Abstract:
ABSTRACTCommentators have concluded that frequent reference in Veritatis splendor to Gaudium et spes demonstrates a continuity of thought with the pastoral constitution, characteristic of a reiterative model of the use of prior magisterial teaching, one continuous teaching applied to additional issues. Recent centuries have shown that the encyclical teachings are often a vehicle for papal reinterpretation or recontextualization of previous teachings. This paper contends that the use of Gaudium et spes in Veritatis splendor follows this second model. The study demonstrates: first, that the theological anthropology of Gaudium et spes is recast in a dualist, individualist concept in Veritatis splendor, and second, that Veritatis splendor has re-contextualized quotations from Gaudium et spes on change, conscience, human autonomy, and human anthropology into teachings on law and precept. Thirdly, reliance on selective wording from Gaudium et spes enables Veritatis splendor to transform the role of the moral theologian into that of exclusively a disseminator of magisterial teaching.

Abstract:
The encyclical Veritatis splendor represented a renewal of moral theology in the spirit of Vatican Council II. Pope St. John Paul II emphasized Gospel teaching in light of the Old Testament, reiterating the animating role of the Holy Spirit in the New Law. Properly understood, the New Law is not a code of obligations, but a dynamic life of charity made intelligible through grace and the natural law. As a primary connection between human beings and divine law, natural law inclines persons toward the good, thus providing an apprehensible link between human freedom and objective truth—enabling us to determine what is good and evil. This understanding of judgment provides a corrective for theological trends toward proportionalism and consequentialism.

Esta tese refere-se ao estudo da permanência das doutrinas morais da Igreja Católica no Pontificado de João Paulo II através do discurso das encíclicas Veritatis Splendor e Evangelium Vitae, as quais demonstram o interesse da Igreja em resgatar os valores morais tradicionais do catolicismo com o intuito de sensibilizar a população cristã, a fim de manter seus fiéis e recuperar sua identidade. Este resgate dos valores da Igreja Católica ressurge com mais intensidade no papado de João Paulo II, pois a Igreja sente-se confusa após os ideais do Concílio Vaticano II, que apesar de não ter sido colocado em prática, deixou alguns leigos, fiéis, teólogos, padres, bispos e cardeais com expectativa de mudança. No entanto, a Igreja, na figura de João Paulo II retomou seus ideais tridentinos e manteve-se inflexível nas questões morais que tanto afligem a população mundial.
This thesis mentions the study of the permanence of the Catholic Church's moral doctrines in the John Paul II's pontificate through the speech of the encyclicals Veritatis Splendor and Evangelium Vitae, which demonstrate the interest of the Church in rescuing the traditional moral values of the catolicism with intention to sensetize the christian population in order to keep its fidiciary offices and to recoup its identity.This rescue of the Catholic Church's values resurges more intensively in John Paul II's period, cause the Church's members felt confused after the ideals of II Vatican Council, even it was not practiced left some laypeople, fidiciary offices, theologians, priests, bishops and cardinals with hope of changes . However, when almost nothing happened, the Church in the John Paul II's figure reviewed its tridentinos ideals and it was remained inflexible in the moral questions that much afflict the world-wide population.

Abstract:
Three main questions give the fundamental structure for this master thesis: 1) In what way is the notion of law being perceived in the following theologians respectively; David P. Scaer, Dietrich Bonhoeffer and Wolfhart Pannenberg? 2) In what way is the notion of law being perceived in the encyclical Veritatis Splendor? 3) Which similarities and divergences can be found in the respective expositions of the notion of law?For the purpose of comparison, I have employed four questions of analysis. These are: A) What is “the law”? B) Is the law being effected, or is it working, in the world and if so - in what ways and for what purposes is it meant to serve? C) Does human beings have any capacities to understand and/or live in accordance to the law? D) Does the Gospel, perceived as the earthly life, actions, death and resurrection of Jesus Christ, effect any alteration with respect to the purpose, range, function or interpretation of the law?In order to better understand Roman-Catholic concepts of law, the treatise on law of Thomas Aquinas Summa Theologica is briefly presented. I have also analyzed and presented the encyclical Evangelium Vitae, so as to see whether it can add to the understanding of the Roman-Catholic notion of law as found in Veritatis Splendor. The Lutheran reception of Veritatis Splendor has been briefly discussed.Finally, I have compared the positions of these theologians in order to find similarities and divergences. Notable similarities are the tendency of John Paul II and David P. Scaer to view law as a unity, related to the essence of God. Each of the theologians also perceive a notion of law related to creation, expressed in terms of “natural law” and the concept of “the natural” found in Bonhoeffer. Furthermore they all have a high regard for the Decalogue, and find in it an expression of moral norms that can be said to be universal and appropriate for every human society. Notable divergences are the question of the absolute binding power of law, where Pannenberg and particularly Bonhoeffer answer in the negative whereas John Paul II answers in the affirmative. There are also apparent disagreements between the theologians in the questions of how the law relates to the Christian, and how the law relates to and functions in society.

Ce mémoire aborde la question de Puniversalisme éthique. L’auteur analyse les positions de Jürgen Habermas et de Jean-Paul II. Après avoir mis en lumière les préoccupations de Habermas, sa conception de la rationalité, et plus précisément de la rationalité pratique, ainsi que sa théorie de Pagir communicationnel sont examinées. Cette démarche est le préalable à la présentation de l’éthique de la discussion habermassienne, i.e. de la théorie discursive de la morale. La partie sur Jean-Paul II porte sur une seule œuvre : l’encyclique Veritatis Splendor. L’analyse s’attarde à la conception de la raison pratique et au concept de vérité à l’œuvre dans l’exposé de la position du Magistère sur Puniversalisme moral. Le concept de loi naturelle est également examiné dans la mesure où celle-ci est la figure catholique de Puniversalisme moral. Ce mémoire permet enfin de cerner les divergences et les convergences des deux auteurs quant à la possibilité d’une morale universaliste.

AbstractThe word “truth” features prominently in the mission statements of the International Association of Universities, the United Nations, and other post-World War II organizations. “Truth” also appears in the official mottoes of many universities: Harvard’s simple Veritus (“Truth”), National University of the South’s elegant Ardua Veritatem (“Through the difficulties to the truth”), Pontifícia Universidade Católica de Campinas’ celebratory Fide Splendet et Scientia (“May it shine with truth and knowledge”), Tianjin University’s practical (“seeking truth from facts”). Yet, “truth” is an elusive concept. This essay argues that a new history of the university and truth is required. A new history of truth will explore the idea from pluralistic perspectives, not the monolithic and all-powerful “Truth” of the twentieth century and those centuries before it.
