This is the first comprehensive work on the origins, development, and sociopoliticalramifications of the Usuli movement within Twelver Shi‘ism. Giventhat Wahid Bihbahani (1709-91), the founder and catalyst for Usuli revivalismduring the nineteenth century, is barely known in the West, it is a welcome additionto the growing Western literature on medieval and modern Shi‘ism. Thisongoing movement is the most powerful force in Twelver Shi‘ism.Using a wide range of primary and secondary sources, Heern highlightsthe emergence of modern Usulism during the eighteenth and nineteenth centuries.While locating its genesis within a global context, he outlines its ideologicalroots, historical background, and development. His central argument isthat Usulism was a response to the ummah’s changing sociopolitical conditionsand part of a wider trend of Islamic reform and revivalist movements that beganin the eighteenth century. He maintains that its emergence enabled the Shi‘iclerical establishment to attain sociopolitical and economic ascendancy in Iranand Iraq, and that the movement survived without government patronage bycultivating transnational links with the Shi‘i laity. Abstract:
The study of takhrij (retrieval) is one of the most important mechanisms in ijtihad (independent reasoning) by fuqaha’ (jurists) and usuli (lit. those who go back to first principles). In usul (principles) and furu’ (branches) of Islamic law, the usulis were deliberately referring to madhab (school of law) founders especially after the decrease of mujtahids who managed to attain a level of independence and able to deal with detailed evidences in finding solutions to legal problem. Among the attention of takhrij of usuli is to expound legal maxim principles from fundamental sources the Quran and hadith contained of principle of legal reasoning and branches of Islamic jurisprudence. Utilizing descriptive analytical method, this article scrutinizes the concept of takhrij of usuli, its categories and some of its applications. The research found that the takhrij of usuli is concerned with the derivation of Islamic legal maxims, the principles of legal reasoning as well as the branches of law. However, the derivation is unconcerned about specific evidence of Islamic jurisprudence topics but the whole evidence whether literal, divergence or conformity of ibadat (submissive obedience), mu’amalat (transactions), and personal interest topic.

In any analysis of Bahrain’s political structure, it is fundamental to understand the relationship between the Usili, Akhbaris, and authority. This analysis includes an assessment of the implications of the differences between the Usili and Akhbaris, thus shedding light on the dynamic interaction between these players in local and external structures and clarifying the effect of ideology and identity on the ties of authority with Shi’a. Usuli and Akhbaris principles have incontrovertible implications for the political perceptions of Shi’a groups and elites with regard to their dealings with the government in Bahrain. These religious perceptions form part of the political equation involved in ensuring the convergence of authority with the Shi’a community. This paper considers how differences between the Usuli and Akhbaris have shaped the relation between authority and Shi’a in Bahrain.

Abstract:
AbstractIt is "only our lack of familiarity with Sasanian law," von Grunebaum opined (1970: 37), "that prevents us from uncovering its traces in the fiqh". And Joseph Schacht argued that Sasanian law did have an influence on Islamic law. But neither Schacht nor any other modern scholar has provided persuasive evidence for such influence. In this article I argue that the influence of Sasanian legal theory on Islamic legal theory in the formative period was minimal, at best. It is true that, like Islamic law, Sasanian law was based on four sources: (1) The Awesta or holy book of the Zoroastrians; (2) oral law; (3) the consensus of the sages; and (4) the judicial practice of the courts (kardag). However, the possibility of Iranian influence on early Islamic jurisprudence is limited by historical, cultural, geographical and chronological factors, and the evidence of the sources suggests that Sasanian legal thinking was distinctive from that of the Sunni usulis.

Abstract:
The fundamental question I have tried to answer in this thesis is how the Ni‘matullāhī ‎masters were successful in reviving Ni‘matullāhī Sufism in Shi‘ite Persia during the ‎early nineteenth century. This study investigates the revival of the Ni‘matullāhī Sufi ‎order in Persia after the death of the last Indian Ni‘matullāhī master, Riḍā ‘Alī Shāh (d. ‎‎1214/1799) in the Deccan. Meticulous attention is given to the role of Ḥusayn ‘Alī ‎Shāh (d. 1234/1818), Majdhūb ‘Alī Shāh (d. 1239/1823) and Mast ‘Alī Shāh (d. ‎‎1253/1837), who were the masters (quṭbs) of the Ni‘matullāhī order after Riḍā ‘Alī ‎Shāh. The Ni‘matullāhī Sufi order flourished as a Persian Sufi order in 8th/14th century. ‎During the Safavid era most of the Sufi orders in Persia became inactive or ‎systematically suppressed. With the advent of the Safavids, the Ni‘matullāhī order ‎moved to Hyderabad in India, and gradually became less important in the mystical ‎milieu of Persia. After the fall of the Safavids, the revival movement of the Ni‘matullāhī ‎order began with the arrival of the enthusiastic Indian Sufi master Ma‘ṣūm ‘Alī Shāh ‎during the last quarter of the eighteenth century. Later Persian masters of the ‎Ni‘matullāhī order in the beginning of the early nineteenth century solidified the ‎order’s place in the mystical and theological milieu of Persia.‎ Ma‘ṣūm ‘Alī Shāh and his disciples soon spread their mystical and ecstatic beliefs all ‎over Persia. They succeeded in converting a large mass of Persians to Sufi teachings ‎despite the opposition and persecution they faced from Shi‘ite clerics, who were ‎politically and socially the most influential class in Persia. The clerics were able to turn ‎the political powers against the Sufis to a certain extent, such that Āqā Muḥammad ‘Alī ‎Bihbihānī, principal champion of this oppression, largely succeeded in his persecution ‎of Ma‘ṣūm ‘Alī Shāh and his disciples. The question of the Ni‘matullāhī Sufis’ survival ‎in Persia after Maṣūm ‘Alī Shāh is evaluated here by using the biographies and ‎writings of later masters and modern scholars. ‎ The conclusion is reached that Ḥusayn ‘Alī Shāh, Majdhūb ‘Alī Shāh and Mast ‘Alī ‎Shāh were able to consolidate the social and theological role of the Ni‘matullāhī order ‎by reinterpreting and articulating classical Sufi teachings in the light of Persian Shi‎‘ite ‎mystical theology.‎

Surge, ent?o, o ambiente prop?cio ao controle das cl?usulas abusivas, pautado nos fundamentos da nova teoria contratual e na interpreta??o t?pico-sistem?tica do direito. O controle das cl?usulas abusivas ? bastante desenvolvido na legisla??o estrangeira, onde se busca realizar a justi?a substancial de forma a compensar a desigualdade entre os contratantes. O sistema de controle previsto no CDC poder? ser preventivo ou repressivo, privado ou p?blico e este, por sua vez, administrativo ou judicial. With this goal, it starts, in the first half, with the analysis of the theoretical fundamentals that underlie the objective of this research. It begins with the presentation of the consumer protection as a fundamental right and its insertion in the Brazilian legislative context. Next, it exams the insurance contracts, its concept, its purpose and importance, its characteristics and features, as well as the actors that figure in the domestic insurance market. Following, are commented some of the most important contractual aspects, including the evolution and the transformations that the Contract Law suffered, the principles that govern the contractual bonds and the main rules related to consumer contractual protection. In the second part, it?s worked on some of the major coverage negatives involving insurance contracts in the light of the national jurisprudence, which is done three stages, subdivided according to the insurance modalities. In each part, it?s worked on the general aspects of each controversy, including the arguments summoned by the parties, followed by the jurisprudential understandings. All with the end goal of analyzing which understandings and fundaments are presented in these kinds of demands.<br>Este trabalho tem como objetivo analisar a incid?ncia do direito do consumidor nos contratos de natureza securit?ria, principalmente no ?mbito da discuss?o entre as cl?usulas limitativas e abusivas, ? luz da jurisprud?ncia. Com esta meta, inicia-se, na primeira parte, com a an?lise dos fundamentos te?ricos que subjazem ao objetivo desta pesquisa. Come?a-se com a apresenta??o da prote??o do consumidor como direito fundamental, analisando-se a sua evolu??o e o seu enquadramento no contexto legislativo brasileiro. Na sequ?ncia, examinam-se os contratos de seguros, seu conceito, sua finalidade e sua import?ncia, seus elementos e caracter?sticas, bem como os atores que comp?em o mercado de seguros nacional. Abstract:
This thesis delineates the transformation of Iran’s so-called post-revolutionary ‘religious intellectuals’ (rowshanfekran-e dini) from ideological legitimators within the political class of the newly-established theocratic-populist regime to internal critics whose revised vision for the politico-religious order coalesced and converged with the growing disillusionment and frustration of the ‘Islamic left’, a constellation of political forces within the governing elite of the Islamic Republic, that following the death of Ayatollah Khomeini increasingly felt itself marginalised and on the outskirts of power. The historical evolution of this complex, quasi-institutionalised and routinized network, encompassing theologians, jurists, political strategists and journalists, which rose to prominence in the course of the 1990s, and its critical engagement with the ruling political theology of the ‘guardianship of the jurist’, the supremacy of Islamic jurisprudence, political Islamism and all forms of ‘revolutionary’ and ‘utopian’ political and social transformation, are scrutinised in detail. In this vein, the thesis examines the various issues provoked by the rowshanfekran-e dini’s strategic deployment and translation of the concepts and ideas of a number of Western thinkers, several of which played a pivotal role in the assault on the ideological foundations of Soviet-style communism in the 1950s and 1960s. It then moves to show how this network of intellectuals and politicos following the election of Mohammad Khatami to the presidency in May 1997 sought to disseminate their ideas at the popular level by means of the press and numerous party and political periodicals, and thereby achieve ideological and political hegemony. The thesis proceeds to demonstrate the intimate connection between the project of ‘religious intellectualism’ and elite-defined notions of ‘democracy’, ‘electoral participation’, ‘reform’ and ‘political development’ as part of an effort to accumulate symbolic capital and assert their intellectual and moral leadership of the polity.

In the face of the importance of the competitive freedom's control study within the Brazilian Oil Industry, Natural Gas and Biofuels, this study centers its attention on evaluation of Local Content Policy economic efficiency adopted by Brazil in this area and its contribution in the country's development process. It is intended to study in this legal-economic approach, if its freedom market's mitigation from the insertion of Local Content Clauses contributes positively to the Brazilian development construction. In this context, the regulatory model adopted by the State becomes a fundamental tool concerning to the interests of investors' attractiveness in the country, used like reference for verification of potential competition from the country's agents. Therefore, in compass with this research's proposal, discusses with the theme in light of theoretical and practical senses, in order to promote, focused on oil and gas sector, an analysis about the impact of the Local Clauses Content's insertion in the market scenario what demands more freedom on the action of economic agents at local and global level. For the present work have been used hypothetical-deductive as methods and systemic functionalist as approach, while the indirect documentation is applied within bibliographical and documentary research. Once undertaken the proposed analysis, according the applied methods, it concludes that the competitivity elevation of the Brazilian hydrocarbons industry, essential to the development process conclusion, can only be done by inserting innovation in this dynamic focus. Likewise, the effectiveness of the country's Local Content Policy, although significantly contribute to the strengthening of national production chain, has to constitute a temporary measure and receive rearrangement in order to separate anti-competitive barriers and minimize production costs.

Le waqf est l'un des phénomènes socioculturels religieux majeurs du monde musulman, en vigueur dans les sociétés islamiques depuis les débuts de l'islam jusqu'à nos jours. Dans cette recherche, on s'est attaché à l'étude du waqf selon l'école chiite imâmite duodécimaine en Iran du 16ème au 18ème siècle. Pour que cette analyse soit la plus complète possible, on a abordé la question sous trois aspects complémentaires. Ainsi, la première partie examine le waqf dans les ḥadîths de la tradition chiite duodécimaine, les présentant, les traduisant et les analysant alors que la seconde partie se concentre sur des positions des jurisconsultes les plus influents de la période concernée par rapport à la praxis et à la théorie de waqf. La recherche sur les pratiques de waqf dans la société safavide compose la troisième partie de cette thèse. Cette approche tripartite a produit une étude qui analyse les fondements théoriques de waqf dans le chiisme duodécimain ainsi que des pratiques mêmes de waqf en islam chiite. Cette recherche constitue une première étape pour comprendre la spécificité du waqf chiite dans un cadre géographique et historique précis qui façonna les bases de la jurisprudence chiite contemporaine sur le waqf qui reste toujours d'actualité<br>Waqf is one of the major sociocultural phenomena in Islam since the early generations up until today.This dissertation focuses on waqf according to the Twelver Imamite Shiite doctrine in Iran from the 16th to the 18th century. To study this in different ways, we have used three complemetary aspects. The first part closely examines waqf in Twelver Shiite ḥadîths, presenting, translating and analyzing them while the second section concentrates on the positions of the most influential Shiite ulama of the period with respect to waqf theory and praxis. Research on waqf practices in Safavid society make up the third section of this thesis. This tripartite approach has produced a study which analyzes the theoretical foundations of waqf in Twelver Shiism as well as the practices of waqf in Shiite Islam. This research is a step on the way to understanding the specificity of Shiite waqf within a geographical and historical context which has established the basis for contemporary Shiite jurisprudence on waqf up until today

Les analyses politiques et médiatiques dominants réduisent souvent le chiisme dans le champ sociopolitique bahreïni aux projets politiques dominants en Iran, en Iraq, et au Liban, qui projettent le renforcement de leur pouvoir religieux et politique. Or, les chiites de Bahreïn sont souvent assimilés à des adeptes des politiques menées par les clercs influents outre le pays insulaire. Ils sont considérés comme des instruments de l’hégémonie des acteurs chiites. Ces grilles de lecture ne représentent qu’une approche réductrice et partielle du champ chiite. Certes, le chiisme bahreïni est influencé par les acteurs et les politiques régionales et transnationales, mais l’analyse de ses fondements et de son évolution démontre qu’il est spécifique à son contexte local. Le champ chiite local est façonné par des interactions sociopolitiques diverses, tels que des processus de socialisation politique, la transnationalisation, la pratique des rites particuliers, l’organisation des institutions, les relations avec l’Etat, etc. A l’époque contemporaine, les acteurs chiites bahreïnis sont influencés par des théories et des projets qui émanent de la sphère transnationale, cependant ils développent des projets sociopolitiques distincts. Dans ce contexte spécifique du Bahreïn, l’Etat même dominant, ne peut pas contrôler ses acteurs et leurs projets sociopolitiques, qu’ils soient transnationaux ou nationaux<br>Shiism in Bahrain is a complicated socio-political phenomenon. Dominant political and media analysis consider shi’ism in the Bahraini context as a simplest extension of dominant political projects in Iran, Iraq, and in Lebanon.However, Bahraini shi’a are frequently assimilated to unconditional followers of influential non-Bahrainis clerics and their politics. In that framework, shi’a in Bahrain are considered as instruments of the shi’a actors’ hegemony. Those methods of interpretation appear superficial.Certainly, as we noted above, regional and transnational actors and politics affect the shiism in Bahrain, but the examination of its basis and its evolution demonstrate that it’s specific to the local schema. Various socio-political interactions shapes the local political sphere; such as political socialization processes,transnationalization, rites’ practicing, institutions’ organization's, relations avec the State, etc. In the contemporary period Bahrainis shi’a actors are indeed influenced by the theories and the projects stems from the transnational sphere, however, they develops their own and distinct socio-political projects. In this specific context, the State, even dominant, control neither these actors, nor their projects whether they are transnational or nationals
