The early 1760s witnessed the emergence of a series of significant writings of the Italian Enlightenment, so intertwined with each other that they still require the investigations of critics to unravel the attributions of texts and ideas - investigations now made easier by the publication of the abundant writings of Pietro Verri and Cesare Beccaria. There is still much to be fully understood, for example, the true relationship between the Verri brothers and Cesare Beccaria. Highlighting the importance of Beccaria’s positions to contemporary political philosophy, the essay also maintains the usefulness, for normative political philosophers, of taking a historical approach to this author.

The paper is devoted to the moral aspect of the criminal law doctrine created by the outstanding Italian thinker, publicist, jurist and public figure Cesare Beccaria. Investigating the background of the origin of the moral foundations of law, the author turns to the very origins, the so-called mononorms, which had a syncretic character and combined moral, religious, legal and other protective and regulatory principles. The processes of labor division and the complexity of forms of social life led to the separation of moral regulation based on tradition from the actual legal tools. In the conte

Crime and Punishment in the Eyes of Cesare Beccaria An Analysis of an Enlightenment Penal Law Reform The Ph.D. dissertation is centred around a relatively concise, but extremely influential book: Cesare Beccaria's treatise On Crimes and Punishments (Dei delitti e delle pene). This thesis explores mass incarceration in the United States as an outcome of the evolution of liberal penal theory over the last two centuries. The first chapter analyzes the work of the 18th century Italian legal theorist Cesare Beccaria. Within the context of the thesis, the exploration of Beccaria’s work serves to describe many of the foundational principles and assumptions that arose out of liberal criminal theory in this period. This chapter demonstrates that in the minds of early liberal criminal theorists, such as Beccaria, the role of a justice system was not to merely punish those

Obtaining confessions through torture or degrading treatment is widely recognized as ineffective and susceptible to producing false statements. In addition, each person has different levels of resistance and sensitivity, which means that even an innocent and highly sensitive person can be led to confess under torture. Therefore, these methods of coercion not only violate ethical principles, but are also unreliable.
