Les activités de distribution et d’entreposage sont des piliers importants de la chaîne d’approvisionnement. Ils assurent la stabilité du flux de matières et la synchronisation de toutes les parties prenantes du réseau. Un centre de distribution (CD) agit comme un point de découplage entre l’approvisionnement, la production et les ventes. La distribution comprend un large éventail d’activités visant à assurer la satisfaction de la demande. Ces activités passent de la réception au stockage des produits finis ou semi-finis, à la préparation des commandes et à la livraison. Les opérations d’un CD sont maintenant perçues comme des facteurs critiques d’amélioration. Elles sont responsables de la satisfaction d’un marché en évolution, exigeant des délais de livraison toujours plus rapides et plus fiables, des commandes exactes et des produits hautement personnalisés. C’est pourquoi la recherche en gestion des opérations met beaucoup d’efforts sur le problème de gestion des CDs. Depuis plusieurs années, nous avons connu de fortes avancées en matière d’entreposage et de préparation de commandes. L’activité de préparation de commandes est le processus consistant à récupérer les articles à leur emplacement de stockage afin d’assembler des commandes. Ce problème a souvent été résolu comme une variante du problème du voyageur de commerce, où l’opérateur se déplace à travers les allées de l’entrepôt. Cependant, les entrepôts modernes comportent de plus en plus de familles de produits ayant des caractéristiques très particulières rendant les méthodes conventionnelles moins adéquates. Le premier volet de cette thèse par articles présente deux importants et complexes problèmes de manutention des produits lors de la préparation des commandes. Le problème de préparation des commandes a été largement étudié dans la littérature au cours des dernières décennies. Notre recherche élargit le spectre de ce problème en incluant un ensemble de caractéristiques associées aux installations physiques de la zone de prélèvement, comme les allées étroites, et aux caractéristiques des produits (poids, volume, catégorie, fragilité, etc.). Une perspective plus appliquée à la réalité des opérations est utilisée dans notre développement d’algorithmes. Les déplacements liés à la préparation des commandes sont fortement influencés par le positionnement des produits. La position des produits dans la zone de prélèvement est déterminée par une stratégie d’affectation de stockage (storage assignment strategy). Beaucoup de ces stratégies utilisent de l’information sur les ventes des produits afin de faciliter l’accès aux plus populaires. Dans l’environnement concurrentiel d’aujourd’hui, la durée de vie rentable d’un produit peut être relativement courte. Des promotions peuvent également être faites pour pousser différents produits sur le marché. Le positionnement fourni par la stratégie d’hier ne sera probablement plus optimal aujourd’hui. Il existe plusieurs études mesurant l’impact d’une bonne réaffectation de produits sur les opérations de prélèvement. Cependant, ils étudient la différence des performances avec les positionnements passés et actuels. La littérature démontre clairement que cela apporte des avantages en termes d’efficacité. Toutefois, les déplacements nécessaires pour passer d’une position à une autre peuvent constituer une activité très exigeante. Ceci constitue le second volet de cette thèse qui présente des avancées intéressantes sur le problème de repositionnement des produits dans la zone de prélèvement. Nous présentons le problème de repositionnement des produits sous une forme encore peu étudiée aux meilleurs de nos connaissances : le problème de repositionnement. Plus précisément, nous étudions la charge de travail requise pour passer d’une configuration à l’autre. Cette thèse est structuré comme suit. L’introduction présente les caractéristiques et les missions d’un système de distribution. Le chapitre 1 fournit un survol de la littérature sur les principales fonctions d’un centre de distribution et met l’accent sur la préparation des commandes et les décisions qui affectent cette opération. Le chapitre 2 est consacré à l’étude d’un problème de préparation de commandes en allées étroites avec des équipements de manutention contraignants. Dans le chapitre 3, nous étudions un problème de préparation des commandes où les caractéristiques des produits limitent fortement les routes de prélèvement. Le chapitre 4 présente une variante du problème de repositionnement (reassignment) avec une formulation originale pour le résoudre. La conclusion suit et résume les principales contributions de cette thèse. Distribution and warehousing activities are important pillars to an effective supply chain. They ensure the regulation of the operational flow and the synchronization of all actors in the network. Hence, distribution centers (DCs) act as crossover points between the supply, the production and the demand. The distribution includes a wide range of activities to ensure the integrity of the demand satisfaction. These activities range from the reception and storage of finished or semi-finished products to the preparation of orders and delivery. Distribution has been long seen as an operation with no or low added value; this has changed, and nowadays it is perceived as one of the critical areas for improvement. These activities are responsible for the satisfaction of an evolving market, requiring ever faster and more reliable delivery times, exact orders and highly customized products. This leads to an increased research interest on operations management focused on warehousing. For several years, we have witnessed strong advances in warehousing and order picking operations. The order picking activity is the process of retrieving items within the storage locations for the purpose of fulfilling orders. This problem has long been solved as a variant of the travelling salesman problem, where the order picker moves through aisles. However, modern warehouses with more and more product families may have special characteristics that make conventional methods irrelevant or inefficient. The first part of this thesis presents two practical and challenging material handling problems for the order picking within DCs. Since there are many research axes in the field of warehousing operations, we concentrated our efforts on the order picking problem and the repositioning of the products within the picking area. The order picking problem has been intensively studied in the literature. Our research widens the spectrum of this problem by including a set of characteristics associated with the physical facilities of the picking area and characteristics of the product, such as its weight, volume, category, fragility, etc. This means that a more applied perspective on the reality of operations is used in our algorithms development. The order picking workload is strongly influenced by the positioning of the products. The position of products within the picking area is determined by a storage assignment strategy. Many of these strategies use product sales information in order to facilitate access to the most popular items. In today’s competitive environment, the profitable lifetime of a product can be relatively short. The positioning provided by yesterday’s assignment is likely not the optimal one in the near future. There are several studies measuring the impact of a good reassignment of products on the picking operations. However, they study the difference between the two states of systems on the picking time. It is clear that this brings benefits. However, moving from one position to another is a very workload demanding activity. This constitutes the second part of this thesis which presents interesting advances on the repositioning of products within the picking area. We introduce the repositioning problem as an innovative way of improving performance, in what we call the reassignment problem. More specifically, we study the workload required to move from one setup to the next. This thesis is structured as follows. The introduction presents the characteristics and missions of a distribution system. Chapter 1 presents an overview of the literature on the main functions of a DC and emphasizes on order picking and decisions affecting this operation. Chapter 2 is devoted to the study of a picking problem with narrow aisles facilities and binding material handling equipment. In Chapter 3, we study the picking problem with a set of product features that strongly constrain the picking sequence. Chapter 4 presents a variant of the reassignment problem with a strong and new formulation to solve it. The conclusion follows and summarizes the main contributions of this thesis. Kund X efterfrågar en RFID-märkning på artikelnivå för att bland annat dra fördelar av en sådan teknik vid lagerinventering. För att PostNord TPL:s största kund ska kunna ta steget mot att implementera en RFID-lösning ute i butikerna, så krävs det att lagret i Ljungby implementerar tekniken först. PostNord TPL:s tanke, utefter kundens önskan att erbjuda dem denna tjänst, är att all RFID- märkning av Kund X artiklar sker på lagret i Ljungby. Denna studie är unik i sitt slag dels för att det förekommer ett stort forskningsgap i den existerande forskningsteorin med användning av RFID-teknik inom TPL, men att studien också fokuserar på RFID-märkning på artikelnivå.  Syfte: Syftet med studien är att föreslå riktlinjer för en implementering av RFID inom TPL i in- och utleveransprocessen. Riktlinjerna innehåller kategorisering av relevanta variabler för RFID-implementering samt implementeringsprocessen och kostnadskalkyl.  Metod: Denna studie är en fallstudie på företaget PostNord TPL i Ljungby. Forskarna har tillämpat en mönsterjämförelse där teorin och empirin har jämförts. Empirin har samlats in genom målstyrt urval och snöbollsurval, där semistrukturerade och ostrukturerade intervjuer med ett flertal olika aktörer har genomförts. Studien grundar sig i en kvalitativ forskningsmetod med ett deduktivt angreppssätt.  Slutsats: Studien har analyserat tre forskningsfrågor, där den första är mer generell inom TPL och de andra två riktar sig mot PostNord TPL förutsättningar. Studien har tagit fram förslag på vilka variabler som är relevanta vid implementering av RFID inom lagerverksamhet i TPL och hur de kan kategoriseras. Vidare har studien visat i vilken lagerhanteringsprocess RFID kan implementeras hos PostNord TPL och hur en sådan implementeringsprocess kan se ut. This study is unique in its kind, partly because there is a large research gap in the existing research theory using RFID technology within TPL, but also because the study focuses on RFID labeling at article level.  Purpose: The purpose of the study is to propose guidelines for an implementation of RFID within TPL in the inbound and outbound process. The guidelines contain a categorization of relevant variables for RFID implementation as well as the implementation process and cost calculation.  Methodology: This study is a case study at the company PostNord TPL in Ljungby. The researchers have applied a pattern comparison where the theory and empiricism have been compared. The empirics have been collected through goal-directed selection and snowball selection, where semi-structured and unstructured interviews with a number of different actors have been conducted. The study is based on a qualitative research method with a deductive approach.  Conclusion: The study has analyzed three research questions, where the first is more general within TPL and the other two focus on PostNord TPL conditions. The study has produced suggestions on which variables are relevant when implementing RFID within warehousing operations in TPL and how they can be categorized. Furthermore, the study has developed in which inventory management process RFID can be implemented at PostNord TPL and what such an implementation process can look like. Finally, three different cost calculations have also been produced for an RFID implementation in the inbound and outbound process at PostNord TPL.

Data Warehouses have been traditionally accepted as a subject-oriented, integrated, non-volatile, time-variant collection of data in support of management's decisions. They support the process of top and middle management decision-making and the organization's strategic planning processes. Their use to support operational data requirements as well has been somehow controversial by being either supported or criticized by different authors. This thesis focuses on the identification, for a Data Warehouse containing some level of operational activities, of the reasons that may be driving this kind of activities into the Data Warehouse. The thesis is made up of two parts. The first part departed from a literature review of Data Warehouse concepts, its characteristics, its usage and its role into organizations to the general opinion concerning the support of operational activities in Data Warehouse environments. The second part describes a single case study used to search for evidences of operational support in a Data Warehouse environment and to identify possible reasons that may be forcing the Data Warehouse to support operational activities. The research findings show that, for the specific case of the organization studied, there is evidence of the support of operational activities in the organization's Data Warehouse and some evidence was collected concerning the reasons that motivate the localization of these activities. Finally, we will discuss findings and opportunities for further research.
Os Data Warehouses têm sido tradicionalmente aceites como uma coleção de dados orientados por assunto, integrados, não voláteis, com diferentes períodos temporais que suportam a tomada de decisões pela gestão. Suportam o processo de tomada de decisão pela gestão de topo e intermédia e os processos de planeamento estratégico da organização. A sua utilização para suportar igualmente requisitos de dados operacionais tem sido de alguma forma controversa sendo apoiada ou criticada por diferentes autores. Esta tese coloca o enfoque na identificação, para um Data Warehouse suportando um determinado nível de actividades operacionais, das razões que podem estar a desviar este tipo de actividades para o Data Warehouse. A tese é constituída por duas partes. A primeira parte partiu da revisão da literatura sobre os conceitos de Data Warehouse, as suas características, a sua utilização e o seu papel nas organizações, para a opinião geralmente aceite relativamente ao suporte de actividades operacionais em ambientes de Data Warehouse. A segunda parte descreve um único estudo de casos utilizado na busca de evidências de suporte operacional num ambiente de Data Warehouse e na identificação das possíveis razões que podem estar a forçar o Data Warehouse a suportar actividades operacionais. Os resultados da investigação mostram que, para o caso específico da organização estudada, existe evidência do suporte de actividades operacionais no Data Warehouse da organização e foi recolhida alguma evidência relativamente às razões que motivam esta localização de actividades. Por fim, serão analisadas as conclusões e oportunidades futuras de investigação.

O presente trabalho descreve um modelo para, a partir de Bancos de Dados Operacionais, projetar e implementar Bancos de Dados Analítico-Temporais, cujo principal objetivo é o de armazenar históricos de dados, os quais, por sua vez, visam servir de alicerce para, principalmente, auxiliar no processo de tomada de decisões de médio e longo prazo. O modelo é dividido em três atividades principais. Na primeira atividade o objetivo é mapear os Modelos de Dados Operacionais em um Modelo de Dados Unificado, sendo que este último modelo serve de base para a segunda atividade que é a geração do Modelo de Dados Analítico-Temporal. Para realizar essas duas primeiras atividades, foram elaborados alguns passos que englobam as principais características a serem verificadas e desenvolvidas. Na terceira atividade objetivou-se disponibilizar mecanismos que possibilitem a geração, o transporte e o armazenamento dos dados Analítico-Temporais. Para a realização dessa terceira atividade foram especificados gatilhos e procedimentos armazenados genéricos.
This work describes a model whose main objective is to store historic data, resulting in the Analytic-Temporal Databases. The origins of the data are the Operational Databases. This model can aid in the design and implementation of the Analytic-Temporal Databases that constitutes a very adequate foundation to help in the medium and long time decision taking process. The model is divided into three main activities. In the first activity the objective is to map the Operational Data Models into a Unified Data Model. This last model is the base for the second activity, which is the generation of the Analytical-Temporal Data Model. Considering these two activities, there were elaborated some steps, which encompass the main characteristics to be evaluated and developed. In the third activity the objective is to make available mechanisms, allowing the generation, the transport and the storage of the Analytical-Temporal data. For this third activity, there were specified generic triggers and stored procedures.

The main goal of this thesis is to summarize and introduce general theoretical concepts of Data Warehousing by using the systems approach. The thesis defines Data Warehousing and its main areas and delimitates Data Warehousing area in terms of higher-level area called Business Intelligence. It also describes the history of Data Warehousing & Business Intelligence, focuses on key principals of Data Warehouse building and explains the practical applications of this solution. The aim of the practical part is to perform the evaluation of theoretical concepts. Based on that, design and build Data Warehouse in environment of an existing company. The final solution shall include Data Warehouse design, hardware and software platform selection, loading with real data by using ETL services and building of end users reports. The objective of the practical part is also to demonstrate the power of this technology and shall contribute to business decision-making process in this company.

Due to highly development for import and export activity and shipper’s diversified needs, marine transit need promote in full scale to achieve the target of competitiveness improving. Now the interaction between the range of warehousing activities and activities of enterprise, establishment of information system and equipment play an important role. In other word, efficiency of warehouse system also influence the efficiency of logistic activity system. It prove the morden warehousing avtivity is very important for logistic system. In the process of warehousing activity for import and export, equipmental factors and contrived error often cause serious accident. These accident not only cause proprietary loss but also make warehousing activity break down. Generally speaking, import and export warehousing put emphasis on the efficiency and cost-down. If any accident make warehousing activity break down, warehousing operator will suffer from huge loss of profit and trust. We believe how to achieve risk management by lowest cost is the key point for successful warehousing operator. Through experience of warehousing operator ,this research calculate average and standard deviation of risks by Likert Scale. It rank risk factor according to the level to recognize which risk factor is more important. At the same time this research can analyze potential frequency and severity of risks, finally provide policy to warehousing operators for import and export.

This study conducted a case analysis, in which work process planned prior to the construction of a factory and distributed inventory management practiced by an old factory were analyzed using the supplier–input–process–output–customer (SIPOC) table and value stream mapping (VSM). Aspects such as human resource structure, inbound process, receipt process, and outbound process were analyzed to identify areas of improvement, and a new automated operating procedure was introduced to diminish inefficient operations. The study results showed that the implementation of said procedure reduced waiting time from 2520 s to 1200 s (an improvement of 210%), which was lower than that for the old factory. The use of the new automated operating procedure is expected to help the case company decrease 65.8% of its manpower, lower waiting time, and offer a suitable centralized warehouse management procedure for its new factory.

Although the RFID technology has been developed as early as WWII, due to the cost exorbitant and the whole structure has not been mature, until last few years has been widely applied. There are many successful applications such as metro ticket, exercise competition, security of entrance guard , biochips, cargo tracking , medical administration , even in supply chain and the logistics in Iraqi war also can be seen the RFID tech and obtained effective of well-monitoring and fine-management by the RFID tech successful application. With the martial rhythm is continual accelerating, in order to well-support the combat operations and tasks, well-control and trace the supply term, if we can introduce RFID tech into ROC. Armed Forces logistic operations, we can reach the “Lean Logistic” status by RFID system’s characteristics include total asset visibility and real time responding, which optimizes the efficiency of logistic operations. At present, RFID system has not been practical applied in ROC. Armed Forces logistic operations. Therefore, many related documents just stay in the tech research and practicing-evaluation. Policy-makers still have reservation and keep doubt toward to should RFID been introduced. Hence, this research utilizes 6-sigma process improvement tool(DMAIC) and Unified Modeling Language(UML) to decompose current warehousing operations, then build a module which RFID has been introduced. Compare with as-is and to-be modules and tell if to-be ones can obviously improve Combined Logistic unit’s warehousing operations. Finally, provide a reference example for policy-makers to establish RFID systems in days to come.

Development of Taiwan’s logistics was started later then the developed countries, such as, Hong Kong, Japan and Singapore, but it is gradually in the trend of developing recent years. In addition to the newly-established logistics, former transportation companies are gradually transforming into full-scale logistics operations, including warehousing and picking-related businesses. Due to this reason, it is worthwhile discussing whether companies starting logistics business fully make use of their resources. DEA (Data envelopment analysis) is adopted in this research to analyze the operational performance of transportation and warehousing related companies and discuss the difference of different style companies’ efficiency. CCR, BCC, A&P and simple cross efficiency model are adopted to carry out efficiency analysis of the data of fourteen local transportation and warehousing companies from 1998 to 2002. Through efficiency analysis, we know inefficiency is due to improper operation of return to scale or improper use of resources. Then, slack variable analysis is adopted to improve the input resources. Finally, sensitive analysis is used to find out how the change of sets of input influences efficiency. The input that has greatest influence is found out to help companies acquire the advantage of enhancing efficiency. The research results show that through various model analysis, Tait and Wan Hai transportation and warehousing companies rank top among fourteen companies in terms of operation performance. Land transportation and warehousing companies comprise a large percentage of inefficiency companies. Because of too much input of “number of employees,” this kind of companies lack in overall efficiency. In general, “operation cost” is the input that has greatest influence on company efficiency. Therefore a proper control of operation cost will help the enhancement of efficiency. Keywords: Data Envelopment Analysis (DEA), logistics operation.

Analysis of the Efficiency of Pre & Post Privatisation of Keelung Harbour Warehousing Operation Candidate: Hu Ti-chi Adviser: Prof. Huang Cheng-chuan Graduate Institute of Transportation, National Chiao Tung University Abstract Being a nation of island economy, ocean shipping is critical to Taiwan. On account of which, the government has been actively promoting the Plan for Asia Pacific Regional Ocean Shipping Transit Centre with the hope of developing Taiwan into a cargo transit centre with added-value activities in the East Asia region. Toward such ends, the enhancement of harbour operation efficiency and competitiveness has become a vital issue. Privatisation has become the instinctive reaction for many governments in solving the low efficiency problem of state business operations. To salvage Keelung Harbour''s progressing decline, propelled by the government policy, Keelung Harbour''s warehousing was released to the private sector on car-park January 1999 following the Kaohsiung Harbour. This study is focused on Keelung Harbour; related data before and after the privatisation have been gathered, and through statistical analysis, the loading/unloading efficiency of varied cargo categories, the efficiency of recruiting workers for the loading/ unloading, the machine loading/unloading efficiency and the financial status of the department of port affairs are used as indices in gaining indepth understanding of post-privatisation operation efficiency of Keelung Harbour. The statistical evaluation shows that in cargo loading/unloading efficiency, other than grains and other cargoes, the operation of cargo containers and loose cargoes has shown significant growth after the privatisation. With the worker and machinery efficiency, the operation of all cargo categories show apparent progress after the privatisation. In addition, with the financial indices, although the department of port affairs shows slight decline in income and mild increase in expenditure, the situation would not impose excessive burden on to the department of port affairs. Overall, Keelung Harbour has demonstrated actual results after the privatisation. Nonetheless, certain parts of the system remain to be improved. Therefore, in addressing the problems entailed from privatisation, this study further proposes pragmatic practice of port order management, stringent control of service quality, prevention against malicious price reduction competition and sound corporate management concept with the hope of service to the government and related organisations in the future.

The logistics has become the competitive power of business, many enterprises in order to increasing competitive power and reducing cost, which endeavored to streamline organizations. They also moved their production lines to overseas plants or better produce manufactures, and effectively uses its competitive advantage to set up the logistics strategies. This research discusses operational performance in Taiwan’s sixteen companies during for 2002-2006 year, including five inputs and one output. At first, we use analytic hierarchy process(AHP)to design questionnaire and makes questionnaire to survey. It is expected to extract the important perspectives of logistics experts. And then use data envelopment analysis(DEA)to evaluate the performance of logistics companies、reference set analysis、sensitivity analysis and slack variable analysis, to offer inefficiency units the improvement direct suggestions. Then, we use the malinquist productivity index(MPI)to evaluate productivity during the five years, and according to sixteen logistics of the company different businesses, we segment it to the international logistics and domestic logistics. In conclusion, the results show that through various model analysis of discovery, most of all the inefficient companies cause from its scale inefficiency, and the companies are still at scale efficiency increasing phrase. Therefore; the companies should expand its scale to increase operational performance. Finally, through the sensitivity analysis to proceed the variables variation to find competitive advantage item, and provide the logistics industries to decide its logistics strategies of reference information.

This study investigated the operational performance of logistics and warehousing industries of various counties/cities in Taiwan from 1991 to 2006. In addition, data envelopment analysis was used as the operational performance assessment model, where the number of employees, labor remuneration, floor area, and net value of fixed assets were used as input, gross output was used as output, and current assets were used as intermediate goods. Efficiency analysis, slack analysis, Malmquist productivity index analysis, and dynamic network DEA were performed in order to understand the general status of the operational efficiency of logistics and warehousing industries of various counties/cities. Moreover, this study investigated the direction and range of efficiency improvement and provided such information as reference for development of governmental regional industrial policies and improvements of regional industrial competitiveness. Efficiency analysis found that, in the past 15 years, an increasing return to scale was observed in the development of logistics and warehousing industries in 23 counties and cities in Taiwan. The operational scale has room for expansion, and was at the growth phase of the industry life cycle. Malmquist productivity index analysis showed that, from 1991 to 2006, the average change of total factor productivity, technical efficiency, and technological innovation were all greater than 1. Such information suggested that, over the past 15 years, technical efficiency and technological innovations of logistics and warehousing industries in Taiwan made significant progress. In consideration of the effects of inputs, deferred outputs, and intermediate goods, as opposed to static DEA, dynamic network DEA had greater application to the assessment of the operational performances of regional industries.

With the trend and popularity of sports and leisure, bicycle industry drives the demand of its related parts, making the annual supply remain high. However, enterprises must have a sound system and continue with improvement and pursuit of perfection so as to create a wide variety of products with high quality as required by consumers. In recent years, the cost of mainland manpower rises, so some enterprises will shift their production center to Southeast Asia or return to the original old factories in Taiwan. The case company also highlighted the current lack of manpower and personnel, the disordered system and the old plant and equipment etc. in Taiwan factory due to the surge of orders. It is a worry for many traditional industries remaining in Taiwan that how the undesirable situation of current system and processes could be improved by use of the minimum investment and ways. This study will apply lean production and management thinking to improve the case company, re-examine the real value in warehouse operation management to remove unnecessary waste, and explore and improve each process problems in warehouse operations by implementing 5S improvement and seven activities of waste reduction; only producing the quantity meeting customer needs pull way in order to improve the efficiency of warehousing operation and ensure the quality of supplies. It’s found that after the application of lean production management thinking in warehouse operation management, the storage information of warehouse materials becomes more clear; scrap materials can be disposed quickly; goods road turns are unobstructed; materials are placed neatly and easily to send and receive; distance of goods picking and completion time of work orders are shortened, thereby making goods picking efficiency increase by 40%. Enterprises can provide the necessary number of production processes if necessary, meeting customer needs by guaranteeing the quantity and finish time and eliminating waste maintain so as to enable employees to maximize their potential and strengthen the company’s future competitiveness.

Taiwan International Commercial Ports amended partial article of chapter 3 and 4 of the Regulations on Wharf and Transit Sheds at Commercial Port for privatization on the stevedoring and warehousing operations in Jan.2004. Because the individual context conflicted with the regulations, and drove a lot of issues for covering privatization. Law for Promotion of Private Participation Infrastructure Projects promulgated in Feb.2000. The Port Authority runs wharf and transit shed facilities whether based on the Commercial Port Law or Law for Promotion of Private Participation in Infrastructure Projects, the concurrence of laws was perplexed at the authorities. Government Procurement Act assized in May 1998. Tendentiousness occurred repeatedly on selection investor procedure. Administrative Procedure Act enacted in Mar. 2000, the current privatization law correspondence with Principle of legal reservation and Principle of explicit authorization by law was remaining to be discussed. The above-mentioned laws should be conferred on applications. This thesis is studied by historical research, inductive approach and comparative approach. The privatization on the stevedoring and warehousing operations was illustrated and stated its history, status and relevant regulations. As well as collected the data from Keelung, Taichung and Kaohsiung Ports. The conclusions and suggestions are summarized below. 1.Before the Regulations on Wharf and Transit Sheds at Commercial Port in 2004, there were two methods for privatization, one was to run wharf and transit shed facilities, and the other was to run ship cargo stevedore, after amending only a running wharf and transit shed facilities. 2.The relevant laws and regulations of privatization on the stevedoring and warehousing operations are Commercial Port Law, the Regulations on Wharf and Transit Sheds at Commercial Port and Law for Promotion of Private Participation in Infrastructure Projects. The application and evaluation law for running wharf and transit shed facilities is Government Procurement Act. The supervision and administration law for privatization is the Regulations on Port Services at International Commercial Port. The article of lease for running wharf and transit shed facilities is in Civil Code Part Ⅱ Obligations. There are presented items by the paper. 3.The concurrence of laws in Commercial Port Law and Law for Promotion of Private Participation in Infrastructure Projects is to amend article 12, to append 12-1 in Commercial Port Law, and to delete subparagraph 1 of paragraph 4 of Article 2 in The Enforcement Rules of Law for Promotion of Private Participation in Infrastructure Projects. 4.The rule of article 84-1 and 90 of the Regulations on Wharf and Transit Sheds at Commercial Port violates the Administrative Procedure Act of Principle of legal reservation and Principle of explicit authorization by law. The suggestion is to amend paragraph 3 of Article 15,Article 23-2 in Commercial Port Law, and to amend Article 90 in the Regulations on Wharf and Transit Sheds at Commercial Port. There is an explicit authorization by Commercial Port Law for approval application, abolishment and concessions in the chapter 4「ship cargo stevedore operator」. 5.A state-run or private enterprise according to chapter 3 of Regulations on Wharf and Transit Sheds at Commercial Port has an agreement with the government, runs ship cargo stevedore ,and should follow chapter 4 article 84-1 and 86 to apply the commercial port authority for a permit. In accordance with the spirit, it is not proper the right of public law is vested in contracts of private law. 6.Because inexplicit authorization by law, it is not proper for commercial port authorities to constrain ship cargo stevedore operator to give priority to hire existing stevedores. The commercial port authorities could coordinate private enterprise to hire existing stevedores legally. 7. The Detailed Regulations for running wharf and transit shed facilities is a class of Directions. Its contents of application and evaluation should be according to Government Procurement Act and its relevant rules. 8.The agreements of running wharf and transit shed facilities are lease. To respond the change of economy and management circumstances, the agreements could be amended through negotiation and discussion based on the mutual benefit or frustration of contract.
