AbstractThe purpose of this review is to summarize Title 42 U.S.C. §1983, sometimes known as the “other” or “original” federal discrimination law in the United States that applies to elected officials, their appointed public administrators, and other employees in state and local governments. This federal statute provides a procedural process that allows a person to bring a private right of action to seek redress when just laws and policies are administered unjustly by state and local governmental entities. A hypothetical set of facts from a municipal setting is used to explore a typical Title 42 U.S.C. § 1983 proceeding. Included in the review are typical defenses and immunities that make these proceedings for both the complaining party and the political entity complex, if not paradoxical. Strategies to prevent such claims are also discussed.Key words:Title 42 U.S.C. §1983, state and local government, employment discrimination, defenses and immunities.

Abstract:
In a survey on research misconduct, roughly 20% of the respondents admitted that they have submitted federal grant proposals that include scholars as research participants even though those scholars were not expected to contribute to the research effort. This manuscript argues that adding such false investigators is illegal, violating multiple federal statutes including the False Statements Act (18 U.S.C. §1001), the False Claims Act (31 U.S.C. §3729), and False, Fictitious, or Fraudulent Claims (18 U.S.C. §287). Moreover, it is not only the offending academics and the false investigators that face civil and criminal penalties because administrators may also be liable if they sign off on proposals and are in a position to know that false investigators might be included. Policy recommendations that should reduce the use of false investigators include changing institutional cultures, better training and oversight of the responsible conduct of research, and, most importantly, making all grant reviews double blind.

Abstract:
In May 1974 the Ulster Workers' Council (U.W.C.), comprising loyalist trade unionists, paramilitaries and politicians, mounted a general strike backed by widespread intimidation. Their target was the Sunningdale Agreement, which produced a power-sharing executive for Northern Ireland and proposed a crossborder institution with the Republic of Ireland. After a fortnight the U.W.C. successfully brought Northern Ireland to a halt and the Executive collapsed, leading to the restoration of direct rule from Westminster. Three years later the United Unionist Action Council (U.U.A.C.) adopted the same strategy, demanding a return to devolution with majority rule and the repression of the Provisional Irish Republican Army (P.I.R.A.). This second strike was defeated. Many contemporary politicians were critical of the Labour government's failure to put down the U.W.C. strike. William Whitelaw, formerly secretary of state for Northern Ireland in Edward Heath's Conservative administration and the minister responsible for the bulk of the negotiations prior to Sunningdale, believed that the prime minister, Harold Wilson, and the new secretary of state for Northern Ireland, Merlyn Rees, did not have the same attachment to the political settlement and were less willing to support the Northern Ireland Executive in its hour of need. Paddy Devlin of the Social Democratic and Labour Party (S.D.L.P.) argued that the unwillingness to arrest those involved, ‘more than any other single action by the authorities ... caused thousands of law-abiding people who had earlier given support to the executive to switch loyalties’.

Appellant, Thomas J. Ward, appealed a district court decision appointing commissioners to obtain evidence sought by the Crown Prosecution Service of the United Kingdom (Crown Service). The district court had appointed the commissioners pursuant to 28 U.S.C. §1782 (1982), to depose in the United States certain third-party witnesses with knowledge relevant to a criminal investigation in the United Kingdom. On review, the Court of Appeals for the District of Columbia Circuit (per Ginsburg, J.) affirmed the district court’s decision and held: that 28 U.S.C. §1782 authorized the appointment of the commissioners, even though there was no pending criminal proceeding in the United Kingdom when the depositions were requested and the procedure for the depositions might vary from that normally applicable in the United States. The court remanded the case, however, for a further determination to ensure that the depositions would comply with procedural rules applicable in the United Kingdom.

Tendo em vista que a maioria dos desinfetantes químicos tem a sua atuação antimicrobiana prejudicada pela presença de matéria orgânica, o objetivo do presente trabalho foi o de investigar, comparativamente, a influência da presença de fezes ou de soro de bovinos sobre a atividade micobactericida de desinfetantes químicos de uso pecuário. Foram ensaiados cinco desinfetantes: A - hipoclorito de sódio; B - combinação de fenóis e cresóis; C - combinação de aldeídos e amorno quaternário; D - iodóforo; E - composto fenólico. A suspensão microbiana foi representada por uma cultura de Mycobactenum fortuitum na concentração de 0,0005% (peso úmido). 0 período de atuação dos desinfetantes foi de 60 minutos, à temperatura de 4 a 8 °C. A interrupção da ação dos desinfetantes foi estabelecida pelo emprego de inativantes. A recuperação dos microrganismos remanescentes foi obtida por cultivo em meio de Lowenstein-Jensen, com quantificação do número de unidades formadoras de colônias (U.F.C.). Os produtos "A", “B" e "C" revelaram possuir atividade micobactericida em presença de matéria orgânica, com percentuais de redução do número de U.F.C. em relação aos controles, superiores a 55,0%. O produto "D" apresentou variabilidade de comportamento frente ao sistema de ensaio adotado. 0 produto "E" mostrou-se destituído de poder micobactericida. A despeito de apresentar percentuais de redução de U.F.C. em relação aos controles, superiores a 90%, o produto "A" teve a sua atividade micobactericida inibida pela matéria orgânica (Teste U de Mann-Whitney: nível de significância de 0,05). 0 produto "B" foi inibido apenas quando a matéria orgânica foi representada por soro bovino. 0 produto "C" não apresentou redução de seu poder micobactericida quando em presença de soro ou fezes.

Foi investigada a maior diluição do hipoclorito de sódio comercial com 2,5% de cloro ativo (água de lavadeira) capaz de inativar o Mycobacterium fortuitum em presença de níveis variáveis de fezes de bovino como fonte de matéria orgânica. Os ensaios foram conduzidos de modo que o desinfetante atuasse durante 60 minutos à temperatura de 4 a 8°C. A neutralização da ação do desinfetante foi obtida com a solução de tiossulfato de sódio a 0,5% e tween-80 a 0,05% (v/v). Os microrganismos sobreviventes foram recuperados em meio de Lowenstein-Jensen. A quantificação das unidades formadoras de colônias (U.F.C.) foi analisada pelo Teste “U" de Mann-Whitney. Os resultados obtidos demonstraram que a presença de fezes bovinas prejudicou a atividade micobactericida do desinfetante ensaiado. Foi possível constatar-se que as diluições de trabalho capazes de determinar a redução de 70% do número de U.F.C. foram de 1:64 e 1: 16, respectivamente, em ausência e presença de matéria orgânica. Em diluições de trabalho superiores ao valor de 1:64 a atividade micobactericida do hipoclorito de sódio foi muito irregular.

In the course of litigation against an ex-employee, Gould, Inc. (Gould) allegedly learned that its proprietary technical data had been improperly supplied to Mitsui Mining & Smelting Co., Ltd. (Mitsui) and Miyakoshi Machine Tools Co., Ltd. (Miyakoshi), which then used those trade secrets in a joint venture with Pechiney Ugine Kuhlmann, a French state-owned company, and its wholly owned subsidiary, Trefimetaux (Pechiney/Trefimetaux). Gould filed a civil lawsuit against Pechiney/Trefimetaux, together with Mitsui and Miyakoshi, in U.S. district court, alleging violations of the Racketeer Influenced and Corrupt Organizations provisions of the Organized Crime Control Act of 1970 (18 U.S.C. §1961-1968 (1988)) (RICO). Gould’s complaint also included claims of unfair competition and unjust enrichment based upon the defendants’ alleged misappropriation of trade secrets. On the motion of Pechiney/Trefimetaux, the district court held that the civil RICO claim should be dismissed because, as “foreign states” under the Foreign Sovereign Immunities Act of 1976 (28 U.S.C. §1330, 1602-1611 (1988)) (FSIA), Pechiney and Trefimetaux were immune from criminal indictment for the acts alleged to have formed the basis for the RICO violation.

Plaintiffs and respondents, Amerada Hess Shipping Corp. and United Carriers, Inc., were respectively the charterer and owner of the Hercules, a crude oil tanker that was bombed in international waters by Argentine military aircraft during the war over the Malvinas or Falkland Islands. The ship was severely damaged and had to be scuttled off the coast of Brazil. After unsuccessfully seeking relief in Argentina, the companies filed suit against defendant and appellant, the Argentine Republic, in the Southern District of New York. Plaintiffs argued that the federal courts had jurisdiction under the Alien Tort Statute (28 U.S.C. §1350 (1982)), which confers federal jurisdiction over “any civil action by an alien for a tort only, committed in violation of the law of nations or a treaty of the United States.” The district court dismissed the suit for lack of subject matter jurisdiction, holding that the Foreign Sovereign Immunities Act of 1976 (28 U.S.C. §§1330, 1602-1611 (1982)) (FSIA) is by its terms the sole basis of federal jurisdiction over cases against foreign states. A divided panel of the U.S. Court of Appeals for the Second Circuit reversed. The Supreme Court (per Rehnquist, C.J.) unanimously reversed the Second Circuit and held that the FSIA provides the exclusive basis of federal jurisdiction over suits against foreign states.

ABSTRACTCandida glabratais the second leading cause of candidemia in U.S. hospitals. Current guidelines suggest that an echinocandin be used as the primary therapy for the treatment ofC. glabratadisease due to the high rate of resistance to fluconazole. Recent case reports indicate thatC. glabrataresistance to echinocandins may be increasing. We performed susceptibility testing on 1,380 isolates ofC. glabratacollected between 2008 and 2013 from four U.S. cities, Atlanta, Baltimore, Knoxville, and Portland. Our analysis showed that 3.1%, 3.3%, and 3.6% of the isolates were resistant to anidulafungin, caspofungin, and micafungin, respectively. We screened 1,032 of these isolates, including all 77 that had either a resistant or intermediate MIC value with respect to at least one echinocandin, for mutations in the hot spot regions ofFKS1andFKS2, the major mechanism of echinocandin resistance. Fifty-one isolates were identified with hot spot mutations, 16 inFKS1and 35 inFKS2. All of the isolates with anFKSmutation except one were resistant to at least one echinocandin by susceptibility testing. Of the isolates resistant to at least one echinocandin, 36% were also resistant to fluconazole. Echinocandin resistance among U.S.C. glabrataisolates is a concern, especially in light of the fact that one-third of those isolates may be multidrug resistant. Further monitoring of U.S.C. glabrataisolates for echinocandin resistance is warranted.
