Abstract:
Ever since a new way of reading Plato based on “unwritten doctrines” was articulated, it became a matter of dispute. However, the testimonies of its existence are undeniable. This expression was used by Aristotle in his Physics and its description can be found both in Aristotle and other in the classical thinkers. There are three key points crucial for Plato’s “unwritten doctrines” i. e. his oral lectures held at the Academy. These are: the doctrine about the Principles i. e. the One and the Indeterminate Dyad (hen and aoristos duas), the thesis about the geometrical construction of the world

In Hermias’ commentary on Phaedrus (In Platonis Phaedrum Scholia), it is possible to identify several direct references to the philosophers and pre-Socratic doctrines, including Pythagoras. We point out to three references to Pythagoras in Hermias: (1) Pythagoras is characterized as an unwritten philosopher, (2) there is a special connection with the divinities and Muses, and (3) there is a special connection with the Phaedrus dialogue, revealed by the affinity between Pythagoras and Socrates. We show how the explicit references to Pythagoras in Hermias constitute a certain method of interpret

The development of constitutionalism in the anti-Bolshevik state formations during the Civil Period in Russia (1918–1920) is one of the most poorly studied historical and legal issues. In this regard, the purpose of this work is determined to investigate the influence of constitutional doctrines and teachings on the constitutional development of “white” Russia. The main at-tention is paid to the study of anti-Bolshevik legislator positions regarding the question of what the constitution of the future Russia should be – written or unwritten. The broad context is a discussion of priority and posteriority, which runs from 1018b9–1019a14 (compare Categories 14a26–b24). A type of priority is described at 1019a2–4, and then further discussed at 1019a4–14. It is described as follows: ‘All those things are said to be prior in respect of nature and being, which can exist without other things, while those other things cannot exist without them.’ My concern in this note is with the parenthesis which immediately follows: ‘This is a distinction which Plato employed.’All the commentators despair of locating this reference to Plato. In this paper, I will show the deep roots of dialogue in Plato’s thought, in order to examine the validity of the so-called ‘esoteric Plato’. The confrontation between dialogicity and unwritten doctrines is the main theme of this article. These two views — Hermeneutics and Tübingen School — are not far away on concrete contents, with more or less variations. But it must be noticed that both conceptions of Platonic thinking are contradictory and that is reflected in their explanations of Plato’s own philosophical project.

Supreme Court Justice Joseph Story, responding in 1837 to the Massachusetts state legislature’s inquiry whether common law should and could be codified, reported that there could be tremendous saving of effort and time by lawyers and judges if a group of experts set out in written form the agreed principles and doctrines of common law. It also demonstrates that textuality does not have the monopoly on discursive splendour in international law. The chapter argues that textuality is everywhere in cu

Abstract The United Kingdom (UK) is a liberal democratic state where democracy is exercised in the context of the doctrine of the sovereignty of parliament. Neither the democratic features of the UK nor even the doctrine of parliamentary sovereignty are codified in a written constitution, but are rather the accumulation of unwritten ‘conventions’ as well as written rules—laws passed by parliament and case-laws made by judges— that have developed over long periods of time. The concept of democracy in the UK has similarly developed over time and in a piecemeal manner during a period of about two

Abstract Milton’s theology of renewal raises questions about how human speech becomes authoritative for others. These questions are ecclesial in nature, and Milton responds by conceptualizing the church as a forum for collectively testing human speech by the Holy Spirit. This ecclesiology provokes a methodological crisis for the treatise by revealing the limits of its founding assumption that using Ramist logic to organize scripture should eliminate the need for rhetorical human speech. Consequently, Milton redefines the rule of faith to emphasize the Spirit rather than scripture, laying a the

This chapter explains seven reasons why constitutional designers choose to codify unamendable rules. In explaining these reasons, the chapter discusses many different examples of codified unamendability around the world. This chapter also explains that unamen
