Abstract:
The governmental role played by the United Nations in Kosovo since 1999 raises a host of questions for international lawyers. Chief among these is whether governmental acts of the United Nations Interim Administration Mission in Kosovo (UNMIK) should be subject to review within Kosovo for compliance with applicable legal standards. In principle, such review would be helpful in ensuring UNMIK accountability and in sending the message that the governors—as well as the governed—in Kosovo are subject to the rule of law. However, for many, the prospect of actors in Kosovo second-guessing decisions taken by UNMIK is problematic, partly due to a fear that review could be used to derail the UNMIK-led peacebuilding process in the territory.

Abstract:
A new semi-nonparametric method for modeling data with Normal variance-mean mixtures (NVMM) is presented. This new method is based on the least-squares programming routine, UNMIX. Density estimates based on random samples of size n from two, three, and four components of NVMM are found using UNMIX. Graphical comparisons of the UNMIX fit found by the EM Algorithm and the Bayesian approaches are done using three real life examples. A quantitative comparison using the AIC and Chi-Square is done for one of the most commonly used examples, the Galaxy Data. The results are promising and the method has great potential for improvement.

This article uses original survey data to study the effects of the United Nations Mission in Liberia (UNMIL) on the political attitudes and behaviors of ordinary Liberians. Three results emerge: (i) UNMIL has positive, statistically significant effects on political participation measured over multiple outcome indicators; (ii) UNMIL’s effects display heterogeneity across individual outcome indicators, most positive effects are concentrated around measures associated with participation in national politics as well as political interest and efficacy, while the effects on participation in local politics are mixed; and (iii) self-reported measures of citizens’ interactions with UNMIL military personnel and exposure to democracy and to human rights campaigns carried out by international actors have strong positive associations with political participation, suggesting that results are driven by security and nonsecurity mechanisms. This article discusses the implications of these findings and areas for future research.

AbstractThe UNMIS Human Rights Section is called to promote respect for international human rights standards as part of a peacekeeping operation in a post-conflict society. As such, it is exposed to conflicting but equally legitimate demands from different stakeholders. To illustrate some of the dilemmas arising in practice from the tensions between these demands, the paper looks at three case studies taken from the work of the UNMIS Human Rights Section in Southern Sudan. They concern the tension between customary law and the protection of women's rights, the right to counsel in capital cases, and justice for atrocities committed during the civil war. The paper argues that, also because of the inherent fundamental contradictions in what a field presence such as the UNMIS Human Rights Section seeks to achieve, attempts to promote meaningful accountability of the field operation for the results obtained encounter significant limitations.

Abstract. Two receptor modeling techniques were applied to a common data set of daily measurements of 11 elements in particulate matter (PM). Samples of PM were collected in the 5 yr period at an urban site located at the sea coast. In the vicinity of the sampling site traffic is a permanent but not significant anthropogenic source. In this study we used both the Unmix and PMF receptor models for evaluation of the sources contribution. Unmix found thirteen solutions for several combinations of species, but four solutions satisfy the criteria Min R2 > 0.8 and Min S/N > 2. Unmix identified three and four sources in satisfactory solutions. The PMF model has given 3 possible solutions and by further analysis the best solution of four sources was selected. F peak refinement enabled finding a more realistic solution that includes re-suspension and traffic as dominant source contributions. The results given in this study are in accordance with the results of Enrichment Factors analysis presented in our previous work.

This paper analyzes the birth of VETVENDOSJE as a social movement through different symbolic representations. Based on the theoretical model of symbolic interaction the study will analyse how the Network Action for Kosovo, created as a counter response against the Serbian dictatorship in Kosovo, continued its actions by creating the slogan “NO NEGOTIATION- VETVENDOSJE”, collecting signatures by the citizens and requiring to UNMIK, to investigate on the destiny of numerous Albania disappeared during the war by the Serbian Army. UNMIK did not take into consideration the petition because it was more interested in the development of institutional conversations to define the judicial status of Kosove. This made the followers of VETVENDOSJE to put the big slogan in front of the UNMIK building “NO NEGOTIATION-VETVENDOSJE! The appearance of this slogan transformed the network into the VETVENDOSJE movement and in the same time it made possible the idea that people will have their right to decide on the judicial and political sovereignty of Kosovo. This slogan had strong conceptual and emotional power on its followers and incited numerous protests and public meetings. From this we can conclude that symbols and their symbolic representations serve perfectly for the creation social movements

This article applies Diehl & Druckman’s peace operation evaluation framework to the activities of the United Nations Mission in Liberia (UNMIL) during the Liberian transitional peace process (2003-2006). It finds that in general UNMIL performed strongly during the transitional period, particularly in relation to the core mission goals of violence abatement, conflict containment, conflict settlement and organizational effectiveness. UNMIL’s achievements were less clear and less pronounced in relation to the more complex areas of non-traditional and peacebuilding mission goals. The article also provides critical reflections on the framework for evaluating peace operations, arguing that it is difficult to escape the politics that influence the activities of peacekeeping and peacebuilding.

AbstractWhat are the effects of international intervention on the rule of law after civil war? Rule of law requires not only that state authorities abide by legal limits on their power, but also that citizens rely on state laws and institutions to adjudicate disputes. Using an original survey and list experiment in Liberia, I show that exposure to the UN Mission in Liberia (UNMIL) increased citizens’ reliance on state over nonstate authorities to resolve the most serious incidents of crime and violence, and increased nonstate authorities’ reliance on legal over illegal mechanisms of dispute resolution. I use multiple identification strategies to support a causal interpretation of these results, including an instrumental variables strategy that leverages plausibly exogenous variation in the distribution of UNMIL personnel induced by the killing of seven peacekeepers in neighboring Côte d'Ivoire. My results are still detectable two years later, even in communities that report no further exposure to peacekeepers. I also find that exposure to UNMIL did not mitigate and may in fact have exacerbated citizens’ perceptions of state corruption and bias in the short term, but that these apparently adverse effects dissipated over time. I conclude by discussing implications of these complex but overall beneficial effects.

Rapid urbanization and industrialization have caused the continuous discharge of heavy metals into the soils of China’s Poyang Lake region, where they pose a major threat to human health. Yet, the spatial characteristics of these heavy metals in farmland soils and their pollution sources in this region remain unclear. This study was conducted to document the pollution caused by heavy metals in the Poyang Lake region through sampling that consisted of the collection of 215 soil samples from agricultural fields. The UNMIX model provided identification of the sources causing heavy metal pollution and source contributions to soil pollution. ArcGIS was used to study the spatial distribution of the eleven heavy metals and to validate the apportionment of pollution sources provided by the UNMIX model. Soil concentrations of heavy metals were above the local background concentrations. The average content of eight heavy metals, including Cd, Mo, Zn, Cu, Sb, W, Pb, and Ni, was approximately 1–6 times greater than natural background levels (6.91, 2.0, 1.67, 1.53, 1.23, 1.38, 1.11, and 1.24, respectively), while the average content of V, Cr, and Co was lower than natural background levels. The average contents of Cr, Ni, Cu, Zn, Cd, and Pb were all lower than the screening levels for unacceptable risks in agricultural land soils. The percentage of Cd content exceeded the risk screening value in all sampling sites, up to 55%, indicating that agricultural soils may significantly be affected by cadmium contamination. Five pollution sources of heavy metals were identified: natural sources, copper mine tailings, agricultural activities, atmospheric depositions, and industrial activities. The contribution rates of the pollution sources were 7%, 13%, 20%, 29%, and 31%, respectively. The spatial pattern of heavy metals was closely aligned with the outputs of the UNMIX model. The foregoing supports the utility of the UNMIX model for the identification of pollution sources of heavy metals, apportionment study, and its implementation in agricultural soils in the Poyang Lake region.

This research was conducted in Ponorogo using quantitative descriptive research method. The population is lecturers of STAIN and FAI UNMUH Ponorogo. The sample of the research is 75 respondents. Primary data were collected using questionnaire. Analysis of the data in the field done by using descriptive quantitative format.Perception of both lecturers of STAIN Ponorogo and Islamic Faculty of UNMUH Ponorogo toward Islamic bank is good. It can be seen from the behavior of the consumers / respondents which was influenced by the factor of education in which it is majority dominated bypostgraduate level, culture factor through Islamic culture in work environment both in STAIN and UNMUH Ponorogo, as well as the stimulus of knowing Islamic products that generate the perception as a feedback of the stimulus. Financial transactions carried out by most of the respondents, or 63% of respondents use the services of conventional banks and <strong>Sharia</strong> banks, while those who use only pure Islamic financial services are just 11 respondents from the whole number of respondents. This has become a new phenomenon found in this study and the respondents use the services of conventional and <strong>Sharia</strong> banks are based on the rules of the institution where they work.</em>

On 15 May 2001 the Head of the United Nations Interim Administration in Kosovo (‘UNMIK’) signed into law Regulation 2001/9 establishing a Constitutional Framework for Provisional Self-Government in Kosovo. The document creates a provisional institutional framework for the exercise of public authority by Kosovo's institutions of self-government during the territory's administration under United Nations rule. UNMIK delegates important parts of its responsibilities in the legislative, executive and judicial field to the local institutions envisaged in the document. At the same time, however, crucial areas remain under the direct authority of the United Nations administration. This article examines the modifications brought about by the Constitutional Framework by discussing the legal nature and the contents of the document in the light of the various legal instruments governing Kosovo's institutional system throughout the last thirty years and previous international practice in the field of state-building and territorial reconstruction.

Public opinion in postconflict societies toward international missions is widely believed to be important. We offer a theory that local satisfaction critically depends on an individual’s perception of whether the mission is furthering the wartime political agenda of his or her social group. To test this theory and competing hypotheses, we examine Kosovo Albanian satisfaction with the United Nations Mission in Kosovo (UNMIK). We use data from seventeen different representative surveys conducted in Kosovo from 2002 to 2007 as well as focus group and other primary and secondary sources. Consistent with our theory, we find that aggregate satisfaction over time reflected UNMIK’s growing acceptance of Kosovo’s independence and individuals with more radical views tended to be less satisfied with UNMIK. Our analysis implies that missions can achieve greater local satisfaction by doing what is possible to be responsive to, or at a minimum recognize, the wartime political agendas of the key social groups.

Frequent political-legal changes as well as the form of organization of the government in Kosovo from 1999 until the second part of 2008 have been reflected in the budget procedure. Budget procedure in Kosovo under the administration of United Nations Missions in Kosovo (UNMIK) was a sui generis case alike UNMIK administration itself, where role of the Kosovo Assembly was nothing more than symbolic. With declaration of the independence on 17th February 2008 and promulgation of the Constitution on 8th April 2008 de jure, the role of the Assembly in the budget procedure has been empowered. However, regardless improvements in the constitutional position of the Assembly, a survey of the Assembly of Kosovo revealed many shortcomings that are necessary to be addressed in order to increase the role of the Assembly in the budget procedure. In this direction we shall emphasize increasing of the role of the Assembly in accordance with constitutional authorizations in the budget procedure, increasing of the technical capacities of the Assembly to conduct research and analysis of the budget and undertaking steps on facilitation the communication between MEFGovernment-Assembly-the Budget and Finance Committee.

Abstract:
Some UN peacekeeping operations are generally regarded as a success, e.g. El Salvador, Sierra Leone and Mozambique. Other missions are seen as obvious failures, such as Rwanda and Somalia. Not only do these mixed results justify research into the question “do peacekeeping operations actually contribute to durable peace?”, but both academic scholars and policy makers also try to identify factors explaining these differences. In earlier research, factors for success and failure were distilled from literature to explain the differing contributions of UN peacekeeping operations. After further research on the cases of Rwanda, Mozambique, El Salvador and Cambodia nine factors for success and failure were identified. According to these nine factors the probability that a peacekeeping operation makes a positive contribution to durable peace increases if: 1) the parties are sincere and willing to cooperate with the implementation of the operation; 2) the operation is able to provide a sufficient sense of security to the parties; 3) the operation has sufficient attention to the causes of the conflict both in depth and in breadth; 4) the operation receives co-operation from important outside actors and parties; 5) the operation is deployed timely and at the right time; 6) the operation is implemented by competent personnel under competent leadership, and with clear command structures; 7) the operation is part of a long term approach; 8) the ‘policy tools’ implemented in the operation are coordinated within the operation, as well as externally; and 9) the operation provides ‘ownership’. The questions addressed in this paper are: a) to what extent does UNMIS meet these different factors for success and failure for UN peacekeeping operations?; and b) to what extent does this picture match the image that results from a review of the North-South conflict and peace process, the role of UNMIS, and an analysis of the extent of durable peace? The answers to these two questions allow more insight into the chances for success or failure of UNMIS and provide further knowledge on factors for success and failure of UN peacekeeping operations.

This contribution discusses the politicization of the civil service system in Kosovo as a framework through which politicians exert influence in the system. The article employs the concept of formal-political discretion, as a means of explaining and elucidating the extent to which both the United Nations Interim Administration Mission in Kosovo (UNMIK) and current legislation regulating civil service preconditions/pre-favours the politicization of the senior civil service in Kosovo. It first discusses the concept of politicization based upon current scholarship and gives hints on the way in which these concepts fit with both UNMIK and Kosovo’s current situation. Next, the article discusses and compares the previous civil service system built by UNMIK with the current one – built in post-independence Kosovo based upon the formal-political discretion model. The article further argues that the former system of civil service – in contrast to the current system – provided less formal-political discretion to political elites with which to politicize the senior civil service. The article concludes by suggesting that the current post-independence legislation regulating the civil service grants the executive institutions a significant level of formal-political discretion in the appointment, dismissal and promotion of civil servants. Points for practitioners The articles offers a thorough, both theoretical and practical, policy explanation of the model and structure of Kosovo's civil service, hinting on the previous and current legislative gaps that allow for partisan influence and control. The article also portrays the routes via which the politicization of the civil service in Kosovo is being developed, giving insights on how civil servants perceive such a process. Comparing the previous civil service system with the current one, the article informs practitioners on the directions that the new reform on Kosovo's civil service should take. Finally, the article provides in-depth policy information on the means to redesign the key protection mechanisms of Kosovo's senior civil service management.

Abstract Background Peripherally inserted central catheters (PICC) are used for treating infections requiring prolonged intravenous antibiotic therapy (IVAT) in children. Given the lack of data on rural PICC use as well as the rural nature of our state, we studied the safety of home PICC use for treating infections in children living in rural settings. Methods We identified children &lt;18 years admitted from January 1, 2005 to March 1, 2014 to the University of New Mexico Hospital (UNMH) through analysis of 43 different ICD-9 and CPT codes indicative of PICC placement, with analysis of the medical record to identify patients discharged on IVAT. All data were entered into REDCap and analyzed on Stata. We recorded demographic data, the antibiotic used, the duration/indication for the PICC, and the type/timing of complications. To classify rural vs. urban residence, we used the rural-urban continuum code (RUCC) from U.S. Census data, and the driving time in hours (h) to the nearest level 1,2 or 3 trauma center and UNMH using MapQuest. All patients had either weekly home health or clinic visits, but none utilized an outpatient parenteral antimicrobial therapy (OPAT) clinic. Linear regression models assessed for differences between outcome and response variables. Results Of 866 subjects with a PICC, 221 were discharged on IVAT. 134 (60.6%) were boys and 87 (39.4%) were girls (mean age 9.8 years). The mean driving time to the nearest level 1, 2, or 3 trauma center was 0.6 hours (range 0.1–3.0 hours), while the mean driving time to UNMH was 1.3 hours (range, 0.1–5.0 hours). PICCs were utilized for a mean of 26.1 days at home. The most common antibiotics used were tobramycin (n = 41) and nafcillin (n = 40). Osteoarticular infections and cystic fibrosis exacerbations were the most common indications for PICC use (68.8%). 47 children (21.3%) experienced complications associated with their PICC at a mean of 24.7 days from insertion, most commonly occlusion (n = 13, 27.7%) or accidental removal (n = 13, 27.7%). 40 PICC’s (18.1%) were removed prematurely due to a complication. No association was found between RUCC’s or driving times to UNMH or the nearest level 1, 2 or 3 trauma center with any of these complications nor with complications overall (P = 0.11 to 0.96). Conclusion Our study demonstrates that home IVAT with a PICC is safe in children in rural locales. Disclosures All authors: No reported disclosures.

Water source identification is important for water hazard controlling in coal mines. In this study, major ion concentrations of the groundwater collected from four representative aquifer systems in the Baishan coal mine, northern Anhui Province, China, have been analysed by a series of statistical methods. The results indicate that the major ion concentrations of the groundwater from different aquifer system are different with each other, and provided the possibility of water source identification based on hydrochemistry. Factor analysis indicates that these differences are controlled by different types of water rock interactions. The analysis based on US Environmental Protection Agency (EPA) Unmix model identified three sources (weathering of silicate minerals, dissolution of carbonate and evaporate minerals) responsible for the hydrochemical variations of the groundwater. Also, it shows that their contributions for the groundwater in different aquifer systems vary considerably. Based on these variations and on step by step analysis, the source aquifer system for the groundwater samples with unknown source has been determined and, similar to the result obtained by the cluster and discriminant analysis. Therefore, EPA Unmix model can be applied for water source identification in coal mine, as it can provide information about water rock interaction and water source identification simultaneously.

Some studies have suggested that the interim administration (IA) mission in Kosovo (UNMIK) has failed in its aim to transform the society and contributed to a complicated completion of the mission. In this article, primarily reports of the UN General-Secretary (SG) on UNMIK are analyzed to answer the question posed in the title. Important development points during the reporting periods that cover key research areas such as security, political cooperation, Northern Kosovo, ethnic tensions, and violence are analyzed. The transitional process and the mode of transition have been influenced by three important factors that significantly undermined the aim of interim administrators to achieve benchmarks. Moreover, conflicting ethnic interest has emerged as the most influential factor that has had a serious detrimental impact on the mode of transition. The IA has failed to transform individual interests that are still very deeply rooted in the political system and in society. Present diplomatic achievements are still strongly imperiled by a deep hostility in the region, largely because of a chronic ignorance on the part of administrators of the intensity of conflicting ethnic interests. To ensure security in the area an international presence will probably be needed in Kosovo for a very long time.

Below are some of the topics which will be elaborated:- Development of police terminology in Albania;- Development of police terminology in Kosovo;- Word formation of police terminology in Albanian language;- Influence of foreign languages (Serbo-Croatian, Italian and English).Police terminology in Albania differs based on time period and historic developments, two World Wars from 1913 until 1945, with main influence from Italian language police terminology. Influence by Russian language is present during the communist time in Albania from 1945 until 1990 when the Italian influence returns again and it also starts influence by English language with the establishment of democratic pluralist system. In Kosovo, as a result of historic developments, development of police terminology was mainly influenced by Yugoslav system of government, Serbo-Croatian language, which was the dominant language in use in comparison to other languages in ex-Yugoslavia: Slovenian, Macedonian, Albanian and Hungarian. Whereas, after declaration of Kosovo independence in 2008 the dominant influential language in police terminology in Albanian language has been English after 10 years (1999-2008) during which Kosovo Police was led by United Nations Mission (UNMIK) and the police force in Kosovo was called UNMIK Police.

Terry’s view, however, Muhammadiyah University of Ponorogo apply detailed process of planning consisting of five steps. The first step is determining vision, mission and goals of library which is appropriated to the vision, mission and goals of an institution. Secondly, strategic plan must be formulated. The third step is setting up library’s work programs, namely annual, semiannual and monthly work program. The fourth is developing library program comprising of the human resources, collection and facilities and infrastructure development. The final step is planning for evaluation. 2) the implementation of the library service in the Muhammadiyah University of Ponorogo support George R. Terry and Hasibuan’s viewpoint. It emphasizes for stages of implementation. The first stage is formulating quality standards and instructions as a guideline for each library staff to serve users. The second phase is distributing responsibilities, function and authority. The third is developing good relationship, coordination and communication among library staffs. The fourth stage is evaluating library service. 3) the evaluation of library services at the Muhammadiyah University of Ponorogo refers to the view of George R. The concept of the Protection of Civilians (PoC) is a prevalent buzzword in the discourse on peacekeeping operations. All actors from the military, development and humanitarian segments relate to PoC. Although there is mainstreaming and general infusion of the concept within the international community, there is no coherent and comprehensive understanding of what the concept really means and what kind of practices it comprises and entails. The concept’s seminal thinkers and proponents fail to provide a clear and unambiguous definition of the concept. Rather it seeks to infuse a culture of protection among international actors operating in contexts which see grave human right violations and direct and indirect targeting of civilians. This article addresses the protection discourse as perceived by various actors in the field in Sudan. Rather than making the case for a narrow definition of PoC, we argue for mainstreaming a culture of protection, which in turn can succeed in including a multiplicity of actors. However, this may not be sufficient to engender an inclusive culture of protection, as PoC will be interpreted at the backdrop of organisations’ embedded mandates and institutional culture, which in turn can lead to a general conceptual dilution.

Unlike in the countries of Central and South-East Europe, where the transformation of property and political transition were smooth and peaceful, in the countries of former Yugoslavia (except Montenegro and Macedonia) these processes were accompanied by war; the effects are present even nowadays. After 1999, it was Kosovo’s turn to be part of these changes. Normally, in these processes, the political transition occurs prior to the transformation of property. This was not the case in Kosovo, where the order was reversed. It cannot be said that the privatisation method chosen by UNMIK was not the best. As of now, this method has failed to fulfil its duties of economic recovery and solve the unemployment problem. UNMIK has chosen the method of transforming the social property of Kosovo as a set up for the total transition of the political system, which later on would be one of the main elements and will serve to proclaim independence of Republic of Kosovo. It will remain an unanswered question whether the method that used is actually better, whether it is more productive economically, or not. As Kosovo’s case for many things is sui generis, and as far as the process of privatisation of the social property is concerned, it is a process which tried to adjust to the existing circumstances in Kosovo, circumstances which were earlier unknown in the other countries.

Since January 1, 2002, pursuant to UNMIK Regulation[1] no. 1999/4, the EURO (‘’EUR’’) was adopted as the legal currency in Kosovo, and was made the factual currency of the country. All client accounts held by the Central Bank of the Republic of Kosovo (CBK) and commercial banks were converted from DEM into EURO, on an irreversible currency ex-change rate of DEM 1,95583 per 1 EURO. As a result, in practice, while the Euro is legal and while accounts are held in this currency, almost all transactions made in Kosovo are titled and made in Euro. The use of a sustainable currency was important to maintaining a macro-economic stability and played a decisive role in rebuilding the people’s trust on the financial sector. On the other hand, the CBK does not emit currency, and as such, it does not perform any monetary and exchange policies. The currency regime adopted by Kosovo may be rather challenging, given the absence of traditional monetary instruments and the exchange rates. Therefore, the main concern remains whether fair policies (both fiscal and regulations related to the financial sector) will support this regime. The purpose of this paper is to demonstrate costs and benefit brought upon the Kosovar economy by the use of Euro as a main currency in circula-tion, and how affordable are the costs in comparison to benefits brought by the Europeanization of the Kosovo’s economy.[1] UNMIK - United Nations Mission Interim in Kosovo.
