Abstract:
Mary Wollstonecraft’s A Vindication of the Rights of Woman makes its feminist argument primarily through literary criticism. Recent scholarship has generally considered the literary critical dimension of Rights of Woman as a minor component of Wollstonecraft’s explicit political argument and cultural critique. This thesis locates and analyses three literary critiques in Rights of Woman in order to illustrate the specificity of Wollstonecraft’s methods. Wollstonecraft’s critique of Milton utilises a practice of quotation and commentary, and interrogates his prominent role in literary and political canons. Her critique of Rousseau’s Emile is highly instructive because she both attacks its content and attempts to undercut the modes by which this paradigmatic statement of the submissive domestic female had become ‘a prevailing opinion of a sexual character’. Wollstonecraft’s critique of John Gregory, the author of the influential conduct book A Legacy to His Daughters, claims that this work perpetuates Rousseau’s repressive norms, even without the conscious knowledge of its apparently capable author. In doing so, Wollstonecraft theorizes the existence of a self-reproducing ‘male’ literary tradition, one which comprises a broad range of texts, whether by ‘great’ writers or less gifted men, a notion which challenges benevolent images of a purist canon of aesthetic value. In the development of her criticism, Wollstonecraft draws from two contemporary critical traditions. The first is that of the bluestocking women, whose public mastery of literary knowledge gives them the status to promulgate social agendas. The second is the literary periodical, which stands at the very centre of print culture in the eighteenth century. A specific analysis of the literary critical dimension of Rights of Woman illuminates new aspects of the organisation and rhetoric of this key work.

Abstract:
The thesis uses poststructuralist feminist theories in conjunction with cultural history to challenge the common feminist suspicion of Mary Wollstonecraft's Vindication of the Rights of Woman and propose instead a reading that is historically specific and sympathetic. To bring present-day theories to bear on past texts implicitly raises as an issue the question of reading the past. Part One of the thesis explicitly addresses this question. It examines debates that occurred in the lQ70s over the relationship between narrative an~ history alongside postmodernist interventions in the question of history and explores their implications for what a feminist cultural history might look like. The following~ three chapters silently but consistently allude to the questions of history raised in the opening chapter. These are: how do present-day knowledge's and theoretical projects shape the way we (re)read the past? What is the relationship between the past and the present? Where are past meanings, for example, of femininity produced? Each chapter examines how different editions of a Vindication of the Rights of Woman printed in the eighteenth and nineteenth centuries invite readers to understand what it means to be feminine, feminist and female and to show in consequence how the meaning of woman, and relatedly of a Vindication, is historically changing and perpetually in struggle. Part Two of the thesis comprises three chapters where feminist poststructuralist theories are used to reread a Vindication of the rights ~ Woman, ~ Wrongs of Woman: ~ Maria and Letters Written during ~ Short Residence in Sweden, Norway and Denmark. The readings enter into a dialogue with each other on the central question of the relationship between gender, genre and style. They are not offered as definitive interpretations. Rather, their engagement with issues of language, meaning and gender ands to and puts into process the cultural history given in Part One.

Les romans de Jane Austen sont souvent perçus comme étant une narration parfaite de la vie domestique au dix-neuvième siècle. La plupart des intrigues sont centrées autour de quelques familles et d'une héroïne qui, à la fin du roman, est récompensée à travers son mariage avec l'homme de son choix (qui s'avère souvent riche et muni d'une bonne position sociale). Puisque les romans d'Austen se terminent généralement par un mariage conventionnel et apparaissent d'une envergure limitée, les analyses des thèmes féministes sous-jacents ne sont pas apparues avant le vingtième siècle. Plusieurs études ont révélé qu'au dessous de ces romans à caractère domestique se cache des arguments féministes en faveur de l'éducation des femmes et une critique des inégalités entre les sexes et des codes de conduite. L'étude qui suit comparera le féminisme d'Austen à celui de Mary Wollstonecraft, à partir de ses essais A Vindication of the Rights of Woman, A Vindication of the Rights of Men, ainsi que ses romans Mary et The Wrongs of Woman. Cette analyse portera aussi sur trois des romans d'Austen : Northanger Abbey, Sense and Sensibility et Mansfield Park. Abstract:
In recent years, Canadian governments and courts have increasingly responded positively to the demands of lesbian and gay communities for legal rights. As a result, in several instances, such rights have been extended, at both statutory and constitutional levels. In this thesis, I consider the politics of struggles for lesbian and gay legal equality in Canada. Although I explore several developments in this area, I focus my analysis upon two key examples: the struggle, in 1986, to add a "sexual orientation" ground to Ontario's Human Rights Code; and a key legal rights case launched in the late 1980s, and still on-going as of this writing (Mossop). More specifically, I address three key questions: [1] how are lesbian and gay subjects and subjectivities constituted through human rights law and what forces produce these legal constructions? [2] how capable are liberal democracies of accommodating 'sexual pluralism', and what are the implications of this for other areas of social transformation? [3] what is the relationship between the lesbian and gay rights movement, its principal opponents the New Christian Right, and 'the state' - how do the struggles of social movements for interpretive authority shape the law-making process (and vice versa)? In responding to these questions, I draw upon diverse approaches in legal theory, sociology, feminism, and lesbian and gay studies. My analysis centres upon the role of law as a site of struggle. I explore the engagements between the lesbian and gay rights movement, and its key opponent the New Christian Right. I assess the effects of lesbian and gay rights campaigns in both the short and long terms, considering issues to do with social movement mobilisation, effective political communication, and the role of these struggles in shifting dominant frameworks of meaning. I offer a detailed discussion of the role of rights, as goal and rhetoric, within political action. And I consider the relationship between law, and other forms of knowledge. I argue that the effects of legal struggle are complex, contradictory, and unpredictable. Lesbian and gay rights reforms have both entrenched and undermined dominant paradigms of sexuality, and the effects of legal struggle in this and other areas must be assessed in the long-term. This thesis contributes to knowledge in four key areas: critical rights theory; theories of law and social change; the sociology of social movements and religions; and lesbian and gay politics. I use a combination of legal, sociological, feminist, and historical methodologies.

Abstract:
Australian women faced the last two decades of the twentieth century, optimistic in their capacity to contribute positively to social change in the restructuring state. Encouraged by the relative euphoria of the late 1970s and early 1980s, women had a fleeting glimpse of the possibilities of woman-friendly legislation and feminist inspired government policy. What eventuated was the dismantling of supportive welfare structures, under the guise of economic rationalist state action, which undermined and eventually halted women’s economic and social advancement. This research project examines the impact of government policy on the welfare of Victorian women, through a feminist analysis of state and federal decision-making, framed in the context of case studies in the areas of employment, education and health. The promotion of ‘gender-neutral’ policy, by generally conservative bureaucracies, effectively exposes the mythical woman-friendly state. The implications do not auger well for Victorian women in the new millenium.

This thesis analyses international gay rights advocacies in Africa, using the country Ghana as a focal point. Gay rights by their mere sound, seem a concept that all should embrace without questions or qualms. Yet, there are not many concepts that have seen so much controversies, complexities and ironies than gay rights; especially in Africa. This thesis attempts to understand what gay rights are; how they have been received; and the reasons that underpin such receptions in an African country. It argues that, the intrinsic complexities embedded in gay rights advocacies require a cautious socio-legal unpacking beyond the easy and lazy racial stereotyping that currently characterises the debates. That systematic unpacking of the events of the (colonial) past and (postcolonial) present in order to make sense of the future is the central objective here. Using qualitative empirical evidence from primary and secondary sources, this thesis juxtaposes the philosophical realms of human rights theory, postcolonial theory and queer theory to the everyday and practical realities affecting gay people and stakeholders alike. It holds that, perhaps it is through engaging these theories holistically; and transposing them meaningfully to the contextual dispositions, could we make sense of the enormous issues (like the sources and effects of homophobia) that confront us.

"Man's Duty to Woman: Men and the First Wave of German Feminism, 1865-1919" charts the modernization of gender relationships in Imperial Germany through an exploration of German men's engagement with both organized feminism and the so-called "Woman Question." An examination of German men's contributions (as well as challenges) to feminist newspapers, women's suffrage societies, women's educational and vocational organizations, and the discourse of expanding women's civil and political rights illuminates not only the ways in which German men helped shape the "first wave" of German feminism, but also the process by which German men were, in turn, shaped by feminism and women's breach of a male-defined public sphere during the second wave of the Industrial Revolution. While Germany is better known for its misogynistic intellectual legacy of thinkers like Arthur Schopenhauer and Friedrich Nietzsche, as well as the maxim of "Kinder, Küche, und Kirche" (children, kitchen, and church) used to describe the so-called "women's sphere," my dissertation demonstrates that the cause of German women's rights enjoyed a broad base of male support during the Imperial era and that women's reforms were pivotal to progressive liberal, socialist, and conservative social policies. My examination of male allies, therefore, counterbalances and critiques the longstanding view of Imperial German society and German men as fundamentally hostile to women's rights. Male allies of German feminism, I contend, were motivated by a twin mission to genuinely improve the lives of and opportunities for women in the industrial economy, and to utilize feminine energies--both spiritual and biological--for their own ideological designs. While these male allies retained some degree of principled commitment to expanding women's opportunities in Germany society over time, they were opportunistic men, as well, who sought to harness and direct the power of the "eternal feminine," a power which the moderate female-led feminist movement celebrated and deployed in their own work. My dissertation also considers the ways in which German men reconciled their own masculine identity with their support of reforms that ultimately undermined male hegemony. In the late 1870s, after female leaders took the helm of women's educational and vocational associations and began to embrace the rhetoric of maternalist feminism, men committed to women's reforms were forced to carve out new forms of pro-woman and feminist advocacy within, or alongside of, woman-led feminist organizations. As a result, male allies of German feminism developed a variety of masculinities. Although a few feminist men like Karl Heinzen, Georg von Gyzicki, and Hanns Dorn advocated a gentler, egalitarian masculinity that rejected most aspects of traditional masculinity, the majority of male friends of first wave feminism embodied a hyper-masculinity to balance their commitment to increasing women's social, economic, and (in some cases) political power. The act of becoming a "modern German man" in the late nineteenth and early twentieth century necessarily entailed figuring out how to retain one's manliness and maintain refuges of male authority in a world in which women were becoming ever more powerful and visible. Male allies of German feminism represent an essential case study in this project of modernizing masculinity

Abstract:
This thesis examines the appropriateness of the use of rights based strategies in meeting children's needs. In an era of proliferating international conventions this is an issue that demands further debate. The starting point of the thesis is the way that rights talk about children. It is suggested that ideas of difference are integral to child rights. Needs and rights are attributed on the basis of difference. The difference between children and adults is defined and informed by the scientifically based discourse of child development, on which a prescriptive model of childhood is built. Difference also structures the relationship between child rights and other cultural norms of childhood. Rights make claims to a universal application. Other constructions of childhood are redefined as local, and required to fit into the rights framework, or delegitimised. Developing these points it is asked whether rights, as an internationally dominant discourse, can succeed in accommodating rather than excluding difference, since the process of exclusion involves an operation of power which serves to reinforce the status quo. This is a problem that is recognised in some theoretical perspectives (although only rarely applied to child rights). The response is usually in terms of restating universal claims, or advocating some form of cultural relativism. This thesis leans in favour of the latter. However, it also departs somewhat from this dichotomy, and argues, relying on ideas of chaos and complexity, that child rights need to be reworked. Two distinct approaches are suggested: either the recognition of radical, incommensurable difference, in which there can at best be convergence under a limited overarching framework of values; or the removal of difference as a structuring concept. The argument is elaborated through a detailed analysis, structured by theories of globalisation, of the interaction between the dominant rights discourse of childhood, and alternative conceptions of childhood in Sri Lanka. The analysis is based on field research, in which the response of the child care authorities to the practice of child placement was investigated, as was the impact on children and families of their responses. This investigation involved one of the only pieces of empirical research yet done in Sri Lanka, on either the juvenile courts, or on child placement and domestic service. The findings supported the conclusion that in order to be able to embrace complexity, and empower children, child rights need to be rethought.

Abstract:
This study offers a concentrated view of how a national movement developed networks from the grassroots up and how regional identity can influence national campaign strategies by examining the roles Texas and Texans played in the woman suffrage movement in the United States. The interest that multiple generations of national woman suffrage leaders showed in Texas, from Reconstruction through the ratification of the Nineteenth Amendment, provides new insights into the reciprocal nature of national movements. Increasingly, from 1868 to 1920, a bilateral flow of resources existed between national women's rights leaders and woman suffrage activists in Texas. Additionally, this study nationalizes the woman suffrage movement earlier than previously thought. Cross-regional woman suffrage activity has been marginalized by the belief that campaigning in the South did not exist or had not connected with the national associations until the 1890s. This closer examination provides a different view. Early woman's rights leaders aimed at a nationwide movement from the beginning. This national goal included the South, and woman suffrage interest soon spread to the region. One of the major factors in this relationship was that the primarily northeastern-based national leadership desperately needed southern support to aid in their larger goals. Texas' ability to conform and make the congruity politically successful eventually helped the state become one of NAWSA's few southern stars. National leaders believed the state was of strategic importance because Texas activists continuously told them so by emphasizing their promotion of women's rights. Tremendously adding credibility to these claims was the sheer number of times Texas legislators introduced woman suffrage resolutions over the course of more than fifty years. This happened during at least thirteen sessions of the Texas legislature, including two of the three post-Civil War constitutional conventions. This larger pattern of interdependency often culminated in both sides-the Texas and national organizations-believing that the other was necessary for successful campaigning at the state, regional, and national levels.

Abstract:
The achievements made at the continental level since 21 October 1986 when the African Charter on Human and Peoples‟ Rights (African Charter) came into force have been modest yet significant. Following its adoption, the African Charter was hailed as a very ambitious document. This is because of its uniquely African features: emphasis on morality, anti-colonial stance, absence of derogations justiciability of economic, social and cultural rights, recognition of peoples‟ rights as well as the imposition of duties on states and individuals. As a result of these distinctive characteristics, many scholars have criticised the normative framework of the Charter. Sindjoun is of the view that the Charter is „window-dressing for the purpose of acceding to international civilization.‟ Ouguergouz described the rights guaranteed in the Charter as „imprecise‟ and that „the pertinent clauses of the African Charter offer only weak legal protection to the individual.‟ Early writings on the Charter also raised doubts about the likelihood of its implementation. Good or bad as the normative standards of the Charter may be, Heyns and Viljoen are of the view that „the conceptual battle is over.‟ The relevant battle now is for implementation. Thus recent discourses on the Charter have shifted from celebrating or further criticising the Charter‟s distinctive normative framework to evaluating its implementation mechanism. A system of human rights is only as good as its enforcement mechanism.

This research report analyses Uganda’s legal requirements on local content, particularly its impact on the rights of women to participate and obtain benefit from extractive industry activities. Regard is had to the fact that much of Africa’s non-renewable natural resources have not been applied to the benefit of its peoples. Resultantly, governments have developed legislation and other requirements to among others, attract foreign direct investment without unnecessarily disadvantaging the nationals. The discussion considers the situation in other common law countries – specifically Tanzania and South Africa – as well as the implications of obligations imposed on member countries by international treaties, agreements and frameworks. The research is anchored on the need to improve on the livelihood of women in extractive industries and thereby examines the implications of the law on their rights. The study then delves into a critical review of the effectiveness of the local content legal framework in Uganda and also draws lessons from Tanzania and South Africa for purposes of comparison. The study narrows the discussion to the problem of law and policy making which end up excluding and disadvantaging women. Recommendations made are intended to contribute to the body of knowledge in the extractives sector generally and on the local content stipulations and their impact on the rights of women specifically. Recommendations include; embracing gender inclusiveness and taking into account women’s views in policy and law making, balancing political rhetoric and agenda with the need to secure women’s participation, as well as setting specific quotas to be complied with by extractives companies are paramount. Further, encouragement of women to participate in extractive industry activities, development of more cohesive and gender inclusive policies as well as adoption of a strategy approach in extractive industry policy making. Also, eradication of archaic practices which exclude women from participating in and taking direct benefits in extractives activities. Much as the local content requirements in Uganda are designed to engender equality and equity, more still needs to be done to enhance women’s rights in the extractive industry.

The dissertation examines the significant yet neglected career of Yamei Kin, a Chinese woman whose transnational career influenced medicine and women’s rights in the United States and China. Although men dominated medicine, female doctors and nurses played an important role serving the poor and reaching women in China and Japan, where social norms restricted contact between the sexes. Thus, female medical professionals, represented by Yamei Kin, promoted the general welfare of the people, spread medical knowledge, and inspired more women to independence and excellence by their medical work. Yamei Kin is the first Chinese woman who obtained a medical degree in the United States (1885). A trailblazing physician, Kin broke the Chinese and Japanese prejudice against Western medicine and opened the medical profession to women in these two countries. She gave public lectures around America and England on women’s issues such as suffrage and prison reforms. Limited knowledge is available about the experiences and outcomes of family members, specifically those of children who were raised by parent(s) with disability. This gap in research is highly consequential, influencing the development of policies that are based on prejudiced assumptions about disabled parenting, rather than on empirical evidence. This study examined the experience of 13 adult children who were raised by at least one parent with disability in order to obtain a first-hand account of their perspectives. A transcendental phenomenology facilitated objectivity while capturing the essence of their experience. Research questions presented were the following: (a) What has been the experience of adult children who grew up with parent(s) with disability? (b) What familial, interpersonal, and/or personal contexts (if any) have produced a strengths-based retrospection of the experience? The study utilized Walsh's family resilience framework as a theoretical guide to counter deficit-focused research that has dominated disability research. Findings suggest the highly systemic and contextual quality of the experience, with children reporting overall strengths-based retrospections. Participants described family processes that were critical to the development of individual resilience, including belief systems, organizational processes, and open communication. Findings also demonstrated the development of favorable child outcomes such as empathy among adult children who were raised by parent(s) with disability. The findings have research, policy, and clinical implications, emphasizing the need to amplify disability discourses within the field of family science.

Discrimination against parents with disability is a long-standing issue in US history, impacting policies that lead to the involuntary separation of families. Assumptions about disabled parenting that focus on individual impairment may have contributed to this issue. The purpose of this study was to examine the experience of adult children who grew up with a parent(s) with disability, to obtain a first-hand account of their perspectives. The research questions presented were (a) What has been the experience of adult children who grew up with parent(s) with disability? Overall, children report strengths-based perspectives, describing the family processes that were critical to effective navigation. The experience was also highly contextual and relational, challenging traditional perspectives that have historically prevailed. The study offers research, policy, and clinical implications, directing attention to the need to amplify disability discourses within the field of Family Science.

This dissertation examines the periodical essay as a site for women's political activity in the nineteenth century. I suggest that the essays and articles of well-known writers Fanny Fern, Marie Corelli, and Sarah Grand, and others who are less well-known, such as Ignota and Mary Livermore, together form a significant body of prose non-fiction that highlights women's active involvement in political debate. I focus primarily upon women's contributions to general-interest periodicals---where women were competing for space against a wider variety of male writers---rather than on ladies' magazines or the suffrage press, whose more narrow goals diminish the potency of women's appearance in the press. Much of my study focuses on the British Nineteenth Century and the American North American Review , both of which turned to series of articles and carefully organized groups of essays to showcase women's inclusion in the debate, often summarized as the Woman Question, over women's position in nineteenth-century society. Throughout, I posit that women's publication on topics concerning women's rights constitutes culturally and generically sanctioned political activity. The five chapters represent increasingly specific aspects of this activity. The first positions women's involvement within the press's penchant for diversity. The second argues for a connection between the influential function of the periodical press and the role of women as positive influences on others. While this influence is generally interpreted as purely domestic, I suggest an alternative reading that endorses women's publication in periodicals. The third chapter examines how women play on notions of gender and identity to create viable public voices in the press. In chapter four, I turn my attention to the ways in which women occupy the forum of the periodical to comment on and prescribe male behavior. Equality before the law, protection of the rights and non-discrimination are considered as core set of human rights norms and must form the whole legal system. Equality means that all people are born free and equal, have same rights and are equally respected and valued both in family and society. In accordance with the principle of equality of all people are equal in their natural rights and dignity, so no one should be denied human rights on grounds of nationality, ethnicity, race, religion, gender, age, language, sexual orientation, disability, political or other opinion which are based on other discriminatory basis. The principle of equality is inherent in the principle of non-discrimination which it complements and includes general and basic human rights. Hindu women's right to independent ownership of property has been established in India since 1956. Given that legal rights have not brought about a significant increase in women's ownership of land, this thesis explores the factors that affect women's effective claim to land ownership. Taking the particular case of Hindu peasant women in small farming households in Western Orissa, it analyses their ability to claim land ownership as the outcome of bargaining. The bargaining approach, as developed by economists, and by Amartya Sen and Bina Agarwal in particular, is adopted to analyse women's access to land as an effect of women's perceptions of self-interest and perceptions of women's contribution. The thesis evaluates the legal framework as it incorporates and reflects these perceptions. It argues that law constructs women's claim to land as a right addressed to 'Hindu' women, located within the family (through succession) and informed by religious ideology. It further argues that recognising women's interests as a basis of their claim to land ownership, as 'peasant' women, located within the household and affected by their work and role within agricultural production, would widen the scope of legal analysis. This would be a starting point towards a deeper understanding of the ways in which law impacts upon women's access to land.

O presente estudo buscou fazer uma releitura dos processos-crime na cidade de Caxias do Sul/RS, na década de trinta do século passado, que envolveram a violência contra o sexo feminino. Tomando os processos-crime como fonte, foram escolhidos os que continham os crimes de defloramento, estupro e violência sexual. O trabalho teve como objetivo estudar a trajetória da mulher caxiense vítima de violência, com enfoque no contexto social, político, cultural e organizacional, verificando, assim, as relações de trabalho e poder, condições de vida, educacional e sexual. Sendo o estudo de suma importância, pois nos reporta para a realidade atual, melhorando, assim, a compreensão das relações existentes entre os sexos. Realizou-se, também, um recorte sobre a legislação vigente na época em que ocorreram os crimes, abordouse um breve histórico sobre os processos-crime catalogados em Caxias do Sul. O estudo permeia a formação da Comarca de Caxias do Sul, seus primeiros habitantes, a imigração italiana, bem como o papel da mulher caxiense na sociedade e como ela foi apresentada na história, por meio do discurso e da prática de submissão e dependência. Propõe-se a implantação, nas escolas, da temática de igualdade de gêneros e a abordagem do papel da escola como agente de transformação social.

This study aimed to make a rereading of criminal cases in the city of Caxias do Sul/RS, in the thirties of the last century, involving violence against women. Taking the criminal proceedings as a source, they were chosen that contained the deflowering of crimes, rape and sexual violence. The work aimed to study the trajectory of caxiense woman victim of violence, focusing on social, political, cultural and organizational, checking thus labor relations and power, living conditions, educational and sexual. And the study of paramount importance because the reports for the current reality, thus improving the understanding of the relationship between the sexes. Held also a cutout on the legislation in force at the time they occurred the crimes, addressed to a brief history of the criminal cases cataloged in Caxias do Sul. The study permeates the formation of Caxias do Sul County, its first inhabitants, the Italian immigration and the role of women in society caxiense and how it was presented in history, through discourse and practice of submission and dependence. It is proposed the implementation in schools, the issue of gender equality and the approach of the school's role as agents of social transformation.

Abstract:
The purpose of this essay is to examine how transgender people are represented in modern day popular fiction. To do this, I have analyzed two tv-programmes, Orange Is the New Black and Transparent. To do this, I have used thematic analysis as well as analyzed the images produced within the programs. The theories that I base my analysis on is largely based on the theories of representation as coined by Stuart Hall as well as queer theory and Judith Butler’s take on gender. I find that they share many common themes such as the process of “coming out” and a clear focus on what transgender peoples’ bodies look like and how they interact with gender. It is mainly trans women who are the subject of fictional movies and tv-programmes and this is perhaps because they are believed to be more approachable and hu-morous than other transgender people. The key to representation is variation and overlook-ing the fact that trans women are somewhat overrepresented, Orange Is the New Black and Transparent portray transgender people in a realistic and intersectional fashion.

Abstract:
Olivia de Havilland’s legal victory over Warner Brothers in 1943 set a new precedent for labor relations in Hollywood. Not an isolated piece of litigation, the resulting law now is referred to by her name. It was the culmination of long struggle for actors in the studio system for representation and fair treatment under the law. Much of the work during Hollywood’s studio era was undertaken by women. They used their positions on screen both to appeal to their individual audiences. More than any other, the female star defined the pictures they performed in and the brand of the studios that employed them. Hollywood’s studio system bound stars like de Havilland contractually for a period of up to seven years, which was the legal limit at the time. This did not stop studios from abusing those legal limits through loopholes like the suspension clause. In 1943, the suspension clause was what Warner Brothers used to keep Olivia de Havilland beyond the seven calendar years she had worked for the studio. Actors rejoiced when the powerful suspension clause was declared unlawful by de Havilland’s suite. With the De Havilland Law, actors were entitled to independence that had previously be reserved for the lucky few.

O presente trabalho investigou a concepÃÃo do direito à educaÃÃo e sua expressÃo de universalidade, inserida no Ãmbito dos direitos humanos bÃsicos em contextos geo-sÃcio-polÃticos, culturais e religiosos, dentre outros aspectos, tÃo distintos em suas fundamentaÃÃes, como das comunidades islÃmicas. Intencionamos conhecer mais aprofundadamente os impactos dessas questÃes entre o normatizado nas legislaÃÃes locais e internacionais (DeclaraÃÃo IslÃmica Universal dos Direitos Humanos de1981, DeclaraÃÃo de Cairo sobre Direitos Humanos IslÃmicos de 1990 e a Carta Ãrabe dos Direitos Humanos de 2004) e a perspectiva dos âsujeitos de direitoâ. A pesquisa de campo inclui entrevistas semi-estruturadas, junto aos sujeitos muÃulmanos, quer no Brasil ou em outras comunidades islÃmicas, como os campos de refugiados (por email, em idioma InglÃs), aliadas aos depoimentos coletados no site TED.COM.. A partir da anÃlise das informaÃÃes obtidas, observamos que os sujeitos entrevistados destacaram a presenÃa de fatores econÃmicos, polÃticos, culturais e religiosos como determinantes e impedidores e/ou favorecedores do usufruto do direito educacional, paradigma mundialmente conclamado, mas indicaram tambÃm percepÃÃes singulares de famÃlias que podem, em exceÃÃo, contradizer circunstÃncias como as de guerra e territÃrios em perigo e/ou regras sociais ainda arraigadas. Tal fato nos aproximou exemplarmente de sujeitos com elevados nÃveis de escolaridades e atuaÃÃes profissionais no mundo do trabalho.

This thesis aims at assessing violence to the detriment of women in the Old Testament, which served as a religious amalgam for her elimination in the social environment of male domination, but not before proceeding with an approach to Hebrew history, in addition to the contextualization of the ancient Hebrew codes : Covenant, Deuteronomy and Leviticus, with the intercalation and paradox of violence exercised against her in each of the Old Testament codices, which have been transfused into all societies, even the most modern, in the West. It contributed, therefore, the feminist historical oppression, by the patriarchal connotation biblical, religious and social for the enactment of laws that, notoriously, inhibited in the human genesis the devaluation by the feminine condition. Its recrudescence, in the social context, in Brazil needed to establish equality between the sexes, by the Federal Constitution of 1988 and specific punishment for gender violence, due to the publication of the Laws of Maria da Penha (Lei nº 11.340 / 2006), besides the Feminicide Law no. 13.104 / 2015), to reduce the existing androcentric intolerance in Brazilian society, still pending social re-signification, to reduce contempt, humiliation, monetization and domestic violence, so common in Brazilian homes.
Esta tese tem por fito aquilatar a violência em detrimento da mulher, no Antigo Testamento, que serviu de amálgama religioso para alijamento dela, no meio social de dominação masculina, não sem antes proceder uma abordagem da história hebraica, além da contextualização dos códigos antigos hebreus: Aliança, Deuteronômico e Levítico, com a intercalação e paradoxo da violência exercitada contra ela em cada qual dos códices veterotestamentários, que se transfundiram para todas as sociedades, até mesmo as mais modernas, no Ocidente. Contribuiu, assim, a opressão histórica feminina, pela conotação patriarcal bíblica, religiosa e social para a promulgação de leis que, notoriamente, inibiram na gênese humana o desvalor pela condição feminina. Seu recrudescimento, no contexto social, no Brasil necessitou estabelecer igualdade entre sexos, pela Constituição Federal de 1988 e punição específica pra a violência de gênero, em virtude da edição das Leis Maria da Penha (Lei nº 11.340/2006), além do Feminicídio (Lei nº 13.104/2015), para amainar a intolerância androcêntrica existente na sociedade brasileira, ainda pendente de ressignificação social, para diminuição do desprezo, humilhação, monetarização e da violência doméstica, tão comum nos lares brasileiros.

As mulheres trans são consideradas e tratadas como figuras abjetas, por não se enquadrarem no sistema de normas de gênero e sexualidade vigentes na sociedade. Com isso, há os processos de estigmatização e discriminação à sua identidade de gênero, produzindo a negação de seus direitos enquanto cidadãs, inclusive do direito à saúde integral. Por outro lado, recentemente foram produzidas políticas públicas voltadas a essa população, com o intuito de garantir os seus direitos humanos. Diante desse cenário, buscou-se descrever e compreender como se dá o acesso das mulheres trans aos serviços de saúde e à saúde integral no município de Curitiba, à luz das práticas sociais, individuais e programáticas envolvidas em tal processo. Para tanto, foram realizadas entrevistas semiestruturadas, com a utilização do recurso das cenas, com sete mulheres trans residentes em Curitiba. Para a análise do material obtido, foram eleitas as cenas que mais expressavam o seu (não)acesso à saúde integral, que compuseram, posteriormente, uma narrativa sobre o percurso e vivência delas na área da saúde, tendo como pano de fundo o quadro dos direitos humanos e da vulnerabilidade, e as normas regulatórias de gênero. O exame desse material possibilitou observar que as mulheres trans têm uma trajetória na área da saúde marcada pela violação de seus direitos humanos e à saúde, demonstrando que, por mais que existam documentos que garantam esses direitos, a efetividade destes na vida cotidiana das mulheres trans esbarra em barreiras individuais, sociais e programáticas (que são permeadas e produzidas primordialmente pelas normas regulatórias de gênero), que aumentam a sua vulnerabilidade ao adoecimento. À luz das cenas e narrativas trazidas pelas mulheres trans entrevistadas e considerações apontadas, ao longo deste texto, com base no quadro teórico adotado são oferecidas na conclusão algumas recomendações para o aumento da qualidade das políticas públicas e legislação vigentes, para que assim haja um aumento na efetividade das ações pautadas nesses documentos
The trans women are considered and treated as abject beings, because they dont frame in the system of gender and sexuality norms effective in the society. With that, there are the stigmatization and discrimination processes to their gender identity, producing the denial of their rights while citizens, including the right to the integral health. On the other hand, recently, public politics turned to that population were produced, with the intention of guaranteeing their human rights. Before that, it was looked for to describe and to understand how the trans womens access to the services of health and the integral health in the municipal district of Curitiba happens, to the light of the social, individual and programmatic practices involved in this process. For so much, semi-structured interviews were accomplished, with the use of the scenes resource, with seven trans women residents in Curitiba. For the analysis of the obtained material, they were chosen the scenes that expressed more their (not) access to the integral health, which composed, later, a narrative on the course and existence of them in the health field, having as backdrop the picture of the human rights and of the vulnerability, and the regulatory norms of gender. The exam of that material made possible to observe that the trans women have a path in the health field marked by the violation of their human rights and their right to the health, demonstrating that, no matter how much documents that guarantee those rights exist, their effectiveness in the trans women\'s daily life bumps into individual, social and programmatic barriers (that are permeated and produced firstly by the regulatory norms of gender), that increase their vulnerability to the illness. To the light of the scenes and narratives brought by the trans women interviewees and of the considerations pointed along this text, with base in the adopted theoretical picture, they are offered in the conclusion some recommendations for the increase of the quality of the current public politics and legislation, so that there is an increase in the effectiveness of the actions ruled in these documents

Trata-se de um estudo qualitativo, exploratório/descritivo. Para a obtenção das informações foram realizadas entrevistas por saturação de informação junto a 56 puérperas que tiveram seus partos entre os anos de 2010 a 2013 em 14 maternidades públicas das oito regiões de saúde do Estado do Tocantins, sendo 11 instituições de gestão estadual, duas municipais e uma filantrópica. As participantes foram selecionadas aleatoriamente a partir dos registros de parto das Unidades de Saúde e pelas listas dos Agentes Comunitários de Saúde. Os objetivos foram: Identificar as principais políticas públicas de atenção ao parto e nascimento implementadas no Estado do Tocantins e identificar a percepção das mulheres sobre violência institucional no processo de parto em maternidades públicas do Estado do Tocantins no período de 2010 a 2013. Quanto aos relatos de violências sofridas na maternidade, das 56 mulheres entrevistadas, 49 consideraram ter sofrido algum tipo de violência institucional no parto. As queixas se referiram à dificuldade no acesso aos serviços obstétricos, negligência, violência verbal, que inclui tratamento grosseiro, ameaças, repressões, gritos, humilhação, desrespeito; violência física; violência psicológica, precariedade de recursos humanos e materiais; descontinuidade da assistência do pré-natal ao parto; descumprimento da lei do direito ao acompanhante de livre escolha, utilização de procedimentos que não são mais indicados. Tendo em vista os resultados apresentados, considera-se que esse estudo cumpriu seus objetivos propostos. Observou-se em todas as quatorze maternidades pesquisadas descumprimento de várias políticas brasileiras de atenção ao parto e nascimento, havendo violência institucional no momento do parto, em todas as instituições, o que demonstra a magnitude do problema nessas regiões e a necessidade de melhoria desses serviços. A negligência foi um dos tipos de violência mais destacados pelas entrevistadas e chama atenção os relatos trágicos trazidos pelas participantes das pesquisas onde apontaram a relação desse tipo de violência a óbitos no período neonatal precoce. A Lei do Acompanhante foi apontada como uma das mais descumpridas pela maioria das maternidades públicas do Tocantins. Os problemas relacionados à ambiência das maternidades foram apresentados como outro ponto negativo nos relatos realizados pelas mulheres. Ficou evidente o papel e compromisso dos gestores, dos profissionais de saúde, das instituições formadoras, e de outros atores, além do empoderamento das usuárias e consequentemente o reconhecimento dessa assistência como direito, constituindo aspectos fundamentais para a mudança de práticas.

The thesis studies the human rights in Islam and evaluates them in concrete comparison of Muslim women's position in two different Muslim countries. It approaches two main human rights concepts: universalism and cultural relativism and describes the system and structure of Islamic law which determine all Muslims and Muslim society and therefore human rights perception itself. The diploma work follows two main goals:1) analysis of human rights from Islamic perspective, namely by its confrontation with prevalent universal model of human rights and 2) comparison of the status of Muslim woman in Turkey and Saudi Arabia. The thesis is logically divided into four consequential parts. First two chapters introduce to theoretical issues of human rights and Islamic religion, the two other pivotal parts are concentrated on the above mentioned set goals. The objectivity of the thesis should be ensured by using various foreign-language sources of information from which studies and reports of international organizations such as United Nations, Human Rights Watch or Amnesty International form a considerable part.

Varför har FN inte kunnat erkänna våldtäkt som ett krigsbrott?

Denna studie har ägnats åt att upplysa användning av våldtäkt och andra former utav sexuella övergrepp under krig och dess konsekvenser för utsatta kvinnor. Studien har tillämpat en kvalitativ och litterär metod. Den största delen av materialet har tagits ur diverse artiklar, dokument och tidsskrifer. Uppsatsen upplyser kvinnors rättigheter inom den internationella arenan och studien ifrågasätter varför Förenta Nationerna (FN) har dröjt (ca.50 år) med att identifiera våldtäkt som ett krigsbrott inom internationall lagstiftning.

Första delen av uppsatsen kommer att presentera de underliggande teorierna som preciserar konceptet sexuellt övergrepp och mer djupgående, också förklara anledningar bakom anvädning av våldtäkt, därav begränsa dess anvädning inom krigsförhållanden.

Andra delen av uppsatsen sätter fokus på termen våldtäkt och dess utveckling inom den juridiska ramen. Den behandlar folkrätt, och framhäver även orsaker till FN’s svaghet och svårighet att kunna erkänna, inte bara våldtäkt som ett krigsbrott, utan också andra frågor som är problematiska för FN att kunna hantera. Eftersom begreppet ’våldtäkt’ är relativt brett, faller det både under kvinnors rättigheter och i sin tur under mänskliga rättigheter. Av denna anledning kommer uppsatsen att ta upp de möjliga anledningar om varför det har dröjt för FN, men också dess svårighter, att kunna erkänna anvädning av våldtäkt som ett vapen inom krig.

Tredje delen av uppsatsen tar upp några av de möjliga problem som är ohanterliga för FN, bland annat kulturella skillnader och individuella åsikter mellan medlems staterna, vilket medför brist på konsensus. Uppsatsen ifrågasätter även om kvinnors rättigheter är del av mänskilga rättigheter. Utöver det kommer även uppsatsen resonera kring FN’s dilemma att kunna särskilja sin roll som ett mellanstatligt och transnationellt organ. Och sist men inte minst kommer suveräniteten, som varje stat har rätten till att erhålla, att diskuteras. Denna punkt kommer att klargöra den oenighet som förekommer mellan medlems staterna, vilket ännu än gång har resulterat i det dröjsmål som uppstått i att kunna indentifiera våldtäkt som ett krigsbrott.


Why haven’t the UN been able to recognise rape as a weapon of war?

The thesis enlightens the usage of rape in war and the consequences this has brought on women who have been subjected to rape. The bulk of the information is taken from various articles, documents and journals and the method used is of a qualitative nature. The thesis sheds light upon women’s rights in the international arena and questions why it took so long (almost 50 years) for the United Nations (UN) in addressing rape as a war crime within international law.

The first part of the thesis will present various theories that elucidate the word sexual violence and more accurately ‘rape’ in the context of war. The second part generates the judicial part that will depict the difficulty for the international community to address rape as a war crime within international law.

Furthermore the thesis takes the approach in presenting obstacles faced by the UN, within the framework of human rights, to handle delicate issues such as rape and sexual violence. Since rape is, to a large extent, complicated and a broad concept, and since it falls under the category of women’s rights and under human rights, the thesis will explain reasons behind the dawdling and the hurdles faced by the UN in accepting rape under the category of war crime.

The third part of the thesis will present possible predicaments that are unmanageable for the UN. Some possible issues that the thesis has touched upon, is cultural diversity and differing opinions among the member states which has resulted in lack of consensus. Furthermore, the study will present the notion of women’s rights, and question if they are part of human rights. The thesis will also discuss the dual role of the UN and its struggle for the past decade to uphold its role both as an intergovernmental as well as a transnational body. Lastly the thesis will enlighten sovereignty that each state must enjoy. Sovereignty has resulted in lack of agreement among the member states which again has caused delay in recognising rape as a war crime.

A dissertação trata do direito à privacidade como um direito humano fundamental, e concentra-se na mulher como titular desse direito, constitucionalmente garantido. Indaga-se se a mulher efetivamente usufrui o direito à privacidade, como forma de desenvolver plenamente vida contemplativa, na concepção que lhe empresta Hannah Arendt. Significa pensar que a mulher destina momentos de sua intimidade para que mergulhe na introspecção e possa enriquecer a capacidade cognitiva, refinar o juízo reflexivo, com vistas a ampliar os horizontes para um melhor desempenho na esfera pública. Trata-se de um processo de crescer mental e intelectualmente. Aborda-se o direito de a mulher escolher livremente sobre os assuntos referentes ao seu corpo e a sua vida, analisado sob uma visão do feminismo, que vem descontruindo a dicotomia público/privado por ser, no pensamento político contemporâneo, incapaz de descortinar a questão de gênero. Objetiva-se analisar o direito à privacidade da mulher superando a distinção clássica entre público e privado, e chamando atenção para o tratamento desigual secularmente recebido pela mulher na esfera doméstica. No que tange aos objetivos específicos, procura-se identificar as dificuldades existentes para a mulher obter na plenitude o direito à privacidade, particularmente para a mulher no Brasil, e verificar se este direito é garantido na mesma proporção para homens e mulheres. Serão apresentados argumentos que possam identificar o direito à privacidade da mulher como um direito humano, no espaço reservado às ações privadas, e na intimidade das relações familiares. A metodologia empregada na pesquisa é conceitual, visando a fornecer um arcabouço teórico consistente para refletir sobre o alcance e os limites do direito à privacidade da mulher.
The dissertation concerns about the right of privacy as a fundamental human right, and it focuses on woman as the holder of this right constitutionally guaranteed. It is inquired if the woman effectively uses the right of privacy as a way of developing a contemplative life, according to n Hannah Arendt´s conception. It questions if the woman reserves moments of her intimacy to develop to develop the introspection, and thus enrich her cognitive ability and reflexive judgment in order to broaden the horizons for a better performance in the public sphere. It concerns a process of mental and intellectual growth. It discusses is the right of the woman to freely choose about the subjects that refer to her body and her life, analyzed it under by a feminist perspective , which has been deconstructing the private/public dichotomy in the contemporary political thought as it is unable to reveal the gender issue. The purpose is to analyze the right of the woman to privacy, overcoming the classic distinction between public and private. Moreover, it intends to draw attention to the secular uneven unequal treatment suffered by women in the domestic sphere. About the specific objectives, this dissertation aims to identify the actual difficulties for a woman to obtain the right of privacy, mainly in Brazil, and verify if this right is guaranteed in the same proportion for men and women. Furthermore, it will be present arguments that could identify the right of privacy as a human right for women, in the space reserved to private actions and family intimate relations. The research methodology is conceptual, aiming to supply a consistent theoretical framework for reflecting the reach and the limits of the women's right to privacy.

The childbirth humanization as a movement searches for changes on the childbirth attention practices, discussing among other questions the abusive use of technology and the woman space in childbirth scene. As a public policy intends to ensure the access to assistance to childbirth in the services of the health unique system (HUS/SUS) and improve the maternal health indicators and neonatal. This study had as goal: Analyze the meaning of the humanization actions proposed by the Childbirth Humanization Program and Birthing in the Materno Infantil Hospital in São Luís-MA, having as empirical support speeches of women about the lived experience in the childbirth and of institutional leaders about the viability of the process of humanization in the maternity. Therefore, was made a qualitative approach research that used the focus group techniques with 28(twenty-eight) women in postpartum period and a semi structured interview with 5(five) female managers of the institution. The material analysis was made through the content analysis technique, showed the following categories: the violence on childbirth assistance and childbirth humanization and their meanings. Data revealed that women lived childbirth as an violent event, which have reveled the search for a bed, devaluation of the partum pain, exam s recurrence and companion s restrictions. The users mean the humanization as an ambience, presence of the father in the partum and the right to cesarean. To the responsible the humanization means the decrease of pain through anesthesia, be empathic and take care of the caregiver. Companion s unpreparedness and lack of professional s evolvement were the main boundaries to humanization and the physical structure and professional ability were advantages. Centralized management, insufficiently participation in decision-making by users and servers, institutional violence in childbirth practices, becomes conflicting and contradictious, besides an obstacle to reach a humanized childbirth attendance at the studied maternity.
A Humanização do Parto como movimento busca mudanças nas práticas de atenção ao parto, discutindo entre outras questões o uso abusivo da tecnologia e o espaço da mulher na cena do parto. Como política pública se propõe a garantir o acesso à assistência ao parto nos serviços de saúde do Sistema Único de Saúde (SUS) e melhorar os indicadores de saúde materna e neonatal. Este estudo teve como objetivo geral: Analisar o significado das ações de humanização propostas pelo Programa de Humanização do Parto e Nascimento no Hospital Universitário Materno Infantil em São Luís-Ma, tendo como suporte empírico discursos de mulheres sobre a experiência vivida no parto e de dirigentes institucionais sobre a viabilização do processo de humanização na Maternidade. Para tanto, foi realizada pesquisa de abordagem qualitativa que utilizou as técnicas de grupo focal com 28(vinte e oito) mulheres no período de pós-parto e a uma entrevista semiestruturada com 5(cinco) mulheres responsáveis na Instituição. A análise do material foi realizada através da técnica de análise de conteúdo, e evidenciou as seguintes categorias: A violência na Assistência ao Parto e Humanização do Parto e seus significados. Os dados revelaram que as mulheres vivenciam o parto como um evento perpassado por situações de violência, as quais se evidenciaram pela busca por leito, desvalorização da dor do parto, exames de repetição, e restrições ao acompanhante. As usuárias significam a humanização como ambiência, presença do pai no parto e direito à cesárea. Para as responsáveis, a humanização significa redução da dor através de analgesia, ser empático e cuidar do cuidador. O despreparo dos acompanhantes e falta de envolvimento dos profissionais foram as principais limites para a humanização e a estrutura física e o preparo profissional um dos principais facilitadores. A gestão centralizada, a pouca participação das usuárias e servidores nas tomadas de decisão, a violência institucional nas práticas de atenção ao parto, tornam conflitante e contraditório, e mesmo empecilhos para a viabilização do atendimento humanizado ao parto na maternidade de ensino.

The hypothesis projected in this thesis presumed that the difficulty of breaking up between the victims and their aggressors in situations of home and gender violence is related to the absence of institutional mechanisms, which materialize politics of care to women. Values and moral contribute to the maintenance of women s sub-alternation to men, to the forms of political and social domination as well as to economic, patriarchal and racial exploitation. The change of this reality will depend on the development of material conditions which might enable conscious ways that will allow patterns of conscience able to target new values. To make the investigation development possible, some aims were established: to analyze the historical constitution of the human rights for women, facing the process of their violence; to identify and deepen the knowledge of the different institutional paths gone through by women which search for alternatives for domestic violence; to know how the political proposals for women have been formulated once non-violence actions are characterized; to analyze the legal procedures which involve situations of serious physical violence, characterized as domestic and gender-based violence; and to analyze the contribution of the social service in the process of formulation of the political proposal for women. In order to reach these aims, studies of women s legal rights and documents about politics for women were necessary. An exploratory investigation was carried out in the region of the big São Paulo SP and redoubled in deep inquires in the municipality of São Carlos SP. The knowledge of the proposal of politics for women, in the municipal context, involved institutions of public security, social assistance, health, Law Court and the university where the interviews were carried out, visits to the services of care to women in situations of violence, and analyses of documents
A hipótese adotada nesta tese subentendeu que a dificuldade de rompimento entre as vítimas e os agressores, nas situações de violência doméstica e de gênero tem relação com a ausência de mecanismos institucionais, que concretizem a política de atenção à mulher. Os valores e a moral contribuem com a manutenção da subalternidade das mulheres em relação aos homens, às formas de dominação política e sexual e de exploração econômica, patriarcal e racial. A modificação dessa realidade dependerá do desenvolvimento de condições materiais que possibilitem formas de consciência capazes de objetivar novos valores. Para o desenvolvimento da investigação, foram estabelecidos alguns objetivos: analisar a constituição histórica dos direitos humanos das mulheres, frente ao processo de sua violação; identificar e aprofundar o conhecimento dos diferentes espaços institucionais percorridos pelas mulheres, que buscam alternativas para a violência doméstica; conhecer como vêm se formulando as propostas de política para as mulheres nas particularidades das ações de não-violência; analisar processos jurídicos que envolvem situações de violência física considerada grave, caracterizados como violência doméstica e de gênero; analisar a contribuição do serviço social no processo de formulação da proposta de política para as mulheres. Para concretizar esses objetivos foram necessários estudos sobre os direitos humanos das mulheres, da legislação criminal e dos documentos sobre a política para as mulheres. Uma investigação exploratória foi realizada na região da grande São Paulo - SP e desdobrou-se em aprofundamentos no município de São Carlos - SP. Les États africains de l’espace francophone ont rénové leurs droits civils, par la refonte des dispositions du Code civil français de 1804, reçu en héritage colonial. Les textes issus des réformes, dénommés « Codes des personnes et de la famille », étaient censés mettre fin au pluralisme juridique dans les relations d’ordre privé, lequel résultait de la coexistence du droit positif et des normes coutumières et religieuses, par l’unification des droits de la famille. L’occasion devait en même temps être saisie de conformer les législations du mariage au dispositif juridique international des droits humains, en particulier sur le mariage. À cet effet, l’égalité de l’homme et de la femme tenait la place centrale dans l’énoncé des motifs des lois. Cependant, les droits des sexes définis, au terme des codifications, se signalent par leur faiblesse pour ce qui concerne la femme. Bien davantage, le caractère sectoriel des approches juridiques de réduction des inégalités ne permet pas au droit de jouer le rôle transformateur escompté. Par ailleurs, il est constaté, à travers ses manifestations, que le pluralisme normatif demeure, avec une incidence négative sur l’effectivité des règles en vigueur.En comparant les Codes du Bénin, du Burkina Faso et du Mali, il apparaît qu’en contrepartie de certains droits nouveaux institués en faveur de la femme (comme l’autonomie professionnelle), qui souffrent en outre d’inapplication, des coutumes inconciliables avec les droits humains (comme la polygynie) ont été incorporées dans les droits républicains. Il en découle que les législateurs africains ne se sont pas significativement détachés des traditions qui participent au maintien de la condition juridique et sociale féminine. La situation appelle des réformes en profondeur des droits de la famille, de même que la mise en œuvre de politiques gouvernementales coordonnées, afin d’atteindre l’égalité réelle des sexes dans le mariage
French-speaking black African countries have renewed their civil rights, on the basis of the French civil code resulting from the 1804 colonial legacy. The texts issued from the reform called “Codes of persons and family” were supposed to put an end to legal pluralism within private relationships, resulting from the coexistence between positive law, customary and religious rules, by the unification of family rights. It provides at the same time the opportunity to confirm marriage regulations within the legal law of international human’s rights, particularly about nuptiality. In this respect, equality of man and woman held the central place in statements of laws patterns. However, the rights of sexual equality moreover disadvantage women. Much more, the sectoral character of the legal approaches concerning the reduction of the inequality, compromises the transforming role of the right. Furthermore, some facts demonstrate that normative pluralism remains and that its impact is negative on the efficiency of the rules in force.When we compare the Codes of Benin, Burkina and Mali it reveals that in return of some new rights instituted in favor of woman, for example the unapplied professional autonomy, irreconcilable customs with human rights such as polygyny has been incorporated in republican rights. It follows that some African legislators are not significantly detached from traditions that contribute to the maintenance of woman legal and social condition. This situation calls for deep reform of family rights, as well as the implementation of a governmental action plan to achieve equality of sexes within marriage

En 2012, en Corée du Sud, une association de patientes atteintes d’un cancer du sein organise une grève du silence devant la Cour Constitutionnelle pour dénoncer les inégalités d’accès à la reconstruction mammaire. Cette action collective inédite des patientes revendiquant un meilleur accès à la chirurgie questionne le lien entre l’émancipation et l’action collective. Cette étude examine dans quelle mesure l’action collective et le discours des patientes mobilisées pour revendiquer l'accès à la reconstruction mammaire sont émancipateurs et explore d’autres voies possibles d’émancipation. Cette recherche repose sur une enquête ethnographique réalisée à Seoul pendant 7 mois entre 2013 et 2014 et une intervention sociologique d’une durée de trois mois menée en 2015. L’observation du quotidien des malades s’est déroulée au sein de l’association nationale de patientes et dans un hôpital public. Une soixantaine d'entretiens ont été réalisés avec les femmes et les professionnels qui travaillent auprès de patients atteints d’un cancer (du sein). La thèse rend compte de la manière dont le cancer du sein s’introduit dans l’économie et la politique nationale welfariste tout en étant traversé par les normes sociales. L’analyse révèle les messages véhiculés par les femmes au nom de leur libération. Nous montrons que leurs messages nourrissent les tensions entre les patientes de profils sociodémographiques différents au lieu de les atténuer, tout en favorisant le conformisme aux normes sociales et à la culture biomédicale du cancer. In 2012, in South Korea, an association of breast cancer patients organized a silence vigil before the Constitutional Court to criticize unequal access to breast reconstruction surgery. This unprecedented collective action by patients demanding better access to health care questions the link between emancipation and collective action. This study examines to what extent the collective action and the discourse of patients mobilized to demand better access to breast reconstruction are emancipatory and explores other possible ways of emancipation.An ethnographic survey was carried out in Seoul for 7 months between 2013 and 2014 and a sociological intervention was put in place for three months in 2015. The observation of patients' daily lives took place in the national patients’ association and in a public hospital. About 60 interviews were conducted with women and professionals who work with (breast) cancer patients.The thesis accounts for the way in which breast cancer is introduced into the national welfarist politics and economy and while being crossed by social norms. The analysis reveals the messages conveyed by women in the name of their liberation. It also shows their messages foster tensions between patients of different socio-demographic profiles rather than attenuating them, while promoting conformity with social norms and the biomedical culture of cancer. The thesis reveals how the experience of the body of patients in the process of care pathway is the basis of their ability to act vis-à-vis the medical profession

Abstract:
What is the fundamental justification of the idea of human rights? In this dissertation I argue that human rights are justified in virtue of the special role they play in practical thought: they function as the constitutive conditions of the relationship of right. This answer has two distinctive features: it justifies human rights non-instrumentally and relationally, as those claim rights universally necessary for relating to each other as juridical equals, as lacking authority over one another. This constitutive argument for human rights contrasts with the predominant theories of human rights, which tend to justify human rights instrumentally as means for the protection of an independently intelligible (and non-relational) purpose (e.g., basic needs, urgent interests, autonomy, capacity-development). A strong reason for endorsing the account proposed here is that it explains better than its instrumentalist competitors the universal validity of human rights while offering a more robust response against the human rights skeptic. Furthermore, this constitutive argument gives us the resources for seeing how human rights form an indivisible whole comprising civil, political, social, economic and cultural rights and how human rights structure an international order of peace. My account thus promises to offer a much-needed defense of the ideals enshrined in the Universal Declaration of Human Rights.

The period from Opium War to 1911 Revolution (1840-1911) was the age of rapid change about politics, economy, society, culture in China. Opium War urged the government of Ching Dynasty to accept international exchange. The intellectual class promoted the reforms of military affairs and social system to solve the problem of others countries’ aggression. At the same time, they gradually attached great importance to the issues about woman, including the abolition of Foot binding, the encouragement of female education, the struggle for woman’s rights and woman’s participation in revolution. According to their promotion, the treatment of woman was humane and awakened women to concern about themselves. Chiu Chin was the awakening one. She made great effort to struggle for woman’s rights. The research focuses on Chiu Chin’s thoughts about woman’s rights. First, it describes the source of thoughts about woman’s rights in the late of Ching Dynasty to clear the source of Chiu Chin’s. Second, it explores Chiu Chin’s life. It is constructed from five aspects: her family background, marriage, friendship, studies in Japan and revolutionary business. Each life stage influenced the formation of her thoughts. Third, it analyzes not only from her poetry, verse, and articles but also from her biography and life story to reorganize her thoughts and to discover her concrete achievement about woman’s right. Her thoughts about woman’s right are divided into four categories: equality of the sexes, encourage of female’s education, opposition of Foot binding and opposition of traditional marriage system. Finally, as a feminist and a female revolutionary, Chiu Chin crossed the boundary of traditional woman, synchronizing with the times. Her life set up the new feminine model for the later generation, and gives them courage to overcome difficulties.

Mary Wollstonecraft’s Thoughts about the Rights of Woman and Its Implications on Gender Equity Education Hui-wen Huang Abstract The purpose of this study is to discuss Mary Wollstonecraft’s thoughts about the rights of woman and its’ implications on gender equity education with the hope that it would be helpful for the gender equity education propelled in Taiwan. The thesis is mainly about Wollstonecraft’s thoughts about the rights of woman and her educational ideas, and wishes to provide some suggestions. The purposes of this thesis are as follows: (1) to analyze the background of Wollstonecraft’s time, her writing process and how she germinate the thought of the rights of woman. (2) to discuss Wollstonecraft’s thoughts about the rights of woman and its’ influence. (3) to discuss Wollstonecraft’s educational thoughts. (4) to explore the applications of Wollstonecraft’s thoughts to gender equity education. Based on the results above, the conclusions of this study are as follows: (1) Challenge the idea of patriarchy, including the ability of reason, and the stereotype of female and fight for the rights of education, work and politic for women. (2) The key point of liberating women from oppression and being independent is “education”. The first step to achieve gender equity is to adopt “co-education”. (3) The government should implement the gender equity education actively in respect of legislation and policy. Schools should build the culture of gender equity, and the curriculum should not based on gender. To sum up, although there has been some progress about the promotion of gender equity since 18 century, it is still not easy to change the ideology of gender stereotype. Therefore, we should continue to advocate the idea of gender equity, especially on education, and with the spirit and ideas of Wollstonecraft and other prophets, we will create a bright future for all women and men.

The thesis discusses Virginia Woolf’s creation of a new set of rites of passage for British women of her time in her two works, The Voyage Out and Orlando: A Biography. Adopting Sara Mills’ analysis of the effect of the discourses of femininity and colonialism on women travel writers and theories on the patterns of rites of passage, the thesis aims to draw an outline of Woolf’s rites of passage which is to fit her idea of a new woman image. Through the life events of the two protagonists, Rachel Vinrace in The Voyage Out and Orlando in Orlando, Woolf distorts the conventional social rites of passage in British patriarchal society and experiments with new patterns and transitional stages of development. Especially using the themes of transsexualism and transvestism in Orlando, Woolf suggests that her new woman image is to have androgynous characteristics. The androgynous knowledge thus helps the protagonist in Orlando to complete the rites of passage and to become the new woman who ultimately transcends the sex boundaries and female confinements for British women in the early twentieth century Britain. The introduction explains the relationship between Woolf’s two novels and patterns of rites of passage, which also involve the discourses of femininity and colonialism discussed in Sara Mills’ Discourses of Difference: An Analysis of Women’s Travel Writing and Colonialism. The experiences of both protagonists are generally summarized with Van Gennep’s three-part construction of rites of passage, and they show Woolf’s distortion and transgression of traditional passage boundaries as well. Chapter One focuses on the problematic status of the young woman Rachel Vinrace in Woolf’s early work The Voyage Out. Being pressured and confined by the British patriarchal norms, young Rachel as a result fails to accomplish the enlightenment journey to a colonized island and a projected successful return to England with new awareness: that is, her death abruptly ends her completion of the rites of passage. Chapter Two examines Woolf’s treatment of the British masculinity and male superiority represented by the male Orlando. Through a series of certain life crises and satires of the protagonist, Woolf undermines the British male and imperial authority with a severe criticism of patriarchal orthodoxy. However, the male Orlando could also be read as a connection in Woolf’s work between Rachel’s problematic situation and the female Orlando’s return to England. Chapter Three is an analysis of the female Orlando’s breakthrough within the British imperial and patriarchal society. By using her androgynous knowledge, Woolf enables Orlando to have a play at transsexualism as well as transvestism, and to complete the new rites of passage with full rights to transcend gender distinctions. Chapter Four concludes that Woolf’s “new woman” results from her deconstruction of conventional rites of passage and her construction of an idealistic human androgynous state in her characters. And with this image of a new woman, Woolf reviews women’s limitations in British society and seeks the liberation of potential for British women in the early twentieth century.

In my thesis I firstly aim to investigate the global constructions of Arab women in news platforms, through a semi-structured theoretical discussion of frames of representation. In the State of the Art I firstly reflect the fieldwork in the chapter on Politics of Media Frames and Silenced Realities, in assessments on: 1.1 Languages and Power of Media, 1.2 Eurocentrism: Collective Outrage versus Collective Apathy, and 1.3 Women’s Resistance in Epistemology: Human Rights Encounters and Arab Feminisms Deconstructing Double Patriarchies. I move on to explore the portrayals of the Arab in productions of the Orient and the “Third World”, discussing: 2.1 Frames of Oppression: Framing the Other, 2.2 Orientalism and The Immoral “Moral” Contest of Human Rights, 2.3 Doctrines of Exclusion: The “Civilising Mission” and the Burden of Representation, and 2.4 Double Patriarchies: (Non)Recognition of the Other of the Other. Finally, I assess dichotomies between the South and North, assessing constructions on women in the research dialogue Polarized Geographies and Polarized Feminisms, inquiring: 3.1 Veiling and Unveiling: Injustice(s) on the “Arab” and the Arab Woman’s Body, 3.2 Social Construction of Vulnerability and Violence on the Woman’s body, 3.3 Purity, Honour Crimes and Crimes of (Dis)Honour, and 3.4 Orientalist (Mis)Representations and the Egyptian Women’s Burden(s). My fieldwork encompasses the scrutinization of media reportage on the region and with particular focus on Egyptian women, in order to de-orient the homogenizing frame. De-orienting epistemology constitutes of critical discourse analysis articles from a renowned international newspaper, under a specific Egypt-centric time frame rather than a western-centric one. Articles are collected and analysed under the keywords Egypt, Women and Rights and are assessed for their frame: imagery, language, content and layout. Under a Key of Analysis which I designed, the articles are coded to assess trends, frames of silencing and empowerment and their frequencies and instances. In doing so, the critical findings of media portray that the image of the general Arab women and more so Egyptian women has been blurred. The dangers of misrepresentations were underlined under trends of normalized depictions of alienation of the woman from her rights, face and body. Double Patriarchies are evident in systematic narrations of violence, in western experts and Human Rights organizations speaking for and on the region, in focuses of men over women speaking for women’s rights, portrayals of the woman as victim and the vilification of Egyptian society. The few instances in which direct quotes of agency of empowered women are stated are acknowledged to be as objective as possible. It was disclosed that languages largely perpetuate oppressive frames evident from the critical key of analysis discussion in quantitative and qualitative findings. Imageries to a high extent reproduce prevalence of repeated Double Patriarchies. Abstracting a small number of instances of direct women’s quotes reflects stigmatic perpetuation of foreign imposition, cultural obscurement and focus on men in Egyptian women’s empowerment. The research therefore sought to de-frame Frames of Oppression by deconstructing them and their languages, and to go beyond this, through articulations of Egyptian women leaderships themselves involved in women’s rights whether directly or indirectly. This was carried out through semi-structured interviews which carry my own resonances with them as an Egyptian woman and as the interpreter and producer of the research, whereby my own voice is present throughout the work. The interviews reveal that the voices of Egyptian women, let alone Arab women are clearly non-homogenous and diverse, each with important stories to share. While there are nuances between perspectives, these must be seen and heard. The relational distance among women is seen within Cairo, between Cairo and outer cities, and levels of education. This mirrors the significance of exchange in women’s rights discourse within Egypt and amongst feminisms of the South and North. Epistemologies ultimately should seek to listen to and invite women from the South to produce their own knowledge on the world, on women’s rights and most crucially on themselves.

No Estado da Arte, reflito primeiramente o trabalho de campo no capítulo Política de Estruturas dos Média e Realidades Silenciadas, em avaliações sobre: 1.1 Idiomas e Poder dos Média; 1.2 Eurocentrismo: Indignação Coletiva versus Apatia Coletiva; 1.3 Resistência das Mulheres na Epistemologia: Encontros de Direitos Humanos e Feminismos Árabes Desconstruindo Patriarcados Duplos. Exploro retratos do Árabe em produções do Oriente e do “Terceiro Mundo”, discutindo: 2.1 Quadros de opressão: enquadrando o outro; 2.2 Orientalismo e o Debate "Moral" Imoral dos Direitos Humanos; 2.3 Doutrinas de Exclusão: a Missão Civilizadora e o Fardo da Representação; 2.4 Patriarcados Duplos: (Não)Reconhecimento do Outro do Outro. O meu trabalho de campo exigiu o exame minucioso dos relatórios dos média na região e com foco especial nas mulheres egípcias, a fim de desorientar o quadro de homogeneização. Desvincular a epistemologia dos artigos de análise crítica do discurso de um jornal internacional de renome, em um período específico no Egito, em vez de no Oeste. Os artigos são coletados e analisados sob as palavras-chave Egito, Mulheres e Direitos e avaliados pelo seu enquadramento: imagens, idioma, conteúdo e disposição. Sob uma Chave de Análise que eu projetei, os artigos são codificados para avaliar tendências, quadros de silenciamento e empoderamento e das suas frequências e instâncias. Ao fazê-lo, as descobertas críticas dos média retratam que a imagem das mulheres Árabes em geral e mais ainda a das egípcias ficou confusa. Os perigos das deturpações foram sublinhados sob tendências de representações normalizadas de alienação da mulher, dos seus direitos, rosto e corpo. Os patriarcados duplos são evidentes nas narrativas sistemáticas de violência, nos especialistas ocidentais e nas organizações de Direitos Humanos que falam pela e da região, nos focos dos homens nas mulheres que falam pelos direitos das mesmas, nos retratos da mulher como vítima e na difamação da sociedade egípcia. Nos poucos casos em que são citadas alegações diretas da agência de mulheres com poder são reconhecidos como os mais objetivos possíveis. Foi revelado que as línguas perpetuam amplamente quadros opressivos evidentes da chave crítica na discussão da análise em resultados quantitativos e qualitativos. As imagens reproduzem, em grande medida, a prevalência de repetidos patriarcados duplos. Abstrair um pequeno número de instâncias de citações diretas de mulheres representa perpetuação estigmática de imposição estrangeira, obscurecimento cultural e foco dos homens no poder das mulheres egípcias. A pesquisa, portanto, buscou desqualificar os quadros de opressão desconstruindo-os e os seus idiomas, além disso, através de articulações das líderes egípcias que estão envolvidas nos direitos das mulheres, direta ou indiretamente. Isto foi realizado por meio de entrevistas semiestruturadas, onde carrego as minhas próprias ressonâncias com elas como mulher egípcia, como intérprete e produtora da pesquisa, em que minha própria voz está presente em todo o trabalho. As entrevistas revelam que as vozes das mulheres egípcias, muito menos das Árabes, são claramente não homogêneas e diversas, cada uma com histórias importantes para compartilhar. Embora existam variações entre perspetivas, elas devem ser vistas e ouvidas. A distância relacional entre as mulheres é vista no Cairo, entre o Cairo, nas cidades exteriores e nos níveis de educação. Isso reflete a importância do intercâmbio no discurso dos direitos das mulheres no Egito e entre os feminismos do Sul e do Norte. As epistemologias deveriam, eventualmente, procurar ouvir e convidar as mulheres do Sul a produzirem seu próprio conhecimento sobre o mundo, nos direitos das mulheres e, mais crucialmente, sobre si mesmas.

Abstract:
This dissertation describes the genesis of the idea of femicide in a period of English and American Letters, the last decade of the eighteenth century and the first half of the nineteenth century, in which patriarchal values and constructions were entering a crisis which resulted in the revision of the idea of gender—in a way, that was the period in which the concept of gender was coded. In the first chapter, I look at the way the term femicide was first given currency in the English language in 1827 through Robert Macnish’s The Confessions of an Unexecuted Femicide, a fiction disguised as a true story, and how it spawned a short-lived literary sub-genre. In the second chapter, I examine Poe’s reworking of the femicide story, and to the ways in which he has drawn attention to its Gothic roots. Finally, in the third chapter, I offer a reading of Memoirs of the Author of ‘A Vindication of the Rights of Woman,’ in which I argue that Godwin’s “sentimentalised” portrait of Mary Wollstonecraft, and by extension of the female intellectual, constitutes an implicit refutation of her ideas, and therefore can be profitably compared to the portraits Poe’s femicide narrators make of Morella and Ligeia in the tales named after them.
Esta dissertação descreve a génese da ideia de femicídio durante um período nas letras Anglo-saxónicas, entre a última década do séc. XVIII e meados do século seguinte, em que os valores e elaborações ideológicas patriarcais entravam numa crise que conduziria a uma revisão da ideia de género (de certo modo, poder-se-ia mesmo dizer que é nesse período que o conceito de género começa a ser codificado). No primeiro capítulo, descrevo como o termo femicídio ganhou pela primeira vez projecção na língua inglesa depois da publicação, em 1827, de The Confessions of an Unexecuted Femicide de Robert Macnish, uma ficção apresentada ostensivamente como relato verídico que deu origem a um efémero sub-género de ficção, a que chamo “história de femicídio.” No segundo capítulo examino a reinterpretação da história de femicídio por Edgar Allan Poe, e sobre o modo como este autor pôs em evidência as suas raízes góticas. Finalmente, no terceiro capítulo, apresento uma leitura de Memoirs of the Author of ‘A Vindication of the Rights of Woman’ em que argumento que o retrato “sentimentalizado” que Godwin aí faz de Mary Wollstonecraft, e por extensão da mulher intelectual, porquanto constitui uma refutação implícita das ideias dessa autora, ganha em ser comparado com os retratos que os narradores femicídas de Poe fazem das suas esposas em “Morella” e “Ligeia.”
