This thesis investigates the extent to which human rights law may be used to challenge the forced eviction of people who live in public space under public space laws. The specific case study is the operation of Darwin City Council By-law 103, which bans camping, or adults sleeping in a public place between sunset and sunrise. The by-law is used to criminalise or forcibly evict people who live in public space in Darwin in the Northern Territory. This thesis is an intensive study on the Guatemala City garbage dump community - a community of scavengers who work informally in the city's largest sanitary landfill. I argue that the garbage dump community is a 'forgotten' wasteland- a community that has continuously been treated as a subaltern population by the Guatemalan government, environmentalists, citizens, and the global economy at large. This thesis provides a comprehensive history of Latin American economic development and transformation into modern day neoliberal, free market economic policies as a form of hegemonic neocolonialism.

The conversion of industrial waste sites, also known as brownfields, into sustainable green space can impact the surrounding community in a number of ways. This thesis is a compilation of three case studies in low-income areas of Los Angeles which have all experienced a brownfield to green space conversion. All three projects are dictated by various stakeholders and are located at the intersection of economic and environmental issues. I examine how the stakeholders of these projects affect the process and design and in turn how the process and design affects the community surrounding the site.
