Abstract:
The chapter looks at the nature of copyright user rights from the perspective of the remedies users may have against copyright holders when they are restricted in their uses of copyright works. Given the almost non-existent obligations of copyright holders to users under copyright statutes, on the basis of which users could assert claims, copyright users need to resort to other bodies of law. This chapter looks at how users may construct claims for restricted uses of copyright works on the basis of a breach of contract, sale of goods law, consumer law, or as a breach of the obligation of good faith, or in tort. It demonstrates the uncertainty and obstacles around how users may assert claims under those various bodies of law. This may explain in part the relatively few cases involving copyright user claims. This account of copyright user remedies reveals another weak strain of copyright user rights.

Abstract:
The anaesthetist will routinely use many different types of medical devices during normal working practice, and will have access to many other devices for more challenging use in emergency and other difficult scenarios. The anaesthetist will expect and rely on each medical device to work first time and not to compromise the safety of the user, the patient, their relatives, or other healthcare workers in the vicinity. The equipment will also be expected to be effective, that is, that it will perform as expected when used in a defined population of patients (e.g. small children). Manufacturers and users of equipment use risk management procedures to reduce the risk to patients and others of using the equipment. Following use, the equipment will need to be reprocessed to make it safe for use for a subsequent patient, or disposed of safely.

Abstract:
Users are important innovators in many fields. Often, they do not need socially costly patent incentives to invent, disclose, and disseminate their inventions. A patent-free user innovation (UI) paradigm is likely to be successful and socially desirable when an invention’s value to users has a substantial non-competitive component. If a user innovator values an invention primarily for providing a competitive edge, the patent-free UI paradigm is not viable. Most such inventions have little social value. Some, however, such as improved manufacturing processes, produce significant collateral value for non-users and should be encouraged. Patents may be important for these UIs. Socially beneficial policy interventions to buttress the patent-free UI paradigm might include tools and infrastructure to support user communities and changes to patent doctrine, such as accounting for UI in assessing nonobviousness, patentable subject matter exemptions, particularly for many types of processes, and user exemptions from infringement liability.

Instrumentation and Terminology describes the general design of mechanical ventilators, reviews the functions of the ventilator–user interface, and defines and explains commonly used terms and acronyms associated with mechanical ventilators. Despite big differences in outward appearance, all mechanical ventilators have several basic features in common. All must be connected to high-pressure sources of oxygen and air. All ventilators have a user interface, which allows the clinician to easily choose from a wide variety of ventilator settings, and displays these settings, as well as important, real-time patient data. Tables 4.1 and 4.2 in this chapter list most of the terms that you’ll need to use and understand when caring for mechanically ventilated patients.
