Full textOs direitos à imagem e à reserva sobre a intimidade da vida privada têm algumas particularidades quando os seus titulares ainda se encontram na fase da menoridade e são, por isso, incapazes de exercer os seus direitos. A difusão da internet e dos aparelhos eletrónicos trouxe consigo uma nova perspetiva para os direitos de personalidade com novos problemas legais que nunca se haviam colocado. Dentro desta perspetiva, e atendendo aos princípios orientadores do direito das crianças, consideramos que o entendimento atual da menoridade e os instrumentos legais hoje existentes podem revelar-se insuficientes para uma adequada proteção dos direitos à imagem e à reserva sobre a intimidade da vida privada. Esta dissertação pretende, num primeiro momento, mostrar a inadequação do entendimento tradicional do sistema português de menoridade para, posteriormente, proceder a uma articulação entre o exercício das responsabilidades parentais e a proteção dos direitos de personalidade das crianças.Os direitos à imagem e à reserva sobre a intimidade da vida privada têm algumas particularidades quando os seus titulares ainda se encontram na fase da menoridade e são, por isso, incapazes de exercer os seus direitos. Image and privacy rights have some particularities when holders are children or young people, finding themselves in a wardship stage in which they are unable to exercise their own rights. The dissemination of the internet and the electronic devices brought a new perspective in the understanding of personality rights with new legal issues that have never been seen. Within this outlook, and giving the main principles on children rights, we considered that the traditional understanding of the wardship and the existing legal mechanisms might be unable to properly protect their rights of image and privacy.
