Intersectionality, frequently used by political scientists, sociologists and anthropologists as a highly abstract concept, originated as the socio-legal critique, by Kimberlé Crenshaw, of US courts’ ignorance of discrimination against Black Women specifically. That ignorance emerged in cases such as DeGraffenreid, in which the claimants challenged a collective redundancy scheme resulting in dismissing all Black Women on grounds of indirect discrimination. The court refused to recognise Black Women as a category of relevance and did not find any discrimination because the scheme did not impact disproportionally on White Women or Black Men. As regards EU law, some socio-legal scholars of today doubt that intersectionality has any value as a practically relevant concept. This article discusses the question whether and how intersectionality can and should be used in applying EU non-discrimination law through a critical analysis of three ECJ rulings delivered between 24 November 2016 and 14 March 2017. The Parris case concerning the pension claims of two white homosexual Men can be qualified as the Court’s “DeGraffenreid moment” because it refused to recognise discrimination in a case where the intersection of being over 63 and homosexual was the basis of excluding the Men from a survivor’s pension. The Court refused to recognise combined discrimination and found that neither age nor sexual orientation in isolation were the reason of that exclusion. The more recent Achbita and Bougnaoui cases seem to constitute instances of surprising ignorance of racializing Muslim Women through penalising them for wearing a headscarf: The Court, following its Avocates Générales, refused to protect Women against dismissal on grounds of that garment on the basis of extensive justifications for religious discrimination, thus ignoring a pervasive exclusion on the intersection of gender and ascribed race. The article criticises all three rulings with a twofold argument. First, it is submitted that anti-discrimination law should and can recognise intersectional discrimination without losing its focus by a reconceptualization around the nodes gender, race and disability. Second, it is argued that EU anti-discrimination law can be interpreted to encompass this concept by using a purposive interpretation.

Abstract:
The aims of this research are to identify the types of the code switching appeared on Facebook for the reason phenomena and to investigate the reasons that affect the occurrence of code switching in Facebook. This research uses qualitative method with Hoffman (1991) and Saville-Troike (1986) theories. The data were collected from photos caption and status on Facebook during twenty days from 1st January 2018 to 20th January 2018, that were posted by 90 users who were followed by the researchers on Facebook. 120 data have found on status and photo caption facebok. The result of this research shows that there are three types of code switching on Facebook, namely Inter-sentential switching with 54 data, Intra-sentential switching with 50 data, and Emblematic switching with 16 data. Besides that there are five reasons which influence the use of code switching on Facebook, namely talking about particular topic with 39 cases found, quoting somebody else with 13 cases found, being emphatic about something (express solidarity) with 45 cases found, Interjection (inserting sentence fillers or sentence connectors) with 10 cases found, and real lexical need with 13 cases found. The dominant reasons which influence the use of code switching on Facebook are being emphatic about something (express solidarity) with 45 cases.

AbstractUvulopalatopharygoplasty has become widely performed for chronic snoring and for cases of obstructive sleep apnoea. Unfortunately this operation is not without morbidity and complications. We report our results of a prospective series of 50 patients undergoing uvulopalatopharyngoplasty with a minimum follow-up of one year. Snoring was abolished in 18 (36 per cent) and substantially reduced in the remainder. Obstructive sleep apnoea syndrome, identified in 11 patients pre-operatively, was reduced in severity in all but three. Troublesome complications were seen in 18 (36 per cent) patients, namely intermittent velopharyngeal incompetence in five (10 percent), pharyngeal dryness in 11(22 per cent) and loss of taste in five (10 per cent). One patient had nasopharyngeal stenosis requiring correction. A cautious approach to this operation is required with rigorous case selection. The importance of full assessment and careful follow-up should not be underestimated.

This study aimed to clarify whether patients attending an emergency room generally had non-urgent problems. A study was made of 2841 patients attending the emergency room of Prince Zaid Ben Al-Hussein military hospital [south Jordan]over a 1-month period using data from the registration book. Patients were classified into four classes of urgency [life-threatening, urgent, non-urgent, trivial]. The attendees were mainly children [26.4%]. The admission rate was 3.2% and non-urgent conditions accounted for 91% of cases. Much of the use of emergency services was found to be inappropriate, a situation which should be changed.

This paper will focus on two controversial cases relating to the [mis]use of the notion of autonomy in situations of life and death. While in one case the patient’s will to die was not respected, in the other there was no attempt to save the life of the individual. I have chosen to put these two specific cases in parallel for the fact that in both instances the presence of some kind of mental impairment is not given at all. Yet, in both situations there is substantial reference to some type of temporary competence -as this is the key element that, allegedly, should function as decisive to assess the moral and legal justification behind the decision to enforce -or not- medical treatment upon the protagonists of these two very sad stories. Following on from the objective of this paper thus, the contraposition of these two cases will provide us with a vivid image of the practical implications of using the notion of autonomy (here presented under the form of a more psychiatric-oriented term: competence) in an inconsistent manner within the Western world (US and EU). Raising many doubts over its appropriateness.

Summary Background: Patient and surgical case complexity are important considerations in creating appropriate clinical assignments for trainees in the operating room (OR). The American Society of Anesthesiologists (ASA) Physical Status Classification System is the most commonly used tool to classify patient illness severity, but it requires manual evaluation by a clinician and is highly variable. A Risk Stratification System for surgical patients was recently published which uses administrative billing codes to calculate four Risk Stratification Indices (RSIs) and provides an objective surrogate for patient complexity that does not require clinical evaluation. This risk score could be helpful when assigning operating room cases. Objective: This is a technical feasibility study to evaluate the process and potential utility of incorporating an automatic risk score calculation into a web-based tool for assigning OR cases. Methods: We created a web service implementation of the RSI model for one-year mortality and automatically calculated the RSI values for patients scheduled to undergo an operation the following day. An analysis was conducted on data availability for the RSI model and the correlation between RSI values and ASA physical status. Results: In a retrospective analysis of 46,740 patients who received surgery in the year preceding the web tool implementation, RSI values were generated for 20,638 patients (44%). The Spear-man’s rank correlation coefficient between ASA physical status classification and one-year mortality RSI values was 0.404. Conclusions: We have shown that it is possible to create a web-based tool that uses existing billing data to automatically calculate risk scores for patients scheduled to undergo surgery. Such a risk scoring system could be used to match patient acuity to physician experience, and to provide improved patient and clinician experiences. The web tool could be improved by expanding the input database or utilizing procedure booking codes rather than billing data.

Nation states, or partisans thereof, control and allocate symbolic resources as one means of legitimizing power and authority, and in pursuit of their perceived nationalistic goals and ideologies. A major symbolic resource is the past. In this paper I review three cases in which the past and, in particular, relevant archaeological resources were "used" for such purposes, and I refer to several other well-known instances. The three cases discussed are Mexico from ca. A.D. 900 to the present, Britain from ca. A.D. 1500 to the present, and the People’s Republic of China since 1949. The implications of such uses in relation to archaeological theories and interpretations are discussed.

Quantitative protein measurements by mass spectrometry have gained wide acceptance in research settings. However, clinical uptake of mass spectrometric protein assays has not followed suit. In part, this is due to the long-standing acceptance by regulatory agencies of immunological assays such as ELISA assays. In most cases, ELISAs provide highly accurate, sensitive, relatively inexpensive, and simple assays for many analytes. The barrier to acceptance of mass spectrometry in these situations will remain high. However, mass spectrometry provides solutions to certain protein measurements that are difficult, if not impossible, to accomplish by immunological methods. Cases where mass spectrometry can provide solutions to difficult assay development include distinguishing between very closely related protein species and monitoring biological and analytical variability due to sample handling and very high multiplexing capacity. This paper will highlight several examples where mass spectrometry has made certain protein measurements possible where immunological techniques have had a great difficulty.

Abstract Some non-appropriated uses of slurs seem to be non–derogatory. In this paper, I argue that in a range of cases, the lack of derogation is owed to the term not being genuinely used. I first examine so–called pedagogical uses and show that they can be assimilated to what I call “distancing uses.” I then turn to a range of other apparently non–derogatory, non–appropriated uses of slurs – such as non–weapon uses, comedic uses – and argue that they can depart from standard, genuine usage in relevant ways. I finally turn to so–called “affectionate” uses, and show that, if the conditions in which they obtain can be described as standard, then they are derogatory because they are genuine uses, no matter the benevolent feelings of the speaker.

Post-secondary educational institutions and training providers also have use cases for industry- and discipline-specific competency frameworks. Los Alamos National Laboratory (LANL) has used competency frameworks for both organizational uses and individual assessment purposes. While these uses are briefly touched on, the focus of this paper is on use of competency frameworks for communicating employer needs to education providers for recruitment purposes and for aligning curricula to meet discipline-specific competency requirements. LANL’s approach to developing and managing competency frameworks for several types of technicians is described, as is the use case methodology.

Recent celebrated criminal cases have raised the public's awareness of forensic science. The advent of DNA technology, in particular, has led to a perception of instrumental techniques that lead to a mathematical probability of guilt that approaches certainty. Mostly passed over in press accounts of forensic operations is the use of the microscope in the examination of physical evidence. By the use of an example from an adjudicated criminal case it is hoped that a greater appreciation is gained of the microscope, that in its various forms, is by far the most widely used instrument in a crime laboratory today.A middle-aged woman was reported missing by her son after the Memorial Day weekend in 1997. An examination of her apartment by members of the Washington State Patrol Crime Scene Response Team revealed a small amount of blood on her bedding. This bedding, together with other items, was taken into evidence.

This study analyzes the results of clinical trials of treatments with melatonin conducted in children, mostly focused on sleep disorders of different origin. Melatonin is beneficial not only in the treatment of dyssomnias, especially delayed sleep phase syndrome, but also on sleep disorders present in children with attention-deficit hyperactivity, autism spectrum disorders, and, in general, in all sleep disturbances associated with mental, neurologic, or other medical disorders. Sedative properties of melatonin have been used in diagnostic situations requiring sedation or as a premedicant in children undergoing anesthetic procedures. Epilepsy and febrile seizures are also susceptible to treatment with melatonin, alone or associated with conventional antiepileptic drugs. Melatonin has been also used to prevent the progression in some cases of adolescent idiopathic scoliosis. In newborns, and particularly those delivered preterm, melatonin has been used to reduce oxidative stress associated with sepsis, asphyxia, respiratory distress, or surgical stress. Finally, the administration of melatonin, melatonin analogues, or melatonin precursors to the infants through the breast-feeding, or by milk formula adapted for day and night, improves their nocturnal sleep. Side effects of melatonin treatments in children have not been reported. Although the above-described results are promising, specific studies to resolve the problem of dosage, formulations, and length of treatment are necessary.

The inconsistency of law enforcement in implementing the substance of the narcotics law has led to a polemic in the community, especially against cases of drug abuse committed by minors, it becomes unclear, the approach method used in this study uses a normative juridical approach. The research found that children as perpetrators of narcotics crimes, if they are not proven to be dealers, which can be dangerous as a basis for imprisonment for children, it is necessary to be rehabilitated as regulated in the narcotics law. Considering that children who are perpetrators of narcotics crimes are only users and are affected by bad environmental conditions both in the family and the environment. Narcotics in the Islamic perspective is analogous to the prohibition of drinking alcohol. This prohibition is carried out because narcotics cause hatred, hostility, disaster and dangerous disasters, both for users, families, communities and the nation and state. Narcotics are prohibited in Islamic law and producers, dealers and users will be subject to Had or Ta’zir sanctions.

We developed this study to examine the issue of parental refusal of treatment, looking at the issue through a cultural competence lens. Recent cases in Canada where courts have declined applications by clinicians for court orders to overrule parental refusal of treatment highlight the dispute in this area. This study analyses the 16 cases of a larger group of 24 cases that were selected by a literature review where cultural or religious beliefs or ethnic identity was described as important reasons behind the refusal. The most significant finding was that nearly all of the cases cited unacceptable side effects as the main reason for declining treatment. We then analysed the detail of the cases and concluded that in the first instance a skilled clinical approach to develop an agreed management plan is by far the best approach. In the event that agreement cannot be reached we recommend engaging a mediator to help the clinician and parents/child to find an agreeable way forward. We argue that the option of seeking a court order was of significant detriment to many of the children in our cases and that this option should be used sparingly. There is a need for empirical research on the outcome of cases where a court order is sought.

Background: Excessive consumption of cola beverages is accompanied by numerous public health risks. But besides these well-known adverse effects, recently, several medical articles have been published that show some indications for cola beverages in clinical practice like resolution of gastrointestinal or feeding tube obstructions, increasing bioavailability and palatability of other medications, rehydration and other uses in healthcare settings. These approaches are not without shortcomings and complications. Methods: In this systematic review we tried to explore these new uses for practitioners and also reemphasize on the most evidence-based complications of cola consumption like bone loss and metabolic and cardiovascular adverse effects in cases of misuse and overuse from both clinical and nutritional points of view via searching the PubMed database. Results: We chose 145 journal articles from the most relevant ones plus 30 extra references and categorized their topics in two classes of medical uses and adverse effects. Conclusion: It could be stated that cola beverages have demonstrated interesting uses and benefits in medicine but their use should be regulated as strict as possible.

It aims to promote the concept of “irresistible inference” from UK case law as a basis for establishing international consensus that this provides an alternative and possibly more effective means of prosecuting the crime.Design/methodology/approachThe paper considers academic research into the incidence of money laundering and the effectiveness of anti‐money laundering measures; it considers the efficacy of current UK legislation on money laundering; assesses legal views on recent developments in UK case law relating to the concept of “irresistible inference”; identifies what “irresistible inference” looks like and asserts its practical value as an alternative basis for proving criminality of funds in money laundering prosecutions.FindingsAn effective international response to the increasing threat to international institutions posed by money laundering requires development of new approaches to proving criminality of funds. The use of irresistible inference as an alternative to predicate offence, however, requires development of the international understanding of what it looks like in order that relevant policy makers and legal decision makers can deploy it with confidence so that it is able to make the significant contribution to the international effort against money laundering it is capable of.Practical implicationsTo facilitate the necessary international consensus, it may be necessary in some jurisdictions to amend legislation where it currently relies on predicate offence for the prosecution of money laundering cases.Social implicationsA failure to effectively combat international money laundering implies acceptance of an attitude of complacency in the face of increasing exposure to levels of threat in the form of political and social corruption, organized crime and terrorism that ought to be unacceptable to the international community.Originality/valueInternational acceptance of “irresistible inference” as a means of proving criminality in money laundering cases would deliver a radically more hostile environment for international money launderers. This paper is designed to open up thinking along these lines across international borders.

This paper discusses two negation types (standard negation (SN), negative doubling (ND)) in Chipileño Spanish, a variety that has emerged as a result of contact between Spanish and Veneto (an Italo-Romance language) in Mexico. In Veneto, negation can be formed in two ways: preverbally (SN) and as a negative doubling (ND). Based on sporadic observation, bilingual speakers of Spanish and Veneto transfer a final no while speaking Spanish, a language that does not allow repetition of the same negator in the postverbal position. Using both a spontaneous and a controlled tasks, the results show two possibilities: preverbal negation only (no vino ‘[S/he] did not come’) and sentence final (no me gusta no ‘I do not like’) in both tasks. This study compares the findings from Chipileño Spanish to the other Romance varieties that exhibit similar cases of negation, while discussing its scope and relevance to discourse-pragmatic factors.

Drug therapy in cases of infections by viruses is only to prevent secondary infections. The use of drugs for each action must be evaluated through a drug use evaluation program (EPO) in order to guarantee a rational and effective drug. This study aims to examine the drugs in case for handling and the effectiveness of drug use in cases of infections caused by viruses, in this study the therapeutic use of drugs in cases of feline calicivirus and feline panleukopenia. This research is a descriptive study using data from 543 patients who came to get treatment of clinic in Bogor City during 2017 and 2018, 29 of which were infected with feline calicivirus and 32 infected with feline panleukopenia. Evaluation of drug use in these two viral diseases is done descriptively by comparing research data with literature. The results showed the use of drugs in the case of feline calicivirus there were 12 types of drug treatment, while in the case of feline panleukopenia there were 9 types of drug treatment. The use of drugs most often used is based on the records of veterinary clinical records, namely the preparation of metronidazole combined with cefadroxil to handle cases of feline calicivirus and metronidazole alone to handle cases of feline panleukopenia.

Some controversy exists about the relative frequency of criminal and self-defense gun use in the United States. Using data from a national random-digit-dial telephone survey of over 1900 adults conducted in 1996, we find that criminal gun use is far more common than self-defense gun use. This result is consistent with findings from other private surveys and the National Crime Victimization Surveys. In this survey, all reported cases of criminal gun use and many cases of self-defense gun use appear to be socially undesirable. There are many instances of gun use, often for intimidation, that are not reported to the police and may not appear in official crime statistics.

Omani Copyright and Neighboring Rights Law of 2008 contains a list of exceptions to the exclusive rights of copyright holders. These exceptions allow people to copy and use copyrighted materials in certain cases without paying any fees or obtaining any permission from the copyright holders. The exceptions cover free uses for purposes like teaching, education, quotation in another work, dissemination of news etc. However, the Omani Copyright and Neighboring Rights Law puts many conditions for such free uses. Some of these conditions mirror similar conditions under the Berne Convention and other copyright conventions to which Oman is a party. Other conditions under Omani law are more restrictive than those that appear under international conventions. These additional conditions restrict the scope of free uses of copyrighted materials in Oman. Yet, some countries like USA and Canada, despite their being parties to the same international conventions, have much wider exceptions under their national legislation. The paper, therefore, recommends that Oman should follow the legislative approach of those countries in order to widen the scope of copyright exceptions for the benefits of users of copyrighted materials in Oman.

The potential of these natural compounds, either directly or as the basis of new chemistries for herbicides, has remained largely untapped.

This study is entitled Appraisal Analysis of Tempo’s and Kompas’ Editorials on Papua Cases. This research aims to find what kind of appraisal items used in Tempo’s editorial entitled “Misunderstanding Papua” and in Kompas’ entitled “Exodus and Urgent Action”, as well as to describe the differences between them in term of appraisal. Descriptive qualitative were used as the research method. Martin and White (2005) and Martin and Rose (2007) theories regarding appraisal are used as the theoretical framework. Firstly, the editorials that talked about Papuan demonstration in September 23, 2019 were collected from Tempo’s and Kompas’ website. The data obtained were analyzed by identifying the appraising items in each clause. Then, the clauses containing appraising items were classified into the appropriate kind of appraisal items. After that, each appraisal items found were explained and the meaning behind were interpreted. And the last, drew the conclusion. The result reveals that in term of attitude, Tempo’s editorial uses more negative judgement and the appraised item is mostly the government. It shows that Tempo is not afraid to criticize the government. Meanwhile Kompas uses more negative affect and the appraised items are mainly Papuan people and the condition in Papua. It shows that Kompas chooses to express their sympathy more to those affected by the riots. In term of graduation, both editorials use more force than focus, especially intensification, to raise/emphasize their evaluation. As for engagement, Tempo and Kompas use more monogloss than heterogloss. AbstractThis paper addresses the (inter)subjective functions of progressive aspect in Dutch. While the aspectual profile of the various Dutch progressive constructions has received considerable attention in the last few years, much less attention has been paid to their non-aspectual uses. As we will demonstrate in this paper on the basis of a corpus study of spoken Dutch, complemented with native-speaker elicitations, the Dutch progressive constructions can be specifically recruited to express (inter)subjective meanings such as surprise, irritation and intensity, and they differ in this respect from their simplex counterparts. Our analysis of progressive aspect in terms of backgrounded boundaries provides an explanation for (i) the general association of progressive aspect with (inter)subjectivity and (ii) our observation that some Dutch progressive constructions are more prone to such (inter)subjective exploitation than others. This semantic account also underlies the last part of this contribution, in which we discuss cases of what we call “(inter)subjective reinforcement” in complex progressive constructions, that is, the embedding of progressive constructions in other constructions that are also semantically affiliated to (inter)subjectivity (e.g. the perfect,gaan/komen‘go/come’, modals and the bare infinitive construction), which has been largely neglected in the literature.

Land-use planning and policymaking is central to how communities manage their economic activity and the social and environmental impacts these activities produce. Because of this central role, enhancing land-use practices to better incorporate the needs and impacts of freight activity has strong potential to improve the efficiency of their associated supply chains. This paper summarizes the key findings of the NCFRP 08-111 project on “Freight-Efficient Land Uses (FELUs)”, probably the most comprehensive research project to date aimed at designing policy procedures to foster land-uses that minimize the private and external costs associated with the production, transportation, and consumption of goods. As part of the paper, the authors define freight efficient land-uses, identify the principles that should guide the process towards FELUs, outline the process to develop FELU plans and programs, propose to analyze the freight efficiency of current and future land uses in their jurisdictions, and identify complementary initiatives (both land-use and transportation related) that could help mitigate the negative impacts on local communities. The authors discuss three illustrative cases that provide evidence on how land-use decisions produce unintended effects on local communities. The paper explains how decision makers can carefully consider the FELU principles in their planning and avoid or mitigate such negative results.

Organizations fail due to incentive problems (agents do not want to act in the organization's interests) and bounded rationality problems (agents do not have the necessary information to do so). This survey uses recent advances in organizational economics to illuminate organizational failures along these two dimensions. We combine reviews of the literature with simple models and case discussions. Specifically, we consider failures related to short-termism and the allocation of authority, both of which are instances of “multitasking problems”; communication failures in the presence of both soft and hard information due to incentive misalignments; resistance to change due to vested interests and rigid cultures; and failures related to the allocation of talent and miscommunication due to bounded rationality. However, the vast bulk of the land in the region is held under different forms of customary land tenure, and the perceptions of land and its use are distinctly regional. Selected cases from the region are used to highlight the difficulties that the courts face in blending Common Law principles with customary practice and accommodating changing uses of land that challenge traditional solutions.

Identifying critical land-uses or source areas is important to prioritize resources for cost-effective stormwater management. This study investigated the use of information on ionic composition as a fingerprint to identify the source land-use of stormwater runoff. We used 12 ionic species in stormwater runoff monitored for a total of 20 storm events at five sites with different land-use compositions during the 2012–2014 wet seasons. A stepwise forward discriminant function analysis (DFA) with the jack-knifed cross validation approach was used to select ionic species that better discriminate the land-use of its source. Of the 12 ionic species, 9 species (K+, Mg2+, Na+, NH4+, Br−, Cl−, F−, NO2−, and SO42−) were selected for better performance of the DFA. The DFA successfully differentiated stormwater samples from urban, rural, and construction sites using concentrations of the ionic species (70%, 95%, and 91% of correct classification, respectively). Over 80% of the new data cases were correctly classified by the trained DFA model. When applied to data cases from a mixed land-use catchment and downstream, the DFA model showed the greater impact of urban areas and rural areas respectively in the earlier and later parts of a storm event.

Claims of causality and generalizability are the primary means through which sociologists triumph over ambiguity. Yet ambiguity also has significant uses in the process of theorizing. This article identifies and examines three ethnographic approaches: (1) Ambiguity in shared situations highlights how subjects create and resolve disruptions in face-to-face interactions, (2) ambiguity as a transitional social form addresses certain stages and spaces as persistently ambiguous types of situations and phenomena, and (3) ambiguity as separating means from ends identifies mechanisms that conceal from subjects the risks and limitations of their own behaviors and choices in their everyday lives. Each of these approaches presents patterns in how ethnographers use analytic techniques to make sense of where ambiguities come from and how they can be turned into sociological cases. By making these approaches explicit, researchers can become better equipped at using them as provocations for sociological theorizing.

Biological luminescence stimulated by optical excitation results in signals which are characteristic of the host tissue. The spectrum of the emitted light, the intensity, and the excited state lifetimes are modified as the result of disease or by activation through addition of cell selective phosphors. There is an opportunity to identify diseased tissue both by the spectral signals from activators or, in some cases, by the differences of the natural luminescence responses. For practical reasons, defined by the sensitivity range of standard luminescence detectors, much of the current work has focussed on the short wavelength emissions driven by laser activation. However, the techniques are poised to undergo a dramatic expansion in scope with the advent of higher sensitivity photocathodes with high efficiency responses at long wavelengths. It is now possible to utilise a greater range of emission features with improved discrimination. Further, movement to longer wavelength excitation, and emission, open the way to probe deeper beneath the surface of tissue. The current overview will focus on recent examples from detection of cancer to tooth caries and indicate how the non-destructive luminescence probes can distinguish between tissue changes at an early stage of development.
