The recognition of the defence of change of position in Lipkin Gorman v. Karpnale Ltd. [1991] 2 A.C. 548 was a landmark for the law of restitution. In the ten years which have followed Lipkin Gorman, courts and academics have been involved in two, closely related, tasks: first, a description of the content and nature of the defence of change of position; and, secondly, an analysis of the relationship between change of position and other defences to restitution. An important aspect of the latter task has been the fundamental re-examination of the role of estoppel by representation as a defence to restitution. Two recent cases in the Court of Appeal, Scottish Equitable plc v. Derby [2001] 3 All E.R. 818 and National Westminster Bank plc v. Somer International (UK) Ltd. [2001] Lloyd’s Rep. Bank. 263, indicate that, although estoppel by representation remains a defence, the practical effect of the defence will often be much more limited than had been previously understood.

I'll explain why, as Head of Resource Development for the Retail Branch Networks for the Royal Bank of Scotland Group, I believe it has proved successful. The Royal Bank of Scotland (RBS) and National Westminster (NW) Branch Networks consist of over 2,300 branches employing approximately 30,000 people throughout the U.K. My team are responsible for the design, development and implementation of training and development for these staff. We consider that in today's climate of accelerated change, high performance depends critically on the extent to which our intellectual capital is built, refreshed and leveraged – why?Our customers expect that, as a minimum, our people are appropriately trained and can handle all their enquiries efficiently and effectively. Competent staff and the delivery of excellent customer service are not an option for the Group, but a necessity if we are to sustain our competitive advantage in the financial market place.

There is a legend, popularised by Lytton Strachey, that Henry Manning, on becoming a Catholic, studiously resolved to expunge from his mind all memories of his Anglican past. The letters of his young wife, Caroline, who had died only four years after their marriage, were to be destroyed; her grave to be left untended; all past associations of Lavington, Oxford, Harrow, Coombe Bank, and Copped Hall at Totteridge would be too much of a burden for him to bear on his journey to a position of active influence within the Roman Church; so, like Christian in the Pilgrim’s Progress, he willed that the burden should roll from his back that he should see it no more. The truth is very different. Caroline’s letters he took with him to Rome in 1851, where he was to begin his studies at the Accademia Ecclesiastica, only to discover to his profound grief, that the bag in which they were contained, had been stolen at Avignon. So devoted to her memory was he, that—on his deathbed— he amazed his successor in the See of Westminster, Herbert Vaughan, by extracting from beneath his pillow a ‘small, worn volume’, and handing it to him, saying ‘I leave it to you. Into this little book my dearest wife wrote her prayers and meditations. Not a day has passed since her death on which I have not prayed and meditated from this book. All the good I may have done, all the good I may have been, I owe to her. Take precious care of it’.

Knops (2004) ‘Public participation and collaborative governance’, Journal of Social Policy 33, 203–223.From a term used largely within political science in the mid-1990s, ‘governance’ has become a key conceptual and analytical convention adopted by social policy, largely because of its usefulness in examining questions that are key to the discipline: citizenship; welfare rights and responsibilities; accountability; legitimacy and partnership working. Clarence and Painter (1998) have constructed a useful characterisation of public policy, identifying a shift in emphasis from hierarchies, to markets and now to collaboration. Networks, ‘joined up’ governance and partnership working are now central in both policy practice and analysis. These processes are not new, but New Labour have clearly expanded and accelerated them. For New Labour, collaborative working is now perceived as central in their response to key policy challenges: improving public services, tackling social exclusion and revitalising local democracy. These processes are now evident at all levels of policy making from supranational organisations such as the European Union down to neighbourhood-based initiatives. It appears that we are moving from the closed, unitary system of government of the Westminster model to a more open, decentralised system of governance. Our conceptions of citizenship have accordingly shifted, from one based on representation to one based on active participation, particularly within local communities. Governance is an issue which concerns all levels of government and citizen participation, from international-level World Bank concerns about commitment to efficiency and accountable government, to highly devolved localised urban regeneration partnerships.

Abstract:
This chapter delves into the privileges of parliament as an integral part of the Westminster System, going back to Article 9 of the Bill of Rights 1689. It lists freedom of speech, the immunity of members from legal liability for statements made in the House, and the freedom of each House to order its own affairs without interference by the Crown as the privileges of Parliament. It also refers to Westminster Model constitutions that replicate privileges in the parliament by directly specifying and enumerating them in the constitution, or by conferring on parliament the power to determine its own privileges. The chapter cites the Constitution of Trinidad & Tobago as a typical example that applies the privileges of the House of Commons. It discusses how the constitution gives parliament the power to prescribe the powers, privileges, and immunities of each House.
