The author, former Professor and Dean of Law at Victoria University of Wellington and President of the Court of Appeal, discusses his experience working a law reform project in Mauritius with Professor Tony Angelo. As the author has experience in income tax reform, the article focuses on Professor Angelo's legislative drafting and policy development in relation to income tax law. Professor Angelo is described as a "one man Law Reform Commission" regarding his role in Mauritius, and discusses the importance of rules relating to technical interpretation and accessibility.

Florentin Smarandache is known as scientist and writer. He writes in three languages: Romanian, French, and English. He graduated the Department of Mathematics and Computer Science at the University of Craiova in 1979 first of his class, earned a Ph. D. in Mathematics from the State University Moldova at Kishinev in 1997, and continued postdoctoral studies at various American Universities such as University of Texas at Austin, University of Phoenix, etc. after emigration. He did post-doctoral researches at Okayama University of Science (Japan) between 12 December 2013 - 12 January 2014; at Guangdong University of Technology (Guangzhou, China), 19 May - 14 August 2012; at ENSIETA (National Superior School of Engineers and Study of Armament), Brest, France, 15 May - 22 July 2010; and for two months, June-July 2009, at Air Force Research Laboratory in Rome, NY, USA (under State University of New York Institute of Technology). In U.S.A. he worked as a software engineer for Honeywell (1990-1995), adjunct professor for Pima Community College (1995-1997), in 1997 Assistant Professor at the University of New Mexico, Gallup Campus, promoted to Associate Professor of Mathematics in 2003, and to Full Professor in 2008. Between 2007-2009 he was the Chair of Math & Sciences Department.

Dr. David Bevan held the Wesley-Bourne Chair of Anesthesia at McGill University, Chair of Anesthesia at UBC, Anesthetist-in-Chief at the University Health Network/Mount Sinai Hospital and subsequently Chair of the Department of Anesthesia at University of Toronto until his retirement in 2006. Dr. Bevan’s research contributions included seminal work in neuromuscular blockade and this work, in addition to his expertise as a reviewer, led to several editorial appointments, including Editor-in-Chief for CIM (2003–2010). Dr. Bevan played a role in the introduction of the Anesthesia Care Team concept in Ontario. He published widely and was awarded multiple international pro-fessional honors.

Abstract:
The recognition of the right to language under international human rights is still an ongoing debate. By examining the nature, extent and adequacy of the protection according to linguistic rights in international human rights laws, this paper offers solutions for this ongoing debate. In addition to resolving the issues in international law, it also discusses the extent of protection accorded to linguistic rights in Mauritius as well as under the express linguistic and ethnic form of Ethiopian federalism. Compares the practice and language policies of Ethiopia and Mauritius in light of international standards and identifies further issues to be addressed.

In recent years , climate change has caused numerous natural disasters all over the world. Taiwan , being on the junction of Eurasian plate and the Philippine plate , located in the pacific seismic belt and the hub of the western Pacific typhoon route , has more frequent chances of natural disasters than other countries. Therefore , people and government are facing severe challenges and tests on the topic of “Disaster Prevention”. Local governments have never reduced the efforts in improving relevant laws and organizational system on strengthening disaster prevention and relevant measures to effectively dealing with the aftermath of disaster rescue , improving national disaster response capabilities , preventing disaster losses , protecting life and property safety of people in order to create a safe environment . However , natural disasters that had taken place in Taiwan these years have caused a large number of casualties and losses according to local governments’ statistics . Since921 earthquakes in 1999 , National Army had played an active and important part in disaster prevention . Our Nation Army are originally trained to meet the external operations and war-preparation-based requirements ; however , with major natural disasters one after another caused by global climate anomalies , people are prone to be fearful for the fact that natural disasters are difficult to grasp or predict . Therefore , people’s expectations on instant disaster response and rescue have become in evitable tasks for National Army. However , after Typhoon Morakot relief operations in 2009 , the fact that the central government failed to render National Army forces in time has made people express their dissatisfaction and distrust towards the government . President Ma then instructed National Army that disaster prevention must uphold the principle of “ahead of the Deployment , Preset Troops , Prevention and Protection at any time “. This thesis id conducted through literature analysis and understanding on the research topic . In-depth interviews are also combined in this thesis in order to identify the core issues . The behavior of National Army’s disaster relief operations and current problems will also be discussed from aspects of policy and law in order to explore the appropriateness of National Army in Disaster Prevention and Response Act , and to give concrete proposals on disaster prevention data for the government.

ABSTRACT The purposes of this study were: (1) To investigate the characteristics of scholarly literature used by the graduate students of Department of Law of Soochow University for their theses. (2) To evaluate the satisfaction degree on how library collections support the graduate students research at the Department of Law of Soochow University. (3) The result of this study could be used to assist Soochow University Library in law collection development. The 258 theses studied generated a total of 34,306 citations. Types of materials cited, language and currency of literature were all analyzed. The results of this study indicated that: (1) Monographs and journal articles were cited mostly. (2) The majority of citations were to Chinese materials, English materials were cited less than Chinese. The citations in Japanese, Germany and French are obviously on the low side. (3) Generally speaking, materials published in 20 years were the main demand. (4) Law books and legal periodicals were the main demand. Case law and regulations were cited, but there were not amount to much. About one-third of the citations were “Non-legal materials”. (5) 91.5% of the citations were from printing materials, only 8.5% from the digital materials. It showed that the graduate students relied mostly on printing materials for their research. (6) The library could only provide 59.8% of the required collections under exact match; and could provide 67.1% of the required collections under partial match. Suggestions of improving services of Soochow University Library as follows: (1) To enrich the collection to fulfill the teaching and research needs of Soochow University. (2) To make good use of resources sharing through the “Interlibrary Loan” , which can make up for the shortage of collections . (3) To emphasize on iii information services to meet the research needs. (4)To increase in legal journal subscription. (5)A formal collection policy should be established in Soochow University Library. (6) To Coorperate with the Department of Law to promote the use of electronic resources.

It serves as a national model, and many of the current leaders in mental health law and forensic psychiatry and psychology have received or provided training as part of this collaboration.

This chapter looks at how John Roy Lynch formed a law partnership with Robert H. Terrell, under the firm name of “Terrell and Lynch.” This firm opened an office and carried on business at Washington, D.C. Terrell was an able and brilliant young man. He was a graduate from the college department of Harvard University. The firm continued in active business until the inauguration of President William McKinley, by whom, in June of 1898, Lynch was made a major and Paymaster of Volunteers to serve as such during the Spanish–American War. Subsequently, Terrell was also called into public service, having been appointed a justice of the peace for the District of Columbia, and later one of the judges of the municipal court of said district.

Abstract:
The rights of disabled students are protected law in nearly every country. However, the lack of awareness of the laws and the need to make web pages accessible has created barriers to fully implementing the intent of these laws. These laws typically go beyond web pages to include all instructional devices including e-readers, social networking sites, and smart phone apps. This paper takes a look at the requirements of accessibility laws, the formation of the accessibility initiative, and the resulting WCAG 2.0 standard. Accessibility testing tools for websites and web content are discussed and then used to measure the level of compliance for a number of universities. It was found that almost all university sites checked had multiple accessibility errors. Finally, a number of recommendations are made based on the compliance issues found and on the terms of several U.S. Department of Justice consent decrees.

Abstract:
John Cyril Smith (1922–2003), a Fellow of the British Academy, was Emeritus Professor of Law at the University of Nottingham where he headed the Law Department for three decades. In 1952–1953, Smith was awarded a Commonwealth Fund Fellowship at Harvard University and became impressed by the casebook method of teaching. The only subject he had taught every year throughout his career was evidence. His deep understanding of the law was apparent in his case commentaries on the subject for the Criminal Law Review, although by the mid-1980s he was handing over many evidence cases to his colleague and former student Diane Birch for commentary. He was a strong advocate of the presumption of innocence, in the form of the principle. It is chiefly for his work on the substantive criminal law that Smith will be long remembered. In addition to his three decades as Head of the Law Department at the University of Nottingham, and all his academic writings, Smith gave considerable time to official committees and other public service work.

‘Another Legal Monster?’ That was the question asked by the Law Department of the European University Institute on 16 February 2012 in a debate about the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union (TSCG), also known as the Fiscal Compact Treaty. On 2 March 2012, twenty-five Member States of the European Union minus the United Kingdom and the Czech Republic signed the TSCG. A month before, on 2 February 2012, the euro area Member States signed the Treaty Establishing the European Stability Mechanism (ESM Treaty), another legal monster. In both cases, the monstrosity lies in the fact that Member States have preferred to conclude an international treaty, rather than to use the European Union (EU) institutional system. Why did the European Commission not propose a legislative act to establish a financial assistance mechanism in the Eurozone and strengthen the fiscal discipline in the EU? Does this mean the end of community method and a victory for the intergovernmental method? As Herman Van Rompuy commented about the crisis; ‘often the choice is not between the community method and the intergovernmental method, but between a co-ordinated European position and nothing at all’. In 2010, Angela Merkel defended her vision of a new ‘Union Method’ in a speech held at the College of Europe. This approach can be defined by the following description: ‘co-ordinated action in a spirit of solidarity–each of us in the area for which we are responsible but all working towards the same goal’. Each of us means the European institutions and Member States. The new ‘Euro-international’ treaties (or inter se treaties) raise a number of questions regarding their compatibility with EU law, implications for the Union legal system, institutional balance, national sovereignty and democratic accountability. These questions are all the more important because international treaties raise a number of questions on their compatibility with EU law, implications for the Union legal system and institutional balance.

Robert (Bobbie) Robins was a pioneer in the establishment of linguistics as an academic subject in Britain and the leading scholar throughout the world in the history of linguistics whose undergraduate career was interrupted by service in the RAF, in which he was required to learn Japanese and then teach it to service personnel. He joined the new Department of Phonetics and Linguistics at SOAS, University of London, in 1948 and became a professor in 1966. Robins published General Linguistics: an introductory survey in 1964 (4th edition 1989). His textbook, A Short History of Linguistics (1967), was the most comprehensive published, and he was elected Fellow of the British Academy in 1986. After his death, the Philological Society established an annual Robins Prize and the University of Luton has the R. H. Robins Memorial Prize for linguistics. Obituary by F. R. US assistance programs under the 1954 Agricultural Trade and Assistance Act (Public Law 480) put excess currency toward archaeology. “Winning hearts and minds” included the preservation and rehabilitation of historical monuments in-situ. These open-air museums represented a US commitment to research and tourism infrastructure. Yet, the branding and prestige of Egypt’s Abu Simbel broke the bank and led to a major shift in US policy that cut future funding for archaeological fieldwork. This chapter analyzes the correspondence of Lucius Battle at the US Department of State and US representative to UNESCO, as well as archaeologists Dr. George Hanfmann of Harvard University and director at Sardis and Dr. A. Henry Detweiler of Cornell University and president of the ASOR. I demonstrate the catastrophic consequences of the US Congressional decision for the Archaeological Exploration of Sardis and their vision to realize one of the largest restoration programs in Turkey at the time: the reconstruction of the Bath Gymnasium and Marble Court.

‘Be something great’ and ‘fast track to top jobs’ were two headlines in advertisements for education that caught my eye some time ago. The specific message was that a specific school was offering a route to success and a brilliant career. In other words, education paves the way for success in life. With the passing of time, this has become a well-established truth. There are no other options—unless you have exceptional talents in the arts, sports, or the entertainment context. Fantasies and hopes for an outstanding career are encouraged on a broad front. The higher education sector has developed rapidly, even exploded, in recent decades and so have promises of a fantastic career resulting from a degree of the right kind and at the right place. In one UK university, the business school building is plastered with large posters claiming that ‘We create world-class minds’. And a Swedish university, located in a remote part of the country and with difficulties in recruiting faculty members and students, advertises heavily, claiming ‘research and education in world class’. If an institution is not ‘world class’ it is often described in terms of ‘excellence’. At my own university a few years ago, I saw a poster headed ‘Do you want to be President or Group CEO?’ for a course in commercial law specially designed for people who expect to reach the top in the near future. Since the target group consists of students, and most of them will probably have to bide their time for a decade or two before they can put ‘President’ or ‘Group CEO’ on their business cards, we may conclude that the department in question has realized the value of a long-term approach, and is assuming that many students have a high estimation of their potential. Perhaps education institutions support such more or less realistic self-images and career aspirations. If the department in question succeeds in recruiting a large number of students, it is perhaps primarily the less realistic self-images that will be reinforced. At a more collective level, education is now also considered to pave the way for national greatness.

Abstract:
This paper describes actual experience applying a technology to achieve volume reduction while producing a stable waste form for low and intermediate level liquid (L/ILW) wastes, and the L/ILW fraction produced from pre-processing of high level wastes. The chief process addressed will be vitrification. The joule-heated ceramic melter vitrification process has been used successfully on a number of waste streams produced by the U.S. Department of Energy (DOE). This paper will address lessons learned in achieving dramatic improvements in process throughput, based on actual pilot and full-scale waste processing experience. Since 1991, Duratek, Inc., and its long-term research partner, the Vitreous State Laboratory of The Catholic University of America, have worked to continuously improve joule heated ceramic melter vitrification technology in support of waste stabilization and disposition in the United States. From 1993 to 1998, under contact to the DOE, the team designed, built, and operated a joule-heated melter (the DuraMelterTM) to process liquid mixed (hazardous/low activity) waste material at the Savannah River Site (SRS) in South Carolina. This melter produced 1,000,000 kilograms of vitrified waste, achieving a volume reduction of approximately 70 percent and ultimately producing a waste form that the U.S. Environmental Protection Agency (EPA) delisted for its hazardous classification. The team built upon its SRS M Area experience to produce state-of-the-art melter technology that will be used at the DOE’s Hanford site in Richland, Washington. Since 1998, the DuraMelterTM has been the reference vitrification technology for processing both the high level waste (HLW) and low activity waste (LAW) fractions of liquid HLW waste from the U.S. DOE’s Hanford site. Process innovations have doubled the throughput and enhanced the ability to handle problem constituents in LAW. This paper provides lessons learned from the operation and testing of two facilities that provide the technology for a vitrification system that will be used in the stabilization of the low level fraction of Hanford’s high level tank wastes.

Wind turbine icing represents the most significant threat to the integrity of wind turbines in cold weather. Advancing the technology for safe and efficient wind turbine operation in atmospheric icing conditions requires the development of innovative, effective anti-/de-icing strategies tailored for wind turbine icing mitigation and protection. Doing so requires a keen understanding of the underlying physics of complicated thermal flow phenomena pertinent to wind turbine icing phenomena, both for the icing itself as well as for the water runback along contaminated surfaces of wind turbine blades. In the present study, an experimental investigation was conducted to characterize the surface wind-driven water film/rivulet flows over a NACA 0012 airfoil in order to elucidate the underlying physics of the transient surface water transport behavior pertinent to wind turbine icing phenomena. The experimental study was conducted in an icing research wind tunnel available at Aerospace Engineering Department of Iowa State University. A novel digital image projection (DIP) measurement system was developed and applied to achieve quantitative measurements of the thickness distributions of the surface water film/rivulet flow at different test conditions. The measurement results reveal clearly that, after impinged on the leading edge of the NACA0012 airfoil, the micro-sized water droplets would coalesce to form a thin water film in the region near the leading edge of the airfoil. The formation of rivulets was found to be time-dependent process and relies on the initial water runback flow structure. The width and the spacing of the water rivulets were found to decrease monotonically with the increasing wind speed. The film thickness icing scaling law is evaluated by the time-average measurement film thickness. The measurement results show good consistent with the analytical scaling predictions.

This paper deals with design and manufacturing of a mechanical variable valve actuation (VVA) system, developed as part of a MUR financed research project concerning the realization of a high performance motorcycle engine, through a partnership of Moto Morini (Bologna), Dell’Orto (Milano), Istituto Motori - CNR (Napoli) and DiME (Department of Mechanical Engineering and Energetics) – University of Napoli Federico II. After a synthetic description of the main variable valve actuation methods currently employed, the paper presents the results of our mechanical VVA system, consisting of three main elements: cam, main rocker arm with fixed fulcrum and secondary rocker arm with mobile fulcrum. This VVA system (system 1) enables valve lift variation by a simple translation of one of the three elements (the intermediate one). The study has been conducted implementing a numerical procedure specifically designed to determine cam profile and kinematic and dynamic characteristics of the whole system, starting from the following input data: rocker arm geometry, relative positions and inertial data of elements, spring stiffness and preloading, camshaft speed and valve lift law. The model has been validated against the conventional timing system using kinematic simulations. Results of the numerical procedure verify the validity of the VVA system, capable of a valve lift variation, with a limited acceleration. Starting from the numerical results, we have developed a new mechanical variable valve actuation system (system 2): it consists of the same three elements used previously, but they are connected in a different way. The newer system enables more general lift profile distributions with a similar geometric complexity. The activity has been extended to research for a new solution (always a mechanical system), capable to allow inlet valves complete closing and timing and duration variation (system 3). This paper reports results reachable with the simplest system 1, that gives better perspectives of use for a new two-wheel vehicle engine.

Abstract:
This study describes the achievements of a program that provides technology education about low-level radiation to develop practical core engineers. An education program starting at an early age and continuous and consistent educational agendas through seven years of college has been constructed in collaboration with regional organizations. Subjects relating to atomic energy or nuclear engineering were regrouped as “Subjects Related to Atomic Power Education” for most grades in each department. These subjects were included in the syllabus and the student guide book to emphasize a continuous and consistent policy throughout the seven-year period of college study, comprising the five-year system and the additional two-year advanced course. Furthermore, the content of lectures, experiments, and internships was enriched and realigned in collaboration with the Japan Atomic Energy Agency (JAEA), Okayama University, and Chugoku Electric Power Co., Inc. Additional educational materials were developed from inspection visits by teaching staff to atomic energy facilities were also used in the classes. Two student experiment textbooks were developed to promote two of the subjects related to atomic energy: “Cloud Chamber Experiment” and “A Test of γ-ray Inverse Square Law.” In addition to the expansion and rearrangement of atomic power education, research on atomic power conducted for graduation thesis projects was undertaken to enhance educational and research activities. Some examples are as follows: “Study on the Relation between γ Dose Rate and Rainfall in Northern Okayama Area,” “Remote Sensing of Radiation Dose Rate by Customizing an Autonomous Robot,” and “Nuclear Reaction Analysis for Composition Measurement of BN Thin Films.” It should be noted that an atomic-energy-related education working group has been in place officially to continue the above activities in the college since 2011. In consequence, although government subsidy has been decreasing, both human and material resources have been enhanced, and many students with a satisfactory understanding of atomic energy are being developed. This program was partially funded by the Ministry of Education, Culture, Sports, Science and Technology in Japan.

Abstract:
The study of flow and transport in porous media has relevance in many industrial, environmental (Geologic sequestration of CO2) and biological disciplines. In many engineering applications we require the knowledge of the velocity field for flow through porous objects. Historically, simplified models such as Darcy’s law [1,2], provide a reasonable description of the flow in the interior for single phase flow but require empirical coefficients to match the boundary conditions with the outer flow. The scientific basis for understanding flow and transport phenomena in porous media has largely been developed from experimental and theoretical studies in “bulk” or macroscopic systems in which coupled behavior at the pore scale is not measured or observed directly. To understand the flow behavior at the pore scale, flow characterization in porous media is very important. Multiphase, immiscible, low Re flow through a simulated porous media is studied experimentally. The experimental test cell, Figure 1, designed in collaboration with the Department of Energy, National Energy Technology Laboratory (DOE NETL), was manufactured from an optically clear polycarbonate material. It has a lattice type pattern of 2.5 mm pores bodies interconnected by angular capillary throats varying in size from 200 μm to 1000 μm. The experimental flow loop (Figure 2), utilizes air as the displacing fluid and sodium iodide (NaI) solution in water as the defending fluid. Air is provided at a constant pressure at the inlet. The refractive indices of the NaI solution and the optically clear test cell are matched to facilitate the observance of the air-liquid interface motion. Experimental data recorded with respect to time are the inlet gage pressure, delta pressure, inlet to outlet, across the test cell, volume flow rate at the outlet and the position of the displacement interface as the invading fluid, air, displaces the defending fluid, NaI solution. Parameters that can be varied in the experiment are viscosity ratio, micro and macro capillary number, the bond number and the volume flow rate. The details of the test loop are provided in Figure 2. The figure shows the piping arrangement to fill the test cell with the NaI solution and supplying the air for the tests. A CCD camera (Redlake ES 1.0 cross-correlation camera; resolution: 1008 × 1018 pixels) equipped with a 20 mm Micro Nikkor lens (Nikon) and a data acquisition system consisting of a PC and a PIXCI D2X frame grabber card (EPIX) is utilized to obtain a series of digital images as the invading air enters the test cell through the inlet manifold and makes way through the liquid until the breakthrough to the exit manifold. The pore scale velocity of the displacement interface is determined using a “Difference Threshold Technique” developed at Case Western Reserve University (CWRU), Laser Flow Diagnostics Lab (LFDL), Department of Mechanical and Aerospace Engineering. The difference threshold technique developed to processing the images is described in the next section.
