Abstract:
Studie se zabývá útvarem federálního ministerstva vnitra (FMV), který měl v 70. a 80. letech 20. století na starosti kontrolu zahraničního tisku, oficiálně objednávaného z ciziny československým státem nebo individuálně importovaného jeho občanům. Zahraniční tisk a šíření informací v něm obsažených představovaly pro vládnoucí Komunistickou stranu Československa (KSČ) potenciální riziko, a proto podléhal poměrně přísné kontrole. V rámci Státní bezpečnosti (StB) dohlížel nad tiskovinami směřujícími do země tzv. odbor zahraničního tisku (OZT). Jeho zaměstnanci pracovali mj. v utajení na poštách, kde prověřovali balíčky se zahraničními časopisy a knihami a závadné tituly vyřazovali z oběhu. Podíleli se tak na cenzuře a usměrňování toku informací, aby byl v souladu s představami vládnoucí KSČ. Studie se zaměřuje na mechanismy, na kterých stálo fungování tohoto odboru. Zároveň sleduje i personální složení OZT a s ním i sociální profil těch, kteří se podíleli na jeho chodu.

Abstract:
Artykuł stanowi krytykę książki Gunnara S. Paulssona Secret City: The Hidden Jews of Warsaw, 1940–1945. Autorka po wnikliwej analizie danych i obliczeń zawartych w książce zarzuca Paulssonowi błędny w obliczeniach co do: (1) liczby Żydów, którzy przetrwali po aryjskiej stronie Warszawy do wybuchu powstania warszawskiego; (2) całkowitej liczby Żydów, którzy spędzili wojnę w ukryciu po stronie aryjskiej, i tych spośród nich, którzy przetrwali lata Zagłady; oraz (3) (ogromnej!) liczby Polaków, którzy pomagali Żydom w okupowanej Warszawie. Obliczenia, prowadzone według błędnych złożeń statystycznych i metodologicznych, prowadzą do wątpliwych wniosków historycznych i należy je odrzucić. Paulsson wykorzystuje źródła w sposób wybiórczy cytując fragmenty, które potwierdzają jego szacunki liczbowe, jednocześnie lekceważąc całą resztę. W wieli miejscach obarcza Żydów winą za ich własną tragedię. Wykazał rażącym braku znajomości zarówno dostępnych źródeł, jak i ówczesnych realiów. Autorka ocenia wkład Paulssona w debatę nad liczbą ukrywających się Żydów jako pozbawiony wartości, a nawet szkodliwy, gdyż przywołuje język pozornie stałych danych.

Abstract:
U radu se raspravlja o tome je li svako neplaćanje poreza porezna utaja, tj. utaja poreza, te je li svaka utaja poreza kazneno djelo. S tim u vezi željelo se dodatno istražiti je li poslovanje preko tzv. poreznih oaza, zakonita ili nezakonita aktivnost, odnosno porezna evazija, tj. može li se u tim slučajevima uopće govoriti o poreznoj evaziji. Postavlja se i dodatno pitanje, ako se utvrdi da poslovanje preko poreznih oaza, tj. utočišta, jest porezna evazija, je li u tim slučajevima riječ o kaznenom djelu utaje poreza. U tom su kontekstu postavljene dvije hipoteze. H1: svaka porezna evazija veća od 20.000,00 kuna kazneno je djelo utaje poreza. H2: poslovanje preko poreznih utočišta nezakonito je i označuje kazneno djelo utaje poreza.

Nazywam ją „strategią marańską”, budując analogięmiędzy sytuacją conversos, którzy zostali zmuszeni do przyjęcia chrześcijaństwa, przechowującprzy tym judaizm „utajony”, a filozoficzną interwencją nowoczesnych myślicieli żydowskich,którzy wkroczyli w idiom zachodniej filozofii, jednocześnie nasycając go motywami wywiedzionymiz ich „partykularnego” kontekstu: nie po to jednak, by podważyć perspektywęuniwersalistyczną, lecz po to, by ją przekształcić. Dla Waltera Benjamina i Jacques’a Derridywłaściwy uniwersalizm okazuje się równoznaczny z „zadaniem tłumacza”: projektem sklejaniarozbitej całości od środka, horyzontalnie, przez wysiłek wielojęzyczności, czyli bez przyjmowaniawyniosłej pozycji ogólnego metajęzyka, który mógłby uzurpować pozycję hegemona.

V této práci je autorova pozornost zaměřena na překážky a problémy, se kterými se musí setkávat projektové týmy při své práci pro (název utajen). Motivem k sepsání této práce byla možnost otevřít některá témata, která dosud nebyla diskutována, ale především představit problémy o jejichž existenci řadoví pracovníci i management již nějaký čas vědí v jiném světle a to pomocí analýzy kauzalit. K tomu byl využit teoretický aparát Teorie omezení, který zahrnuje především nástroje Strom současné reality, Konfliktní strom a Strom budoucí reality. Postupně byly během analýzy odhaleny klíčové problémy a úzká místa a nastíněno směřování řešení pro některé z problémů.

Abstract:
The aim of this diploma paper is to analyse and define the nature of secret exercise of public authority and to asses this phenomena in respect of the fundamental principles of the democratic rule of law. Any secrecy in exercising public authority is in fact a clear contradiction to a natural concept of the human rights and fundamental freedoms. Therefore the republic, as a public institution, should not have too many secrets to hide away from the people if its own principles are not to be completely disgraced. Secrecy in exercising public authority is a specific feature often related to the areas such as securing the sovereignity and territorial integrity of the Czech Republic, protecting its democratic foundations, protection of the lives and health of the population as well as the right to own the property. This is in full accordance with the constitutional duty of the state. Limited access to the information has a unique and 84 inevitable role in these areas and it is clearly mentioned in the Charter of Fundamental Rights and Freedoms, the European Convention of Human Rights and Freedoms and the International Covenant on Civil and Political Rights. This thesis deals with six texts by two of the best-known contemporary American novelists, namely Paul Auster and Thomas Pynchon. The thesis analyzes three most recent novels by each writer: Invisible, Sunset Park and 4 3 2 1 by Paul Auster and Against the Day, Inherent Vice and Bleeding Edge by Thomas Pynchon. All six novels explore various modes of authenticity - a notion which in each author's work adopts specific mechanisms of establishing ways of existing within the world that are directed towards a critique of the forms of society that try to limit individuals, confine them to prescribed objective categories. Chapters I to IV establish one by one the primary approaches to understanding how authenticity works within individual novels. First two chapters explore Paul Auster's works, and emphasize their portrayal of change as an organizing leitmotif. Chapters III and IV deal with selected works by Thomas Pynchon and analyze their use of entropy and information overload within individual narratives. The final chapter then combines all these notions and provides a comparative analysis and a critical interpretation of all six works against a theoretical and critical framework. R I G H T T O R E S P E C T F O R P R I V A T E A N D F A M I L Y L I F E I N T H E C A S E - L A W O F T H E E U R O P E A N C O U R T O F H U M A N R I G H T S Abstract The aim of the thesis is to explain wording and application of the Article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms (the Convention) from the perspective of the European Court of Human Rights (the ECHR). The scope of Article 8, which guarantees the right to respect for private and family life, is very broad. For this reason the thesis especially deals with the issue of the right of the child to know his/her origin and information about his/her early childhood. In particular it attempts to outline the way how the ECHR deals with the conflict of the right to know one's origin with the right of the parent to stay anonymous. The thesis is divided into five chapters which illustrate the particular aspects of the application of Article 8. These chapters are linked through the judgements Gaskin, Mikulić, Odiévre, Jäggi and Phinirikadou which are related to the right of the child to know his/her origin. This thesis is concerned with the legislature of the Czech Republic, Bundesrepublik Deutschland and the Republic of France, as regards the anonymous abandonment of children in babyboxes, anonymous births and births with the identity of the mo- ther classified. It presents a complex overview of the legal framework in which the above mentioned institutions are functioning, from the point of view of the current legislation and factual state of affairs, set in the background of historical evolution of the individual institutes in individual states. The first chapter of the thesis de- als with the terminology, which in these questions is often somewhat confused and confusing, due to laymen influences and translations between languages. The se- cond chapter presents the current legal framework of the individual states, together with the umbrella framework of the international Agreements which are binding to all three of the countries. The third chapter deals with babyboxes, describing their functioning in Germany and in the Czech Republic. In the theoretical part the student aims to map the situation of leaving children anonymously in the Czech Republic in comparison with selected countries in Europe, the history of this phenomenon, the current situation and possible insights into the future. Anonymous leaving of children is studied from several perspectives, in terms of legal, psychological, medical and mainly social point of view. In the empirical part the method of inquiry, namely the interview technique is used. For this purpose experts on the specific areas were interviewed - lawyers, psychologists, doctors and social workers. Abstract:
This thesis focuses on organized crime that has recently become one of the most serious global problems threatening the stability, security and development of civil society. At the beginning of the thesis, its author defines a basic term ,,organized crime" and its relation to the organized criminality. Then the author deals with the history of organized crime groups, describes the most important of the groups, and concentrates on new forms of organized crime. Furthermore, the author lists Czech and international substantive and procedural legal regulations with regard to the organized crime. Finally, the author discusses other non-legal means of the fight against the organized crime. The main part of the thesis is devoted to the methodology of investigation with a focus on specific initiatives and the subject of investigation, initial and subsequent acts, and the specific versions of investigation, planning, organization of investigation, and prevention. In greater detail, the thesis deals with methods of witnesses hearing, and especially with the legal concept of a secret witness, and protection provided to witnesses by special law, and the concept of a cooperating accused person. The thesis also analyzes operative and investigative means and other means of investigation.
