Abstract:
There are two remarkable features of post-independence economic policy-making in Zimbabwe: the very limited nature of the changes made by the new government in 1980, and the complete reversal of policy announced in 1990. It was surprising that a more radical transformation had not been introduced soon after independence, since this had been achieved by a civil war prompted not only by the denial of even basic rights to the majority of the population, but also by an extremely inequitable distribution of economic resources. The volte-face in 1990 was also unexpected, because it required a repudiation of governmental rhetoric at a time when the economy was by no means in a state of crisis, even though under stress. This article attempts to understand these policy shifts.

Abstract:
This article describes how traditional leaders play important developmental, administrative and political roles in rural areas, despite modern state structures. They regulate rural life, control access to land, and settle various disputes. They are respected leaders in their communities. The existence of traditional leaders means that both the decentralisation and the strengthening of local governance are not taking place in a vacuum. Documentary sources such as the Constitution of Zimbabwe; the Traditional Leaders Act (2000) and Chiefs and Headmen Act (1982); newspapers and unpublished non-governmental organisations (NGOs) evaluations and reports were used in this article. Traditional leaders have played a pivotal role in ensuring that the ZANU-PF government remains in power since 1980. In principle, traditional leaders should not be drawn into party politics and their role should remain one of the neutral leadership. If the traditional leader assumes a party-political role, one should appoint a substitute to handle their traditional role to avoid a conflict of interest.

Given the 2017 coup in Zimbabwe, a rare event in Southern Africa but sadly common in the rest of the continent, this paper discusses the beginnings of the politicization of the Zimbabwe Defence Forces (ZDF) during the 1980s. At the end of the country’s war for independence in 1980, the ZDF formed as an amalgamation of former Rhodesian state military personnel and insurgents from the liberation movements of the Zimbabwe African People’s Union (ZAPU) and the Zimbabwe African National Union (ZANU). Personnel from ZANU came to dominate Zimbabwe’s new military given the lack of a specific agreement over the integration process, their numerical superiority, and ZANU’s electoral success that gave it political power. During the ZDF integration exercise of the early 1980s, British advisors attempted to create a Western-style force but acted pragmatically while North Korean instructors helped create an overtly ZANU affiliated brigade and party militia. In addition, South African destabilization and the rapid departure of former Rhodesian officers gave way to the accelerated promotion of former insurgents mostly affiliated with the ZANU government. Lastly, the further ZANU-ization of the ZDF occurred within the context of operations in southwestern Zimbabwe where it eliminated ZAPU as an opposition political movement and committed atrocities, and in Mozambique where Zimbabwean troops cooperated with allies from overtly politicized armies of neighboring states

AbstractThis paper explores, analyses and discusses Zimbabwean gospel song themes from 1980 up to 2007 in relation to the Zimbabwean political and socio-economic situations in the country. The history of the socio-economic and political development of Zimbabwe during 1980-2007 would certainly be incomplete without including gospel music. Until about the mid-1980s, the general atmosphere in the newly-independent state of Zimbabwe was characterized by liberation euphoria and great optimism for the future. Equally so, local gospel music during this period was largely celebrative and conformist as far as the political and socio-economic dispensation was concerned. Socio-economic hardships crept in as a result of the government's implementation of neo-liberal economic reforms under the guidance of the World Bank and the International Monetary Fund (IMF) during the early 1990s. The ruling party soon found itself confronted by a multitude of gospel musicians criticizing its policies and malpractices. Works of various gospel artistes will be used as evidence but due to issues of space, it has not been possible to cover all Zimbabwean gospel artists.

Since Zimbabwe’s independence in 1980, the Christian community was largely silent about Zimbabwe’s economic and political quagmire. However, the country’s growing political and economic turmoil drew the Zimbabwean Christian community into direct confrontation with Mugabe’s administration. The community experienced political awakening after decades of political indifference, passivity and silence. In 2016, several Christian leaders and their denominations publicly challenged the government on several occasions calling for Mugabe to step down and demanded economic reforms. In response, the Mugabe regime employed different tactics to silence and undermine the Christian community.

Purpose: The purpose of the study was to assess how far the government of Zimbabwe’s tourism policies and strategies have affected the development of the tourism and hospitality sector. Methods: The study was based on a review of the literature on tourism development in Zimbabwe. A range of peer-reviewed papers, reports from the United Nations World Tourism Organization (UNWTO). reports from the Zimbabwe Tourism Authority (ZTA), and those of the Ministry of Environment, Tourism, and Hospitality Industry were consulted. The information offered a clear picture of how far the government had contributed to influencing the development of the tourism and hospitality industry during the period. Results: The results of the study showed that for the period up to 2000 the government played only a facilitating role in the development of the sector. The results further showed that the government took a more proactive role in planning the development of the industry only when the persistent negative image of the country threatened the collapse of the sector. Implications: It is recommended that the country effectively implements the National Tourism Master Plan and the National Tourism Sector Strategy which were launched in 2016 and 2018 respectively. A constant review of the National Tourism Sector Strategy will ensure an effective response to the global and national macro-economic, social and political changes that will occur during the plan period.

In 1980 the Republic of Zimbabwe became recognized internationally as an independent state. This independence marked a shift from white minority rule to black majority rule in the form of ZANU–PF in a transition in government that was fraught with brutal violence, tense negotiations and tremendous hope for the democratic state that would emerge. This article begins with a brief overview of key political-theatre and public-arts funding practices that emerged in the newly independent Zimbabwe in the 1980s and continues with an examination of an influential political play from the era by Cont Mhlange entitled Workshop Negative (1986). This article's analysis of Workshop Negative considers how the economic pressures explored in the play mirror the precarious working conditions that arts-funding models placed on political-theatre practitioners in Zimbabwe at the time.

Abstract:
Historically, health care in Zimbabwe was provided primarily to cater to colonial administrators and the expatriate, with separate care or second-provision made for Africans. There was no need for legislation to guarantee its provision to the settler community. To address the inequities in health that had existed prior to 1980, at independence, Zimbabwe adopted the concept of Equity in Health and Primary Health Care. Initially, this resulted in the narrowing of the gap between health provision in rural areas and urban areas. Over the years, however, there have been clear indications of growing inequities in health provision and health care as a result of mainly Economic Structural Adjustment Policies (ESAP), 1991–1995, and health policy changes. Infant and child mortality have been worsened by the impact of HIV/AIDS and reduced access to affordable essential health care. For example, life expectancy at birth was 56 in the 1980s, increased to 60 in 1990 and is now about 43. Morbidity (diseases) and mortality (death rates) trends in Zimbabwe show that the population is still affected by the traditional preventable diseases and conditions that include nutritional deficiencies, communicable diseases, pregnancy and childbirth conditions and the conditions of the new born. The deterioration of the Zimbabwean health services sector has also partially been due to increasing shortages of qualified personnel. The public sector has been operating with only 19 per cent staff since 2000. Many qualified and competent health workers left the country because of the unfavourable political environment. The health system in Zimbabwe has been operating under a legal and policy framework that in essence does not recognize the right to health. Neither the pre-independence constitution nor the Lancaster House constitution, which is the current Constitution of Zimbabwe, made specific provisions for the right to health. Progress made in the 1980s characterized by adequate financing of the health system and decentralized health management and equity of health services between urban and rural areas, which saw dramatic increases in child survival rates and life expectancy, was, unfortunately, not consolidated. As of 2000 per capita health financing stood at USD 8.55 as compared to USD 23.6, which had been recommended by the Commission of Review into the Health Sector in 1997. At the beginning of 2008 it had been dramatically further eroded and stood at only USD 0.19 leading to the collapse of the health system. Similarly, education in Zimbabwe, in addition to the changes it has undergone during the different periods since attainment of independence, also went through many phases during the colonial period. From 1962 up until 1980, the Rhodesia Front government catered more for the European child. Luckily, some mission schools that had been established earlier kept on expanding taking in African children who could proceed with secondary education (high school education). Inequity in education existed when the ZANU-PF government came into power in 1980. It took aggressive and positive steps to redress the inequalities that existed in the past. Unfortunately, the government did not come up with an education policy or philosophy in spite of massive expansion and investment. The government had cut its expenditure on education because of economic and political instability. This has happened particularly in rural areas, where teachers have left the teaching profession.

This article is about the appropriate role of the judiciary in the constitutional debate over land redistribution in Zimbabwe. The possession of land in Zimbabwe has been the most volatile political issue since the war for independence. White ownership of the most productive land fuelled the war against Rhodesia. A constitutional settlement in 1979 resulted in a cease-fire, but the Declaration of Rights prohibited the new government from acquiring land for resettlement purposes except on a “willing seller, willing buyer” basis. With the expiration of the decade-long entrenchment of the Declaration of Rights in 1990, President Robert Mugabe declared his intention to honour a promise made eleven years before: to resettle peasant farmers on previously white-owned land. Since then, Parliament has amended the Constitution of Zimbabwe three times to allow the state to acquire property for resettlement and to give Parliament the power to fix the amount of compensation without judicial review.

On 18 April, 1991, the Republic of Zimbabwe celebrated its 11th year of independence. Coincidentally, just a few months earlier, the 11th constitutional amendment Act was passed. This flurry of legislative activity was the result of a desire on the part of the government to develop a new constitutional structure rather than to remain with the constitution which was essentially imposed upon it by the British during the 1979 Lancaster House conference which eventually led to independence in 1980. The new constitutional model is of considerable interest as it is based upon those operating in many other African nations but, according to the Minister of Justice, is designed to provide safeguards on the exercise of presidential power and to avoid unnecessary conflict and division between the various branches of government. On several occasions, ministers have stressed the autochthonous nature of the new structure and some have indeed suggested that it might form a model for other African countries.It is the intention of this article to examine the legitimacy of these assertions by analysing both the new constitutional structure and its operation in practice. In order to assess the significance of these changes, it is first necessary to examine very briefly the Lancaster House constitution and constitutional developments in the early years of independence.

LAND ACQUISITION AMENDMENT ACT, 2000 (ZIMBABWE)Since Zimbabwe became independent in 1980 the issue of land reform and, in particular, the issue of land acquisition and redistribution has seldom been off the political agenda. For the first ten years of independence there were constitutional constraints on the acquisition of land for resettlement purposes, but the National Land Policy of 1990 set out plans for an accelerated programme of resettlement. In order to achieve its ambitious targets the government of Zimbabwe saw the need to strengthen its powers of compulsory acquisition both by amending section 16 of the Constitution (which provided strong protection against the compulsory acquisition of property) and by enacting the Land Acquisition Act to provide a statutory basis for the new policy. These reforms were extremely controversial both inside and outside the country and a clause excluding the right to fair compensation for expropriated land was dropped partly in response to international pressure.

After spending a decade as an independent trucker hauling milk, watermelons, and paper across the United States, Mike Parkhurst sold his tractor-trailer in 1961 and used the proceeds to establish Overdrive magazine—the “Voice of the American Trucker.” Believing “truckers were ready for a magazine that would pull no punches,” Parkhurst launched a decades-long editorial assault on transportation regulations that he believed bound American enterprise in the chains of corporate control, government malfeasance, and brutish boss unionism. By the mid-1970s, Parkhurst became one of the nation's most outspoken advocates of transportation deregulation. As he told a reporter for Time in 1975, he hoped “to wake the truckers up to the fact that they're slaves to a monopoly”—a monopoly on freight transportation maintained by corporate trucking firms, abetted by the Teamsters Union, and sanctioned by corrupt government officials. In the summer of 1979, Parkhurst helped to orchestrate a nationwide strike by tens of thousands of independent truckers, in which drivers demanded, according to William Scheffer of the Overdrive-sponsored Independent Truckers Association, “the dismantling of a giant Federal bureaucracy that has grown to govern the trucking industry since the mid-1930's.”

ABSTRACTBetween 1907 and 1984 unearned income in Britain was taxed at higher rates than wages and salaries, a bias that was supported intermittently by limiting shareholders’ dividends and attempting to tax capital wealth. Although apparently accepted as part of the fiscal order until 1979, Margaret Thatcher's government was able to complete the dismantling of the bias in favour of earned income by 1984. This article examines the events and politics of the 1970s to explain the volte-face. The article initially charts the role of political prejudice against rentiers in maintaining higher taxes on unearned income in the context of 1970s economic turmoil and inflation. The article then considers the 1970s fiscal shift from the perspective of equity shareholdings, juxtaposing the use of tax and dividend restraint as a mechanism for control of investment capital with pressure for wider share ownership, particularly for employees. Finally, Avner Offer's theories on prudent financial behaviour are imported as a backdrop for the trend away from tax relief for long-term, illiquid savings towards market-driven incentives. Ultimately, the article detects a change of approach in both main political parties which in turn creates a more stable environment for future policy formation.

AbstractWhere two opposing sides are engaged in violent conflict and a process of political disintegration, the ability to protect an already-contested legitimacy becomes crucial to a negotiated agreement. Lord Carrington, the mediator between the government of Zimbabwe-Rhodesia and the guerrilla forces of the Patriotic Front, helped the parties save face at the Lancaster House Conference in 1979. Using a tactic of strong third-party mediation, Carrington accepted responsibility for the concessions the opposing delegations made, allowing them to protect their reputation among supporters. This paper examines the three primary ways the parties at Lancaster House attempted to save face: using the mediator as scapegoat, engaging in sharp confrontation in public and flexible conciliation in private, and conducting “shadow” negotiations through Commonwealth Secretary-General Sir Shridath Ramphal.

POLITICIANS LIKE TO BE REGARDED AS EFFECTIVE IN THE WORK THEY do. They insist that the promises they make and the programmes they decide on are more than mere declarations of goodwill. To practise what they preach is of special importance to governments which stress that their policies are substantially different from the policies of their predecessors. Thus, a departure from conventional politics on the model of the social-democratic consensus was asserted by the previously more pragmatic, now more ideologically minded, Conservative governments in Britain (1979), the United States (1980) and to some degree also by the electoral successes of Conservative parties in West Germany (1983) and France (1986). The conservative ground-swell in current government policies in Western democracies is, however, not restricted to the countries mentioned here, although Britain and the United States have played a special role as pathfinders for the political reorientation process.

Southern Africa has become a battleground between two ideologically and fundamentally opposed constellation of states, Pretoria and Lusaka constellations. The conflict between the two basically concerns the domestic racial policies and the future of South Africa. The Pretoria constellation was launched on July 22, 1980, and is led by P. W. Botha, the South Africa's Prime Minister. The Botha's axis is a designed strategy which essentially aims at using South Africa's economic power and wealth to manipulate its neighboring nine black ruled states; and to exert subtle pressure to ensure that they cohere with the white minority regime of South Africa. This ambition of the Pretoria constellation is a vital part of the total strategy of survival of the Botha government. This particularly involves the use of the economy as an instrument of maintaining ultimate political power and control based on the maintenance of the basic structures of apartheid. This has in turn motivated South Africa's opposition to the policies of economic and political liberation of the Southern African Development Coordination Conference (SADCC) states. The second, the Lusaka constellation and also known as the “Southern Nine” was launched on April 1, 1980. It consists of the nine Southern African States of Angola, Botswana, Lesotho, Malawi, Mozambique, Swaziland, Tanzania, Zambia and Zimbabwe. The declared aim of the Southern Nine is to form an alliance which would pursue an economic strategy that would reduce or eliminate their economic dependence on South Africa. To this end, the Southern Nine and the South African-occupied territory of Namibia unanimously adopted a Programme of Action aimed at stimulating inter-state trade with the ultimate objective of economic independence from South Africa.

Abstract:
The development of contemporary South Africa political economy occurred within the context of a global capitalist order characterized by increasingly unequal political and economic relations between and within countries. Before liberation in 1994, many people across the world actively supported the struggle against apartheid, with South Africa’s neighbouring states paying the highest price. The ‘sovereignty’ of the apartheid state was challenged by three processes: first, economic, cultural and sporting sanctions called for by Nelson Mandela’s African National Congress and other liberation movements, which from the 1960s-80s were increasingly effective in forcing change; second, solidaristic foreign governments including Sweden’s and the USSR’s provided material support to overthrowing the Pretoria Regime; and third, military defeat in Angola and the liberation of neighbouring Mozambique (1975), Zimbabwe (1980) and Namibia (1990) signalled the inevitability of change. But that state nevertheless maintained sufficient strength - e.g. defaulting on foreign debt and imposing exchange controls in 1985 - to ensure a transition to democracy that was largely determined by local forces. Since 1994, the shrinkage of sovereignty means the foreign influences of global capitalism amplify local socio-economic contradictions in a manner destructive to the vast majority of citizens. This is evident when considering economic, ecological, geopolitical and societal considerations.

SouthernAfrica has been at war since the 1960s. Following the capitulation of Ian Smith's Rhodesian Front and the acceptance of majority rule in Zimbabwe in 1980, the widely acknowledged root of most of the regional conflict has been South Africa. In defendingapartheid, the régime in Pretoria engaged in a systematic campaign of destabilisation designed to bring its neighbours to heel. Military invasions, raids, sabotage, support of dissident groups, and assassinations were all part of the National Party (NP) Government's ‘total strategy’ that employed violence as a key element in its regional policy to achieve economic, military, and political hegemony. P. W. Botha during his tenure as Prime Minister and President, 1978–89, ‘politically modified the role’ of the South African Defence Force (SADF), as explained by Herbert Howe, and ‘created the military-dominated State Security Council, which effectively replaced the Cabinet and became the centre of national decision-making and official power in the 1980s’.1The result was the militarisation of South African society and a swath of destruction across the southern part of the continent.

A recent study (Fourquet 1989), which rests on the approaches of Fernand Braudel (1979) and Immanuel Wallerstein (1980), has radicalized the thesis already propounded by Edmond Silberner (1939) who claimed that Quesnay was profoundly ignorant of military matters and failed to understand the power struggles being played out on the seas and in the colonies. Did not Quesnay propose turning back to an agricultural economy, banishing industry, trade, and the navy—in short, all the active forces thanks to which Great Britain had snatched domination of the world economy from Holland and thanks to which she would prevent France from obtaining it?Yet this thesis is weak. It must be remembered that Quesnay's first economic writings date from 1756–57, that is to say a period when confrontation between France and England was at a peak, with the start of the Seven Years' War. How could an author who claims to de ne the economic government ofan agricultural nation ignore the military problems which were so crucial in this period? Even if he wanted to, how could he succeed in doing so once he came to deal with taxes and the highly sensitive question of finance? How could he make himself understood by his contemporaries with a political theory that set aside all the burning issues of the day? How could he find an audience among those developing the science of commerce who always accorded great importance to the pursuit of power?Under scrutiny the traditional thesis appears inaccurate. After recalling the writings of some of his contemporaries, whom Quesnay knew and read (section 1), I shall show that articles drafted between 1756 and 1757, like published or unpublished works which Mirabeau and Quesnay elaborated between 1757 and 1760, give significant room to the nation's military power, particularly when the economic government is in question (section 2). From the years 1763–64 the idea of a natural order does not lead Quesnay to neglect the pursuit of power (section 3). These links between power and wealth in the work of the founder of Physiocracy will lead finally to some remarks on political economy as a form of rationalization of politics.

Abstract:
The article considers the political aspect of land reform in the Republic of Zimbabwe. The problem of land reform has been one of the crucial ones in the history of this African country, which celebrated 40 years of independence on April 18, 2020. In recent decades, it has been constantly in the spotlight of political and electoral processes. The land issue was one of the key points of the political program from the very beginning of Robert Mugabe’s reign in 1980. The political aspect of land reform began to manifest itself clearly with the growth of the opposition movement in the late 1990s. In 2000–2002 the country implemented the Fast Track Land Reform Program (FTLRP), the essence of which was the compulsory acquisition of land from white owners without compensation. The expropriation of white farmers’ lands in the 2000s led to a serious reconfiguration of land ownership, which helped to maintain in power the ruling party, the African National Union of Zimbabwe – Patriotic Front (ZANU – PF). The government was carrying out its land reform in the context of a sharp confrontation with the opposition, especially with the Party for the Movement for Democratic Change (MDC), led by trade union leader Morgan Tsvangirai. The land issue was on the agenda of all the election campaigns (including the elections in July 2018); this fact denotes its politicization, hence the timeliness of this article. The economic and political crisis in Zimbabwe in the 2000–2010s was the most noticeable phenomenon in the South African region. The analysis of foreign and domestic sources allows us to conclude that the accelerated land reform served as one of its main triggers. The practical steps of the new Zimbabwean president, Mr. Emmerson Mnangagwa, indicate that he is aware of the importance of resolving land reform-related issues for further economic recovery. At the beginning of March 2020, the government adopted new regulations defining the conditions for compensation to farmers. On April 18, 2020, speaking on the occasion of the 40th anniversary of the independence of Zimbabwe, Mr. E. Mnangagwa stated that the land reform program remains the cornerstone of the country’s independence and sovereignty.

Abstract:
The article argues that the Fast Track Land Reform Programme should be viewed from a security and strategic perspective motivated by its historiographical heritage regarded as worthy of preservation. It has always been a sensitive issue so compelling that successive colonial administrations, setter regimes and governments were determined to utilize all their instruments of power to exert authority for its preservation and control. The Fast Track Land Reform Programme, like its predecessors was a clear expression of the close relationship between foreign, domestic and military policy in pursuit of national goals and values. The subtext of the article is the assertion of the principle of self-determination over the right of ownership of land on a people as expressed by the United Nations norms and values. The aim of the article is to interrogate the security and strategic dimension of the Fast Track Land Reform Programme. The article argues that the involvement of the Zimbabwe Defence Forces in the Fast Track Land Reform Programme must be understood and analysed from the long held Clauzewitzian philosophy of the crucial inter-relationship between; foreign, domestic, and military policy (Dimitriu, 2018). Four main areas are discussed: the historical land brutal military conquests through the foreign policy pronouncements at the 1884/5 Berlin conference; the United Nations Resolution on the colonised people and how the Lancaster House torpedoed the principle in 1979; the constitutional provisions and prescriptions on the repossession of land; the historical role of Armed Forces in supporting civilian authorities in the implementation of domestic and foreign policy objectives deemed to be of security and strategic nature by successive colonial and settler regimes in Zimbabwe. The major findings of the study provide the modern classical background theoretic, necessary principles that explain the legitimacy and rationale for the professional military involvement in politics of the day. The study concludes that the issue of land on a State or Nation is an emotive matter, which can easily be a source of conflict, if not addressed from a security and strategic perspective.

Human history has witnessed varied surveillance and counter-surveillance activities from time immemorial. Human beings could not surveille others effectively and accurately without the technology of their era. Technology is a tool that can empower both people and governments. The outcomes are different based on the users’ intentions and aims. 2,500 years ago, Sun Tzu noted that ‘If you know both yourself and your enemy, you can win numerous (literally, "a hundred") battles without jeopardy’. His words still ring true. To be a good surveiller and counter-surveiller it is essential to know both sides, and in order to be good at these activities access to technology is vital. There is no doubt that knowledge is power, and without technology to access the information, it is impossible to be powerful. As we become more expert at technology, we will learn what makes surveillance and counter-surveillance more effective, and will be more powerful.“Surveillance” is one of the most important aspects of living in the convergent media environment. This essay illustrates government surveillance and counter-surveillance during the Iranian Green Movement (2009) on social and mobile media. The Green Movement refers to a non-violent movement that arose after the disputed presidential election on June 2009. After that Iran was facing its most serious political crisis since the 1979 revolution. Claims of vote fraud triggered massive street protests. Many took to the streets with “Green” signs, chanting slogans such as ‘the government lied’, and ‘where is my vote?’ There is no doubt that social and mobile media has played an important role in Iran’s contemporary politics. According to Internet World Stats (IWS) Internet users in 2009 account for approximately 48.5 per cent of the population of Iran. In 2009, Iran had 30.2 million mobile phone users (Freedom House), and 72 cellular subscriptions for every 100 people (World Bank). Today, while Iran has the 19th-largest population in the world, its blogosphere holds the third spot in terms of number of users, just behind the United States and China (Beth Elson et al.). In this essay the use of social and mobile media (technology) is not debated, but the extent of this use, and who, why and how it is used, is clearly scrutinised.Visibility and Surveillance There have been different kinds of surveillance for a very long time. However, all types of surveillance are based on the notion of “visibility”. Previous studies show that visibility is not a new term (Foucault Discipline). The new things in the new era, are its scale, scope and complicated ways to watch others without being watched, which are not limited to a specific time, space and group, and are completely different from previous instruments for watching (Andrejevic). As Meikle and Young (146) have mentioned ‘networked digital media bring with them a new kind of visibility’, based on different kinds of technology. Internet surveillance has important implications in politics to control, protect, and influence (Marx Ethics; Castells; Fuchs Critique). Surveillance has been improved during its long history, and evolved from very simple spying and watching to complicated methods of “iSpy” (Andrejevic). To understand the importance of visibility and its relationship with surveillance, it is essential to study visibility in conjunction with the notion of “panopticon” and its contradictory functions. Foucault uses Bentham's notion of panopticon that carries within itself visibility and transparency to control others. “Gaze” is a central term in Bentham’s view. ‘Bentham thinks of a visibility organised entirely around a dominating, overseeing gaze’ (Foucault Eye). Moreover, Thomson (Visibility 11) notes that we are living in the age of ‘normalizing the power of the gaze’ and it is clear that the influential gaze is based on powerful means to see others.Lyon (Surveillance 2) explains that ‘surveillance is any collection and processing of personal data, whether identifiable or not, for the purpose of influencing or managing those whose data have been granted…’. He mentions that today the most important means of surveillance reside in computer power which allows collected data to be sorted, matched, retrieved, processed, marketed and circulated.Nowadays, the Internet has become ubiquitous in many parts of the world. So, the changes in people’s interactions have influenced their lives. Fuchs (Introduction 15) argues that ‘information technology enables surveillance at a distance…in real time over networks at high transmission speed’. Therefore, visibility touches different aspects of people’s lives and living in a “glasshouse” has caused a lot of fear and anxiety about privacy.Iran’s Green Movement is one of many cases for studying surveillance and counter-surveillance technologies in social and mobile media. Government Surveillance on Social and Mobile Media in Iran, 2009 In 2009 the Iranian government controlled technology that allowed them to monitor, track, and limit access to the Internet, social media and mobiles communication, which has resulted in the surveillance of Green Movement’s activists. The Iranian government had improved its technical capabilities to monitor the people’s behavior on the Internet long before the 2009 election. The election led to an increase in online surveillance. Using social media the Iranian government became even more powerful than it was before the election. Social media was a significant factor in strengthening the government’s power. In the months after the election the virtual atmosphere became considerably more repressive. The intensified filtering of the Internet and implementation of more advanced surveillance systems strengthened the government’s position after the election. The Open Net Initiative revealed that the Internet censorship system in Iran is one of the most comprehensive and sophisticated censorship systems in the world. It emphasized that ‘Advances in domestic technical capacity have contributed to the implementation of a centralized filtering strategy and a reduced reliance on Western technologies’.On the other hand, the authorities attempted to block all access to political blogs (Jaras), either through cyber-security methods or through threats (Tusa). The Centre for Investigating Organized Cyber Crimes, which was founded in 2007 partly ‘to investigate and confront social and economic offenses on the Internet’ (Cyber Police), became increasingly important over the course of 2009 as the government combated the opposition’s online activities (Beth Elson et al. 16). Training of "senior Internet lieutenants" to confront Iran's "virtual enemies online" was another attempt that the Intelligence minister announced following the protests (Iran Media Program).In 2009 the Iranian government enacted the Computer Crime Law (Jaras). According to this law the Committee in Charge of Determining Unauthorized Websites is legally empowered to identify sites that carry forbidden content and report that information to TCI and other major ISPs for blocking (Freedom House). In the late fall of 2009, the government started sending threatening and warning text messages to protesters about their presence in the protests (BBC). Attacking, blocking, hacking and hijacking of the domain names of some opposition websites such as Jaras and Kaleme besides a number of non-Iranian sites such as Twitter were among the other attempts of the Iranian Cyber Army (Jaras).It is also said that the police and security forces arrested dissidents identified through photos and videos posted on the social media that many imagined had empowered them. Furthermore, the online photos of the active protesters were posted on different websites, asking people to identify them (Valizadeh).In late June 2009 the Iranian government was intentionally permitting Internet traffic to and from social networking sites such as Facebook and Twitter so that it could use a sophisticated practice called Deep Packet Inspection (DPI) to collect information about users. It was reportedly also applying the same technology to monitor mobile phone communications (Beth Elson et al. 15).On the other hand, to cut communication between Iranians inside and outside the country, Iran slowed down the Internet dramatically (Jaras). Iran also blocked access to Facebook, YouTube, Wikipedia, Twitter and many blogs before, during and after the protests. Moreover, in 2009, text message services were shut down for over 40 days, and mobile phone subscribers could not send or receive text messages regardless of their mobile carriers. Subsequently it was disrupted on a temporary basis immediately before and during key protests days.It was later discovered that the Nokia Siemens Network provided the government with surveillance technologies (Wagner; Iran Media Program). The Iranian government built a complicated system that enabled it to monitor, track and intercept what was said on mobile phones. Nokia Siemens Network confirmed it supplied Iran with the technology needed to monitor, control, and read local telephone calls [...] The product allowed authorities to monitor any communications across a network, including voice calls, text messaging, instant messages, and web traffic (Cellan-Jones). Media sources also reported that two Chinese companies, Huawei and ZTE, provided surveillance technologies to the government. The Nic Payamak and Saman Payamak websites, that provide mass text messaging services, also reported that operator Hamrah Aval commonly blocked texts with words such as meeting, location, rally, gathering, election and parliament (Iran Media Program). Visibility and Counter-Surveillance The panopticon is not limited to the watchers. Similarly, new kinds of panopticon and visibility are not confined to government surveillance. Foucault points out that ‘the seeing machine was once a sort of dark room into which individuals spied; it has become a transparent building in which the exercise of power may be supervised by society as a whole’ (Discipline 207). What is important is Foucault's recognition that transparency, not only of those who are being observed but also of those who are observing, is central to the notion of the panopticon (Allen) and ‘any member of society will have the right to come and see with his own eyes how schools, hospitals, factories, and prisons function’ (Foucault, Discipline 207). Counter-surveillance is the process of detecting and mitigating hostile surveillance (Burton). Therefore, while the Internet is a surveillance instrument that enables governments to watch people, it also improves the capacity to counter-surveille, and draws public attention to governments’ injustice. As Castells (185) notes the Internet could be used by citizens to watch their government as an instrument of control, information, participation, and even decision-making, from the bottom up.With regards to the role of citizens in counter-surveillance we can draw on Jay Rosen’s view of Internet users as ‘the people formerly known as the audience’. In counter-surveillance it can be said that passive citizens (formerly the audience) have turned into active citizens. And this change was becoming impossible without mobile and social media platforms. These new techniques and technologies have empowered people and given them the opportunity to have new identities. When Thompson wrote ‘the exercise of power in modern societies remains in many ways shrouded in secrecy and hidden from the public gaze’ (Media 125), perhaps he could not imagine that one day people can gaze at the politicians, security forces and the police through the use of the Internet and mobile devices.Furthermore, while access to mobile media allows people to hold authorities accountable for their uses and abuses of power (Breen 183), social media can be used as a means of representation, organization of collective action, mobilization, and drawing attention to police brutality and reasons for political action (Gerbaudo).There is no doubt that having creativity and using alternative platforms are important aspects in counter-surveillance. For example, images of Lt. Pike “Pepper Spray Cop” from the University of California became the symbol of the senselessness of police brutality during the Occupy Movement (Shaw). Iranians’ Counter-Surveillance on Social and Mobile Media, 2009 Iran’s Green movement (2009) triggered a lot of discussions about the role of technology in social movements. In this regard, there are two notable attitudes about the role of technology: techno-optimistic (Shriky and Castells) and techno-pessimistic (Morozov and Gladwell) views should be taken into account. While techno-optimists overrated the role of social media, techno-pessimists underestimated its role. However, there is no doubt that technology has played a great role as a counter-surveillance tool amongst Iranian people in Iran’s contemporary politics.Apart from the academic discussions between techno-optimists and techno-pessimists, there have been numerous debates about the role of new technologies in Iran during the Green Movement. This subject has received interest from different corners of the world, including Western countries, Iranian authorities, opposition groups, and also some NGOs. However, its role as a means of counter-surveillance has not received adequate attention.As the tools of counter-surveillance are more or less the tools of surveillance, protesters learned from the government to use the same techniques to challenge authority on social media.Establishing new websites (such as JARAS, RASA, Kalemeh, and Iran green voice) or strengthening some previous ones (such as Saham, Emrooz, Norooz), also activating different platforms such as Facebook, Twitter, and YouTube accounts to broadcast the voice of the Iranian Green Movement and neutralize the government’s propaganda were the most important ways to empower supporters of Iran’s Green Movement in counter-surveillance.‘Reporters Without Borders issued a statement, saying that ‘the new media, and particularly social networks, have given populations collaborative tools with which they can change the social order’. It is also mentioned that despite efforts by the Iranian government to prevent any reporting of the protests and due to considerable pressure placed on foreign journalists inside Iran, social media played a significant role in sending the messages and images of the movement to the outside world (Axworthy). However, at that moment, many thought that Twitter performed a liberating role for Iranian dissenters. For example, Western media heralded the Green Movement in Iran as a “Twitter revolution” fuelled by information and communication technologies (ICTs) and social media tools (Carrieri et al. 4). “The Revolution Will Be Twittered” was the first in a series of blog posts published by Andrew Sullivan a few hours after the news of the protests was released.According to the researcher’s observation the numbers of Twitter users inside Iran who tweeted was very limited in 2009 and social media was most useful in the dissemination of information, especially from those inside Iran to outsiders. Mobile phones were mostly influential as an instrument firstly used for producing contents (images and videos) and secondly for the organisation of protests. There were many photos and videos that were filmed by very simple mobile cell phones, uploaded by ordinary people onto YouTube and other platforms. The links were shared many times on Twitter and Facebook and released by mainstream media. The most frequently circulated story from the Iranian protests was a video of Neda Agha-Sultan. Her final moments were captured by some bystanders with mobile phone cameras and rapidly spread across the global media and the Internet. It showed that the camera-phone had provided citizens with a powerful means, allowing for the creation and instant sharing of persuasive personalised eyewitness records with mobile and globalised target populations (Anden-Papadopoulos).Protesters used another technique, DDOS (distributed denial of service attacks), for political protest in cyber space. Anonymous people used DDOS to overload a website with fake requests, making it unavailable for users and disrupting the sites set as targets (McMillan) in effect, shutting down the site. DDOS is an important counter-surveillance activity by grassroots activists or hackers. It was a cyber protest that knocked the main Iranian governmental websites off-line and caused crowdsourcing and false trafficking. Amongst them were Mahmoud Ahmadinejad, Iran's supreme leader’s websites and those which belong to or are close to the government or security forces, including news agencies (Fars, IRNA, Press TV…), the Ministry of Foreign Affairs, the Ministry of Justice, the Police, and the Ministry of the Interior.Moreover, as authorities uploaded the pictures of protesters onto different platforms to find and arrest them, in some cities people started to put the pictures, phone numbers and addresses of members of security forces and plain clothes police officers who attacked them during the protests and asked people to identify and report the others. They also wanted people to send information about suspects who infringed human rights. Conclusion To sum up, visibility, surveillance and counter-surveillance are not new phenomena. What is new is the technology, which increased their complexity. As Foucault (Discipline 200) mentioned ‘visibility is a trap’, so being visible would be the weakness of those who are being surveilled in the power struggle. In the convergent era, in order to be more powerful, both surveillance and counter-surveillance activities aim for more visibility. Although both attempt to use the same means (technology) to trap the other side, the differences are in their subjects, objects, goals and results.While in surveillance, visibility of the many by the few is mostly for the purpose of control and influence in undemocratic ways, in counter-surveillance, the visibility of the few by the many is mostly through democratic ways to secure more accountability and transparency from the governments.As mentioned in the case of Iran’s Green Movement, the scale and scope of visibility are different in surveillance and counter-surveillance. The importance of what Shaw wrote about Sydney occupy counter-surveillance, applies to other places, such as Iran. She has stressed that ‘protesters and police engaged in a dance of technology and surveillance with one another. Both had access to technology, but there were uncertainties about the extent of technology and its proficient use…’In Iran (2009), both sides (government and activists) used technology and benefited from digital networked platforms, but their levels of access and domains of influence were different, which was because the sources of power, information and wealth were divided asymmetrically between them. Creativity was important for both sides to make others more visible, and make themselves invisible. Also, sharing information to make the other side visible played an important role in these two areas. Abstract:
On 19 January 1975, Australia’s first youth station 2JJ (Double Jay) launched itself onto the nation’s airwaves with a NASA-style countdown and You Only Like Me ‘Cause I’m Good in Bed by Australian band Skyhooks. Refused airtime by the commercial stations because of its explicit sexual content, this song was a clear signifier of the new station’s intent—to occupy a more radical territory on Australian radio. Indeed, Double Jay’s musical entrée into the highly restrictive local broadcasting environment of the time has gone on to symbolise both the station’s role in its early days as an enfant terrible of radio (Inglis 376), and its near 40 years as a voice for youth culture in Australia (Milesago, Double Jay). In this paper we explore the proposition that Double Jay functioned as an outlet for youth counterculture in Australia, and that it achieved this even with (and arguably because of) its credentials as a state-generated entity. This proposition is considered via brief analysis of the political and musical context leading to the establishment of Double Jay. We intend to demonstrate that although the station was deeply embedded in “the system” in material and cultural terms, it simultaneously existed in an “uneasy symbiosis” (Martin and Siehl 54) with this system because it consciously railed against the mainstream cultures from which it drew, providing a public and active vehicle for youth counterculture in Australia. The origins of Double Jay thus provide one example of the complicated relationship between culture and counterculture, and the multiple ways in which the two are inextricably linked. As a publicly-funded broadcasting station Double Jay was liberated from the industrial imperatives of Australia’s commercial stations which arguably drove their predisposition for formula. The absence of profit motive gave Double Jay’s organisers greater room to experiment with format and content, and thus the potential to create a genuine alternative in Australia broadcasting. As a youth station Double Jay was created to provide a minority with its own outlet. The Labor government committed to wrenching airspace from the very restrictive Australian broadcasting “system” (Wiltshire and Stokes 2) to provide minority voices with room to speak and to be heard. Youth was identified by the government as one such minority. The Australian Broadcasting Commission (ABC) contributed to this process by enabling young staffers to establish the semi-independent Contemporary Radio Unit (CRU) (Webb) and within this a youth station. Not only did this provide a focal point around which a youth collective could coalesce, but the distinct place and identity of Double Jay within the ABC offered its organisers the opportunity to ignore or indeed subvert some of the perceived strictures of the “mothership” that was the ABC, whether in organisational, content and/or stylistic terms. For these and other reasons Double Jay was arguably well positioned to counter the broadcasting cultures that existed alongside this station. It did so stylistically, and also in more fundamental ways, At the same time, however, it “pillaged the host body at random” (Webb) co-opting certain aspects of these cultures (people, scheduling, content, administration) which in turn implicated Double Jay in the material and cultural practices of those mainstream cultures against which it railed. Counterculture on the Airwaves: Space for Youth to Play? Before exploring these themes further, we should make clear that Double Jay’s legitimacy as a “counterculture” organisation is observably tenuous against the more extreme renderings of the concept. Theodore Roszak, for example, requires of counterculture something “so radically disaffiliated from the mainstream assumptions of our society that it scarcely looks to many as a culture at all” (5). Double Jay was a brainchild of the state: an outcome of the Whitlam Government’s efforts to open up the nation’s airwaves (Davis, Government; McClelland). Further, the supervision of this station was given to the publicly funded Australian national broadcaster, the ABC (Inglis). Any claim Double Jay has to counterculture status then is arguably located in less radical invocations of the term. Some definitions, for example, hold that counterculture contains value systems that run counter to culture, but these values are relational rather than divorced from each other. Kenneth Leech, for example, states that counterculture is "a way of life and philosophy which at central points is in conflict with the mainstream society” (Desmond et al. 245, our emphasis); E.D. Batzell defines counterculture as "a minority culture marked by a set of values, norms and behaviour patterns which contradict those of the dominant society" (116, our emphasis). Both definitions imply that counterculture requires the mainstream to make sense of what it is doing and why. In simple terms then, counterculture as the ‘other’ does not exist without its mainstream counterpoint. The particular values with which counterculture is in conflict are generated by “the system” (Heath and Potter 6)—a system that imbues “manufactured needs and mass-produced desires” (Frank 15) in the masses to encourage order, conformity and consumption. Counterculture seeks to challenge this “system” via individualist, expression-oriented values such as difference, diversity, change, egalitarianism, and spontaneity (Davis On Youth; Leary; Thompson and Coskuner‐Balli). It is these kinds of counterculture values that we demonstrate were embedded in the content, style and management practices within Double Jay. The Whitlam Years and the Birth of Double Jay Double Jay was borne of the Whitlam government’s brief but impactful period in office from 1972 to 1975, after 23 years of conservative government in Australia. Key to the Labor Party’s election platform was the principle of participatory democracy, the purpose of which was “breaking down apathy and maximising active citizen engagement” (Cunningham 123). Within this framework, the Labor Party committed to opening the airwaves, and reconfiguring the rhetoric of communication and media as a space of and for the people (Department of the Media 3). Labor planned to honour this commitment via sweeping reforms that would counter the heavily concentrated Australian media landscape through “the encouragement of diversification of ownership of commercial radio and television”—and in doing so enable “the expression of a plurality of viewpoints and cultures throughout the media” (Department of the Media 3). Minority groups in particular were to be privileged, while some in the Party even argued for voices that would actively agitate. Senator Jim McClelland, for one, declared, “We say that somewhere in the system there must be broadcasting which not only must not be afraid to be controversial but has a duty to be controversial” (Senate Standing Committee 4). One clear voice of controversy to emerge in the 1960s and resonate throughout the 1970s was the voice of youth (Gerster and Bassett; Langley). Indeed, counterculture is considered by some as synonymous with a particular strain of youth culture during this time (Roszak; Leech). The Labor Government acknowledged this hitherto unrecognised voice in its 1972 platform, with Minister for the Media Senator Doug McClelland claiming that his party would encourage the “whetting of the appetite” for “life and experimentation” of Australia’s youth – in particular through support for the arts (160). McClelland secured licenses for two “experimental-type” stations under the auspices of the ABC, with the youth station destined for Sydney via the ABC’s standby transmitter in Gore Hill (ABCB, 2). Just as the political context in early 1970s Australia provided the necessary conditions for the appearance of Double Jay, so too did the cultural context. Counterculture emerged in the UK, USA and Europe as a clear and potent force in the late 1960s (Roszak; Leech; Frank; Braunstein and Doyle). In Australia this manifested in the 1960s and 1970s in various ways, including political protest (Langley; Horne); battles for the liberalisation of censorship (Hope and Dickerson, Liberalisation; Chipp and Larkin); sex and drugs (Dawson); and the art film scene (Hope and Dickerson, Happiness; Thoms). Of particular interest here is the “lifestyle” aspect of counterculture, within which the value-expressions against the dominant culture manifest in cultural products and practices (Bloodworth 304; Leary ix), and more specifically, music. Many authors have suggested that music was pivotal to counterculture (Bloodworth 309; Leech 8), a key “social force” through which the values of counterculture were articulated (Whiteley 1). The youth music broadcasting scene in Australia was extremely narrow prior to Double Jay, monopolised by a handful of media proprietors who maintained a stranglehold over the youth music scene from the mid-50s. This dominance was in part fuelled by the rising profitability of pop music, driven by “the dreamy teenage market”, whose spending was purely discretionary (Doherty 52) and whose underdeveloped tastes made them “immune to any sophisticated disdain of run-of-the-mill” cultural products (Doherty 230-231). Over the course of the 1950s the commercial stations pursued this market by “skewing” their programs toward the youth demographic (Griffen-Foley 264). The growing popularity of pop music saw radio shift from a “multidimensional” to “mono-dimensional” medium according to rock journalist Bruce Elder, in which the “lowest-common-denominator formula of pop song-chat-commercial-pop-song” dominated the commercial music stations (12). Emblematic of this mono-dimensionalism was the appearance of the Top 40 Playlist in 1958 (Griffin-Foley 265), which might see as few as 10–15 songs in rotation in peak shifts. Elder claims that this trend became more pronounced over the course of the 1960s and peaked in 1970, with playlists that were controlled with almost mechanical precision [and] compiled according to American-devised market research methods which tended to reinforce repetition and familiarity at the expense of novelty and diversity. (12) Colin Vercoe, whose job was to sell the music catalogues of Festival Records to stations like 2UE, 2SER and SUW, says it was “an incredibly frustrating affair” to market new releases because of the rigid attachment by commercials to the “Top 40 of endless repeats” (Vercoe). While some air time was given to youth music beyond the Top 40, this happened mostly in non-peak shifts and on weekends. Bill Drake at 2SM (who was poached by Double Jay and allowed to reclaim his real name, Holger Brockmann) played non-Top 40 music in his Sunday afternoon programme The Album Show (Brockmann). A more notable exception was Chris Winter’s Room to Move on the ABC, considered by many as the predecessor of Double Jay. Introduced in 1971, Room to Move played all forms of contemporary music not represented by the commercial broadcasters, including whole albums and B sides. Rock music’s isolation to the fringes was exacerbated by the lack of musical sales outlets for rock and other forms of non-pop music, with much music sourced through catalogues, music magazines and word of mouth (Winter; Walker). In this context a small number of independent record stores, like Anthem Records in Sydney and Archie and Jugheads in Melbourne, appear in the early 1970s. Vercoe claims that the commercial record companies relentlessly pursued the closure of these independents on the grounds they were illegal entities: The record companies hated them and they did everything they could do close them down. When (the companies) bought the catalogue to overseas music, they bought the rights. And they thought these record stores were impinging on their rights. It was clear that a niche market existed for rock and alternative forms of music. Keith Glass and David Pepperell from Archie and Jugheads realised this when stock sold out in the first week of trade. Pepperell notes, “We had some feeling we were doing something new relating to people our own age but little idea of the forces we were about to unleash”. Challenging the “System” from the Inside At the same time as interested individuals clamoured to buy from independent record stores, the nation’s first youth radio station was being instituted within the ABC. In October 1974, three young staffers—Marius Webb, Ron Moss and Chris Winter— with the requisite youth credentials were briefed by ABC executives to build a youth-style station for launch in January 1975. According to Winter “All they said was 'We want you to set up a station for young people' and that was it!”, leaving the three with a conceptual carte blanche–although assumedly within the working parameters of the ABC (Webb). A Contemporary Radio Unit (CRU) was formed in order to meet the requirements of the ABC while also creating a clear distinction between the youth station and the ABC. According to Webb “the CRU gave us a lot of latitude […] we didn’t have to go to other ABC Departments to do things”. The CRU was conscious from the outset of positioning itself against the mainstream practices of both the commercial stations and the ABC. The publicly funded status of Double Jay freed it from the shackles of profit motive that enslaved the commercial stations, in turn liberating its turntables from baser capitalist imperatives. The two coordinators Ron Moss and Marius Webb also bypassed the conventions of typecasting the announcer line-up (as was practice in both commercial and ABC radio), seeking instead people with charisma, individual style and youth appeal. Webb told the Sydney Morning Herald that Double Jay’s announcers were “not required to have a frontal lobotomy before they go on air.” In line with the individual- and expression-oriented character of the counterculture lifestyle, it was made clear that “real people” with “individuality and personality” would fill the airwaves of Double Jay (Nicklin 9). The only formula to which the station held was to avoid (almost) all formula – a mantra enhanced by the purchase in the station’s early days of thousands of albums and singles from 10 or so years of back catalogues (Robinson). This library provided presenters with the capacity to circumvent any need for repetition. According to Winter the DJs “just played whatever we wanted”, from B sides to whole albums of music, most of which had never made it onto Australian radio. The station also adapted the ABC tradition of recording live classical music, but instead recorded open-air rock concerts and pub gigs. A recording van built from second-hand ABC equipment captured the grit of Sydney’s live music scene for Double Jay, and in so doing undercut the polished sounds of its commercial counterparts (Walker). Double Jay’s counterculture tendencies further extended to its management style. The station’s more political agitators, led by Webb, sought to subvert the traditional top-down organisational model in favour of a more egalitarian one, including a battle with the ABC to remove the bureaucratic distinction between technical staff and presenters and replace this with the single category “producer/presenter” (Cheney, Webb, Davis 41). The coordinators also actively subverted their own positions as coordinators by holding leaderless meetings open to all Double Jay employees – meetings that were infamously long and fraught, but also remembered as symbolic of the station’s vibe at that time (Frolows, Matchett). While Double Jay assumed the ABC’s focus on music, news and comedy, at times it politicised the content contra to the ABC’s non-partisan policy, ignored ABC policy and practice, and more frequently pushed its contents over the edges of what was considered propriety and taste. These trends were already present in pockets of the ABC prior to Double Jay: in current affairs programmes like This Day Tonight and Four Corners (Harding 49); and in overtly leftist figures like Alan Ashbolt (Bowman), who it should be noted had a profound influence over Webb and other Double Jay staff (Webb). However, such an approach to radio still remained on the edges of the ABC. As one example of Double Jay’s singularity, Webb made clear that the ABC’s “gentleman’s agreement” with the Federation of Australian Commercial Broadcasters to ban certain content from airplay would not apply to Double Jay because the station would not “impose any censorship on our people” – a fact demonstrated by the station’s launch song (Nicklin 9). The station’s “people” in turn made the most of this freedom with the production of programmes like Gayle Austin’s Horny Radio Porn Show, the Naked Vicar Show, the adventures of Colonel Chuck Chunder of the Space Patrol, and the Sunday afternoon comic improvisations of Nude Radio from the team that made Aunty Jack. This openness also made its way into the news team, most famously in its second month on air with the production of The Ins and Outs of Love, a candid documentary of the sexual proclivities and encounters of Sydney’s youth. Conservative ABC staffer Clement Semmler described the programme as containing such “disgustingly explicit accounts of the sexual behaviour of young teenagers” that it “aroused almost universal obloquy from listeners and the press” (35). The playlist, announcers, comedy sketches, news reporting and management style of Double Jay represented direct challenges to the entrenched media culture of Australia in the mid 1970s. The Australian National Commission for UNESCO noted at the time that Double Jay was “variously described as political, subversive, offensive, pornographic, radical, revolutionary and obscene” (7). While these terms were understandable given the station’s commitment to experiment and innovation, the “vital point” about Double Jay was that it “transmitted an electronic reflection of change”: What the station did was to zero in on the kind of questioning of traditional values now inherent in a significant section of the under 30s population. It played their music, talked in their jargon, pandered to their whims, tastes, prejudices and societal conflicts both intrinsic and extrinsic. (48) Conclusion From the outset, Double Jay was locked in an “uneasy symbiosis” with mainstream culture. On the one hand, the station was established by federal government and its infrastructure was provided by state funds. It also drew on elements of mainstream broadcasting in multiple ways. However, at the same time, it was a voice for and active agent of counterculture, representing through its content, form and style those values that were considered to challenge the ‘system,’ in turn creating an outlet for the expression of hitherto un-broadcast “ways of thinking and being” (Leary). As Henry Rosenbloom, press secretary to then Labor Minister Dr Moss Cass wrote, Double Jay had the potential to free its audience “from an automatic acceptance of the artificial rhythms of urban and suburban life. In a very real sense, JJ [was] a deconditioning agent” (Inglis 375-6). While Double Jay drew deeply from mainstream culture, its skilful and playful manipulation of this culture enabled it to both reflect and incite youth-based counterculture in Australia in the 1970s. Abstract:
IntroductionThe role, function, and future of the Western public intellectual have been highly contested over the last three decades. The dominant discourse, which predicts the decline of the public intellectual, asserts the institutionalisation of their labour has eroded their authority to speak publicly to power on behalf of others; and that the commodification of intellectual performance has transformed them from sages, philosophers, and men of letters into trivial media entertainers, pundits, and ideologues. Overwhelmingly the crisis debates link the demise of the public intellectual to shifts in public culture, which was initially conceptualised as a literary and artistic space designed to liberate the awareness of citizens through critique and to reflect upon “the chronic and persistent issues of life, meaning and representation” (McGuigan 430). This early imagining of public culture as an exclusively civilising space, however, did not last and Jurgen Habermas documented its decline in response to the commodification and politicisation of culture in the 20th century. Yet, as social activism continued to flourish in the public sphere, Habermas re-theorised public culture as a more pluralistic site which simultaneously accommodates “uncritical populism, radical subversion and critical intervention” (436) and operates as both a marketplace and a “site of communicative rationality, mutual respect and understanding (McGuigan 434). The rise of creative industries expanded popular engagement with public culture but destabilised the authority of the public intellectual. The accompanying shifts also affected the function of the curator, who, like the intellectual, had a role in legislating and arbitrating knowledge, and negotiating and authorising meaning through curated exhibitions of objects deemed sacred and significant. Jennifer Barrett noted the similarities in the two functions when she argued in Museums and the Public Sphere that, because museums have an intellectual role in society, curators have a public intellectual function as they define publics, determine modes of engagement, and shape knowledge formation (150). The resemblance between the idealised role of the intellectual and the curator in enabling the critique that emancipates the citizen means that both functions have been affected by the atomisation of contemporary society, which has exposed the power effects of the imposed coherency of authoritative and universal narratives. Indeed, just as Russell Jacoby, Allan Bloom, and Richard Posner predicted the death of the intellectual, who could no longer claim to speak in universal terms on behalf of others, so museums faced their own crisis of relevancy. Declining visitor numbers and reduced funding saw museums reinvent themselves, and in moving away from their traditional exclusive, authoritative, and nation building roles—which Pierre Bourdieu argued reproduced the “existing class-based culture, education and social systems” (Barrett 3)—museums transformed themselves into inclusive and diverse sites of co-creation with audiences and communities. In the context of this change the curator ceased to be the “primary producer of knowledge” (Barrett 13) and emerged to reproduce “contemporary culture preoccupations” and constitute the “social imagery” of communities (119). The modern museum remains concerned with explaining and interrogating the world, but the shift in curatorial work is away from the objects themselves to a focus upon audiences and how they value the artefacts, knowledge, and experiences of collective shared memory. The change in curatorial practices was driven by what Peter Vergo called a new “museology” (Barrett 2), and according to Macdonald this term assumes that “object meanings are contextual rather than inherent” or absolute and universal (2). Public intellectuals and curators, as the custodians of ideas and narratives in the contemporary cultural industries, privilege audience reception and recognise that consumers and/or citizens engage with public culture for a variety of reasons, including critique, understanding, and entertainment. Curators, like public intellectuals, also recognise that they can no longer assume the knowledge and experience of their audience, nor prescribe the nature of engagement with ideas and objects. Instead, curators and intellectuals emerge as negotiators and translators of cultural meaning as they traverse the divides in public culture, sequestering ideas and cultural artefacts and constructing narratives that engage audiences and communities in the process of re-imagining the past as a way of providing new insights into contemporary challenges.Methodology In exploring the idea that the public intellectual acts as a curator of ideas as he or she defines and privileges the discursive spaces of public culture, this paper begins by providing an overview of the cultural context of the contemporary public intellectual which enables comparisons between intellectual and curatorial functions. Second, this paper analyses a random sample of the content of books, newspaper and magazine articles, speeches, and transcripts of interviews drawn from The Australian, The Age, The Sydney Morning Herald, The Sydney Institute, the ABC, The Monthly, and Quadrant published or broadcast between 1996 and 2007, in order to identify the key themes of the History Wars. It should be noted that the History War debates were extensive, persistent, and complex—and as they unfolded over a 13-year period they emerged as the “most powerful” and “most disputed form of public intellectual work” (Carter, Ideas 9). Many issues were aggregated under the trope of the History Wars, and these topics were subject to both popular commentary and academic investigation. Furthermore, the History Wars discourse was produced in a range of mediums including popular media sources, newspaper and magazine columns, broadcasts, blogs, lectures, and writers’ forums and publications. Given the extent of this discourse, the sample of articles which provides the basis for this analysis does not seek to comprehensively survey the literature on the History Wars. Rather this paper draws upon Foucault’s genealogical qualitative method, which exposes the subordinated discontinuities in texts, to 1) consider the political context of the History War trope; and 2) identify how intellectuals discursively exhibited versions of the nation’s identity and in the process made visible the power effects of the past. Public Intellectuals The underlying fear of the debates about the public intellectual crisis was that the public intellectual would no longer be able to act as the conscience of a nation, speak truth to power, or foster the independent and dissenting public debate that guides and informs individual human agency—a goal that has lain at the heart of the Western intellectual’s endeavours since Kant’s Sapere aude. The late 20th century crisis discourse, however, primarily mourned the decline of a particular form of public authority attached to the heroic universal intellectual formation made popular by Emile Zola at the end of the 19th century, and which claimed the power to hold the political elites of France accountable. Yet talk of an intellectual crisis also became progressively associated with a variety of general concerns about globalising society. Some of these concerns included fears that structural shifts in the public domain would lead to the impoverishment of the cultural domain, the end of Western civilisation, the decline of the progressive political left, and the end of universal values. It was also expected that the decline in intellectuals would also enable the rise of populism, political conservatism, and anti-intellectualism (Jacoby Bloom; Bauman; Rorty; Posner; Furedi; Marquand). As a result of these fears, the function of the intellectual who engages publicly was re-theorised. Zygmunt Bauman suggested the intellectual was no longer the legislator or arbiter of taste but the negotiator and translator of ideas; Michel Foucault argued that the intellectual could be institutionally situated and still speak truth to power; and Edward Said insisted the public intellectual had a role in opening up possibilities to resolve conflict by re-imagining the past. In contrast, the Australian public intellectual has never been declared in crisis or dead, and this is probably because the nation does not have the same legacy of the heroic public intellectual. Indeed, as a former British colony labelled the “working man’s paradise” (White 4), Australia’s intellectual work was produced in “institutionalised networks” (Head 5) like universities and knowledge disciplines, political parties, magazines, and unions. Within these networks there was a double division of labour, between the abstraction of knowledge and its compartmentalisation, and between the practical application of knowledge and its popularisation. As a result of this legacy, a more organic, specific, and institutionalised form of intellectualism emerged, which, according to Head, limited intellectual influence and visibility across other networks and domains of knowledge and historically impeded general intellectual engagement with the public. Fears about the health and authority of the public intellectual in Australia have therefore tended to be produced as a part of Antonio Gramsci’s ideological “wars of position” (Mouffe 5), which are an endless struggle between cultural and political elites for control of the institutions of social reproduction. These struggles began in Australia in the 1970s and 1980s over language and political correctness, and they reappeared in the 1990s as the History Wars. History Wars“The History Wars” was a term applied to an ideological battle between two visions of the Australian nation. The first vision was circulated by Australian Labor Party Prime Minister Paul Keating, who saw race relations as central to 21st century global Australia and began the process of dealing with the complex and divisive Indigenous issues at home. He established the Council for Aboriginal Reconciliation in 1991; acknowledged in the 1992 Redfern speech that white settlers were responsible for the problems in Indigenous communities; and commissioned the Bringing Them Home report, which was completed in 1997 and concluded that the mandated removal of Indigenous children from their families and communities throughout the 20th century had violated their human rights and caused long-term and systemic damage to Indigenous communities.The second vision of Australia was circulated by Liberal Prime Minister John Howard, who, after he came to power in 1996, began his own culture war to reconstruct a more conservative vision of the nation. Howard believed that the stories of Indigenous dispossession undermined confidence in the nation, and he sought to produce a historical view of the past grounded in “Judeo-Christian ethics, the progressive spirit of the enlightenment and the institutions and values of British culture” (“Sense of Balance”). Howard called for a return to a narrative form that valorised Australia’s achievements, and he sought to instil a more homogenised view of the past and a coherent national identity by reviewing high school history programs, national museum appointments, and citizenship tests. These two political positions framed the subsequent intellectual struggles over the past. While a number of issues were implicated in the battle, generally, left commentators used the History Wars as a way to circulate certain ideas about morality and identity, including 1) Australians needed to make amends for past injustices to Indigenous Australians and 2) the nation’s global identity was linked to how they dealt with Australia’s first people. In contrast, the political right argued 1) the left had misrepresented and overstated the damage done to Indigenous communities and rewritten history; 2) stories about Indigenous abuse were fragmenting the nation’s identity at a time when the nation needed to build a coherent global presence; and 3) no apology was necessary, because contemporary Australians did not feel responsible for past injustices. AnalysisThe war between these two visions of Australia was fought in “extra-curricular sites,” according to Stuart Macintyre, and this included newspaper columns, writers’ festivals, broadcast interviews, intellectual magazines like The Monthly and Quadrant, books, and think tank lectures. Academics and intellectuals were the primary protagonists, and they disputed the extent of colonial genocide; the legitimacy of Indigenous land rights; the impact of the Stolen Generation on the lives of modern Indigenous citizens; and the necessity of a formal apology as a part of the reconciliation process. The conflicts also ignited debates about the nature of history, the quality of public debates in Australia, and exposed the tensions between academics, public intellectuals, newspaper commentators and political elites. Much of the controversy played out in the national forums can be linked to the Bringing Them Home: National Inquiry into the Separation of Aboriginal and Torres Strait Islander Children from Their Families report Stolen Generation inquiry and report, which was commissioned by Keating but released after Howard came to office. Australian public intellectual and professor of politics Robert Manne critiqued the right’s response to the report in his 2001 Quarterly Essay titled “In Denial: The Stolen Generation and The Right”. He argued that there was a right-wing campaign in Australia that sought to diminish and undermine justice for Aboriginal people by discounting the results of the inquiry, underestimating the numbers of those affected, and underfunding the report’s recommendations. He spoke of the nation’s shame and in doing so he challenged Australia’s image of itself. Manne’s position was applauded by many for providing what Kay Schaffer in her Australian Humanities Review paper called an “effective antidote to counter the bitter stream of vitriol that followed the release of the Bringing Them Home report”. Yet Manne also drew criticism. Historian Bain Attwood argued that Manne’s attack on conservatives was polemical, and he suggested that it would be more useful to consider in detail what drives the right-wing analysis of Indigenous issues. Attwood also suggested that Manne’s essay had misrepresented the origins of the narrative of the Stolen Generation, which had been widely known prior to the release of the Stolen Generation report.Conservative commentators focused upon challenging the accuracy of those stories submitted to the inquiry, which provided the basis for the report. This struggle over factual details was to characterise the approach of historian Keith Windschuttle, who rejected both the numbers of those stolen from their families and the degree of violence used in the settlement of Australia. In his 2002 book The Fabrication of Aboriginal History, Volume One, Van Diemen’s Land 1803–1847 he accused left-wing academics of exaggerating the events of Aboriginal history in order to further their own political agenda. In particular, he argued that the extent of the “conflagration of oppression and conflict” which sought to “dispossess, degrade, and devastate the Aboriginal people” had been overstated and misrepresented and designed to “create an edifice of black victimhood and white guilt” (Windschuttle, Fabrication 1). Manne responded to Windschuttle’s allegations in Whitewash: On Keith Windschuttle’s Fabrication of Aboriginal History, arguing that Windschuttle arguments were “unpersuasive and unsupported either by independent research or even familiarity with the relevant secondary historical literature” (7) and that the book added nothing to the debates. Other academics like Stephen Muecke, Marcia Langton and Heather Goodall expressed concerns about Windschuttle’s work, and in 2003 historians Stuart Macintyre and Anna Clark published The History Wars, which described the implications of the politicisation of history on the study of the past. At the same time, historian Bain Attwood in Telling the Truth About Aboriginal History argued that the contestation over history was eroding the “integrity of intellectual life in Australia” (2). Fractures also broke out between writers and historians about who was best placed to write history. The Australian book reviewer Stella Clarke wrote that the History Wars were no longer constructive discussions, and she suggested that historical novelists could colonise the territory traditionally dominated by professional historians. Inga Clendinnen wasn’t so sure. She wrote in a 2006 Quarterly Essay entitled “The History Question: Who Owns the Past?” that, while novelists could get inside events through a process of “applied empathy,” imagination could in fact obstruct the truth of reality (20). Discussion The History Wars saw academics engage publicly to exhibit a set of competing ideas about Australia’s identity in the nation’s media and associated cultural sites, and while the debates initially prompted interest they eventually came to be described as violent and unproductive public conversations about historical details and ideological positions. Indeed, just as the museum curator could no longer authoritatively prescribe the cultural meaning of artefacts, so the History Wars showed that public intellectuals could not adjudicate the identity of the nation nor prescribe the nature of its conduct. For left-wing public intellectuals and commentators, the History Wars came to signify the further marginalisation of progressive politics in the face of the dominant, conservative, and increasingly populist constituency. Fundamentally, the battles over the past reinforced fears that Australia’s public culture was becoming less diverse, less open, and less able to protect traditional civil rights, democratic freedoms, and social values. Importantly for intellectuals like Robert Manne, there was a sense that Australian society was less able or willing to reflect upon the moral legitimacy of its past actions as a part of the process of considering its contemporary identity. In contrast right-wing intellectuals and commentators argued that the History Wars showed how public debate under a conservative government had been liberated from political correctness and had become more vibrant. This was the position of Australian columnist Janet Albrechtsen who argued that rather than a decline in public debate there had been, in fact, “vigorous debate of issues that were once banished from the national conversation” (91). She went on to insist that left-wing commentators’ concerns about public debate were simply a mask for their discomfort at having their views and ideas challenged. There is no doubt that the History Wars, while media-orchestrated debates that circulated a set of ideological positions designed to primarily attract audiences and construct particular views of Australia, also raised public awareness of the complex issues associated with Australia’s Indigenous past. Indeed, the Wars ended what W.E.H Stanner had called the “great silence” on Indigenous issues and paved the way for Kevin Rudd’s apology to Indigenous people for their “profound grief, suffering and loss”. The Wars prompted conversations across the nation about what it means to be Australian and exposed the way history is deeply implicated in power surely a goal of both intellectual debate and curated exhibitions. ConclusionThis paper has argued that the public intellectual can operate like a curator in his or her efforts to preserve particular ideas, interpretations, and narratives of public culture. The analysis of the History Wars debates, however, showed that intellectuals—just like curators —are no longer authorities and adjudicators of the nation’s character, identity, and future but cultural intermediaries whose function is not just the performance or exhibition of selected ideas, objects, and narratives but also the engagement and translation of other voices across different contexts in the ongoing negotiation of what constitutes cultural significance. Consumer or home use (previously ‘amateur’) moving image formats are distinguished from professional (still known as ‘professional’) ones by relative affordability, ubiquity and simplicity of use. Since Pathé Frères released its Pathé Baby camera, projector and 9.5mm film gauge in 1922, a distinct line of viewing and making equipment has been successfully marketed at nonprofessional use, especially in the home. ‘Amateur film’ is a simple term for a complex, variegated and longstanding set of activities. Conceptually it is bounded only by the negative definition of nonprofessional (usually intended as sub-professional), and the positive definition of being for the love of the activity and motivated by personal passion alone. This defines a field broad enough that two major historians of US amateur film, Patricia R. Zimmermann and Alan D. Kattelle, write about different subjects. Zimmermann focuses chiefly on domestic use and ‘how-to’ literature, while Kattelle unearths the collective practices and institutional structure of the Amateur Ciné Clubs and the Amateur Ciné League (Zimmerman, Reel Families, Professional; Kattelle, Home Movies, Amateur Ciné). Marion Norris Gleason, a test subject in Eastman Kodak’s development of 16mm and advocate of amateur film, defined it as having three parts, the home movie, “the photoplay produced by organised groups”, and the experimental film (Swanson 132). This view was current at least until the 1960s, when domestic documentation, Amateur Ciné clubs and experimental filmmakers shared the same film gauges and space in the same amateur film magazines, but paths have diverged somewhat since then. Domestic documentation remains committed to the moving image technology du jour, the Amateur Ciné movement is much reduced, and experimental film has developed a separate identity, its own institutional structure, and won some legitimacy in the art world. The trajectory of Super 8, a late-coming gauge to amateur film, has been defined precisely by this disintegration. Obsolescence was manufactured far more slowly during the long reign of amateur film gauges, allowing 9.5mm (1922-66), 16mm (1923-), 8mm (1932-), and Super 8 (1965-) to engage in protracted format wars significantly longer than the life spans of their analogue and digital video successors. The range of options available to nonprofessional makers – the quality but relative expense of 16mm, the near 16mm frame size of 9.5mm, the superior stability of 8mm compared to 9.5mm and Super 8, the size of Super 8’s picture relative to 8mm’s – are not surprising in the context of general competition for a diverse popular market on the usual basis of price, quality, and novelty. However, since analogue video’s ascent the amateur film gauges have all comprehensibly lost the battle for the home use market. This was by far the largest section of amateur film and the manufacturers’ overt target segment, so the amateur film gauges’ contemporary survival and significance is as something else. Though all the gauges from 8mm to 16mm remain available today to the curious and enthusiastic, Super 8’s afterlife is distinguished by the peculiar combination of having been a tremendously popular substandard to the substandard (ie, to 16mm, the standardised film gauge directly below 35mm in both price and quality), and now being prized for its technological excellence. When the large scale consumption that had supported Super 8’s manufacture dropped away, it revealed the set of much smaller, apparently non-transferable uses that would determine whether and as what Super 8 survived. Consequently, though Super 8 has been superseded many times over as a home movie format, it is not obsolete today as an art medium, a professional format used in the commercial industry, or as an alternative to digital video and 16mm for low budget independent production. In other words, everything it was never intended to be. I lately witnessed an occasion of the kind of high-fetishism for film-versus-video and analogue-versus-digital that the experimental moving image world is justifiably famed for. Discussion around the screening of Peter Tscherkassky’s films at the Xperimenta ‘09 festival raised the specifics and availability of the technology he relies on, both because of the peculiarity of his production method – found-footage collaging onto black and white 35mm stock via handheld light pen – and the issue of projection. Has digital technology supplied an alternative workflow? Would 35mm stock to work on (and prints to pillage) continue to be available? Is the availability of 35mm projectors in major venues holding up? Although this insider view of 35mm’s waning market share was more a performance of technological cultural politics than an analysis of it, it raised a series of issues central to any such analysis. Each film format is a gestalt item, consisting of four parts (that an individual might own): film stock, camera, projector and editor. Along with the availability of processing services, these items comprise a gauge’s viability (not withstanding the existence of camera-less and unedited workflows, and numerous folk developing methods). All these are needed to conjure the geist of the machine at full strength. More importantly, the discussion highlights what happens when such a technology collides with idiosyncratic and unintended use, which happens only because it is manufactured on a much wider scale than eccentric use alone can support. Although nostalgia often plays a role in the advocacy of obsolete technology, its role here should be carefully qualified and not overstated. If it plays a role in the three main economies that support contemporary Super 8, it need not be the same role. Further, even though it is now chiefly the same specialist shops and technicians that supply and service 9.5mm, 8mm, Super 8, and 16mm, they are not sold on the same scale nor to the same purpose. There has been no reported Renaissances of 9.5mm or 8mm, though, as long term home movie formats, they must loom large in the memories of many, and their particular look evokes pastness as surely as any two-colour process. There are some specifics to the trajectory of Super 8 as a non-amateur format that cannot simply be subsumed to general nostalgia or dead technology fetishism. Super 8 as an Art Medium Super 8 has a longer history as an art medium than as a pro-tool or low budget substandard. One key aspect in the invention and supply of amateur film was that it not be an adequate substitute for the professional technology used to populate the media sphere proper. Thus the price of access to motion picture making through amateur gauges has been a marginalisation of the outcome for format reasons alone (Zimmermann, Professional 24; Reekie 110) Eastman Kodak established their 16mm as the acceptable substandard for many non-theatrical uses of film in the 1920s, Pathé’s earlier 28mm having already had some success in this area (Mebold and Tepperman 137, 148-9). But 16mm was still relatively expensive for the home market, and when Kiyooka Eiichi filmed his drive across the US in 1927, his 16mm camera alone cost more than his car (Ruoff 240, 243). Against this, 9.5mm, 8mm and eventually Super 8 were the increasingly affordable substandards to the substandard, marginalised twice over in the commercial world, but far more popular in the consumer market. The 1960s underground film, and the modern artists’ film that was partly recuperated from it, was overwhelmingly based on 16mm, as the collections of its chief distributors, the New York Film-Makers’ Co-op, Canyon Cinema and the Lux clearly show. In the context of experimental film’s longstanding commitment to 16mm, an artist filmmaker’s choice to work with Super 8 had important resonances. Experimental work on 8mm and Super 8 is not hard to come by, even from the 1960s, but consider the cultural stakes of Jonas Mekas’s description of 8mm films as “beautiful folk art, like song and lyric poetry, that was created by the people” (Mekas 83). The evocation of ‘folk art’ signals a yawning gap between 8mm, whose richness has been produced collectively by a large and anonymous group, and the work produced by individual artists such as those (like Mekas himself) who founded the New American Cinema Group. The resonance for artists of the 1960s and 1970s who worked with 8mm and Super 8 was from their status as the premier vulgar film gauge, compounding-through-repetition their choice to work with film at all. By the time Super 8 was declared ‘dead’ in 1980, numerous works by canonical artists had been made in the format (Stan Brakhage, Derek Jarman, Carolee Schneemann, Anthony McCall), and various practices had evolved around the specific possibilities of this emulsion and that camera. The camcorder not only displaced Super 8 as the simplest to use, most ubiquitous and cheapest moving image format, at the same time it changed the hierarchy of moving image formats because Super 8 was now incontestably better than something. Further, beyond the ubiquity, simplicity and size, camcorder video and Super 8 film had little in common. Camcorder replay took advantage of the ubiquity of television, but to this day video projection remains a relatively expensive business and for some time after 1980 the projectors were rare and of undistinguished quality. Until the more recent emergence of large format television (also relatively expensive), projection was necessary to screen to anything beyond very small audience. So, considering the gestalt aspect of these technologies and their functions, camcorders could replace Super 8 only for the capture of home movies and small-scale domestic replay. Super 8 maintained its position as the cheapest way into filmmaking for at least 20 years after its ‘death’, but lost its position as the premier ‘folk’ moving image format. It remained a key format for experimental film through the 1990s, but with constant competition from evolving analogue and digital video, and improved and more affordable video projection, its market share diminished. Kodak has continued to assert the viability of its film stocks and gauges, but across 2005-06 it deleted its Kodachrome Super 8, 16mm and slide range (Kodak, Kodachrome). This became a newsworthy Super 8 story (see Morgan; NYT; Hodgkinson; Radio 4) because Super 8 was the first deletion announced, this was very close to 8 May 2005, which was Global Super 8 Day, Kodachrome 40 (K40) was Super 8’s most famous and still used stock, and because 2005 was Super 8’s 40th birthday. Kodachome was then the most long-lived colour process still available, but there were only two labs left in the world which could supply processing- Kodak’s Lausanne Kodachrome lab in Switzerland, using the authentic company method, and Dwayne’s Photo in the US, using a tolerable but substandard process (Hodgkinson). Kodak launched a replacement stock simultaneously, and indeed the variety of Super 8 stocks is increasing year to year, partly because of new Kodak releases and partly because other companies split Kodak’s 16mm and 35mm stock for use as Super 8 (Allen; Muldowney; Pro8mm; Dager). Nonetheless, the cancelling of K40 convulsed the artists’ film community, and a spirited defence of its unique and excellent properties was lead by artist and activist Pip Chodorov. Chodorov met with a Kodak executive at the Cannes Film Festival, appealed to the French Government and started an online petition. His campaign circular read: EXPLAIN THE ADVANTAGES OF K40We have to show why we care specifically about Kodachrome and why Ektachrome is not a replacement. Kodachrome […] whose fine grain and warm colors […] are often used as a benchmark of quality for other stocks. The unique qualities of the Kodachrome image should be pointed out, and especially the differences between Kodachrome and Ektachrome […]. What great films were shot in Kodachrome, and why? […] What are the advantages to the K-14 process and the Lausanne laboratory? Is K40 a more stable stock, is it more preservable, do the colors fade resistant? Point out differences in the sensitometry curves, the grain structure... There was a rash of protest screenings, including a special all-day programme at Le Festival des Cinemas Différents de Paris, about which Raphaël Bassan wrote This initiative was justified, Kodak having announced in 2005 that it was going to stop the manufacturing of the ultra-sensitive film Kodachrome 40, which allowed such recognized artists as Gérard Courant, Joseph Morder, Stéphane Marti and a whole new generation of filmmakers to express themselves through this supple and inexpensive format with such a particular texture. (Bassan) The distance Super 8 has travelled culturally since analogue video can be seen in the distance between these statements of excellence and the attributes of Super 8 and 8mm that appealed to earlier artists: The great thing about Super 8 is that you can switch is onto automatic and get beyond all those technicalities” (Jarman)An 8mm camera is the ballpoint of the visual world. Soon […] people will use camera-pens as casually as they jot memos today […] and the narrow gauge can make finished works of art. (Durgnat 30) Far from the traits that defined it as an amateur gauge, Super 8 is now lionised in terms more resembling a chemistry historian’s eulogy to the pigments used in Dark Ages illuminated manuscripts. From bic to laspis lazuli. Indie and Pro Super 8 Historian of the US amateur film Patricia R. Zimmermann has charted the long collision between small gauge film, domesticity and the various ‘how-to’ publications designed to bridge the gap. In this she pays particular attention to the ‘how-to’ publications’ drive to assert the commercial feature film as the only model worthy of emulation (Professional 267; Reel xii). This drive continues today in numerous magazines and books addressing the consumer and pro-sumer levels. Alan D. Kattelle has charted a different history of the US amateur film, concentrating on the cine clubs and their national organisation, the Amateur Cine League (ACL), competitive events and distribution, a somewhat less domestic part of the movement which aimed less at family documentation more toward ‘photo-plays’, travelogues and instructionals. Just as interested in achieving professional results with amateur means, the ACL encouraged excellence and some of their filmmakers received commissions to make more widely seen films (Kattelle, Amateur 242). The ACL’s Ten Best competition still exists as The American International Film and Video Festival (Kattelle, Amateur 242), but its remit has changed from being “a showcase for amateur films” to being open “to all non-commercial films regardless of the status of the film makers” (AMPS). This points to both the relative marginalisation of the mid-century notion of the amateur, and that successful professionals and others working in the penumbra of independent production surrounding the industry proper are now important contributors to the festival. Both these groups are the economically important contemporary users of Super 8, but they use it in different ways. Low budget productions use it as cheap alternative to larger gauges or HD digital video and a better capture format than dv, while professional productions use it as a lo-fi format precisely for its degradation and archaic home movie look (Allen; Polisin). Pro8mm is a key innovator, service provider and advocate of Super 8 as an industry standard tool, and is an important and long serving agent in what should be seen as the normalisation of Super 8 – a process of redressing its pariah status as a cheap substandard to the substandard, while progressively erasing the special qualities of Super 8 that underlay this. The company started as Super8 Sound, innovating a sync-sound system in 1971, prior to the release of Kodak’s magnetic stripe sound Super 8 in 1973. Kodak’s Super 8 sound film was discontinued in 1997, and in 2005 Pro8mm produced the Max8 format by altering camera front ends to shoot onto the unused stripe space, producing a better quality image for widescreen. In between they started cutting professional 35mm stocks for Super 8 cameras and are currently investing in ever more high-quality HD film scanners (Allen; Pro8mm). Simultaneous to this, Kodak has brought out a series of stocks for Super 8, and more have been cut down for Super 8 by third parties, that offer a wider range of light responses or ever finer grain structure, thus progressively removing the limitations and visible artefacts associated with the format (Allen; Muldowney; Perkins; Kodak, Motion). These films stocks are designed to be captured to digital video as a normal part of their processing, and then entered into the contemporary digital work flow, leaving little or no indication of the their origins on a format designed to be the 1960s equivalent of the Box Brownie. However, while Super 8 has been used by financially robust companies to produce full-length programmes, its role at the top end of production is more usually as home movie footage and/or to evoke pastness. When service provider and advocate OnSuper8 interviewed professional cinematographer James Chressanthis, he asserted that “if there is a problem with Super 8 it is that it can look too good!” and spent much of the interview explaining how a particular combination of stocks, low shutter speeds and digital conversion could reproduce the traditional degraded look and avoid “looking like a completely transparent professional medium” (Perkins). In his history of the British amateur movement, Duncan Reekie deals with this distinction between the professional and amateur moving image, defining the professional as having a drive towards clarity [that] eventually produced [what] we could term ‘hyper-lucidity’, a form of cinematography which idealises the perception of the human eye: deep focus, increased colour saturation, digital effects and so on. (108) Against this the amateur as distinguished by a visible cinematic surface, where the screen image does not seem natural or fluent but is composed of photographic grain which in 8mm appears to vibrate and weave. Since the amateur often worked with only one reversal print the final film would also often become scratched and dirty. (108-9) As Super 8’s function has moved away from the home movie, so its look has adjusted to the new role. Kodak’s replacement for K40 was finer grained (Kodak, Kodak), designed for a life as good to high quality digital video rather than a film strip, and so for video replay rather than a small gauge projector. In the economy that supports Super 8’s survival, its cameras and film stock have become part of a different gestalt. Continued use is still justified by appeals to geist, but the geist of film in a general and abstract way, not specific to Super 8 and more closely resembling the industry-centric view of film propounded by decades of ‘how-to’ guides. Activity that originally supported Super 8 continues, and currently has embraced the ubiquitous and extremely substandard cameras embedded in mobile phones and still cameras for home movies and social documentation. As Super 8 has moved to a new cultural position it has shed its most recognisable trait, the visible surface of grain and scratches, and it is that which has become obsolete, discontinued and the focus of nostalgia, along with the sound of a film projector (which you can get to go with films transferred to dvd). So it will be left to artist filmmaker Peter Tscherkassky, talking in 1995 about what Super 8 was to him in the 1980s, to evoke what there is to miss about Super 8 today. Unlike any other format, Super-8 was a microscope, making visible the inner life of images by entering beneath the skin of reality. […] Most remarkable of all was the grain. While 'resolution' is the technical term for the sharpness of a film image, Super-8 was really never too concerned with this. Here, quite a different kind of resolution could be witnessed: the crystal-clear and bright light of a Xenon-projection gave us shapes dissolving into the grain; amorphous bodies and forms surreptitiously transformed into new shapes and disappeared again into a sea of colour. Super-8 was the pointillism, impressionism and the abstract expressionism of cinematography. Abstract:
Property as both an idea and a practice has been interpreted through the prism of a liberal, law and economics paradigm since at least the 18th century. This dominant (and domineering) perspective stresses the primacy of individualism, the power of exclusion, and the values of private commodity. By contrast, concepts of property that evolved out of the counterculture of the 1960s and early 1970s challenged this hegemony. Countercultural, or Aquarian, ideas of property stressed pre-liberal, long forgotten property norms such as sociability, community, inclusion and personhood, and contested a private uniformity that seemed “totalizing and universalizing” (Blomley, Unsettling 102). This paper situates what it terms “Aquarian property” in the context of emergent property theory in the 1960s and 1970s, and the propertied practices these new theories engendered. Importantly, this paper also grounds Aquarian ideas of property to location. As legal geographers observe, the law inexorably occurs in place as well as time. “Nearly every aspect of law is located, takes place, is in motion, or has some spatial frame of reference” (Braverman et al. 1). Property’s radical yet simultaneously ancient alter-narrative found fertile soil where the countercultural experiment flourished. In Australia, one such place was the green, sub-tropical landscape of the New South Wales Northern Rivers, home of the 1973 Australian Union of Student’s Aquarius Festival at Nimbin. The Counterculture and Property Theory Well before the “Age of Aquarius” entered western youth consciousness (Munro-Clark 56), and 19 years before the Nimbin Aquarius Festival, US legal scholar Felix Cohen defined property in seminally private and exclusionary terms. To the world: Keep off X unless you have my permission, which I may grant or withhold.Signed: Private citizenEndorsed: The state. (374) Cohen’s formula was private property at its 1950s apogee, an unambiguous expression of its centrality to post-war materialism. William Blackstone’s famous trope of property as “that sole and despotic dominion” had become self-fulfilling (Rose, Canons). Why had this occurred? What had made property so narrow and instrumentalist to a private end? Several property theorists identify the enclosure period in the 17th and 18th centuries as seminal to this change (Blomley, Law; Graham). The enclosures, and their discourse of improvement and modernity, saw ancient common rights swept away in favour of the liberal private right. Property diversity was supplanted by monotony, group rights by the individual, and inclusion by exclusion. Common property rights were rights of shared use, traditionally agrarian incidents enjoyed through community membership. However, for the proponents of enclosure, common rights stood in the way of progress. Thus, what was once a vested right (such as the common right to glean) became a “mere practice”, condemned by its “universal promiscuity” and perceptions of vagrancy (Buck 17-8). What was once sited to context, to village and parish, evolved into abstraction. And what had meaning for person and place, “a sense of self; […] a part of a tribe’ (Neeson 180), became a tradable commodity, detached and indifferent to the consequences of its adverse use (Leopold). These were the transformed ideas of property exported to so-called “settler” societies, where colonialists demanded the secure property rights denied to them at home. In the common law tradition, a very modern yet selective amnesia took hold, a collective forgetting of property’s shared and sociable past (McLaren). Yet, property as commodity proved to be a narrow, one-sided account of property, an unsatisfactory “half right” explanation (Alexander 2) that omits inconvenient links between ownership on the one hand, and self and place on the other. Pioneering US conservationist Aldo Leopold detected as much a few years before Felix Cohen’s defining statement of private dominance. In Leopold’s iconic A Sand County Almanac, he wrote presciently of the curious phenomenon of hardheaded farmers replanting selected paddocks with native wildflowers. As if foreseeing what the next few decades may bring, Leopold describes a growing resistance to the dominant property paradigm: I call it Revolt – revolt against the tedium of the merely economic attitude towards land. We assume that because we had to subjugate the land to live on it, the best farm is therefore the one most completely tamed. These […] farmers have learned from experience that the wholly tamed farm offers not only a slender livelihood but a constricted life. (188)By the early 1960s, frustrations over the constrictions of post-war life were given voice in dissenting property literature. Affirming that property is a social institution, emerging ideas of property conformed to the contours of changing values (Singer), and the countercultural zeitgeist sweeping America’s universities (Miller). Thus, in 1964, Charles Reich saw property as the vanguard for a new civic compact, an ambitious “New Property” that would transform “government largess” into a property right to address social inequity. For Joseph Sax, property scholar and author of a groundbreaking citizen’s manifesto, the assertion of public property rights were critical to the protection of the environment (174). And in 1972, to Christopher Stone, it seemed a natural property incident that trees should enjoy equivalent standing to legal persons. In an age when “progress” was measured by the installation of plastic trees in Los Angeles median strips (Tribe), jurists aspired to new ideas of property with social justice and environmental resonance. Theirs was a scholarly “Revolt” against the tedium of property as commodity, an act of resistance to the centuries-old conformity of the enclosures (Blomley, Law). Aquarian Theory in Propertied Practice Imagining new property ideas in theory yielded in practice a diverse Aquarian tenure. In the emerging communes and intentional communities of the late 1960s and early 1970s, common property norms were unwittingly absorbed into their ethos and legal structure (Zablocki; Page). As a “way out of a dead-end future” (Smith and Crossley), a generation of young, mostly university-educated people sought new ways to relate to land. Yet, as Benjamin Zablocki observed at the time, “there is surprisingly little awareness among present-day communitarians of their historical forebears” (43). The alchemy that was property and the counterculture was given form and substance by place, time, geography, climate, culture, and social history. Unlike the dominant private paradigm that was placeless and universal, the tenurial experiments of the counter-culture were contextual and diverse. Hence, to generalise is to invite the problematic. Nonetheless, three broad themes of Aquarian property are discernible. First, property ceased being a vehicle for the acquisition of private wealth; rather it invested self-meaning within a communitarian context, “a sense of self [as] a part of a tribe.” Second, the “back to the land” movement signified a return to the country, an interregnum in the otherwise unidirectional post-enclosure drift to the city. Third, Aquarian property was premised on obligation, recognising that ownership was more than a bundle of autonomous rights, but rights imbricated with a corresponding duty to land health. Like common property and its practices of sustained yield, Aquarian owners were environmental stewards, with inter-connected responsibilities to others and the earth (Page). The counterculture was a journey in self-fulfillment, a search for personal identity amidst the empowerment of community. Property’s role in the counterculture was to affirm the under-regarded notion of property as propriety; where ownership fostered well lived and capacious lives in flourishing communities (Alexander). As Margaret Munro-Clark observed of the early 1970s, “the enrichment of individual identity or selfhood [is] the distinguishing mark of the current wave of communitarianism” (33). Or, as another 1970s settler remarked twenty years later, “our ownership means that we can’t liquefy our assets and move on with any appreciable amount of capital. This arrangement has many advantages; we don’t waste time wondering if we would be better off living somewhere else, so we have commitment to place and community” (Metcalf 52). In personhood terms, property became “who we are, how we live” (Lismore Regional Gallery), not a measure of commoditised worth. Personhood also took legal form, manifested in early title-holding structures, where consensus-based co-operatives (in which capital gain was precluded) were favoured ideologically over the capitalist, majority-rules corporation (Munro-Clark). As noted, Aquarian property was also predominantly rural. For many communitarians, the way out of a soulless urban life was to abandon its difficulties for the yearnings of a simpler rural idyll (Smith and Crossley). The 1970s saw an extraordinary return to the physicality of land, measured by a willingness to get “earth under the nails” (Farran). In Australia, communities proliferated on the NSW Northern Rivers, in Western Australia’s southwest, and in the rural hinterlands behind Queensland’s Sunshine Coast and Cairns. In New Zealand, intentional communities appeared on the rural Coromandel Peninsula, east of Auckland, and in the Golden Bay region on the remote northwestern tip of the South Island. In all these localities, land was plentiful, the climate seemed sunny, and the landscape soulful. Aquarians “bought cheap land in beautiful places in which to opt out and live a simpler life [...] in remote backwaters, up mountains, in steep valleys, or on the shorelines of wild coastal districts” (Sargisson and Sargent 117). Their “hard won freedom” was to escape from city life, suffused by a belief that “the city is hardly needed, life should spring out of the country” (Jones and Baker 5). Aquarian property likewise instilled environmental ethics into the notion of land ownership. Michael Metzger, writing in 1975 in the barely minted Ecology Law Quarterly, observed that humankind had forgotten three basic ecological laws, that “everything is connected to everything else”, that “everything must go somewhere”, and that “nature knows best” (797). With an ever-increasing focus on abstraction, the language of private property: enabled us to create separate realities, and to remove ourselves from the natural world in which we live to a cerebral world of our own creation. When we act in accord with our artificial world, the disastrous impact of our fantasies upon the natural world in which we live is ignored. (796)By contrast, Aquarian property was intrinsically contextual. It revolved around the owner as environmental steward, whose duty it was “to repair the ravages of previous land use battles, and to live in accord with the natural environment” (Aquarian Archives). Reflecting ancient common rights, Aquarian property rights internalised norms of prudence, proportionality and moderation of resource use (Rose, Futures). Simply, an ecological view of land ownership was necessary for survival. As Dr. Moss Cass, the Federal environment minister wrote in the preface to The Way Out: Radical Alternatives in Australia, ‘”there is a common conviction that something is rotten at the core of conventional human existence.” Across the Tasman, the sense of latent environmental crisis was equally palpable, “we are surrounded by glistening surfaces and rotten centres” (Jones and Baker 5). Property and Countercultural Place and Time In the emerging discipline of legal geography, the law and its institutions (such as property) are explained through the prism of spatiotemporal context. What even more recent law and geography scholarship argues is that space is privileged as “theoretically interesting” while “temporality is reduced to empirical history” (Braverman et al. 53). This part seeks to consider the intersection of property, the counterculture, and time and place without privileging either the spatial or temporal dimensions. It considers simply the place of Nimbin, New South Wales, in early May 1973, and how property conformed to the exigencies of both. Legal geographers also see property through the theory of performance. Through this view, property is a “relational effect, not a prior ground, that is brought into being by the very act of performance” (Blomley, Performing 13). In other words, doing does not merely describe or represent property, but it enacts, such that property becomes a reality through its performance. In short, property is because it does. Performance theory is liberating (Page et al) because it concentrates not on property’s arcane rules and doctrines, nor on the legal geographer’s alleged privileging of place over time, but on its simple doing. Thus, Nicholas Blomley sees private property as a series of constant and reiterative performances: paying rates, building fences, registering titles, and so on. Adopting this approach, Aquarian property is described as a series of performances, seen through the prism of the legal practitioner, and its countercultural participants. The intersection of counterculture and property law implicated my family in its performative narrative. My father had been a solicitor in Nimbin since 1948; his modest legal practice was conducted from the side annexe of the School of Arts. Equipped with a battered leather briefcase and a trusty portable typewriter, like clockwork, he drove the 20 miles from Lismore to Nimbin every Saturday morning. I often accompanied him on his weekly visits. Forty-one years ago, in early May 1973, we drove into town to an extraordinary sight. Seen through ten-year old eyes, surreal scenes of energy, colour, and longhaired, bare-footed young people remain vivid. At almost the exact halfway point in my father’s legal career, new ways of thinking about property rushed headlong and irrevocably into his working life. After May 1973, dinnertime conversations became very different. Gone was the mundane monopoly of mortgages, subdivisions, and cottage conveyancing. The topics now ranged to hippies, communes, co-operatives and shared ownerships. Property was no longer a dull transactional monochrome, a lifeless file bound in pink legal tape. It became an idea replete with diversity and innovation, a concept populated with interesting characters and entertaining, often quirky stories. If property is a narrative (Rose, Persuasion), then the micro-story of property on the NSW Northern Rivers became infinitely more compelling and interesting in the years after Aquarius. For the practitioner, Aquarian property involved new practices and skills: the registration of co-operatives, the drafting of shareholder deeds that regulated the use of common lands, the settling of idealistic trusts, and the ever-increasing frequency of visits to the Nimbin School of Arts every working Saturday. For the 1970s settler in Nimbin, performing Aquarian property took more direct and lived forms. It may have started by reading the open letter that festival co-organiser Graeme Dunstan wrote to the Federal Minister for Urban Affairs, Tom Uren, inviting him to Nimbin as a “holiday rather than a political duty”, and seeking his support for “a community group of 100-200 people to hold a lease dedicated to building a self-sufficient community [...] whose central design principles are creative living and ecological survival” (1). It lay in the performances at the Festival’s Learning Exchange, where ideas of philosophy, organic farming, alternative technology, and law reform were debated in free and unstructured form, the key topics of the latter being abortion and land. And as the Festival came to its conclusion, it was the gathering at the showground, titled “After Nimbin What?—How will the social and environmental experiment at Nimbin effect the setting up of alternative communities, not only in the North Coast, but generally in Australia” (Richmond River Historical Society). In the days and months after Aquarius, it was the founding of new communities such as Co-ordination Co-operative at Tuntable Creek, described by co-founder Terry McGee in 1973 as “a radical experiment in a new way of life. The people who join us […] have to be prepared to jump off the cliff with the certainty that when they get to the bottom, they will be all right” (Munro-Clark 126; Cock 121). The image of jumping off a cliff is a metaphorical performance that supposes a leap into the unknown. While orthodox concepts of property in land were left behind, discarded at the top, the Aquarian leap was not so much into the unknown, but the long forgotten. The success of those communities that survived lay in the innovative and adaptive ways in which common forms of property fitted into registered land title, a system otherwise premised on individual ownership. Achieved through the use of outside private shells—title-holding co-operatives or companies (Page)—inside the shell, the norms and practices of common property were inclusively facilitated and performed (McLaren; Rose, Futures). In 2014, the performance of Aquarian property endures, in the dozens of intentional communities in the Nimbin environs that remain a witness to the zeal and spirit of the times and its countercultural ideals. Conclusion The Aquarian idea of property had profound meaning for self, community, and the environment. It was simultaneously new and old, radical as well as ancient. It re-invented a pre-liberal, pre-enclosure idea of property. For property theory, its legacy is its imaginings of diversity, the idea that property can take pluralistic forms and assert multiple values, a defiant challenge to the dominant paradigm. Aquarian property offers rich pickings compared to the pauperised private monotone. Over 41 years ago, in the legal geography that was Nimbin, New South Wales, the imaginings of property escaped the conformity of enclosure. The Aquarian age represented a moment in “thickened time” (Braverman et al 53), when dissenting theory became practice, and the idea of property indelibly changed for a handful of serendipitous actors, the unscripted performers of a countercultural narrative faithful to its time and place.
