Abstract:
This chapter provides a comprehensive overview of the value of a Senate seat and a general assessment of the value that a Senate seat added to a state during this era of federalism. It argues that from a purely distributive standpoint, the value of a Senate seat was not high, but for political parties and business interests, the stakes were enormous for the maintenance of political organizations and control over local politics as well as the direction of national policies that affected state and local business interests. The chapter presents case studies from Pennsylvania and Rhode Island to illustrate the desire to use a Senate seat to consolidate state political control and reap the associated economic benefits. It also includes cases from Nevada and Wisconsin to demonstrate the role of national party policies in the dynamics of state-based Senate campaigns.

This chapter discusses the notion of action-minimizing orbits. In particular, it defines the other two families of invariant sets, the so-called Aubry and Mañé sets. It explains their main dynamical and symplectic properties, comparing them with the results obtained in the preceding chapter for the Mather sets. The relation between these new invariant sets and the Mather sets is described. As a by-product, the chapter introduces the Mañé's potential, Peierls' barrier, and Mañé's critical value. It discusses their properties thoroughly. In particular, it highlights how this critical value is related to the minimal average action and describes these new concepts in the case of the simple pendulum.

Abstract:
This chapter examines the ‘role’ or ‘value’ of the persistent objector rule. Firstly, the chapter sets out and critiques the voluntarist conception of the persistent objector rule in more detail than has been done in previous chapters. It then considers competing theoretical approaches to international legal obligation, broadly grouped together as being ‘communitarian’ in nature. Such communitarian approaches have tended to dismiss the persistent objector rule along with their dismissal of voluntarism. It is argued that holistic, absolutist theoretical accounts of customary international law fail to take into account its chaotic nature in reality. The chapter therefore argues this it is problematic to appraise the value of the persistent objector rule from the perspective of either voluntarism or communitarianism. Drawing upon some insights from rational choice theory, it is argued that the rule is inherently one of balance, and that its true value lies in its practical benefits both for individual objectors and the wider international community. The chapter then assesses the rule's various functional benefits as a ‘safety valve’. The chapter also examines the contributions that persistent objection can make to the development of customary international law. At the end of the chapter, the text briefly notes that many of the benefits of the persistent objector rule may, at least in part, stem from the perception of state autonomy that it creates.

There appear to be three main sets of issues that arise upon a focus on animal value: the moral standing or moral considerability of animals, the value of animal life, and the argument from marginal cases (or unfortunate humans). But these issues all arise, and in various ways, in the confines of a larger argument concerned with human benefit that proponents of animal use accept to justify animal experimentation in medicine and that opponents of animal use reject to scuttle that attempted justification. In fact, these main sets of issues are all interconnected, and the ultimate issue in dispute in this general area will turn out to be the comparative value of human and animal life.

This article investigates the tradition of case-oriented configurational research, focusing specifically on qualitative comparative analysis (QCA) as a tool for causal inference. It first presents two analytic procedures commonly used by comparative researchers. A short description of the state-of-the-art of QCA applications is offered, in terms of discipline, types of cases, models, combinations with other methods, and software development. It then reviews different uses of QCA, as well as generic ‘best practices’. Some key recent evolutions are illustrated: on the one hand the development, beyond dichotomous ‘crisp set’ QCA (csQCA), of multi-value QCA (mvQCA), fuzzy sets, and fuzzy-set QCA (fsQCA), and on the other hand technical advances and refinements in the use of the techniques. Finally, the article gives some concluding reflections as to expected developments, upcoming innovations, remaining challenges, expansion of fields of application, and cross-fertilization with other approaches.

In order to explain this, consider a bank which owns 100 of shares in A, but also has a derivative in place with X under which it is entitled to be paid the value of 100 shares in A. Both positions give rise to the same risk as to the future price of A, and both will be valued by reference to the value of the shares in A. However, if the value of the shares in A increases, the bank's credit exposure to X will increase. The rules set out in this chapter seek to capture this extra level of risk by treating the value of the derivative as being slightly higher than its mark to market value; thereby requiring a slightly higher level of capital to be held against it. This is the counterparty credit risk requirement (CCR).

This chapter presents a distinct account of neutrality in which the acceptability or justice of policies or public actions can only be established ‘holistically’, requiring an all-things-considered assessment in which the neutrality of those policies is never by itself definitive. Instead, neutrality is a definitive constraint only on the justification of principles/theories of justice. The chapter sets out a proper understanding of the value behind neutrality, defending this value from autonomy-based objections to neutrality. It then uses that account to show how the value engages with policies and public actions. The chapter also responds critically to views that see neutrality as a standard to be established separately to theories of justice. Finally, it argues that the value of neutrality with its proper scope and object in place can explain how to address cases of claimed exemption on the basis of burdens of conscience by people with ‘deeply’ held convictions.

Underlying the management of revenues from natural resource extraction is a set of assumptions about how abundant and how valuable these resources are. Nevertheless, existing approaches to measuring the value of extractive resources are seriously flawed. This paper proposes two avenues for improving them. It explains how a multidimensional approach to measuring resource wealth can be used to identify the policy challenges that a country might face as it sets out its strategy for managing extractive revenues. It also provides a rethinking of the valuation of extractive wealth by integrating environmental considerations. Extractive activities can at times incur a great loss of (renewable) opportunity income, either directly or indirectly, because of their environmental impact. By analysing a range of examples from across the globe, this paper extracts key lessons on the true value of extractives and why it matters for policy makers, civil society, and international donors today.

This contribution discusses the forcible intervention by NATO against Serbia in 1999 in response to the situation in Kosovo. It sets out the facts and background of the crisis, along with the legal positions of the main protagonists and the reactions of the international community. It then proceeds to survey the debates surrounding the legality of the intervention and to assess the soundness of the legal justifications put forward by states and authors. Finally, it discusses the precedential value of the intervention, especially in view of claims of the existence or emergence of a rule or principle of international law permitting the unilateral use of force in response to humanitarian crises. The contribution concludes that the NATO intervention has significant precedential value in that it confirms the unlawfulness of forcible unilateral humanitarian intervention.
