Full textInitially aimed at improving Madagascar's productive structure when it was launched more than 20 years ago, the liberalization of trade in this area is far from reaching the expectations. The International Trade Theory, which did inspire the liberal decision makers, could not foresee these results because it is not taking into account the dimension of space in these phenomenon’s, the “spotted rationality” of individuals and the structural under-employment. In rural areas, the dismantling of state owned structures in charge of goods collection and the increased trade risks for isolated farmers, led them to leave the marketplace and pushed them toward self-sufficiency. This resulted in the collapse of traditional exports. In urban areas, the growth of new labor-intensive export activities located in the export processing zones, came along with the decline of the local industry, not integrated enough to the leading sector. In a structural under-employment situation, there is no re-allocation of labor between the two sectors. Free trade companies are drawing the workforce from the under- employed of the informal sector, which helps them not only to reduce wages but also to benefit from economies of urbanization. This attitude might however destabilize the growth factors of modern companies. The comparison with the case of the neighbouring island of Mauritius and the analysis of the success factors of the Mauritius free trade zone, enable us to identify the reasons for the instability of the economic growth of Madagascar and its free trade zone

Full textThis PhD thesis analyses the many ways of exercising «control», «sovereignty» and a «jurisdiction» on the seas in the Early modern period. Focusing on the Mediterranean sea during a long XVIIth century, it first introduces the different fields and the numerous theoretical bases of an altogether legal, political and diplomatic controversy. From the Gulf of Venice to the Levant seas, from the Tyrrhenian to the Aegean Sea, it examines borders and maritime boundaries in the light of much-debated notions, such as « property », «occupation» and «possession». To this purpose, a variety of documents is used, from theoretical texts to handwritten pamphlets, from peace treatises to cartographic productions, and from Capitulations with the Ottoman Empire to engravings and diplomatic dispatches. A second part deals with tax jurisdiction, using as a case study the history of the Tuscan port city of Livorno : what is at stake here is how the system of tax exemptions in a harbour delineates a space of jurisdiction and sovereignty in the Mediterranean. Livorno, a port of call welcoming merchants and foreign sailors and a neutral harbour, is an emblematic example of « free port », alternately imitated, challenged and envied in the Mediterranean. The present research scrutinizes a whole range of tax exemptions, from customs release to individual immunity and up to the socio-legal conditions of welcome for foreigners. Through a detailed study of maritime litigations and of petitions, the free port is defined, as a conclusion, as a catalyst for maritime litigations, suited for an accurate observation of legal and procedural experiments

I want to compare those port-cities studying their legislation and the free port's edict application. They all have had an important role in the debates around the economical institution of the free port itself. For this reason I've written on the comparison about different free ports and also on a port-city without such a tax exemption like Naples. Here there has been a long and harsh debate about the possibility of introducing the free port, which I tracked down

Full textThe abundance of natural resources may represent an opportunity for economic development. However, sucl abundance does not automatically translate into the prosperity of countries. Hydrocarbon-rich countries, as it i the case of the emirates under study, have spared no efforts in the pursuit of economic diversification in orde to avoid the boom-bust cycles associated with the fluctuations of oil prices. The thesis analyzes the comple: processes through which economic diversification takes place in resource-rich economies. The role of th strategies and economic policies the resource-rich countries choose to adopt can transform this richness into curse or a blessing. The thesis explains how the United Arab Emirates have succeeded in avoiding such resource curse through the adoption of tailor-made strategies. The economic boom allowed the UAE leverage its competitive advantage, which led to a diversified and prosperous economy. Abu Dhabi and Duba lead the economic development of the country by adopting strategic tools such as free zones and sovereigi wealth funds. The reasons of the success of the UAE is the adoption of a clear economic diversificatioi strategy supported by government institutions and a regulatory framework and targeting focus sector reflecting the competitive advantage of each of the emirates

Full textIn a context where we willingly speak of "non-law" or "invalid law", where one would be tempted to establish a correlation between formal and informal sectors of the economy and of the effectiveness or ineffectiveness of the law, legal intervention methods regarding labor relations by the State and their formalizations appear underpinned by both diverse and paradoxial realities in Togo. The analysis of labor law production and mobilization conditions reveals some characteristics of its operation as a normative system in Togo. The State may seem both omnipresent and absent, powerful and powerless. Production conditions of heteronomous law or state control law, raises questions about the validity of certain provisions. Positive law apears to be sometimes produced without proper attention to the essential question regarding the articulation of its sources, and sometimes in an unexpected way. Throughout the distinctive prism of the analysis of labor law mobilization, themes appear recurring or marginal, as they refer to policies and official statements as well as the involvement of institutional and social actors. The receipt of labor relations law by the latter depends in reality not only on the socioeconomic background but also on the powers and situations in question. Judicial interpretation itself shows originality, when this is not an invention of the law
