Abstract:
This article explores the question of the ‘recognition’ of the material effects of legacies by vindication (legatum per vindicationem), if such legacies concern the right of ownership of immovable property located in an EU Member State the law of which does not provide for such legacies to have a direct material effect, such as Germany. The authors analyse this question in the light of the first judgement issued by the Court of Justice of the European Union on the European Union Regulation No. 650/2012 on Succession and Wills, the Kubicka case (C-218/16). The article’s first part provides a brief account of legacies by damnation and legacies by vindication as they are found in the substantive succession laws of EU Member States. Subsequently, key notions arising under the EU Succession Regulation No. 650/2012 with respect to the recognition of legacies by vindication, such the general principle of unity, the registry exemption, the rights in rem exception as well as the adaption of rights in rem, are discussed. The article’s final part maps out the implication of the Kubicka judgment for the theory and practice of European Succession Law.

The inspiration for writing this article was the entry into force of the provisions introducing the institution of legacy by vindication into Polish inheritance law on 23 October 2011 under the act of 18 March 2011 amending the Civil Code and certain other acts. The aim of the research undertaken in this study is to try to locate, approximate and compare the succession institutions in force in legal systems of European countries (Italy, France, Spain and Greece) which are similar in their form to the institution of legacy with material effects (legatum per vindicationem).

'This doctoral thesis is an examination, and vindication, of a position that has been identified with the expression 'aesthetic empiricism' and typically captured by the claim that 'what is aesthetically valuable in a painting can be detected merely by looking at it - features that cannot be so detected are not properly aesthetic ones' (Currie, 1989). Such a position continues to be a focus for contemporary discussion (e.g., Davies, 2004, 2006, and Graham, 2006), yet it is far from clear precisely what it entails or even who subscribes to it. All that seems to have been agreed is that aesthetic empiricism is false, demonstrably so in the light of Walton's claims in 'Categories of Art' (1970), and Danto's work on indiscernibles (1981). The lack of theoretical clarity would suffice to motivate a closer look at aesthetic empiricism; however, the more specific target of this thesis is· to show that the received treatment is mistaken - aesthetic empiricism, once clearly identified, can be seen to be both intuitive and beguiling. It earns our philosophical consideration by providing a formidable accoiint ofthe aesthetic and also a valuable contribution to our understanding of art criticism.

Abstract:
Some philosophers dispute the claim that there is a notion of logical necessity involved in the concept of logical consequence. They are sceptical about logical necessity. They argue that a proper characterisation of logical consequence - of what follows from what - need not and should not appeal to the notion of necessity at all. Quine is the most prominent philosopher holding such a view. In this doctoral dissertation, I argue that scepticism about logical necessity is not successful. Quine's scepticism takes three forms. Firstly, he is often interpreted as undermining, in his classic paper 'Two Dogmas of Empiricism', the very intelligibility of notions such as meaning, necessity, and analyticity. If the notion of necessity is meaningless, it is clear that ascriptions of logical necessity are also meaningless. In the thesis, I defend Quine's criticism of these notions by situating it in its historical context and emphasising that the real target in those writings is not the intelligibility of these notions as such, but only their Platonistic interpretation. I agree with Quine that a good theory about meaning, necessity, or analyticity must avoid such an ontological commitment. Secondly, Quine advocates, in the same paper, a holistic picture of knowledge and claims that in this picture, ascriptions of logical necessity are superfluous. I then show that holism a la Quine is committed to admit the necessity of statements of logical consequence. Thirdly, there is Quine's substitutional account of logical consequence (as exposed in his (1970)). He contends that this theory makes no use of logical necessity, thus showing its superfluousness. I show that any plausible account of logical consequence needs to appeal to logical necessity, thus undercutting Quine's claim - and, more generally, undercutting scepticism about logical necessity.

Abstract:
Victimisation at work is a problem able to cause mental illness and the victims often search for vindication, where different regulations can be actualized. The purpose of this essay is to examine the legal framework to show the possibilities to vindication and financial compensation, for an individual exposed for victimisation. Also female-dominated professions possibilities to vindication and financial compensation are examined, especially how it will be affected by the regulation Organizational and social work environment (AFS 2015:4). The method that has been used to fulfil the purposes of the essay is the method of jurisprudence. To fulfil the second purpose the sociology of law was also applied. The result of the essay showed that the regulations hold different possibilities to vindication and financial compensation. However the individual often meet with obstacles. The result also showed that the possibilities to vindicaition and financial compensation for female-dominated professions are effected by the new regulation Organizational and social work environment. The final conclusion is thus, that the legal framework does not provide any distinct way for vindication or financial compensation for victimisation.

Abstract:
There exists a scholarly debate on the cultural impact of globalization and how and to what extent it is affecting indigenous people in particular. Three theoretical standpoints can be discerned from the debate; the homogenization-perspective which holds that globalization is making world cultures more similar, the hybridization-perspective which emphasizes that it is fragmenting cultural boundaries and the differentiation-perspective which implies that globalization is augmenting differences and making humanity as a whole more diverse. As regards the cultural impact of globalization on indigenous peoples, many question marks can be raised. The objective of this research is to contribute to the debate by bringing to light the perspective of the indigenous movement in Ecuador, CONAIE. An analysis is made on how they perceive globalization affecting the maintenance of indigenous identities and culture among today’s youth. That information is then used as a foundation to analyze CONAIE’s level of success regarding their main objective; to preserve Ecuador’s indigenous nationalities and peoples. The study, which has a qualitative ethnographic approach and is based on semi-structured interviews, was carried out during an eight weeks long field study in Quito and in San Pedro de Escaleras, Cuenca, Ecuador. The research has an abductive approach and the theoretical debate on globalization’s cultural impact on indigenous peoples sets the analytical frame of the study. The three theoretical standpoints; globalization as homogenization, globalization as differentiation and globalization as hybridization play central roles in the analysis of the empirical material. The findings show that there are many elements that obstruct the maintenance of indigenous culture and identity among youth in contemporary Ecuador. There is a connection between youth being exposed to cultural globalization and that they lose cultural characteristics for the indigenous identity. Hybridization of identities due to globalization is presented as a possible factor to play a role in this. Indigenous youth tend to drop characteristics for the indigenous identity as they adopt features from the mestizo culture, in case they see no benefit in maintaining the former. This indicates that what ultimately might be at stake is cultural homogenization. Light is also shed on that CONAIE lacks strategies and possibilities to reinforce the indigenous identity among the youth that is in a process of identity change. The findings thus point at that despite efforts for cultural revival by the indigenous movement in Ecuador, the maintenance of rigid frontiers between the ethnically diverse nationalities in the country is threatened. Seen to a larger picture, this implies that globalization’s impact on indigenous culture among youth is very difficult to counteract. It appears as if the move towards more cultural similarity in Ecuador cannot be hindered.

Abstract:
The notion, which has persisted over many years, of Mary Shelley as the conservative daughter of a radical, proto-feminist mother can be traced to the views of Edward Trelawney, a contemporary and fair-weather friend of Shelley. This study, by exploring female identity, largely in terms of modern feminist psychoanalytic theory, in several of Shelley's lesser-known novels, attempts to contribute to the efforts of those who have challenged such notions and who have strived to render a more accurate portrait of Mary Shelley.
Anne Mellor's discussion of female identity in Shelley's sentimental novels, Mathilda, Lodore and Falkner, (in her book Mary Shelley: Her Life, Her Fiction, Her Monsters) does much to dispel the notion of Shelley's apathy with regard to gender politics. Mellor convincingly argues that these novels celebrate what she terms the "relational" identity of their heroines, and thus "support a feminist position which argues that female culture is morally superior to male culture." She further maintains, however, that these novels simultaneously reveal the damage that such an identity can do to a woman's personal development.
My paper challenges Mellor's assertion that Lodore and Falkner Shelley's last novels, portray relational identity with ambivalence. (Abstract shortened by UMI.)

The thesis uses poststructuralist feminist theories in conjunction with cultural history to challenge the common feminist suspicion of Mary Wollstonecraft's Vindication of the Rights of Woman and propose instead a reading that is historically specific and sympathetic. To bring present-day theories to bear on past texts implicitly raises as an issue the question of reading the past. Part One of the thesis explicitly addresses this question. It examines debates that occurred in the lQ70s over the relationship between narrative an~ history alongside postmodernist interventions in the question of history and explores their implications for what a feminist cultural history might look like. The following~ three chapters silently but consistently allude to the questions of history raised in the opening chapter. These are: how do present-day knowledge's and theoretical projects shape the way we (re)read the past? What is the relationship between the past and the present? Where are past meanings, for example, of femininity produced? Each chapter examines how different editions of a Vindication of the Rights of Woman printed in the eighteenth and nineteenth centuries invite readers to understand what it means to be feminine, feminist and female and to show in consequence how the meaning of woman, and relatedly of a Vindication, is historically changing and perpetually in struggle. Part Two of the thesis comprises three chapters where feminist poststructuralist theories are used to reread a Vindication of the rights ~ Woman, ~ Wrongs of Woman: ~ Maria and Letters Written during ~ Short Residence in Sweden, Norway and Denmark. The readings enter into a dialogue with each other on the central question of the relationship between gender, genre and style. They are not offered as definitive interpretations. Rather, their engagement with issues of language, meaning and gender ands to and puts into process the cultural history given in Part One.

This chapter explores John Early's return to the Mountain Province. Despite his humiliating 1911 dismissal, the Igorots remembered him as their former protector. His professional experience among the Igorots included his refusal to participate with American officials in a massacre against the Kalinga people, his attempt to keep Igorots from joining the tragic European fair experiences, his defense of the Igorots' land rights, the protection of his constituents from exploitation as cargadores, his use of Igorot traditional laws as a primary guide for keeping law and order, his development of brick structures in Bontoc that could weather seasonal typhoons, and his establishment of an effective system of rural education. Given his previous advocacy of human rights for the Igorots, it is not surprising that the highlanders sought his return. Early did not know that he was being discussed as the Igorots met with the Wood–Forbes Mission. As such, he was stunned to receive a letter from Governor-General Leonard Wood. Wood initially appointed Early superintendent of Mountain Province schools, but he intended to install him as governor to reestablish American executive oversight of the Igorots.

Methodist leaders are eager to sustain, even escalate, the character assaults begun at Avery’s trial, emphasizing the stark contrast between the reputations of Cornell and Avery. Prominent Methodist ministers publish A Vindication to proclaim Avery’s innocence and, just as important, to show the church as a target of its enemies’ conspiratorial behavior. The Vindication allows Avery to present his side of the story, but his account conveys more about his faith and feelings than facts to support his defense.

Vertol Aircraft Corporation's Vectodyne concept (based on the theories of re-known aerospace engineer Dr. Alexander Lippisch and other lesser known inventors) was a tubular wing, dual contra-rotating, propeller driven aircraft design that never left the drawing board. It was created in answer to a 1956 U.S. Army request for unconventional VTOL Tactical Transport weight and performance proposals that would offer direction in the development of a new type of cargo aircraft that would potentially be deployed within the 1962-1965 timeframe. This paper will address the aerodyne origins of the Vectodyne, its strengths, weaknesses and dismissal, and finishing with the vindication flight of the propulsive technology behind its design via a single engine surveillance drone, ending with the question, "After fifty years of false starts, is the Vectodyne a viable concept with today's technology?"

Abstract:
In a color atlas, the uniformity of color spacing between reflectances is disturbed by changes in the spectral power distribution (SPD) of the illumination. Because the atlas may still be useful under different lights, we introduce a new metric of color order that is less sensitive to change of illumination. Three reflectances with labels 1, 2, 3 map to points in chromaticity space (under a particular light) that, if not collinear, are ordered either clockwise or counterclockwise. The ordering parameter P of the reflectances is –1 for clockwise ordering, +1 for counterclockwise ordering, and 0 for collinear points. The perceptual significance of P can be tested via a dichotomous color-blindness test (such as the Farnsworth D-15 test). It has been shown mathematically1 that the P of three reflectances depends on illumination only if, when the reflectances are treated formally as color-matching functions, the chromaticity space that results has a spectrum locus that is not everywhere convex. Illuminants affect P when one or more reflectances is purple—a vindication of the model because purples are known not to be color-constant. A color atlas is called statistically consistent if its first three principal components form a chromaticity space that is convex and well ordered in wavelength. The Munsell atlas is statistically consistent. Convexity of the spectrum locus also insures that no linear combination of the reflectances (or reflectance principal components) has more than two zero crossings. Implications of these theorems for color technology and robotic vision are noted.

È nostra convinzione che gli argomenti della dissoluzione del luogo contribuiscono a ideare una città che va aggiungendo architetture atopici, architetture dove si può manifestare più facilmente la spettacolarità delle sue forme, e dove la rottura spaziale della città diventa più evidente. D'altra parte, la difesa dell’anti-storicità del processo creativo architettonico, nel confronto con la città e la sua architettura in nome del progresso e del futuro, crea le forme di rottura e di disagio e dà forza ad una nuova visione puramente funzionalista. Oggi l'architettura appare come controllata d’altre aree del sapere, manifestandosi, tuttavia, esuberante nelle sue forme, in un’autonomia illusoria, e prigioniera di presupposti che le superano e svalutano. L'architettura contemporanea deve chiamare di nuovo a sé il concetto di continuità e permanenza, della prospettiva di creare nuove memorie e di contribuire alla definizione di riferimenti collettivi che possano edificare le forme della nostra storia attuale, e le forme di una città in crescita che oggi è già difficile da identificare. Siamo preoccupati, tuttavia, in un altro ordine, l'ordine che possiamo trovare attraverso esempi che mostrano una sequenza 'genomica', una struttura che stabilisca la continuità dei fatti che hanno determinato la città e che la hanno configurato in molti modi, nel corso della sua storia. In un processo dicotomico di causa ed effetto, la città contemporanea può anche vedere la sua forma descritta con la precisazione della forma dei suoi spazi pubblici (Il suo design e la sua posizione – una grammatica operativa), ma anche con il rapporto e i legami tra loro, (un ordine – una sintassi efficiente). We are convinced that the arguments surrounding the dissolution of place tend toward the materialization of a city which continues to amass atopic architectures, architectures that facilitate the spectacularism of their forms and where the spatial rupture of the city becomes more discernible. On the other hand, the vindication of the architectural creative process as anti-historical creates forms of rupture and discomfort, and empowers a new, merely functionalist, vision. Today architecture is seen as subsidiary to other branches of knowledge, and, despite its exuberant forms, it retains an illusory autonomy, confined by assumptions that surpass and depreciate it. Contemporary architecture must reclaim the notion of perpetuity and permanence, so as to create new memories and contribute to the maintenance of collective references that solidify our current history’s forms and the forms of a growing city increasingly difficult to identify. We are interested in the order that we can find by way of examples that feature a ‘genomic’ sequence, a structure capable of establishing the continuity of facts that throughout history have determined and configured the city in so many ways. By means of a dichotomous cause and effect process, we may also describe the contemporary city’s form by clarifying the form of public spaces (their design and position – an operative grammar) and the relation and articulation between public spaces (an order – an efficient syntax).

Harold F. Pitcairn, American aviation and Autogiro pioneer, died from a single gunshot wound to the head in the late evening hours of April 23, 1960 at the age of 62 after a gala evening at which he presided over a celebration attended by more than 450 guests for his brother's Raymond's 75th birthday. Initially labelled a suicide by the press, Pitcairn's widow Clara declared that "she never wanted to hear another word about the tragedy", while friends and friendly local authorities made the argument, duly reported by Frank Kingston Smith in Legacy of Wings, his devotional Pitcairn biography (subsidized by the Pitcairn family), that the death was accidental because "there was no note, no indication of depression or unhappiness" and "the police investigation disclosed that two shots had been fired; one had penetrated the ceiling directly over the desk in the first floor study, another had struck Pitcairn in the eye" and that "the next morning it was discovered the semi-automatic pistol was defective: when cocked, it had a supersensitive "hair trigger," and it had a faulty disconnector so that it would fire more than one shot at a time, a condition known as "doubling."" The Pitcairn families, prominent and powerful, prevailed upon the local authorities to declare the death accidental and Kingston Smith's 1981account became the de facto authoritative story of the death of Harold F. Pitcairn. With the perspective, however, of six decades, it appears far more likely that Pitcairn's death was a suicide for reasons that were not readily evident, minimized, unappreciated or deliberately ignored at the time to craft a result that met the needs of Clara Pitcairn and her surviving family. These included the fact that while the claim was made that Pitcairn was making his nightly rounds to check on the estate’s ground-level windows (and had been doing so since the Lindbergh kidnapping in 1932), he actually died at his desk; that those in the house only reported a single shot; the 1907 Savage pistol had no reputation for a hair-trigger, and had not evidenced such a flaw in almost three decades of Pitcairn's nightly ritual; that even though Pitcairn had been assured that his almost-decade-long lawsuit against the United States government for Patent infringement of his Autogiro patents was going well, he was concerned about the impact this lawsuit was having on his aged associates who had been called to give depositions and he had voiced the sentiment that "if he had known that he would have to sue the government, he would not have gone into the Autogiro business"; that the lawsuit, itself intended as a vindication of Pitcairn's contribution to aviation was dragging on and would reach its first legal conclusion in 1967, and not finally conclude upon appeal until 1977; and most importantly, those who deny suicide and point to Pitcairn’s state-of-mind, have failed to take into account when the death occurred or ready evidence of his 'state of mind' To fail to see the tragic end of Harold F. Pitcairn is to forget that 29 years and one day earlier, he had been recognized for "the greatest achievement in aeronautics or astronautics in America, with respect to improving the performance, efficiency, and safety of air or space vehicles, the value of which has been thoroughly demonstrated by actual use during the preceding year." The memory of that day on the White House back lawn with the President was the high point of his life even as Pitcairn prepared to celebrate his older brother's achievements. The evidence, when marshalled and documented, conclusively points to suicide - a death of an American aviation pioneer before his contributions were vindicated in the largest patent infringement judgement against the United States in history. To fail to see the tragic end of Harold F. Pitcairn is to forget that 29 years earlier, he had been recognized for "the greatest achievement in aeronautics or astronautics in America".

Abstract:
Uncertainties are inherent to the physical world, which has made them a prominent field of research. They manifest themselves in many fields of engineering, one of which is known as tolerance analysis, where engineers attempt to predict system performance affected by the tolerance through analytical models. Ordinarily, discrepancies between analytical and experimental models are overcome by calibration techniques, using experimental data. Acquiring experimental data becomes a monetary expensive endeavor, when performed on assemblies with relative large design parameters. This work presents a methodology to formulate and calibrate analytical models, using Bayesian inference and Gaussian processes. The advantage of this methodology is that it uses a single set of overall performance experimental data, with a more accurate result than conventional methods. Subsidiary to the proposed methodology is a case study, vindicating as well as illustrating its transcendence from the confining extremities delineated by the panoply of current tolerance analysis and calibration techniques.

Abstract:
This paper describes high temperature cyclic and creep relaxation testing and modelling of a high nickel-chromium material (XN40F) for application to the life prediction of superplastic forming (SPF) tools. An experimental test programme to characterise the high temperature cyclic elastic-plastic-creep behaviour of the material over a range of temperatures between 20°C and 900°C is described. The objective of the material testing is the development of a high temperature material model for cyclic analyses and life prediction of superplastic forming (SPF) dies for SPF of titanium aerospace components. A two-layer visco-plasticity model which combines both creep and combined isotropic-kinematic plasticity is chosen to represent the material behaviour. The process of material constant identification for this model is presented and the predicted results are compared with the rate-dependent (isothermal) experimental results. The temperature-dependent material model is furthermore applied to simulative thermo-mechanical fatigue (TMF) tests, designed to represent the temperature and stress-strain cycling associated with the most damaging phase of the die cycle. The model is shown to give good correlation with the test data, thus vindicating future application of the material model in thermo-mechanical analyses of SPF dies, for distortion and life prediction.
