A presente tese tem como objeto de estudo o amparo legal da saúde do trabalhador offshore, através da análise interdisciplinar do Anexo II da Norma Regulamentadora n°30; de Convenções Internacionais da Organização Internacional do Trabalho e do Sistema da Occupational Health and Safety Assessment Series 18001:2007. O estudo aborda os tipos de plataformas, como se estrutura o trabalho offshore na Bacia de Campos (RJ); os principais acidentes no passado e como se encontram, atualmente, as condições de trabalho e segurança nas plataformas e os problemas físicos, emocionais e profissionais do trabalhador das plataformas. A tese também apresenta a atuação da Agência Nacional de Petróleo, Gás Natural e Biocombustíveis na prevenção de acidentes. Apesar de existirem normas nacionais e convenções internacionais, direta ou indiretamente, para garantir a segurança quanto ao ambiente de trabalho nas plataformas, elas não são efetivamente aplicadas pelas empresas offshores, o que se torna também um fator passível de comprometer a saúde do trabalhador e necessitar de normatização efetiva.
The purpose of this thesis is to study the legal protection of the health of offshore workers through the interdisciplinary analysis of Annex II of Regulatory Norm 30; International Conventions of the International Labor Organization and the Occupational Health and Safety Assessment Series 18001: 2007. The study addresses the types of platforms, how to structure the offshore work in the Campos Basin (RJ); the main accidents in the past and how are currently working conditions and safety platforms and the physical, emotional and professional problems of the workers of the platforms. The thesis also presents the performance of the National Agency of Petroleum, Natural Gas and Biofuels in the prevention of accidents. Although there are national norms and international conventions, either directly or indirectly, to ensure safety in the work environment on the platforms, they are not effectively enforced by offshore companies, which is also a factor that could compromise workers' health and necessitate of effective standardization.

Full textThe economy’s “tertiarisation” and the development of new information and communication technologies are part of the evolution of the working relationships. Several schemes issued by professional practice and endorsed by the law (fixed annual working time, home office, “umbrella companies”) make it possible to set up a new working relationship that differs from the traditional link of legal subordination, key of the “salariat”. At the same time, there is an expansion of self-employment for which digital platforms are competing. Paradoxically, the expansion of the employee’s autonomy comes with a decline of the autonomy of the self-employed. The convergence between these two schemes of working organization imposes to narrow the gap between the rules governing them. Thus, the decrease of the employer’s sphere of authority must be linked with a lightering of its obligations. At the same time, the benefit of certain protective measures which was reserved to employees should be extended to the self-employed since their situation has evolved. As a whole, it leads to an evolution of the labor relationships which could finally look like a revolution

Work at height is a common operating pattern of engineering. To enable people work at height, a temporary construction, named Scaffolds, is usually built to afford workers and materials. In recent years, the foreign countries had developed the “aerial working platform” to replace the scaffolds which are time-wasting and risky. However, the corresponding laws of aerial working platform are not completed in our country. Besides, the specifications of the construction are not available either. Therefore, it is not secure to use the equipment under lacking of the complete management for safety. In this thesis, the strategies of choosing aerial working platform in different situations are proposed. The actively self-safety management is also introduced to prevent the vocational accident. After all, a rule of safety management for using the aerial working platform is established to be followed. In this research, the specifications of the manufactured Aerial working platforms are firstly evaluated to fit the operating mode. Secondly, the laws and standards of the advanced countries are compared with the domestic rules. In Japan, there are completed laws and detail specifications and prescript of the occupational safety and health facilities for Aerial working platform. The aerial working platform manufacturer are demanded to obey the domestic standards in America and to provide detail operating directions in user’s menu, According to the construction of the aerial working platform, the main concerns of purchase are listed. In order to finish job quickly, the boom-supported elevating work platform is suggested. The safety of operating the platform could never be ignored. The operating procedures and manipulating standards, which are specified by the laws, are provided in the certain platform’s menu and discussed in a specified chapter. For the other types of platform, not only the user’s menu from manufacturer should be obeyed, but also the experience of the master should be learned. Taking the special conditions into account, the accident could be avoided by preventing improper operation. With more serious consideration, the conclusions of this research are made to be followed by the enterprises and to be adopted by the managers. Though there are several different operating mode of work at height, the main idea of this paper is to proper choose a flexible, high performance aerial working platform such that ease and safe can be both achieved. Therefore, the user’s confidence could be established through the professional safety management facilities. With serious standards, the space for wildcatter would no more exist.

Viral marketing is a popular issue in recent business world, we understand the motivation, attitude and behavior of those net-friends share their opinions of products or services online. However, we rarely discuss what make these opinions go on viral, that is this research concerned about. Reviewing the literatures of eWOM and brand attitude, the past research focused on viral emailing. However, these days viral marketing is spread by social media such as Youtbe. Thus, this study proposes that attributes of Youtube can affect consumers’ behavior. This study conducted an experimental design and results are video total views and product logo replacement can effect consumers’ behavior. Based on the total views, consumer will decide whether they share this video online. Product logo replacement will effect consumer to have a different attitude toward the brand. However, this study had not discovered other attributes of Youtube, such as the comments or the ratings of the video, and we left them behind for future research to discover its effects on consumers eWOM intention and their brand attitude.
