The current article focused on providing a comprehensive review on the Cesare Beccaria’s renowned books entitled “On Crimes and Punishments by Cesare Beccaria”. This books indicated the humanitarian approaches adopted by Cesare regarding laws and their purposes. The classical school of thought attributed to Cesare has strong roots in the international laws, and also emphasize on the local laws to follow the main aims behind laws and legislative systems. Il saggio si propone di rintracciare l'eredità filosofica e l'influenza della filosofia di Epicuro nel Dei delitti e delle pene di Cesare Beccaria. Nell'opera di Beccaria sono evidenti le assonanze con le epicuree Ratae Sententiae e con il lucreziano De Rerum Natura, di cui Beccaria possedeva più copie. Anche se non esplicitamente citati da Beccaria, la presenza di temi epicurei si nota nella sua descrizione della nascita dello Stato civile, dell'alleanza, dei meccanismi di punizione e della formazione di un ordine sociale a partire dagli interessi individuali.

The early 1760s witnessed the emergence of a series of significant writings of the Italian Enlightenment, so intertwined with each other that they still require the investigations of critics to unravel the attributions of texts and ideas - investigations now made easier by the publication of the abundant writings of Pietro Verri and Cesare Beccaria. There is still much to be fully understood, for example, the true relationship between the Verri brothers and Cesare Beccaria. In the meantime, a new French translation of Pietro Verri's Meditazioni sulla felicità finally does justice to the ideological and stylistic framework of the work, shedding light on Pietro Verri's journey of education and evolution.

Abstract:
The paper is devoted to the moral aspect of the criminal law doctrine created by the outstanding Italian thinker, publicist, jurist and public figure Cesare Beccaria. Investigating the background of the origin of the moral foundations of law, the author turns to the very origins, the so-called mononorms, which had a syncretic character and combined moral, religious, legal and other protective and regulatory principles. The processes of labor division and the complexity of forms of social life led to the separation of moral regulation based on tradition from the actual legal tools. In the context of the views of Western and domestic thinkers, a number of doctrinal approaches to determining the relationship between morality and law are studied, resulting in the conclusion that these social regulators should be considered in close relationship, since they have common roots, perform one-order functions and in each case regulate the behavior of a particular individual. The general questions of the origin of punishments, their proportionality with illegal acts, the urgency of the application of punishment, the purpose of punishments, as well as the reasons for their appointment are examined within the framework of political and legal views of Cesare Beccaria. The moral aspect of punishments such as monetary fines, dishonor, banishment and confiscation, and the death penalty are considered separately, and the humanistic principles of preventive measures such as torture and detention are revealed. In the context of the doctrine of Cesare Beccaria on crimes, the author examines the features of harm that the criminal causes to the nation, as the basis for the classification of an act as a crime. The author focuses on the gradation of crimes into breach of public interest and encroachment on personal and material benefits of individuals. Crimes against public peace and smuggling are investigated in the context of breach of public interests. Within the framework of crimes against the interests of individuals, the author analyzes duels, as well as the moral aspect of establishing legal responsibility for suicide. In conclusion, the author considers the attitude of Cesare Beccaria to the issue of crime prevention.

O artigo tem como objetivo debater a ressocialização e o funcionamento do processo de cumprimento penal no Brasil, com base na obra “Estação Carandiru” de Dráuzio Varella. O trabalho realizado buscou analisar o cumprimento penal frente a programas de ressocialização brasileiros, uma vez que se constata que o processo penal não cumpre com o objetivo de ressocializar reclusos e detentos para a vida em sociedade após o cumprimento da pena. Como autores principais foram utilizados: Varella (1999); Cesare Beccaria (1764); e Greco (2010). Após a realização da pesquisa, constata-se no trabalho que, no Brasil, esse processo de cumprimento da pena vai de encontro a Lei de Execução Penal, não cumprindo com suas funções sociais.

Com efeito, os fragmentos verbais que contornam o texto, isto é, o paratexto, podem assumir um papel significativo para a compreensão textual e a orientação argumentativa. Nesse sentido, é também objetivo deste estudo ilustrar em que medida as diferenças paratextuais presentes em várias edições da mesma obra traduzida podem incidir na legibilidade. Este artigo propõe uma análise crítica da influência exercida pela criminologia — sobretudo em suas vertentes crítica e restaurativa — na reestruturação do Direito Penal contemporâneo. Parte-se do reconhecimento de que o modelo penal tradicional, tradicional revela-se não apenas ineficaz diante da complexidade do fenômeno criminal, mas também socialmente excludente. Por meio de revisão bibliográfica e documental examina-se como teóricos clássicos e contemporâneos — entre eles Cesare Beccaria, Michel Foucault, David Garland, Nilo Batista, Howard Zehr e Norbert Elias — expandem os horizontes do pensamento jurídico-penal, propondo abordagens que ultrapassam a retribuição e se orientam pela dignidade humana, reintegração social e prevenção da reincidência. Conclui-se que a incorporação das contribuições criminológicas ao Direito Penal favorece a construção de um sistema de justiça mais equitativo eficaz e humanizado.

Hans Joasnak a Die Sakralität der Person című műve szerint az emberi jogi normák kialakulásának történeti okai nem elsősorban a vallásellenes szekularizmusra, hanem egy sajátos szakralizálódási folyamatra vezethetők vissza, amelynek során a modern társadalmak a tagjaik körül a „szentség auráját” teremtik meg. Ezt a tézist sokan pusztán történeti-szociológiai elméletként interpretálták. Én viszont amellett érvelek, hogy Joas művének kiemelt célja az emberi jogok legitimációjára vonatkozó új módszertan megalapozása volt. Feltevésem, hogy két szerző (Cesare Beccaria és Michel Foucault) kritikája adott Joasnak alkalmat egy olyan nézőpont körvonalazására, amely szerint a modern egyén adekvát történetének elmesélése és a vele szemben megfogalmazható normatív elvárások feltérképezése komplementer módon kiegészítik egymást. Azt is bemutatom, hogy elsősorban Joas Durkheim-elemzéseinek tanulmányozásával jelölhetjük ki egy új típusú normatív elmélet viszonyítási pontjait. Tanulmányom végén az így rekonstruált elméletet szembesítem az érvényességet a nyilvános helyesléshez kapcsoló észjogi koncepció elvárásaival, így igyekszem felmérni e normatív koncepció erősségeit és korlátait.

Its focal point is a little-known work created by Florentine choreographer Gasparo Angiolini for the new Teatro alla Scala in 1782: his didactic ‘philosophical ballet’ La vendetta spiritosa, based on the Traité des sensations by Étienne Bonnot de Condillac (in Venice the work was given as La vendetta ingegnosa o La statua di Condilliac [sic]). During the last decades of his career, informed by French linguistic theory and by Milanese writers such as the Verri brothers and Cesare Beccaria, Angiolini aimed to create an unmediated music-gestural language that could overcome linguistic and even political boundaries. The project had significant implications for the use of representative sound, both in music and in language. I examine the development of the impulse towards gestural mimesis and through-composition within scores for the danza parlante, including by Angiolini himself.

A sociedade deve reconhecer a fragilidade do nosso ordenamento jurídico a fim de combater a criminalidade, o que caracteriza um dos grandes motivos pelos quais os criminosos continuam praticando novos delitos após a evasão do sistema prisional. Para tanto deve-se analisar os alarmantes índices de reincidência criminal. Assim, através da análise desses índices, deve-se identificar as bases sociológicas, criminológicas e psicológicas que circundam o delito e o ambiente prisional, com o intuito de caracterizar o perfil de quem delinque e o porquê se delinque. Para tal fim, utiliza-se-a metodologia de análise documental, por meio de artigos científicos, monografias já publicadas, legislações em vigor, revistas e doutrinas, em especial as doutrinas de Guilherme de Souza Nucci, Cezar Roberto Bitencourt, Cesare Beccaria, Rogério Greco, que tratam a respeito da criminologia, psicologia, sociologia, bem como dos aspectos teóricos por trás do direito penal, sendo estes os meios necessários para embasar o presente artigo científico.

Abstract:
This paper’s main objective is to present, based on the Shakespearean play “Measure for Measure”, and the hermeneutical observations of Cesare Beccaria, the necessity of rethinking the role of the court in the criminal procedure. In order to do so, a qualitative research was adopted, as well as a bibliographical-documentary analysis, insofar as it dealt with scientific articles and doctrinal texts, as well as legislative documents and judicial decisions, using the deductive method. The undeniable contribution of literature to the juridical science is thus made visible, as it makes possible a strong critical subversion, besides portraying cultures and also working with interpretation. In this sense, after the synthesis of the Shakespearean plot, two models of judgments, objectivist and subjectivist, were visualized, which facilitates the debate about the magistrate’s role in the criminal process. This same logic was applied by Beccaria in “On Crimes and Punishments”, in which the author dismissed any kind of judicial voluntarism, and attributed to the judge the obedient execution of the written law. Thus, it was found that, since the constitutional reading of the criminal process is intrinsic to democracy, it is incumbent upon the magistrate to construct and maintain the process as a space for effecting guarantees and rights of the accused, so as to be a true spectator. Finally, the excessive emphasis on court decision results in a real disassociation with the accusatory system, as, by ignoring the semantic limits of the legal text, except in the case of constitutionality / conventionality control or in favor of the defendant, it performs a vulgar arbitration, which undermines the constitutional instrumentality.

El presente artículo aborda varias formas de acercarse a la problemática del suicidio frente a la sociedad, la moral y la religión en el siglo XVIII en Francia e Italia. Se trata de un tema de gran importancia que es analizado por algunas mentes ilustradas como es el caso del Barón de Montesquieu, Voltaire, Cesare Beccaria y Giacomo Casanova. Se revisa la incorporación del vocablo “suicidio” a las lenguas inglesa, francesa, española e italiana y se investigan las razones por las cuales algunos filósofos prefieren abordarlo con extrema cautela, mientras que otros lo hacen frontalmente, arriesgándose a severos castigos por parte de la censura. En cada uno de los textos de estos autores, se utilizan diferentes estrategias discursivas para acercarse a un tema tan delicado, castigado por los tribunales civiles y religiosos. Se estudian obras de ficción y tratados políticos tales como Las cartas persas y Del espíritu de las leyes de Montesquieu, El Tratado de la Tolerancia de Voltaire, De delitos y penas de Beccaria y el Discurso y diálogos sobre el suicidio e Historia de mi vida de Giacomo Casanova. A lo largo de ellos, se observa un interesante mecanismo en la historia de las mentalidades, ya que se asiste a un cambio de paradigma que desembocará, poco a poco, en una nueva mirada sobre el acto suicida, pues se desdibuja la creencia de la participación del diablo como responsable de incitar a la persona a realizarlo y se pone en tela de juicio la idea común de que se trata de un comportamiento propio de la locura. El concepto comienza, por fin, a explicarse dentro de un marco racional y absolutamente comprensible, para posteriormente lograr despenalizarlo y secularizarlo.

Abstract:
The article examines the death penalty as a type of criminal punishment based on the analysis of the famous treatise «On Crimes and Punishments» by the 18th-century Italian thinker Cesare Beccaria. The grounds for the admissibility and necessity of the death penalty in situations critical to the existence of statehood are determined, taking into account the opinions of domestic legal scholars. In particular, a state may provide in its legislation for the death penalty for acts committed during war or an imminent threat of war. It is noted that the ideas of Cesare Beccaria have significantly influenced modern international law. This legislation provides for the obligation of the member states of the Council of Europe that have signed the Convention for the Protection of Human Rights and Fundamental Freedoms and its additional Protocols to abolish the death penalty in all circumstances. Ukraine signed and ratified the above international legal acts, following the path of European countries. This was done due to the fact that no one in Ukrainian society foresaw the possibility of armed aggression (war) in Europe in the 21st century. The article analyzes the above international legal acts and concludes that Ukraine has fallen into the same trap as with the Budapest Memorandum of 1994. It is argued that a certain analogy can be drawn between the death penalty and nuclear weapons – both of them are means of deterring (preventing) the commission of particularly serious crimes associated with the mass death of people. The study concludes that as a result of the large-scale Russian aggression, an exceptionally dangerous situation has developed for Ukraine. This is an existential threat to the existence of a sovereign state and the Ukrainian ethnic group, which requires a review of international obligations regarding the death penalty. The opinion is expressed and substantiated that the existence of this institution during martial law will in itself effectively influence the feelings of citizens - carriers of racism, prone to betrayal and collaboration with the aggressor and occupier. This is, first of all, about the criminal activity of individual citizens of Ukraine, which is associated with the death of military and civilian people and other serious consequences (missile guidance, transmission of information about the location of military units, weapons, ammunition, fuel depots, energy facilities, etc.). The current legislation provides for life imprisonment for such actions. It seems quite justified and necessary to use the formula “punishable by life imprisonment or the death penalty” for such crimes. Of course, we are talking about the application of such punishment only during martial law (state of war).

Corruption remains a cankerworm that has continued to hinder genuine efforts towards development in Nigeria. Several efforts have been put in place to curb the menace but it still manifests in various forms. This study was carried out to specifically examine the extent to which the Economic and Financial Crimes Commission has reduced money laundering in Buhari’s regime; to find out the extent to which the EFCC has reduced cybercrimes in Buhari’s regime and to assess how the EFCC has reduced the incidences of embezzlement of public funds in Buhari’s administration. The study was anchored on Deterrence theory espoused by Cesare Beccaria in 1764. The study adopted content analytical technique to analyze data for the study. The study revealed the following among others: that the EFCC has not significantly reduced money laundering in Buhari’s regime; that the EFCC has demonstrated commitments towards reducing cybercrimes in this regime and that the EFCC has not significantly reduced incidences of embezzlement of public fund in Buhari’s regime. The study concluded that development will continue to elude our country as long as corruption continues to ravage the polity. The study therefore, recommended among others that the operatives of the EFCC should always carry out thorough investigations in order to win more cases of money laundering.

A intolerância religiosa é um fenômeno global que afeta milhões de pessoas, desafiando os princípios básicos dos direitos humanos e da convivência pacífica. Essa forma de intolerância manifesta-se quando indivíduos ou grupos são discriminados, perseguidos ou atacados por suas crenças religiosas. A diversidade religiosa é uma característica intrínseca à humanidade, refletindo uma rica tapeçaria de tradições, rituais e convicções. No entanto, ao invés de ser celebrada, essa diversidade tem sido frequentemente a fonte de conflitos violentos e preconceito. Este trabalho aborda a questão da intolerância religiosa dentro do sistema carcerário brasileiro. A análise parte da compreensão da diversidade de crenças e práticas religiosas presentes na sociedade brasileira, destacando como essas manifestações são levadas para o ambiente prisional. Em seguida, são examinados os principais casos de intolerância religiosa vivenciados por detentos, que muitas vezes são alvo de discriminação, violência e coerção por parte de outros presos ou mesmo de agentes penitenciários. Diante do exposto, pretende-se responder à seguinte pergunta-problema: De que maneira a intolerância religiosa influencia a ressocialização do apenado na sociedade brasileira? No referencial teórico, são utilizadas as ideias de Marcelo Almeida, Gisleno Alves, Cesare Beccaria, Paulo Dalgalarrondo. Concluiu-se que a intolerância religiosa pode levar à segregação e ao isolamento do detento dentro do sistema carcerário, dificultando sua integração com outros detentos e, consequentemente, sua reintegração na sociedade após a liberação.

“As punishments become more cruel, men become more ferocious.” That contention, voiced in this instance by a contributor to The Gentleman's Magazine in 1786, had been a respected tenet of Enlightenment penal theory since its articulation by Cesare Beccaria twenty years earlier. In the interim, commentators on both sides of the Channel had continued to theorize about the impact of public physical punishments on the temper of society. Repeated public executions, thought one contributor to The Times, led only to “a shameless apathy”; another cautioned that, “When the wantonness of oppression is made familiar to the eye, the sensibility of the people…degenerates into despondency, degeneracy and stupidity,…” and he repeated Montesquieu's sinister simile likening the tranquility of such a state to the mournful silence of a city that the enemy is about to storm. In the aftermath of the French Revolution, however, such speculation took on the chilling force of prophecy fulfilled, and for the next fifty years a chorus of increasingly alarmed English voices warned of the potential for insurrection inherent in physical punishments. Continued recourse to public executions, a “festival of blood, [was] calculated to shock or brutalize the feelings of man, [to] encourage ferocious habits in the people.” “Revolutions,” trumpeted the Morning Herald in 1835, “are always most bloody in countries whose laws have most familiarized the people with spectacles of vengeance.”

The reconstruction is based mostly on unpublished documentation preserved at the Archivio di Stato of Milan, the Biblioteca Braidense of Milan, the libraries of the Museo di Storia Naturale of Milan and the Archivio di Stato of Milan, the Archivio del Liceo Classico Statale Cesare Beccaria of Milan, the historical archives of the Politecnico of Milan, the Biblioteca di Biologia Vegetale, Dipartimento di Scienze della Vita e Biologia dei Sistemi, University of Turin, the Autografoteca Botanica of the Botanical Garden of the University of Modena, and the library of the Botanical Garden of the University of Padova. Overall, the period was one of slow decline for the Botanic Garden of Brera, against which successive directors – namely, Antonio Bodei, Francesco Enrico Acerbi, Giuseppe Balsamo Crivelli, Vincenzo Masserotti and Giustino Arpesani – combatted in vain. In particular, Balsamo Crivelli fought with great passion for many years to keep the level of the Botanic Garden of Brera at a satisfactory level, but he did not achieve the desired aim. However, he complied a partial list of the garden’s plants, of which an updated version is presented here.

This study explores the socio-religious and human development implications of combating illicit drug use in Nigeria, examining the factors that influence drug involvement and its societal consequences. Illicit drug use threatens public health, social stability, and national development. Despite existing laws, the role of socio-cultural and religious factors in substance misuse remains poorly understood, with gaps in effective interventions and research. This study aims to bridge these gaps by exploring how socio-cultural and religious dynamics combating drug abuse, particularly among youth, and assessing the effectiveness of interventions, including faith-based approaches, in prevention and recovery. The study employs a mixed-method approach of integrating historical and content analysis of qualitative methods, based on Rational Choice Theory, by Cesare Beccaria, to explore decision-making in substance use. The findings highlight peer influence and socio-economic challenges as key factors driving drug use, while faith-based interventions have proven successful in encouraging abstinence and supporting rehabilitation. Drug abuse harms development, while current responses lack cultural fit, calling for a more integrated, community-based approach. Recommendations include strengthening community-based drug prevention programs, enhancing faith-based partnerships, implementation of public education and awareness campaigns targeting youth, investment in socio-economic support programs for vulnerable populations and establishment of comprehensive rehabilitation and mental health services. These efforts will enhance public health systems, strengthen Nigerian government institutions, and bolster resilience within families and communities. Additionally, this research will make a meaningful contribution to academic knowledge and scholarship.
