Tento článek pojednává o Nejvyšším soudu Japonska a o jeho zdráhavém přístupu k vlastní rozhodovací činnosti ve vztahu k moci zákonodárné a výkonné. Text je členěn na tři části. První část se zabývá otázkou vnitřní organizace Nejvyššího soudu Japonska a problematikou závaznosti jeho judikatury v japonském soudnictví. Druhá část popisuje spolupráci mezi jednotlivými složkami státní moci včetně důsledků tohoto provázání na rozhodovací praxi Nejvyššího soudu. V poslední části článku jsou pak diskutovány dvě vybrané skupiny rozhodnutí Nejvyššího soudu odrážející aktuální politické otázky a nástin postojů Nejvyššího soudu k těmto otázkám.

Cílem empirické studie je popsat výzkum představ žáka střední školy ve vybrané partii syntaktického učiva, konkrétně vztahů v souřadném souvětí, a reflektovat její současné didaktické zpracování v učebnicích i vyučovacím procesu. Jako výzkumný analytický rámec byl zvolen model didaktické rekonstrukce, jak jej popisuje Jelemenská, Sander a Kattmann (2003). Nejprve je představen výzkumný problém v obecné rovině, následuje bližší seznámení s problematikou z pohledu školní praxe. Dále je popsána metodologie výzkumu a jeho výsledky. Závěr tvoří shrnutí a diskuze výsledků a doporučení pro vyučování. Z výsledků výzkumu vyplývá, že tradiční postup při výuce zmíněné problematiky nedostatečně odráží komunikační zkušenosti žáků a jejich dosavadní poznání, neusiluje o její skutečné pochopení a rovněž neodpovídá požadavkům moderní didaktiky českého jazyka, neboť opomíjí komunikační cíl. Rozpory, které panují v této oblasti v akademickém diskurzu, nicméně jsou pro potřeby školské praxe zpřehledněny, se projevily také v myšlení zkoumaného subjektu. Výzkum ukazuje, že zásady fungování češtiny, o jejichž osvojení žáky škola usiluje, jsou snáze uchopitelné za podmínky, že vyučování pracuje s jazykovou výbavou žáků jako rodilých mluvčích a podporuje skutečné pochopení probíraného učiva na základě hluboké kognitivní činnosti.

V současném pojetí společného vzdělávání může učitel vykonávat přímou pedagogickou činnost v diverzní společnosti „různých“ žáků. Mezi nimi mohou být rovněž žáci a žákyně s cystickou fibrózou (CF). Jde o nevyléčitelné, progredující a smrtelné onemocnění, které svým nositelům přináší četné zásahy a limitace v každodenních aktivitách, včetně školských. Cílem přehledové studie je analyzovat, popsat a interpretovat vybrané oblasti života dětí, žáků/žákyní a studentů/studentek s tímto onemocněním, které mohou zakládat „jinakost/odlišnost“ v edukačním procesu a prostředí. Metodický rámec byl naplněn analytickou, syntetickou a interpretační činností v podobě monografické procedury založené na rešeršní činnosti zahraničních odborných článků a studií v dostupných databázích. Mezi tematické oblasti, které mohou u osob s CF zakládat „jinakost/odlišnost“, byla zařazena témata symptomatologie CF, přístupu okolí (stigma/stigmatizace, viktimizace, postoje okolí apod.), dále subjektivity stavu (prožívání, osobní zkušenosti, strach ze smrti, strach z progrese onemocnění, úzkost, naděje, deprese, resilience, self-efficacy), oblast žáky s CF „vyžadované“ podpory (psychologické, psychosociální, emoční, vztahové, rodičovské apod.) a rovněž specifika výchovně-vzdělávacího procesu. „Jinakost/odlišnost“ popisovaná v rámci CF spočívá ve specifických potřebách žáků, které vyplývají z případných změn zdravotního stavu a postojů jejich okolí. Současný stav vzdělávání v našich podmínkách, který respektuje požadavek společného vzdělávání, by měl případné „jinakosti/odlišnosti“ a rozdílnosti „stírat“, a to primárně efektivní pregraduální přípravou učitelů a kontinuálním vzděláváním v této oblasti.

The thesis focuses to define the concept of selected activities in construction and further entities which are allowed to conduct the activities in construction and what qualification is needed for them and what is their range of responsibility. The thesis is divided on two parts. The theoretical part deals to define the basic concepts, which origins in law. The practical part contains exact example on which are, used activities of authorized persons, their duties during the activities in construction and their responsibility. The essential part of the thesis are the proposals and recommendations, which could open the discussion for some future changes leading to more effective achievement in selected activities in construction.

This thesis focuses on the specification of specified construction activities, explaining the concepts related to this basic legislation. Here are given duties and responsibilities of authorized persons during the construction process. The description of qualifications that are needed for various activities in the construction industry is also included. This paper describes practical examples for a better understanding of this issue.

The issue of responsibility will always be actual in all human activities. In the construction industry and real estate engineering, the impact of human activities always have a tangible link, it seems to be the assessment of duties and responsibility of each participant seemingly simple. The opposite is true, however, as construction and real estate business has passed in the last few decades significant development so that some activities in these fields have become for the general public is almost unreadable. And not only the lay the general public, but also experts and professionals in the field are often lost in the complicated process of construction, of the various stages and its connections with individual activities which have result in the effective complex. Construction Law, building regulations and authorization law can not be regarded as something of directive and bureaucracy of the state and its institutions, but it needs to see them particularly in terms of protection when it was, is and will be primarily in the interests of professionals to clearly defined rules and limits of their activities. It is therefore in the interest of authorized persons to best oriented in the regulations so that they help to improve the performance of their profession. For each authorized person working in the construction industry is important to know the extent of its competences, duties and responsibilities. Without knowledge of these principles can not be selected activities done and can not fulfill their purpose and definition - which is certainly a quality building work which meets all requirements with respect to all subjects of its surroundings. The knowledge gained from this work should serve to simplify the view of the complicated system building regulations for obtaining a healthy perspective and eliminating concerns of this difficult structure. Diploma work does not attempt to change regulations, but rather to understand their meaning and purpose, and point out their necessity. It can be said that knowledge of the legal context is a necessary condition for the performance of selected activities in construction. In any architect, designer and site management must have been a piece of "lawyer", when these people will be able to clearly understand the regulations not only in their profession, but also in connection with the other professions. Based on the findings contained in this thesis it is possible to establish for example open discussion, whether or not to introduce more fields in the building educational system, such as the real estate engineering at USI in Brno, whether and how to create the most appropriate implementation of the construction legal system in the curricula of technical faculties, how to create conditions for systematic knowledge of construction law of authorized persons throughout their careers.

Práce hodnotí a popisuje personální činnosti, zaměřuje se na oblasti týkající se motivace zaměstnanců, náboru pracovníků, metodik výběrového řízení, problematikou assessment centre a marketingem personálního útvaru. Dále práce představuje možnosti získávání praxe pro studenty studující na vysokých školách a samozřejmě následné uplatnění těchto absolventů na pracovním trhu. Práce také analyzuje možnosti benefitů a sociálních programů pro zaměstnance, jejich výhodnost a účelnost.

Thesis deals with the implementation of human resources in a particular organization. Its main objective was to assess the personnel activities and to propose measures that would help to streamline the activities. The work is divided into four chapters. The first part summarizes the theoretical principles that are the basis for the evaluation of selected personnel activities. The second chapter briefly describes the company, who does not wish to disclose their business name. The third part is focused on description of activities carried out by staff. Its structure corresponds to the first chapter intentionally. Based on PEST analysis were evaluated possible problem areas and a strong areas of the company. Activities are carried out by staff at a good level, level of care for employees is premium. There were, however, found some deficiencies, particularly in the description of positions-content and planning jobs. The conclusion summarizes the findings and formulated recommendations for improvement. For processing thesis was used professional literature, Internet sources, personal interviews with the staff of the company and internal documents.

The aim of this thesis is based on theoretical knowledge and analysis of the basic HR activities in the selected company to identify the strengths and weaknesses of the policies implemented personnel work. Then propose an effective ways of improving HR activities and employee satisfaction. Basic personal activities analyzed in this thesis are the adaptation, acquisition and selection of employees, performance management and staff appraisal, remuneration and training of staff. Analysis of personal work and personal activities is carried out by observation and inquiry. Observations Concerning the work recruiters. Querying applies to employees and their view on the personnel work in the company. Conclusions include an assessment of individual personnel actions based on author's experience and opinions of employees. The conclusions include suggestions for improving analyzed HR activities.

This master's thesis has been created in order to enhance the security, reliability and quality of specific biometric devices and in order to achieve higher work efficiency of specific company. Both existing biometric devices and one new prototype have been chosen for the evaluation. First it was necessary to acquire the basic principles and structure of analyzed subjects. In order to achieve the goals, several risk analyses have been performed. Based on results of performed analyses the most key threats have been identified. For these threats the corrective actions have been suggested in order to make the probability of these threats as low as possible. This thesis also contain the results of performed analyses and benchmarking of the devices from the risk point of view.

Teoreticko-metodologická část obecně popisuje personální útvar a jeho funkce, charakterizuje jednotlivé personální činnosti (získávání a přijímání pracovníků, hodnocení a rozvoj pracovníků, pracovní vztahy, péče o zaměstnance, personální informační systém). Praktická část se zabývá základní charakteristikou firmy, popisuje personální útvar a personální management vybrané firmy, charakterizuje a hodnotí personální činnosti analyzované společnosti a poskytuje doporučení a návrhy pro personální management.

This thesis deals with communication barriers and their impact on the results of the work process and group climate. It explains the concept of communication, elements of communication process and the basic division of communication, verbal communication, nonverbal communication, effective communication and its elements, requirements for effective communication, communication with managers, managerial communication strategy, the specifics of communication in health care management and internal communication. The thesis further analyzes communication barriers from the perspective of different authors, which is crucial for the practical part, where the results of questionnaire-compiled charts reflecting the different communication barriers from different angles are used. Two sets of questionnaires were developed: one for senior staff and one for subordinates. The group examined was a closed working group in one hospital in the Czech Republic. In the discussion section, results of the research are evaluated and recommendations for the prevention and elimination of the communication barriers are given. The main aim of this work was improvement of communication between employees at all levels and between all levels, increasing the efficiency of manpower and making the working environment more attractive, thus increasing the satisfaction of all employees of this working group.

The work is focused on selected aspects of interaction and communication between investigator and investigated person in investigation of serious criminality. The primary social-psychological point of view on this interaction tries to stay within the applied focus to the field of investigative psychology. At the beginning the work is focused on important investigative conditions and also social-psychological context. After that it 5 moves to specific conditions on the side of investigated person, to motivation of participation in criminal investigation, to the topic of suggestibility and its role in testimony, importance of psychological disorders in the interaction with the investigator and context of investigation. Another topic is testimony as a result of interaction between investigator and investigated person, this chapter is more specifically focused on problem situations and a question of deceitful testimony. Following is the topic of social pressure in investigation and its different manifestations. The attention is devoted more thoroughly to different approaches of persuasive information processing as a bases for deeper understanding of specific interviewing techniques.
