievous bodily harm (GBH). The most common criticism of the offence of murder is that the sentence is mandatory irrespective of whether the mens rea is the more serious form (intent to kill) or the less serious form (intent to cause GBH). There were three partial defences to murder under the Homicide Act 1957 (diminished responsibility, provocation, and suicide pact). There are three partial defences to murder under the Homicide Act 1957 as amended and the Coroners and Justice Act 2009; diminished responsibility, loss of self-control, and suicide pact. The chapter considers the first two in detail. These are partial defences because they result in a conviction for manslaughter rather than a full acquittal.
