Abstract:
Chapter 4 provides an in-depth case study of water policy in Chile from the 1970s to present, including an evaluation of the outcomes of water policy under the privatized system from a human rights perspective. The chapter interrogates Chile’s reputation as a privatization success story, finding that although Chile meets the narrow definition of the human right to water and sanitation in terms of access, quality, and price, it fails to meet the broader definition that includes citizen participation in water management and policy decisions. The chapter argues that Chile’s relative success in delivering water services is attributable to strong state capacity to govern the water sector in the public interest by embedding neoliberal reforms in state interventions. The Chile case shows that privatization is not necessarily antithetical to human rights-consistent outcomes if there is a strong state role in the private sector.

Abstract:
Over the past three decades, water supply has become big business, and fierce debates have emerged in many countries over water privatization and water markets. This chapter reviews five dimensions of this debate: (1) the privatization of ownership and management; (2) the commercialization of water management organizations; (3) the environmental valuation and pricing of water; (4) the marketization of exchange mechanisms (“water trading” and “water markets”); and (5) the neoliberalization of governance. The analysis offers an analytical framework within which more structured, comprehensive assessments of market environmentalism—which is multifaceted and highly varied, difficult to implement in practice, and by no means hegemonic—in the water sector might be conducted. The chapter concludes with some reflections on the future of this debate.

Abstract:
Law is at the center of policy and political issues concerning water. Yet, until relatively recently, water law has often been either sidestepped or considered only through limited lenses in international policy debates. This is changing rapidly, in part because increasing economic, social, and physical scarcity of water is fostering increasing conflicts over access to water. This has led to increasing attention to water law and to significant water law reforms. This chapter provides an overview of the basic structure of water law and analyzes recent reforms, with a focus on developments in India where legal reform has been a central part of water-sector reforms. It highlights some of the most contentious issues surrounding legal reforms, in particular the tension between equity and justice, on the one hand, and efficiency and willingness to pay on the other hand, as well as the broader issue of privatization.
