Technological incorporation is a central topic among the concerns regarding health care systems. This paper discusses the role of technology dynamics in health systems' cost increases, suggesting two different approaches - a 'pragmatic-economic' approach and a 'rational-defensive' approach - as guidelines to explain the reasons for this centrality. This chapter proposes a theoretical reflection on the ethical deliberation process in the allocation of beds and respirators, in the light of the Theory of Health Justice, the Accountability for Reasonableness approach and the principle of health equity of the Brazilian Unified Health System (SUS, as per its Portuguese acronym), before the COVID-19 pandemic in Brazil. The pandemic has become a serious threat to health systems, as installed capacity has been exceeded whether in terms of material resources, equipment, technology and human resources. Thus, according to the theory of Accountability for Reasonableness, a fair and deliberative process aims to ensure resource allocation through limits and constraints (reasonableness), but government responsibility derived from human rights must be considered, allowing for health programming (accountability). Faced with this scenario, where the situation will often require us to make choices, this chapter intends to discuss the assumptions for ethical deliberation, taking into account the context of the act and its foreseeable consequences.

Thirty years ago, Brazil’s health system was patchy and elitist, serving mainly the rich or unionized white-collar workers and neglecting the poorest—those living without access even to clean water, sewage, or housing. Today, the country’s Sistema Ùnico de Saúde (SUS) is one of the largest free universal health systems in the world. Conceived of as the country emerged from a brutal 20-year dictatorship and ushered into being by the same political movement that delivered Brazil back its civil democracy, 79% of Brazil’s population now rely solely on the SUS for health services. In this chapter, Mark Britnell takes a closer look at the Brazilian SUS, and PSF, the family health programme, and argues that both of these need to be protected and championed during these difficult times.

Abstract:
In 1996, Brazil became the first developing country to adopt an official policy granting free access to antiretroviral drugs through its broad-reaching but ailing public health care system (SUS). In the wake of the country's highly publicized antiretroviral drug rollout, public health and care have become increasingly pharmaceuticalized and privatized, and the rights-based demand for drug access has migrated from AIDS to other diseases and patient groups. A growing number of citizens are acting within the state to guarantee their right to health, understood as access to medicines of all kinds, whether or not they are available in official drug formularies. This chapter examines the political subjects that emerge from this complex law–state–market ecology and shows how in this new chapter in the history of the right to health, the judiciary has become a crucial arbiter and purveyor of care and technology access.
