Abstract:
Historically, governments have always found ‘lawful’ ways to regulate the power of trade unions. The institutionalisation of the Industrial Conciliation Act propagated in 1934 and successively amended in 1960, and labour legislations that were enacted at independence in 1980 and 1981, and later on amalgamated into the comprehensive Labour Relations Act of 1985, all serve as clear demonstration of such measures. The earliest steps to establish and regulate a labour market were the founding of Provincial Labour Bureaux in 1895 and the Rhodesia Native Labour Bureau (RNLB) of 1903. These instituti

Abstract:
As early as 1952 I launched the idea of enhancing the use of the PCA by making its arbitration facilities accessible for arbitration between states and private parties. A few years later I was requested by the Secretary-General, at that time, Prof. Francois, to draw up draft arbitration rules for this purpose. These rules, as elaborated by the International Bureau of the PCA, became the 1962 Rules of Arbitration and Conciliation for Settlement of International Disputes between Two Parties of Which Only One is a State, hereafter referred to as the 1962 Rules.

Abstract:
Chapter 6 examines the Freedmen’s Bureau courts as an exception to the otherwise prevailing failure of conciliation courts to take root in American soil. Created to integrate the newly freed African-Americans into Southern society and to reconfigure the latter on free labor foundations, the Bureau courts were understood by Northern architects of Reconstruction to be a kind of conciliation court. Long promoted as able to attenuate market-driven conflict and restore communal harmony, the conciliation court seemed tailor-made for the Reconstruction South with its mounting tensions between white l

Abstract This comment presents the activity of the Court of Conciliation and Arbitration within OSCE (CCA) from 1 January 2022 to 31 July 2023. The thirtieth anniversary of the adoption of the Stockholm Convention on Conciliation and Arbitration within OSCE of 1992 provides an opportunity for a realistic review and assessment existing options for the peaceful settlement of disputes offered by the CCA. As thirty years after the conclusion of the Stockholm Convention not one case has been brought before the CCA, in 2022 and until mid-2023 the actions of the CCA were not related to its principal

This chapter focuses on the work of African American activists in the Department of Labor (DOL) during the Progressive era, and on two men in particular: W. E. B. Du Bois and George E. Haynes. The labor problem was in many ways at the heart of the Progressive project, and the establishment of the DOL and its forerunner, the Bureau of Labor, represented an early victory. Like many of these early institutional victories, the DOL was not a huge success. Its power was at the margins, and it rarely used such power for anything more than conciliation and tepid reformism. In the area of race, the DOL
