Full textThe recent changings of broadcasting systems supervened during the eighteens in the ec countries put the problem of self-sufficiency of europe for television programmes (fiction, documentary, cartoons)). After the end of public service monopolies, the national structures of production have been unable to satisfy the demand of new private channels. The risk of weighty deficiency for programmes increased with appearing of satellite tv which number is not limited by the rareness of terrestrial frequencies. The world is dominated by the united states of america, that justify an european reaction in front of an possible attack of its cultural identity. A new construction of european audiovisual industry is requisite. Ways of production and financing have to be changed in order to satisfy the wants of european and international market in traditional programmes, and soon in high definition. Reduction of european deficiency can also occur by growth of intra-european circulation of audiovisual products. In order to realize those aims, states and european institution propose incitative and constraining policies

Full textThe Turkish mass-medias have a great influence and play a dominant role in shaping the public opinion and giving trends regarding evolutions of relationships between the EU and Turkey. Let us recall that the Helsinki summit in December 1999 approved its candidature to become full member of the EU. This candidature was refused on December 17, 1989 by the EC for economic and demographic reasons, but masking others, of a cultural and religious nature : the freezing of relations was unavoidable. The years 1990 will mark the brutal collapse of the USSR, reducing the place of Turkey in the favor of east european countries. In spite of the Association council EC-Turkey confirming criteria equality for all the applicant countries, the Luxemburg summit of December 1997 plead an economic delay and democratic deficiencies to move it apart from the European field. Having a chaotic but competitive economy, a dynamic society and a domestic market supported by a strong purchasing power from part of the population, Turkey has good chances. The permanence of a high inflation rate since the 90's and an uneven distribution of incomes remain nevertheless its weak points. Having the essential characteristics of a modern and laic State, the country is slow in implementing the institutional reforms needed to harmonize democracy and State of right as in European countries. The political and social life, since Mustafa Kemal Atatürk reforms, has been modelled on a Europeanization basis. The EU would be well advised to reinforce this large neighbor and NATO allied so that it can be viewed as model by other countries of the region. Its implication in Balkans along with Greek-Turkish relationships evolution are signs going in this direction. From the point of view of the European security, Turkey can assert its key position within the NATO. Suffering from a negative image, it must use new technology for get rid of generally accepted ideas. Its strengthening in various interior fields remains ignored by international opinion public. Having however the support of the United States and the invitation of Europe, an eventual final refusal is actually not on the air. Progress made to integrate the EU is a boosting factor, having to be used for the country and its population

Full textIn the recent years, the audiovisual sector has seen a signifiant evolvement and development in the states members of OCDE. This expansion has been accompanied by development of the private audiovisual sector and a correlating unprecedented merger movement in the media sector both in Europe and the United-States. Faced with this movement, most of the democratic states are concerned as to the high level of integration of such a special sector. Consequently, by its potential negative impact on pluralism (and even to the democracy itself), they have tried to limit risks against pluralism. The methods used by these states have mainly focused on competition law and media law. Whether media law provisions, especially audiovisual communication law provisions, are effective tools sufficient to ensure pluralism, would not seem to be the case. Moreover, with technological changes in progress, we may wonder if the media sector should not merely and purely be subject to antitrust law, which is becoming more predominant in the media sector

Full textThis thesis proposes a reading of the representations of otherness in the press as a mean of constructing identity. On the basis of a French-Hellenic approach, we build a method for understanding the practices, the representations and also the bias of the mechanism for the construction of a European identity.The representation of otherness does not appear ex nihilo, but it participates in a strategy of repulsion and closure of the European identity towards the Other. This strategy is based in the transmission and the transformation of the discourses of differentiation that form an institutional mean for the construction of stereotypes towards the Other. Hence, another-space appears, into which the representation of reality it‟s reflected and crystallized.Therefore, a European identity it‟s constructed into a context of divergence, a fact that points out the stakes of its legitimization. Between an occidental heritage and different national interests, the policy for the construction of a European identity is established from a strategy of exclusion, which induce the European people to unite culturally in front of the risk of the Other

Full textEn ce qui concerne l’accès des émissions aux réseaux câblés, la thèse met en avant le besoin de sauvegarder un service public de l’audiovisuel. Celui-ci est défini comme un ensemble des règles qui visent à la fois le paysage audiovisuel propre à chaque Etat membre (par exemple pluralisme) et le contenu des émissions proprement dit (émissions informatives, éducatives, épanouissement culturel etc.). Le droit communautaire primaire et dérivé, tel qu’interprété par la Cour de justice, fournit les moyens de conciliation entre, d’une part les intérêts généraux et, d’autre part, les exigences découlant de la libre prestation de services et de la libre concurrence.
En ce qui concerne l’application des droits intellectuels, la thèse aborde la problématique liée à l’épuisement ou la subsistance de ceux-ci. Dans le cas de la câblodistribution, la Cour a affirmé la subsistance du droit. Cette position est corroboré par la nouvelle directive européenne sur le droit d’auteur et les droits voisins dans la société de l’information. La thèse appuie la position de subsistance en considérant qu’elle constitue une condition essentielle pour la juste récompense des auteurs.
Enfin, la thèse aborde les questions plus spécifiques qui naissent à propos de la convergence technologique et juridique. Tout d’abord, il est avancé que le service public de l’audiovisuel n’est pas uniquement lié à des contraintes techniques, mais essentiellement à des objectifs qualitatifs (contenu des émissions). Ainsi, la thèse plaide en faveur de la pérpetuité du service public de l’audiovisuel dans l’ère du numérique. Par ailleurs, des questions plus spécifiques (comme l’accès à la boucle locale, l’interconnexion des réseaux et la numérisation des infrastructures) ont été examinées.

For its part, the International Organization of Francophonie (IOF), which is not a regional integration organization, could not institute such an instrument and the Francophone identity is still at issue. Leaded by solidarity in a prospect of a long-lasting peace, these two international organizations have created tools of rapprochement in the fields of education, culture and media with the useful support of new information and communication technologies
