The paper investigates the norms of laws on trade unions of the states of the Eurasian Economic Union, with respect to international labor standards, in the context of the problems of freedom of association in a comparative legal aspect. This article on social movement unionism in Japan examines the particular ways in which labor unions form coalitions when undertaking disputes that concern the dismissal of blue-collar temporary agency workers. The triangular employment arrangement nullified the right of labor unions that represent the temporary agency workers to bargain with the user corporations. Against this predicament, labor unions formed alliances by flexibly negotiating the divisions that exist among labor. AbstractThe evident failure of voluntary corporate codes of conduct and their monitoring has further intensified debates over the purchasing practices and legal accountability of transnational corporations. This article analyses the development of International Framework Agreements as an alternative approach advanced by trade unions and describes the characteristics of these instruments, pointing out their strengths and weaknesses concerning implementation and monitoring. It specifically focuses on the Indonesian Protocol on Freedom of Association, a special framework agreement concluded between Indonesian trade unions and international sportswear firms to protect freedom of association and trade union rights in the Indonesian textile, garment and footwear industries. After presenting the protocol’s content, the article discusses findings concerning the implementation and monitoring of the agreement, based on interviews conducted by the author in Indonesia between November 2018 and January 2019. It identifies several key factors that led to the successful promotion of strong trade union rights in the formation phase of the agreement, namely public awareness due to intensive campaigning around a mega sporting event, strong support from different civil society actors and the presence of a neutral facilitator. Overall, the Indonesian Protocol on Freedom of Association is an example of a bottom-up process that strengthens the signatory trade unions and thus serves as a potential model for actors in other countries.

This chapter examines the overlap between African Americans' demands for jobs and conservatives' push for “right to work” laws. While compulsory union dues were very different from unions' exclusion of blacks, both movements targeted historically white unions and shared a language of workplace “rights.” Conservative “right to work” activists adopted the tactics of the civil rights movement and aligned themselves with blacks against exclusionary unions. Although this strategy failed to attract African Americans, it called attention to unions' historic and ongoing racism in a way that eventually divided the labor–liberal coalition. This dynamic is key to understanding the National Association of Manufacturers' complicated support for civil rights, equal opportunity, and affirmative action.

The exceptionality of retail unions governing Macy’s Herald Square in New York City and South Center Department Store in Chicago in advancing black labor and civil rights is the subject of chapter three. New York and Chicago locals successfully linked worker and consumer rights and improved African Americans’ social and economic conditions, even propelling some of them into the middle class. Also, in acting as both labor and civil rights organizations, these unions expanded views on fair employment in this industry beyond bread-and-butter issues and promoted equal employment and promotion. This epilogue shows that Hague v. CIO had a legacy more complex than its reputation as a speech rights victory for workers and others over dictatorial city boss Frank Hague under the Bill of Rights. The American Civil Liberties Union and renamed Congress of Industrial Organizations (CIO) immediately split over the decision’s ramifications. Moreover, while the ruling enlarged constitutional protection for the right of public assembly to the benefit of Jehovah’s Witnesses, civil rights demonstrators, and others, it did little to enhance picketing and other “labor speech,” or to shield union organizers from police harassment. And while the decision freed the CIO to organize in Jersey City, it did not destroy Mayor Hague, who accommodated CIO unions and was ousted later due to city politics.
