V této práci je autorova pozornost zaměřena na překážky a problémy, se kterými se musí setkávat projektové týmy při své práci pro (název utajen). Motivem k sepsání této práce byla možnost otevřít některá témata, která dosud nebyla diskutována, ale především představit problémy o jejichž existenci řadoví pracovníci i management již nějaký čas vědí v jiném světle a to pomocí analýzy kauzalit. K tomu byl využit teoretický aparát Teorie omezení, který zahrnuje především nástroje Strom současné reality, Konfliktní strom a Strom budoucí reality. Postupně byly během analýzy odhaleny klíčové problémy a úzká místa a nastíněno směřování řešení pro některé z problémů.

The aim of this diploma paper is to analyse and define the nature of secret exercise of public authority and to asses this phenomena in respect of the fundamental principles of the democratic rule of law. Any secrecy in exercising public authority is in fact a clear contradiction to a natural concept of the human rights and fundamental freedoms. Therefore the republic, as a public institution, should not have too many secrets to hide away from the people if its own principles are not to be completely disgraced. Secrecy in exercising public authority is a specific feature often related to the areas such as securing the sovereignity and territorial integrity of the Czech Republic, protecting its democratic foundations, protection of the lives and health of the population as well as the right to own the property. This is in full accordance with the constitutional duty of the state. Limited access to the information has a unique and 84 inevitable role in these areas and it is clearly mentioned in the Charter of Fundamental Rights and Freedoms, the European Convention of Human Rights and Freedoms and the International Covenant on Civil and Political Rights. This thesis deals with six texts by two of the best-known contemporary American novelists, namely Paul Auster and Thomas Pynchon. The thesis analyzes three most recent novels by each writer: Invisible, Sunset Park and 4 3 2 1 by Paul Auster and Against the Day, Inherent Vice and Bleeding Edge by Thomas Pynchon. All six novels explore various modes of authenticity - a notion which in each author's work adopts specific mechanisms of establishing ways of existing within the world that are directed towards a critique of the forms of society that try to limit individuals, confine them to prescribed objective categories. Chapters I to IV establish one by one the primary approaches to understanding how authenticity works within individual novels. First two chapters explore Paul Auster's works, and emphasize their portrayal of change as an organizing leitmotif. Chapters III and IV deal with selected works by Thomas Pynchon and analyze their use of entropy and information overload within individual narratives. The final chapter then combines all these notions and provides a comparative analysis and a critical interpretation of all six works against a theoretical and critical framework. The scope of Article 8, which guarantees the right to respect for private and family life, is very broad. For this reason the thesis especially deals with the issue of the right of the child to know his/her origin and information about his/her early childhood. In particular it attempts to outline the way how the ECHR deals with the conflict of the right to know one's origin with the right of the parent to stay anonymous. The thesis is divided into five chapters which illustrate the particular aspects of the application of Article 8. This thesis is concerned with the legislature of the Czech Republic, Bundesrepublik Deutschland and the Republic of France, as regards the anonymous abandonment of children in babyboxes, anonymous births and births with the identity of the mo- ther classified. It presents a complex overview of the legal framework in which the above mentioned institutions are functioning, from the point of view of the current legislation and factual state of affairs, set in the background of historical evolution of the individual institutes in individual states. The first chapter of the thesis de- als with the terminology, which in these questions is often somewhat confused and confusing, due to laymen influences and translations between languages. The se- cond chapter presents the current legal framework of the individual states, together with the umbrella framework of the international Agreements which are binding to all three of the countries. In the theoretical part the student aims to map the situation of leaving children anonymously in the Czech Republic in comparison with selected countries in Europe, the history of this phenomenon, the current situation and possible insights into the future. Anonymous leaving of children is studied from several perspectives, in terms of legal, psychological, medical and mainly social point of view. In the empirical part the method of inquiry, namely the interview technique is used. This thesis focuses on organized crime that has recently become one of the most serious global problems threatening the stability, security and development of civil society. At the beginning of the thesis, its author defines a basic term ,,organized crime" and its relation to the organized criminality. Then the author deals with the history of organized crime groups, describes the most important of the groups, and concentrates on new forms of organized crime. Furthermore, the author lists Czech and international substantive and procedural legal regulations with regard to the organized crime. Finally, the author discusses other non-legal means of the fight against the organized crime. The main part of the thesis is devoted to the methodology of investigation with a focus on specific initiatives and the subject of investigation, initial and subsequent acts, and the specific versions of investigation, planning, organization of investigation, and prevention. In greater detail, the thesis deals with methods of witnesses hearing, and especially with the legal concept of a secret witness, and protection provided to witnesses by special law, and the concept of a cooperating accused person. Filozofická fakulta Univerzity Karlovy v Praze DISSERTATION ABSTRACT Daniela Theinová LIMITS AND LANGUAGES in Contemporary Irish Women's Poetry "Irish poetry" is an inherently equivocal concept characterized by two fissures, one linguistic (Irish-English; standard English-Hiberno English) and the other chronological (oral-written; Old Irish-modern Irish). Central to my project is to show how this bifurcate cultural identity, prominent in Irish literature due to Ireland's history and the politicized concept of "national language," figures in poetry by Irish women of the last forty years. While I account for the significance of the hyphen in Anglo-Irish as well as in Gaelic-Irish poets, contradictory tensions are traced not only across and along the linguistic divide. In attending to the shift from feminism (Eavan Boland, Eiléan Ní Chuilleanáin, Paula Meehan, Medbh McGuckian, and Nuala Ní Dhomhnaill) to post-feminism in Irish poetry (Biddy Jenkinson, Vona Groarke, Caitríona O'Reilly, and Aifric Mac Aodha), I illustrate the role that the border between English and Irish has played in these processes. Establishing parentage The subject of this master thesis is the issue of establishing parentage. The thesis targets areas of establishing parenthood, issues of three legal presumptions and last but not least, parenthood denial. The question of establishing maternity is examined mainly from perspectives including surrogate maternity, assisted reproduction method and secret and anonymous delivery. All matters are reviewed based on the valid amendment to Act No. 89/2012 Coll., the Civil Code that has come into effect on 1.1.2014. The goal of the thesis is it to introduce, describe and analyze the new amendment to the Family Act. Further, it aims to compare individual institutions with respect to changes made to the Family Act in the past and those made as a part of the new amendment. Abstract, Keywords The thesis concerns itself with the analysis of Czech legislation currently in effect with respect to the right to know one's origin. Discussed are the contents of this right, the legislation's addressees, Article 7 of the Convention on the Rights of the Child including the reservations to it made by the Czech Republic. The affected Czech regulations and their reforms are also talked about. Attention is also given to the issue of determining one's parentage. The bulk of the thesis is made up of analyzing the issues of assisted reproduction, surrogacy, adoption, anonymized and confidential childbirths, and baby boxes in regard to protecting the right to know one's origin. The thesis aims to critically evaluate current legislation, point out its shortcomings and suggest possible future development as the right to know one's origin isn't currently being given enough attention. Some of the aforementioned institutes aren't set out in law at all, others give preference to the anonymity of the child's biological parents.
