Abstract:
One branch of the study of the philosophy of science is the study of value axiology usefulness of science. Studies are generally intended to enhance human dignity. In the field of legal science in particular the Intellectual Property Rights pragmatic development occurs to break the deadlock laws that are exclusive for instance on the right to the brand with the birth of the license agreement that is expected to penetrate the exclusive restrictions earlier. Article 1 point 13 of Act No. 15 of 2001 on Marks, can be known elements in the Law License Brands include any permission granted by Trademark holders. The permission was given in the form of the agreement. The licensing agreement begins with the submission of the prospective licensee to the licensor as a brand owner. Such a request can be interpreted as an effort to permit application of the prospective licensee to use the trademark. If then reached an agreement in the form of the license contract, such agreement as a strong foundation and lawful for the licensee to produce goods or services using the brand licensor. The license agreement has been made between the licensor and the licensee must be registered. Agreements which have been registered prevail throughout Indonesia, unless agreed otherwise. The setting of this region related to territorial restrictions that allow for the exercise of the right of the registered trademark. In the perspective of axiology, a license agreement is very beneficial for others to use a trademark without breaking the law. In contrast to the brand owner, the license agreement is very beneficial for the legal protection of its brand, and can wreak opinions (income) from the payment of royalties received from licensees, if the license agreement is implemented consistently by the parties, it will bring great benefits to the parties , which in turn can bring justice

Abstract Assisted living (AL) residents and families often assume that care staff have clinical certifications or specialized training. We analyzed direct care worker training requirements for each AL license type across all 50 states and DC, using health services regulatory and content analyses. Across all licenses, we found the most common required training topics specific to care provision were resident rights, providing assistance with daily living, identifying and alleviating safety risks for residents with cognitive impairment, medication management and non-pharmacological interventions, nutrition and hydration, preservation of resident dignity, recognizing and reporting changes in a resident’s condition, understanding resident actions and behavior as communication, and coping with difficult behaviors. We found the most common approach—accounting for the regulations governing 22% of licensed AL communities in the U.S.—was licenses that require between 1 and 10 hours of initial and annual training, but do not have a detailed list of training topics. Only three states (Arizona, Michigan, and New Hampshire) have no training requirements for any unlicensed direct care workers, while 20 states have at least one license without requirements regarding training hours or topics that must be covered. We found that 10 states have a license that requires more than 10 hours of initial and annual training and specifies a detailed list of training requirements. Interestingly, four of these states (New Mexico, Pennsylvania, Virginia, and Washington) have these requirements for all license types, but three of these states (North Carolina, Illinois, and DC) also have a license with no training requirements.

AbstractWe propose a simple feature extraction algorithm for license plate location, which can reduce the occurrence of pseudo-licenses significantly. Our scheme arises from a novel L0-norm image smoothing, in which the multiple local textures in the complex backgrounds can be suppressed remarkably without changing the structures and edges of the license objects. Due to this “edgeaware” property, we then combine a feature filtering with an efficient binarized image, a simple multi-scale image analysis algorithm, to remove the potential false license plates. Finally, we extract license plates with a projection method. Experimental results show the proposed method provides a flexible and powerful way to the license plate location in complex backgrounds.

ABSTRACT Introduction: Blood groups documented in motor vehicle driving licenses can provide quick information during emergency transfusion requirements and imbibe self-awareness about one’s blood group. The tendency of applicants to mention blood groups without verification during the application may result in incorrect documentation of blood groups in their driving license. The study aims to assess the reliability of the blood groups in driving licenses and their association with sociodemographic variables. Methods: This was a single-center cross-sectional study conducted over 6 months. Donors who were accepted for donation and willing to participate were included. Donors without a valid driving license were excluded. The blood group details and sociodemographic variables were collected and analyzed. Cross tabulation and Chi-square test were done for bivariate analysis. Results: In our study, 33 out of 446 (7.39%) participants had incorrect documentation in their driving licenses. Out of 33, 30 were ABO and three were Rh discordant results. Blood group was not mentioned in the case of 37 donors (8.3%). Incorrect documentation was significantly higher for individuals of younger age and those who acquired a license before 2018. Conclusion: Eight out of 100 individuals had incorrect documentation in their driving license, which is a concern, especially in the situation of emergency transfusion requirements. Approximately 19% of participants revealed that they did not undergo blood grouping during the application process. License issuing authorities should ensure proper blood group verification during the application process.

<p>The changes in learning management typically involve the introduction of various alternative learning methods. The development of an effective learning experience requires the modification of conventional learning. Teaching and learning constructively synchronize instructions and assessment toward the desired learning outcomes. Notwithstanding the vast literature on the creation of effective learning, the lack of explanation on how the relationship between effective teaching and effective classroom would likely leave practitioners and academia without a clear guidance on how to operationalize the creation of effective learning in real life. A systematic literature review procedure was conducted upon published papers between 2007 and 2015 in outstanding education journals. This paper contributes to the literature by amassing the knowledge on pedagogical practices in effective learning creation. In addition, to obtain a granular elaboration about the matter, a framework to operationalize the creation of effective learning is suggested. Three aspects compose the framework namely teachers' intrinsic capabilities, educational institution support, and student’s participative involvement. The article discusses business activities in apartment buildings by management companies without a license and the risks that arise. A comparative analysis of the methods of managing apartment buildings in Russia and abroad is carried out. Licensing of business activities for the management of apartment buildings is carried out by the state housing supervision bodies of the constituent entity of the Russian Federation, in particular the state housing inspection. The article presents judicial practice when a management company, on the basis of the minutes of the general meeting of owners, without waiting for the decision of the state housing inspection to be included in the list of licensed organizations for a particular apartment building, begins to provide housing and communal services. Thus, if the management company actually provided services and has contracts with resource supply organizations, then carrying out business activities without a license is legal. Under such circumstances, management companies can provide housing and communal services and make a profit without a license.

In the United States, 48 states have recognized the educational importance of the early years by awarding stand-alone early childhood education (ECE) licenses that require specialized training in teaching young children. Yet, at the same time, teachers with elementary education (ELED) licenses are allowed to teach kindergarten in 34 states and 1st through 3 rd grade in more than 45 states. This means that teachers may be licensed to teach young children without receiving specialized early childhood training. R. Clarke Fowler explores the extent of the licensure overlap, the reasons for it, and the effects it has on early childhood education. He recommends moving toward a preK-3 license that requires teachers to learn developmentally appropriate practices for the education of young children.

Previous studies have frequently reported that those with a driver’s license have better physical and cognitive functions than those without. However, there are many people in the world who do not need or who cannot have a driver’s license. We hypothesized that if the non-driver’s license group had the same or better physical and cognitive functioning as the driver’s license group, they could lead healthy lives without the risk of functional decline or loss of functioning due to surrendering their licenses or giving up driving. The subjects were 47 community-dwelling older adults. We measured their physical function and cognitive function and performed psychological assessment via the following tests: grip strength, Timed Up and Go test, walking speed, Five Times Sit to Stand test, Functional Reach test, Two-Step Test, Mini-Mental State Examination, Trail Making Test, Modified Falls Efficacy Scale, Geriatric Depression Scale, and University of California Los Angeles Loneliness Scale. In previous studies, it has been said that having a driver’s license provides good physical, cognitive, and psychological functions. However, in this study, loneliness and executive function were strongly influenced by age and sex, and no direct relationship to a driver’s license was suggested. Rather, non-driver license holders may be relieved because there is no risk of accidents due to driving, and there is no possibility of a suddenly decline in physical or cognitive function due to revocation of a driver’s license.

Driving may increase mobility and independence for adolescents with autism without intellectual disability (autism spectrum disorder); however, little is known about rates of licensure. To compare the proportion of adolescents with and without autism spectrum disorder who acquire a learner’s permit and driver’s license, as well as the rate at which they progress through the licensing system, we conducted a retrospective cohort study of 52,172 New Jersey residents born in the years 1987–1995 who were patients of the Children’s Hospital of Philadelphia healthcare network ⩾12 years of age; 609 (1.2%) had an autism spectrum disorder diagnosis. Electronic health records were linked to New Jersey’s driver licensing database (2004–2012). Kaplan–Meier curves and log-binomial regression models were used to determine the age at and rate of licensure, and estimate adjusted risk ratios. One in three adolescents with autism spectrum disorder acquired a driver’s license versus 83.5% for other adolescents and at a median of 9.2 months later. The vast majority (89.7%) of those with autism spectrum disorder who acquired a permit and were fully eligible to get licensed acquired a license within 2 years. Results indicated that a substantial proportion of adolescents with autism spectrum disorder do get licensed and that license-related decisions are primarily made prior to acquisition of a permit instead of during the learning-to-drive process.

ImportanceMood disorders are prevalent among adolescents and young adults, and their onset often coincides with driving eligibility. The understanding of how mood disorders are associated with youth driving outcomes is limited.ObjectiveTo examine the association between the presence of a mood disorder and rates of licensing, crashes, violations, and suspensions among adolescents and young adults.Design, Setting, and ParticipantsThis cohort study was conducted among New Jersey residents who were born 1987 to 2000, age eligible to acquire a driver’s license from 2004 to 2017, and patients of the Children’s Hospital of Philadelphia network within 2 years of licensure eligibility at age 17 years. The presence of a current (ie, ≤2 years of driving eligibility) mood disorder was identified using International Classification of Diseases, Ninth Revision, Clinical Modification (ICD-9-CM) or International Statistical Classification of Diseases, Tenth Revision, Clinical Modification (ICD-10-CM) codes. Rates of licensure and driving outcomes among youths who were licensed were compared among 1879 youths with and 84 294 youths without a current mood disorder from 2004 to 2017. Data were analyzed from June 2022 to July 2023.Main Outcomes and MeasuresAcquisition of a driver’s license and first involvement as a driver in a police-reported crash and rates of other adverse driving outcomes were assessed. Survival analysis was used to estimate adjusted hazard ratios (aHRs) for licensing and driving outcomes. Adjusted rate ratios (aRRs) were estimated for driving outcomes 12 and 48 months after licensure.ResultsAmong 86 173 youths (median [IQR] age at the end of the study, 22.8 [19.7-26.5] years; 42 894 female [49.8%]), there were 1879 youths with and 84 294 youths without a mood disorder. A greater proportion of youths with mood disorders were female (1226 female [65.2%]) compared with those without mood disorders (41 668 female [49.4%]). At 48 months after licensure eligibility, 75.5% (95% CI, 73.3%-77.7%) and 83.8% (95% CI, 83.5%-84.1%) of youths with and without mood disorders, respectively, had acquired a license. Youths with mood disorders were 30% less likely to acquire a license than those without a mood disorder (aHR, 0.70 [95% CI, 0.66-0.74]). Licensed youths with mood disorders had higher overall crash rates than those without mood disorders over the first 48 months of driving (137.8 vs 104.8 crashes per 10 000 driver-months; aRR, 1.19 [95% CI, 1.08-1.31]); licensed youths with mood disorders also had higher rates of moving violations (aRR, 1.25 [95% CI, 1.13-1.38]) and license suspensions (aRR, 1.95 [95% CI, 1.53-2.49]).Conclusions and RelevanceThis study found that youths with mood disorders were less likely to be licensed and had higher rates of adverse driving outcomes than youths without mood disorders. These findings suggest that opportunities may exist to enhance driving mobility in this population and elucidate the mechanisms by which mood disorders are associated with crash risk.

In this writing, the method used by the author is a type of normative legal research. Using laws and regulations and other relevant reference materials, then analyzed with applicable laws relating to the practice of doctors without a license to practice. Abstract:
This reflective paper presents a contextual overview of doctoral supervision in low- and middle-income countries. It highlights several models or frameworks used in Western academic settings. Through a critical lens it considers a number of the opportunities and gaps, which may reframe and/or reform doctoral supervision in the low- and middle-income settings. It identifies a significant gap in the evidence and scholarship on the topic of graduate supervision in developing contexts. In the current and evolving higher education milieu and the global emergence of the knowledge economy, the topic of graduate supervision can no longer go without a serious and fulsome discussion.

The purpose of this study is to analyze the urgency of criminal prosecution of perpetrators who carry out mining business activities without a business license, law enforcement in decision Number: 517/Pid.B/2021/PN.Lbp regarding criminal acts of mining without a business license, and the factors that cause the occurrence of criminal acts. mining crime without a business license in Deli Serdang Regency. The type of research used is normative legal research supported by field data through interviews with investigators at the Medan Metropolitan Police. Data analysis in this study was carried out by selecting secondary data from library research and field research data analyzed qualitatively. The results of this study are, the urgency of criminalizing business actors who carry out mining businesses without a permit in Indonesia, namely to avenge criminals' mistakes is also intended to protect the public, by creating order in carrying out mining business activities. Law enforcement against business actors who carry out mining business without a mining business permit in decision Number: 517/Pid.B/2021/PN.Lbp is not optimal and does not reflect a sense of justice. Factors causing the occurrence of cases of mining without a mining business permit in Deli Serdang Regency are divided into 2 (two), namely, internal factors and external factors. Internal factors consist of educational factors and economic factors. On external factors due to the lack of socialization related to mining business licenses and the complicated management of mining business permits.

Indeterminates in Japanese have been studied extensively since Kuroda (1965) and all the previous works share the descriptive generalization that indeterminates must co-occur with overt quantificational particles such as ka and (de)mo. We present novel data indicating that the Japanese indeterminates are licensed “bare” without the presence of an overt particle to associate with. Conversely, we also point out data in which the mere presence of mo fails to license an indeterminate. We argue that our long-standing understanding of indeterminates has been misguided and that what truly licenses a bare indeterminate is a covert Q-morpheme. Our analysis that a covert Q-morpheme is the licensor of bare indeterminates departs from the traditional view that indeterminates require the overt licensing particle ka or (de)mo.

The research aims to determine students' legal awareness of owning a driving license at SMK Muhammadiyah 1 Moyudan. This research uses qualitative research with an empirical juridical approach. The research subjects were grade 10 students who drove motorbikes without driving licenses and vice principals, while the objects were students' legal awareness of owning a driving license. Methods of data collection using interviews and documentation then checking the truth of the source using triangulation of sources and techniques. The results of the study show that students who know the conditions for driving a motorcycle must have a driving license. They do not understand in detail the contents, benefits, and objectives of Article 77 Paragraph (1). All students accept and positively support the existence of these regulations. The legal awareness of students in complying with this article is classified as negative legal awareness because they do not yet have a driver's license, so they are influenced by other factors, namely parents, lack of public transportation, and the school does not prohibit students from bringing motorcycles to school.

Abstract State survey agencies are responsible for developing minimum requirements for assisted living (AL) communities, including penalties for noncompliance. Civil monetary penalties are a common measure state enforcement agencies use to incentivize regulatory compliance. We searched state statutes and regulations governing licensed AL communities in August 2022 to identify enforceable civil monetary penalties and used descriptive statistics and content analysis to describe regulatory differences within and between states according to license type. Our findings indicate that 48 of 51 states may enforce financial penalties for noncompliance against assisted living communities, though four of these states have one or more license types without applicable monetary penalties. 13 states had differing policies and possible enforceable amounts by license type, so some AL communities are possibly being charged more than others for the same offense within the same state. We found that states took three different approaches to calculating fees, sometimes using multiple approaches depending on the citation and license type. One or more license types in 36 states imposed per-instance fines, per-day fines in 32 states, and per-resident-per-day fines in 3 states. We describe the current landscape of financial penalty enforcement policies for US assisted living communities as well as its implications for state agencies and providers.

Abstract This article aimed to determine and analyze the implementation of innovation forms as well as the factors supporting and inhibiting the implementation of innovation in local government level. The research was conducted in three regions in South Sulawesi province: Bantaeng, East Luwu, and Makassar. The results of the research showed that the service innovation implemented in South Sulawesi was quite varied but has the same objective, i.e giving satisfactory service of business licenses for society. Bantaeng Regency Government implemented click innovation, changes employees’ behavior without illegal charges and license delivery to applicant's home. Similarly, the East Luwu Regency government intensively innovated the management and one-day issuance of business license. While the Makassar Municipal Government focused more on weekend service innovation, delivering and picking up license documents. Supporting factors for service innovation in the three regions were regulation and commitment of the local governments while the inhibiting factors of innovation implementation were the limited fund and incompetent personnel in service duties.

Unlicensed driving presents a multifaceted challenge for authorities, with increasing road accidents attributed to limited mobility and heightened anxiety among drivers, often stemming from a lack of road safety knowledge and difficulties in concentration, highlighting the need for understanding emotional responses towards law enforcement and the significance of acquiring a driver's license. Furthermore, this research explores potential interventions to mitigate the risks associated with unlicensed driving and enhance road safety awareness among drivers. The researcher used a qualitative phenomenological approach to explore student unlicensed drivers' experiences. Eight students participated in in-depth interviews, and the data collected were analyzed using Collazzi's method. The results revealed the following recurring themes: emotional and physical challenges, mixed emotions and the privileges of a driver's license. The research findings show that young individuals driving without licenses encounter emotional and physical obstacles, exhibit varied reactions when faced with authorities, appreciate the significance of acquiring a driver's license, and emphasize the importance of responsible driving and compliance with legal requirements.

Novikova Odessa National Medical University, Ukraine e-mail:vesnyk@email.ua Abstract Biocenosis of sulcus in chronic generalized catarrhal gingivitis children (CGCG) without background pathology and with chronic tonsillitis (CH) has been investigated. Its development and clinical course depending on dominant microbial agent (streptococci or staphylococci) are specified. This expands our knowledge about etiology and pathogenesis of CGCG. The results of local immunity and nonspecific resistance study in CGCG children with/ without contaminant pathology are given. A new method of the patients under study treatment has been worked out and clinically tested. It has been established that the use of the complex offered allowes to reduce a number of complications, relapses, and increases the general efficacy of treatment.
