Abstract:
This chapter comments on Article 20 of the Rome Statute of the International Criminal Court. The concept of ne bis in idem has been varoiusly described by such cognate terms such as ‘double jeopardy’, res judicata, and issue estoppel. In the Rome Statute, the principle one of the three components of the admissibility determination, the other two being complementarity and gravity. Article 20 addresses three types of situations: (i) where a person has been tried and either convicted or acquitted by the Court and who is subsequently put on trial again before the Court; (ii) where a person has been tried and either convicted or acquitted by the Court and who is subsequently put on trial again before another court; and (iii) where a person has been tried and either convicted or acquitted by another court and who is subsequently put on trial before the International Criminal Court.

Principle 26 deals with restrictions on extradition and the principle non bis in idem. More specifically, it addresses obstacles to extradition and double jeopardy (ne bis in idem), two issues that both place restrictions rather than prohibitions on the exercise of criminal jurisdiction than interdictions to assert jurisdiction. The principle ne bis in idem and extradition law have evolved from a ‘State-oriented’ approach into an ‘individual-oriented approach’. Principle 26 highlights a series of controversial issues, including the denial of extradition to countries enforcing the death penalty to the so-called ‘shield trials’, and tries to strike a balance between the fight against impunity and the enhancement of individual rights for persons facing trials, even for ‘serious crimes under international law’. This chapter first provides a contextual and historical background on Principle 26 before discussing its theoretical framework and how the Principle has been applied in practice.

Im Strafverfahren gilt der „Ne bis in idem“-Grundsatz: Niemand darf wegen derselben Tat wiederholt strafrechtlich verfolgt werden. Welche Auswirkungen hat dieser Prozessgrundsatz auf die strafrechtliche Verfolgung eines alkoholisierten Fahrzeuglenkers, der einen Unfall mit Personenschaden verursacht? Dieses Verhalten ist sowohl aus der Perspektive der Verwaltungsbehörden wegen des Lenkens eines Fahrzeuges in alkoholisierten Zustand als auch aus der Perspektive der Justiz wegen der grob fahrlässigen Körperverletzung strafrechtlich relevant. Um auf jede Rechtsverletzung zu reagieren, müsste das Geschehen somit doppelt strafrechtlich verfolgt werden. Folgt hingegen aus dem „Ne bis in idem“-Grundsatz, dass ein rechtskräftiges Straferkenntnis einer gerichtlichen Strafverfolgung entgegensteht und umgekehrt? Dieses Buch widmet sich insbesondere der Definition des prozessualen Tatbegriffes zur Klärung des Verhältnisses zwischen Verwaltungs- und Justizstrafrecht. Dabei werden grundlegende Probleme des Strafverfahrens besprochen, wie etwa die Rechtskraft und der „Ne bis in idem“-Grundsatz. Um das Konkurrenzverhältnis zu klären, wird eine verfahrensübergreifende Perspektive eingenommen.

This chapter comments on Article 17 of the Rome Statute of the International Criminal Court. Article 17 sets out the mechanism for ensuring that the Court is indeed complementary to national justice systems. It was carefully negotiated to ensure that States Parties would enjoy a level of confidence that their sovereign right to try crimes committed on their territory would not be encroached upon by the Court. Article 17 imposes three tests for admissibility: ‘complementarity’, double jeopardy (ne bis in idem), and gravity. The Court may not proceed with a case when the concerned States are investigating or prosecuting in good faith.

This chapter comments on Article 89 of the Rome Statute of the International Criminal Court. Article 89 governs the surrender of suspects to the Court. When the Court transmits a request for arrest and surrender, the requested State must comply. A State Party is obliged to authorize transportation through its territory of a person being surrendered to the Court by another State, in accordance with its national procedural law, except where transit through that State would impede or delay the surrender. The Statute also anticipates the possibility that a person whose surrender is sought will challenge transfer in the national courts on the basis of the principle of ne bis in idem, set out in article 20 of the Rome Statute.
