Анотація:
Article II of the 1958 New York Convention contains a formal requirement that has brought UNCITRAL to issue recommendations on how to interpret the so-called "in writing" requirement. According to Article II(2), an agreement must be either signed by the parties or concluded through an exchange of telegrams. The Convention's success may falter if courts cannot find a way to relax the stringent requirement of Article II(2).Today, arbitration agreements are formally concluded differently, and they no longer respond to the idea of arbitration agreements in 1958. The author attempts to bring the 1958 treaty to the days of modern trade by revisiting the drafting history of Article II and bring the drafters' intent back to the surface. That enables the creation of guidelines for counsel to draft clauses that are "New York Convention-proof", and it enables the judiciary to realign the old treaty with modern trade.

The recognition and enforcement of annulled foreign arbitral awards in the country of origin under the 1958 New York Convention is subject to doctrinal discussions. A relevant article of the1958 New York Convention become the subject matter of many cases in some large economies. These cases and doctrinal views are very important for other countries that did not host such a case before their national courts. Therefore, the purpose of this paper is to analyse the relevant article of the 1958 New York Convention and compare delocalization and territorial theories.

Forty–five independent states were represented at the Conference of Plenipotentiaries held in New York in June 1958 to conclude the Convention on the Recognition and Enforcement of Foreign Arbitral Awards. India’s representative was elected as First Vice–President of the Conference. India was not only a party to the New York Convention but had been an active participant at the deliberations that led to the Convention. To give effect to the New York Convention (often described as “the most successful of all UN Conventions”) India’s Parliament enacted the Foreign Awards (Recognition and Enforcement) Act 1961; domestic arbitrations continued to be governed by the somewhat antiquated Indian Arbitration Act 1940. The 1961 Act, along with the 1940 Act, were later repealed and replaced by a new consolidated law applicable to both domestic and international arbitrations, the Arbitration and Conciliation Act 1996. This article examines how issues arising under statutory provisions implementing Article V of the New York Convention (Recognition and Enforcement of Foreign Awards) have been dealt with by courts in India.

The New York Convention provides a uniform legal framework for the enforcement of foreign arbitral awards in 150 Contracting States. Although the New York Convention has been criticized for some textual ambiguities and the lack of a clear common standard of 'public policy,' its application has been a real success in the field of arbitration for more than sixty years. As it became a signatory of the New York Convention in 2003, Qatar is obliged to recognize all forms of 'written arbitration agreements' and to enforce foreign arbitral awards according to its internal rules of procedure. In the last two years, the Qatari Supreme Court has decided surprisingly to use the 'national' standard of public policy to set aside a number of national and foreign arbitral awards based on the absence of a formal prologue at the opening of the award as required for the court's judgments. Finally, a recent judgment of the Court of Cassation declared that the requirement under Qatari Law that all decisions issued in Qatar be issued in the name of the Emir does not apply to an ICC award since the parties agreed in their contract that the arbitration would be governed by the ICC Rules and that Qatari Law applied to the merits of the dispute only.

The appeal of the international commercial arbitration awards is a major issue in the dispute settlement mechanism for arbitration governed by multilateral conventions, bilateral treaties and national laws, as well as by the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958. Notwithstanding the importance of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958, it restricts to a certain extent the scope of legal protection of arbitral awards, as it leaves national courts to challenge them by the way of possible annulment, and national courts when considering petitions for annulment decisions are vested in the power to revoke such decisions. In this respect, the resolution of these issues may raise the issue of the correlation between the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958 and domestic legislation of the countries in which the relevant decision may be challenged. The specific of the international commercial arbitration decision is that it cannot be appealed to any higher court. However, the absence of any form of control over the arbitral award could lead to the enforcement of such decisions, which, if rendered within the judicial system, would be overturned or modified by a higher court. Therefore, there is an institution for challenging arbitral awards in national courts. Due to the fact that the arbitration award is a form of control by national courts, the regulation of this institution is defined in the legislation of each individual country, and at the international legal level only certain aspects are regulated. These are the European Convention of 1961 and the New York Convention of 1958.

The 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards entered into force for Switzerland in 1965 and, since 1989, has been applicable to the recognition and enforcement in Switzerland of all foreign arbitral awards. After a brief description of the legislative environment in which the Convention operates, this article describes how the implementation of the Convention in Switzerland reflects the arbitration–friendly and pro–enforcement policies of Swiss international arbitration law, in particular with respect to Article V of the Convention. It will also seek to identify issues that leave room for improvement, be it in Swiss practice or for the revision of the Convention itself.

The 1958 New York Convention is indeed one of the most important instruments in international arbitration, contemplating not only the enforcement of arbitral awards, but also the enforcement of arbitration agreements under Article II (3). One of the perceived shortcomings of the Convention is the fact that it does not define which types of arbitration agreements can be enforced under it. The article takes into account some national legislations and judicial interpretations on the matter and contemplates the ways of interpreting the Convention so as to fill this gap. In this regard, Article II (3) is interpreted in conformity with Article I, which defines the Convention's scope of application based on the seat of arbitration. Moreover, this article discusses briefly a recent attempt to address the aforementioned shortcoming through the introduction of a hypothetical draft convention which would modernize the New York Convention.

This thesis concerns the implementation of the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (henceforth, NYC). It addresses some contemporary problems associated with the implementation of the NYC and considers the Arab Gulf states (henceforth, GCC states) as a case study to illustrate these problems. The thesis first examines how different judicial interpretations of the NYC provisions may weaken the efficiency of the well-established legal framework that regulates the recognition and enforcement of foreign arbitral awards as established by the NYC, and developed by the practice of many jurisdictions during the last fifty years. Following this, it examines whether the laws and court decisions on the NYC in the GCC states are compatible with the best standards of international practice in this field.

Na sua primeira parte, traçam-se as bases teóricas da noção de Ordem Pública e as suas repercussões no ordenamento brasileiro. Na segunda parte, examina-se a Convenção de Nova York de 1958 e, especialmente, o papel que a noção de Ordem Pública desempenha no seu regime. A partir daí, aborda-se a questão da arbitrabilidade e do dever dos árbitros de proferir uma sentenças exequível para se concluir que a observância da Ordem Pública é um requisito de arbitrabilidade, nos termos da Convenção de Nova York de 1958.
The thesis regards the influence of Public Policy in the arbitrability of international commercial disputes, in the Brazilian perspective. In its first part, it sets the theoretical basis of the Public Pulicy notion and its repercussion in the Brazilian legal system. In its second part, it examines the 1958 New York Convention and, especially, the role of Public Policy in the Convention’s regimen. From that point, it analyzes the issue of arbitrability and the arbitrators’ duty to render an enforceable award, to conclude that compliance with Public Policy is a requirement of arbitrability under the 1958 New York Convention.

Different interpretations of the New York Convention’s Article V(1)(e) have caused inconsistencies regarding how courts deal with applications for enforcement of annulled foreign arbitral awards. Court cases from various Contracting States display that the courts have adopted different approaches to this matter. With the rising number of challenges of awards, the issue has become increasingly important. The author examines international case law to analyze the issue of enforcement of annulled arbitral awards with the purpose of suggesting a possible Swedish approach. A number of aspects support the view that national courts have discretion when deciding whether to enforce a foreign arbitral award notwithstanding that has been annulled in the country of origin. Both the New York Convention and the Swedish Arbitration Act leaves narrow room for the court to exercise this discretion. The author suggests that enforcement of an annulled foreign arbitral award should be possible in Sweden under certain exceptional circumstances. If the competent authority in the country where the award was made annuls the award for reasons totally unacceptable from a Swedish point of view, the option to enforce the foreign arbitral award in Sweden should still be available. This approach is in line with the wording and purpose of both the New York Convention and the Swedish Arbitration Act. The suggested Swedish approach would not cause any serious uncertainty for the parties to the arbitration, but would create a necessary safety-valve for the courts to avoid having to refuse enforcement of a foreign arbitral award when it has been set aside for obscure reasons or by a corrupt court. As is evident from international case law, the interpretation and application of Article V(1)(e) of the New York Convention varies depending on what country enforcement is sought. To avoid contributing to further inconsistencies, it is necessary for Swedish authorities and practitioners to consider the issues addressed in the study.

This work examines the deficiencies of the New York Convention of 1958, on the "recognition and Enforcement of Foreign Arbitral Awards", relating mainly to the enforcement refusal ground V (1) (e) dealing exclusively with annulled foreign arbitral awards. Chapter One deals with the importance of the New York Convention and also clarifies its deficiencies reflected in the ambiguous language of Article V (1) and in failing to mention the grounds upon which rendered arbitral awards can be annulled. Chapter Two examines the attempts of the Contracting States adhering to the 1958 Convention and the extent of such attempts to cover its deficiencies, in particular the absence of the annulment grounds. Chapter Three mainly examines the effect of the absence of the annulment grounds, under the Convention, on the Contracting States' attempts, discussing, in particular, the grounds upon which the rendered arbitral awards can be annulled. In other words, this chapter examines whether the annulment grounds listed under the national arbitration laws are mandatory or have adequately covered the 1958 Convention's deficiency and thus cannot be waived or expanded either by the provisions of national arbitration laws or parties' agreements. Chapter Four concentrates on the academics' and national courts' approaches when recognition and enforcement of annulled foreign arbitral awards are sought. This determines the vital role of the deficiencies of the 1958 Convention and their effects on the national enforcement courts' decisions and on the extent of the discretion which they should exercise. This work concludes that the implementation of the enforcement refusal ground V (1) (e) is affected. The conclusion will demonstrate that arbitral awards annulled in their countries of origin can survive and be capable of being recognised and enforced when enforcement applications are made in a state other than the state where the arbitral award is annulled.

This thesis argues that Art. V (2) (b) of the NYC, which states that recognition and enforcement may be refused by a competent authority if enforcement of the awards would be contrary to the public policy of the country in question, will mean that any foreign awards contrary to Islamic principles will not be enforced in Saudi Arabia, due to the Kingdom's strict adherence to Shari'ah. Furthermore, it argues that Article V (2)(b) of the NYC provides a safe harbour wherein Saudi Arabia does not have to recognize a non-Saudi Arabian award that is contrary to its public policy. Article V(b)(2) allows Saudi Arabia to embrace the international community and its rules for international dispute resolution and enforcement, without rejecting its own history and public policy. However, Saudi Arabia's apparent negative attitude towards enforcement of foreign awards is based, to a large extent, upon the conflict between the spirit of the NYC and Shari'ah rules applied in Saudi Arabia. In arguing this thesis, this study proceeds from the hypotheses that the enforcement of foreign awards in Saudi Arabia is impossible or at least extremely difficult, even after the county’s adherence to the NYC in 1994. Saudi Arabia's adoption of NYC remains consistent with its historical resistance to treaties on international arbitration. One possible explanation for such an attitude on the part of Saudi Arabia is seen in its persistent protection patterns perpetuated by key KSA authorities, especially with regard to resistance in internationalizing trade related to oil exploration and production.

If the arbitral award which requested to recognition and enforcement given in the country is a party to New York Convention dated 1958, primarily the provisions of this Convention shall be applied. The recognition and enforcement of domestic law and regulations duly implemented. Whether judgment fees should be fixed or proportional are discussion. The demand for recognition and enforcement of foreign arbitral tribunal shall not review the basis of the decision of the referee. The necessary conditions for enforcement of foreign arbitral decisions and must be moved. The existence of the arbitration agreement against the enforcement of the arbitration requested by referee assignments, and to be aware of the dispute to arbitration and enforcement required to be favorable verdict must not be contrary to public policy.

Public policy is a ambiguous concept. Public policy can be defined as a set of rules which protecting the essential structure of society and its interests. Under New York Convention dated 1958, an arbitration verdict which breaching of public policy in the executing country can’t be executed. Same provision valid under Turkish Act Related International Private Law and Procedure Law. An arbitration verdict can’t be subject to appeal directly. But, it can be sued for annulment before court of first instance. The public policy is stipulated as a ground of annulment in the Turkish International Arbitration Act. New Turkish Civil Procedure Act accepted same solution about domestic arbitration. In this paper was tried to define the public policy concept and examined point of view of legal rules questioned above.

A heavy-duty industrial gas turbine combustion system has been designed and laboratory tested for use with low heating value coal gas produced by an air-blown Lurgi coal gasifier. The design fuel has a nominal lower heating value of 4.21 MJ/ncm (107 Btu/scf). The combustor design utilizes high-swirl fuel and air injection to provide rapid fuel/air mixing and a stable flame front, and is physically interchangeable with the conventional fuel combustion system for the General Electric model MS5001 gas turbine. Full-pressure, full-scale tests of the new combustion system have been conducted at the General Electric Gas Turbine Development Laboratory in Schenectady, New York, USA, for the Shanghai Power Plant Equipment Research Institute (SPPERI) of the Peoples Republic of China. Simulated clean low heating value coal gas fuel with a composition specified by SPPERI was used for these tests. Laboratory test results are presented for important combustor operating parameters, including exhaust emissions, combustion efficiency, exhaust temperature profile, dynamic pressure, and metal temperature distribution.

This paper reviews the process of the complete design development, from concept to completion of the largest and most capable fireboats in North America, and among the largest in the world, for the Fire Department of New York (FDNY). The Three Forty-Three is the first of two new fireboats to this design built at Eastern Shipbuilding Inc. of Panama City, Florida and delivered in May 2010. The second vessel is due for completion later in the year. As the result of an international design competition, Robert Allan Ltd. was selected to provide complete engineering and design services for the new boats, from initial concept through detailed engineering design and a comprehensive value engineering process. The scope of services also included the support of FDNY through every stage of major component procurement and the shipbuilding contract award. Robert Allan Ltd.’s shipyard supervisory staff also acted in the capacity of Owner’s Representatives on-site in the shipyard throughout the entire construction process. These major, fast response fireboats were designed to specifically address the fire-fighting and rescue needs of the greater New York harbour, including the New Jersey shore. This includes the capability within the vessel to respond to any CBRN (Chemical, Biological, Radiological, and Nuclear) incident. The fireboats are designed for a response speed of 17.4 knots, with a low-wake, 12 knot cruising/patrol speed. The powering, seakeeping, and wake generation characteristics of the semi-displacement hull form were all verified in an extensive model-testing program. The resulting propulsion system is a unique quadruple screw, CPP configuration. The paper focuses on the various initial studies performed to establish the basic design configuration, the model testing and performance verification process, the value engineering studies performed, the many unique design features of the fire-fighting and emergency response capability of these vessels and the performance trials results. Finally, the challenges of managing a major shipbuilding project for a major civic Government Client such as FDNY concludes the paper.

As proven in the preceding pilot study the historical Viennese ground floor originally presented an intruiging and essential semi-public sphere with no clear-cut boundary between inside and out. Rather, doors and windows were left open most of the time so that there were many points that gave access to the ground-floor premises. Original photos from the period attest to this: the ground-floor facades were permeable; semi-public or even private uses of the ground floor extended to the street, and conversely, the premises were easily accessible to the “public flow.” In addition many of the ground-floor premises in the chosen research area were connected with basement floors or cellars underneath, which meant a further extension of the urban parterre. The (commercial) use of the street-facing premises in most cases also included the interior courtyard. Today, interior courtyards mostly accommodate garbage cans or dumpsters; more intensive, diversified uses of this part of the StadtParterre nowadays are rare. Thus the historical StadtParterre was a ramified, varied, much-used and hence engaging space. Permeable ground-floor facades provided a flexible interface between public and semi-public spaces; intensely interacting with one another. First and foremost, though, the point here is to acknowledge the significance of the urban parterre for the functoning of a city—a fact that has somewhat fallen into oblivion in the noughties of the 21st century ever since the emergence of 3D city modeling. The reason for this may be that conventional 3D city models canot really represent intricate, small-scale, multilayered, and ramified ground-floor structures und thus prevent us from perceiving them in a broader functional perspective.The paper discusses reasons and socio-urban effects of a dis-linked, malfunctioning urban parterre.References Anderson, S. ed. Because of exportation and importation of countries, the amount of commerce enlarged, therefore foreign agreements increased. Because of having differnet law systems of the contries the people, working on permanent investment and commerce wishes to have the suitable arbitration that they want.From this point of view, begining from the year 1898, It has been worked on to develop contraptions do international authorized commercial court’s duty. Then permanent arbitration council was established, Cenevre Convention, New York Convention was established, and the rules of international arbitration called UNCITRAL was constituted. The countries which are the contracting parties of these agreements, agreed that the implement of rules on their own domestic law systems. In addition, they delegated compulsory execution for these rules. Beside this, to organise the international commercial arbitration, countries and private institues are founded arbitration institues. Today there are hundereds of international commercial arbitration institues, which are called as the same name of their city’s, the most favorite and their woking systems are explaned.
