Abstract:
This article examines the problems surrounding the application of customary law in the formal courts of Solomon Islands. Commencing with a brief explanation of the status of customary law, it considers the vexed question of proof, in the context of decided cases. It also analyses three Solomon Islands Acts relevant to proving customary law: the Wills, Probate and Administration Act 1987, the Solomon Islands National Provident Fund Act 1973 and the Customs Recognition Act 2000. The article then considers the future of customary law in the formal courts of Solomon Islands.

Abstract:
Objective: To describe a method for the rapid appraisal of new interventional procedures and to compare its conclusions with those derived from a slower, more thorough method. Methods: Explanation of an algorithm, pragmatically developed over a decade at the British United Provident Association (BUPA), to classify requests for funding for new interventional procedures as 'Fund routinely'; 'Fund as a one-off'; 'Fund in trial only'; 'Do not fund currently' within about 48 hours. Comparison of the resulting categorizations of 39 interventional procedures against the subsequent work of the English National Institute for Health and Clinical Excellence (NICE) Interventional Procedures team. The first two BUPA categories were equated with NICE's 'evidence adequate' and the second two with 'evidence inadequate'. Results: The algorithm is fit for purpose. It facilitated 114 requests for funding, received before June 2005, being successfully allocated: fund routinely, 33 (28.9%); fund as a one-off, 20 (17.5%); fund in trial only, 37 (32.5%); do not fund, 24 (21.1%). NICE subsequently categorized 18 being 'evidence adequate' and 21 'evidence inadequate'. There was concordance between BUPA and NICE on 35/39 (90%) of the topics. The four discrepancies are discussed. Conclusion: Rapid appraisal of new interventional procedures using the BUPA algorithm is feasible and in most instances its output is similar to that obtained from a slower more thorough method.

Abstract:
National defined contribution pension systems have long been a mainstay of retirement income in Asia. One of the oldest and best known of these systems is the Singaporean Central Provident Fund, a mandatory retirement scheme managed by the central government for almost a half-century. With required contribution rates that have ranged up to 50%, this program has powerfully shaped asset accumulation patterns and housing portfolios. This paper explores how the structure and design of the Singaporean retirement and housing schemes influence wealth levels and asset mix at retirement. Our model indicates that outcomes rest critically on the interlinked national retirement and housing programs. We show that policies to enhance one program may boost retirement replacement rates but can also lower total wealth in unexpected ways. The lessons we draw may serve as guidance for other countries constructing a national defined contribution retirement system.

<p>In accordance to Act No 24 Year 2011 on The Social Security Administrating Body, the Indonesian National Social Security program is managed by two national organizations, namely: Social Security Administering Body for Health (<em>Badan Penyelenggara Jaminan Sosial Kesehatan = BPJS Kesehatan</em>) and Social Security Administering Body for Labor (<em>Badan Penyelenggara Jaminan Sosial Ketenagakerjaan = BPJS Ketenagakerjaan</em>). The former is responsible for providing health coverage for all Indonesians through the National Social Health Insurance Scheme known as the Jaminan Kesehatan Nasional/JKN. The latter is responsible for providing the worker's social security consisting of Provident Fund Benefit, Accident Benefit, Pension Benefit, and Death Benefit.<sup>1</sup></p>The Indonesian government has been continuously improving the health service program towards better national universal health coverage and has set the 2019 functional achievement target of 95% of the population enrolled in the program. To ensure that this target of the program will be achieved, the government pays the premium of <em>BPJS Kesehatan</em> of the poor and near poor.<sup>2</sup>

Abstract:
In this case note the judgment in the Smith case is criticized for being inconsistent with the landmark ruling in Volks. It is argued that the Adjudicator ought to have remanded the matter in Smith to the Board and ought to have ordered it to re-examine its discretion with a focus on a set of factors. Some of the negative effects of Smith on the pension funds industry are also outlined. While the authors express their understanding that the Adjudicator's decision in Smith was made with the rights of women in mind, they believe that her reasoning was wrong. She may have arrived at the same decision on different reasoning. In order to prevent the negative effects of Smith on the pension funds industry, it is recommended that the Adjudicator, when given an opportunity, should overrule the precedent set in Smith. Failure to do so would create the risk of the inconsistent application of the term "spouse" under South African law, or at the very least in relation to acts of Parliament administered by the National Treasury, which may potentially violate the equality provisions of the Constitution.

Abstract:
The study of current practices in the legal regulation of social and labour relations in the BRICS countries indicates the need to ensure equal treatment of migrant workers with national workers. Discriminatory barriers to migrant workers accessing social security systems contained in the legislation of receiving countries (the legal status of the migrant, duration of stay and other). The legislation of the country of origin of migrant workers also excludes them from the social security systems. Foreign nationals, residing temporarily in Russia, are subject to compulsory pension insurance. The payment of insurance contributions allows establishing a certain amount of pension rights. However, they often do not acquire the right to insurance, since the insurance pension is granted only to foreign nationals permanently resident in Russia. Basic old-age insurance, basic medical insurance, work injury insurance, unemployment insurance, and maternity insurance extend to foreigners legally working in China. In Brazil, foreign workers are insured under the General Social Security Regime. However, it establishes progressive premium rates. In India, international employees are required to be registered as members of the Employees’ Provident Fund and to contribute to it. Foreign nationals, who have entered South Africa to work under a contract of employment and who have been forced to leave the Republic, are not covered by the social security. It is therefore essential to design and implement policies that will strengthen the sustainability of the social security system and eliminate discriminatory norms between labor migrants and national workers.
