Abstract The long-standing dispute between Spain and the United Kingdom over the British overseas territory of Gibraltar was characterized in 2012 by repeated Spanish incursions into Gibraltar’s territorial sea. Spain claims these waters as Spanish historic waters that were never ceded to Great Britain under the Treaty of Utrecht 1713, and therefore insists that Gibraltar has no territorial sea. The United Kingdom maintains that Gibraltar’s entitlement to a territorial sea is in keeping with international law. Although the terms of the Treaty of Utrecht are open to interpretation, the Spanish position does not appear to be compatible with the law of the sea.

Abstract:
The problem of the Spanish Succession kept the European diplomatic system in suspense from 1659 until 1713. Statesmen and diplomats tackled the question. Their practical vision of the law was a necessary complement to legal doctrine. Louis XIV and Emperor Leopold I used incompatible and absolute claims, which originated in private law and Spanish succession law. At the Peace of Utrecht, these arguments completely dissolved. The War of the Spanish Succession thus not only redesigned the political map of Europe: It altered the norm hierarchy in public law, strengthening international law as the framework of the 'Société des Princes'.

Abstract The case of William Law, a Cambridge fellow and high–profile Jacobite, illustrates the character of Jacobitism in the universities and opposition to it at the time of the Utrecht treaty negotiations. This article outlines Law's political beliefs and university career, and suggests that, although Law was disciplined for his vocal Jacobitism, he was not politically isolated, but had support from others with influence in the university. Law's decision to refuse the oaths of allegiance and abjuration in 1715 set him apart from other tories in the university, not because of political ideology or dynastic allegiance, but because of conscience.

Acadia from its initial settlement in 1604 until 1713 was a part of the French colonial empire in North America. By the Treaty of Utrecht most of Acadia and its French population was ceded to the British. The political instability generated by the anomalous position of the Acadians eventually led to their expulsion in 1755. During the following 50 years their efforts at repatriation were thwarted and only toward the end of the period were they finally settled in places offering a measure of security. The trends of their migrations over the period are illustrated, as well as their final settlement pattern in 1800.

AbstractThe title of prince of the Holy Roman Empire was conferred in 1704 upon all the children heirs and lawful descendants, male and female, of John Churchill, the first duke of Marlborough. The title of prince of Mindelheim was granted in 1705 to all male descendants and daughters of the first duke. But following the Treaty of Utrecht in 1713 and the Treaty of Rastatt in 1714 the principality passed to Bavaria. The right of the dukes of Marlborough to use the style and title was thus lost, and any residual rights would have expired in 1722 on the death of the duke, as they could not pass to a daughter (unlike his British titles). Despite this it is still common practice to describe the Duke of Marlborough as a Prince of the Holy Roman Empire and Prince of Mindelheim. This paper considers the differences in the treatment of the descent of the British and imperial titles.

AbstractThe historical Anglo-Spanish dispute over the waters of Gibraltar is based on two separate and specific territorial disputes: one related to the conventional cession of Gibraltar by Spain in the Treaty of Utrecht of 1713 and the other related to the British occupation of the Isthmus. The Spanish government has used the cession in Article 10 of that Treaty as the legal basis in both cases, merely stating that it does not recognise British jurisdiction over any waters other than those expressly ceded by it. Ever since the Tripartite Forum of Dialogue on Gibraltar was created in 2004 by a soft law agreement among the governments of Spain, the United Kingdom and Gibraltar as a separate framework from the Brussels Process on Anglo-Spanish sovereignty claims, we believe that this Forum has become an appropriate institutional framework for addressing issues of practical cooperation related to the disputed waters as well, establishing safeguard clauses related to sovereignty issues.

Esta Dissertação de Mestrado em Diplomacia e Relações Internacionais visa analisar a questão de Gibraltar nas relações diplomáticas entre o Reino Unido e a Espanha, uma temática que é atual e que tem envolvido a diplomacia entre os dois Estados e também a diplomacia europeia na questão do Brexit relativo a Gibraltar. Procura, igualmente, traçar os cenários de futuro do rochedo numa conjuntura em que o modelo «two flags, three voices» não colhe consenso. Neste sentido, o trabalho está dividido em três capítulos. Na primeira parte é feita uma contextualização histórica sobre Gibraltar com especial enfoque no Tratado de Utrecht de 1713 e nos outros tratados celebrados entre o Reino Unido e a Espanha sobre a questão de Gibraltar. A segunda parte visa fazer uma descrição sobre a situação atual de Gibraltar, a sua posição nas organizações internacionais (União Europeia e na Organização das Nações Unidas) e também as posições que a Espanha e o Reino Unido têm tido em relação a aspetos que se prendem com Gibraltar. Por fim, na terceira parte desta Dissertação é traçada uma análise referente ao futuro de Gibraltar, tanto no que concerne ao exercício de soberania como à questão que se prende com o Brexit, pois esse assunto terá impacto político, económico e social em Gibraltar
This Master´s Dissertation in Diplomacy and International Relations aims to analyse the issue of Gibraltar in the diplomatic relations between United Kingdom and Spain, a theme that is current and that has involved the diplomacy between these two states, including the European diplomacy in the issue of Brexit related to Gibraltar. It also seeks to outline the rock's future scenarios in an environment in which the “two flags, three voices” model does not reach consensus. In this sense, the work is divided into three chapters. In the first part, it´s going to be made an historical contextualization of Gibraltar, with special focus on the Treaty of Utrecht of 1713 and on the other treaties celebrated between the United Kingdom and Spain on the question of Gibraltar. The second part aims to describe the current situation of Gibraltar, its position in international organizations (European Union and the United Nations) and also the positions that Spain and the United Kingdom have had in the aspects related with Gibraltar. Finally, the third part of this Dissertation, an analysis regarding the future of Gibraltar is outlined, both with regard to the exercise of sovereignty and the issue related to Brexit, as this issue will have a political, economical and social impact in Gibraltar.
