Abstract:
Recent consumer law cases are shaping consumer law in an unwarranted way. The courts have acknowledged the importance of advancing consumer law and protecting consumers, however, upon closer examination it is questionable whether courts are employing the right framework, tools and considerations. By analysing recent country of origin cases this article identifies some potentially worrying ways in which the courts have eroded consumer law rather than strengthening it. In particular, such cases allow the proprietary interest of goodwill to creep into the Fair Trading Act 1986 (FTA). Doing so, even if only at the stage of determining the penalty to be imposed, may shift the dial further towards the Fair Trading Act (FTA) being a means for protecting traders' interests. This, in turn, may lead to negative unintended consequences.

Abstract:
This article explores laws related to the protection of, and challenges to, consumer rights in the UK after its peoples’ decision to withdraw from the European Union (EU, henceforth) in 2016. Consumer protection laws are formulated and enacted to safeguard consumers from illegal and deceitful behavior of traders and salesmen, etc., and provide buyers with a range of legal guarantees and protections. These laws deal with a number of issues such as the safety of the products used by citizens, criminalize not only false advertising, but also excessive pricing, and breach of contract terms. In the UK, the main piece of consumer protection legislation is the Consumer Rights Act 2015. However, despite the existence of consumer protection laws and regulations, problems still occur, and consumers can still fall victim to fraudulent or unethical business practices. Therefore, it is important for consumers to be informed about their rights and to be vigilant in protecting themselves from scams and other forms of consumer fraud. Additionally, consumer protection is an issue that is constantly evolving as new technologies and business models emerge. For example, the rise of e-commerce and online marketplaces has created new challenges for consumer protection, as consumers may not always know who they are buying from or how to resolve disputes with online sellers. In every company, consumer trust is a top priority. The Consumer Protection Law is one of the important things that must be known, so that in the future we will not be deceived or feel harmed by an item or thing that is purchased and consumed. To protect consumers from fraudulent competition, consumers need to get legal protection. Legal protection that can be provided are: preventive legal protection and repressive legal protection. The purpose of this paper is to determine the form of legal protection for consumers due to unfair competition. The conclusion obtained is that the form of preventive legal protection has been established by the government, namely with the establishment of Law Number 8 of 1999 concerning Consumer Protection and forms of repressive legal protection, carried out by litigation and non-litigation. Litigation settlement is carried out in court and non-litigation with the National Consumer Protection Agency, Non-Governmental Consumer Protection Agency, and Consumer Dispute Settlement Agency.

Several laws, namely: Consumer Protection Act, Health Act, Food Act and Halal Product Guarantee Act are a form of legal protection for halal food products that can provide guarantees for consumption by Indonesian Muslim communities. This paper is a descriptive qualitative one that seeks to provide an overview of the problem of regulating halal food products in relation to consumer protection and legal protection of consumers in consuming halal food products. The results of this review study that the regulation of halal food products for companies or businesses that will trade their products in Indonesia based on the Halal Product Guarantee Act if related to consumer protection has provided legal certainty for the consumer community (Muslims) to consume halal food, namely by there are Halal Certification marks and Halal Labels. Likewise, several laws and regulations relating to halal food products that have been enacted provide legal protection for consumers in consuming food and beverages. Consumers must get information, safety and a sense of security for a food product that will be consumed according to their choices.

The Foreclosure Crisis of the 2000s has likely hurt renters more than homeowners. Incongruously, however, consumer enforcement agencies have been far more zealous in protecting mortgagors than tenants. This Article explores the under-protection of tenants as a class of consumers, particularly in a “commoditized” rental market, and examines how consumer enforcement agencies can more zealously incorporate tenant-protection into their mandates. Much of the prior literature on the legal protections afforded tenants was published in the wake of the consumer rights revolution of the 1970s. This Article is the first to carefully reexamine, in the context of the modern rental market, whether tenants should be protected as consumers and whether tenants have truly reaped the benefits of consumer gains over the last half-century. The Article analyzes original interviews with state consumer protection agencies, engages in the first broad survey of state and federal tenant protection enforcement actions, and provides a new review of the caselaw addressing whether tenants are covered by consumer protection regimes. Concluding that achieving systemic change through broad-scale policing of the rental industry is both vital and often overlooked, the Article proposes specific reforms that consumer protection agencies can adopt to better protect tenants.

Purpose – The purpose of this paper is to make a case for the recognition of privacy and personal data protection as species of consumer rights in Nigeria in line with the revised United Nations Guidelines for Consumer Protection (UNGCP) by amending existing laws or enacting a new law to provide for personal data protection regime for consumers. Methodology/Approach/Design – The study follows a structured review of relevant extant legislation on consumer protection and personal data protection, namely the Federal Competition and Consumer Protection Act 2018 (FCCPA) and the Nigeria Data Protection Regulation 2019 (NDPR). Findings – The paper identifies that the provisions of Nigeria’s foremost consumer protection legislation, FCCPA, does cover electronic commerce (e-commerce) or consumer privacy and personal data protection while the NDPR, subsidiary legislation on personal data protection, which is yet to be effectively implemented is too general as to provide the consumers the much-needed privacy protection in their dealings with businesses. Practical Implications–Given the importance Recognition of data privacy and personal data protection as a species of consumer rights helps in understanding consumer protection in online transactions and opens opportunities for future research on consumer privacy and data protection. Originality/Value – Given the importance attached to the protection of consumer privacy and the various ramifications of transactions involving exposure of consumers’ personal data, recognition of privacy consumers’ rights to privacy is vital in consolidating knowledge of consumer rights and identifying paths for future research.

Abstract:
The paper analyses to what extent financial consumer protection forms part of the competition law objective of consumer welfare that EU competition law nowadays adheres to. It argues that while EU consumer law more generally aims at protecting the final consumer, EU financial consumer protection instruments often protect a broader spectrum of customers. This wider notion of the consumer can also be found in EU competition law, where the consumer is usually likened to any customer. A notable difference between EU financial consumer protection and EU competition law, however, is that they place a different emphasis on structural goals and inherently individual components. In EU competition law, the structural protection of competition is thought to eventually protect consumers. By uniting individual and structural aspects of consumer welfare, as well as by combining reactive and proactive consumer protection, EU competition law and EU financial consumer protection law can together achieve a financial protection of consumers that naturally goes beyond what each area of the law could achieve alone. A stringent approach, however, would require the development of a comprehensive EU financial consumer law which includes both dimensions.

Abstract:
The concept of consumer protection is to guarantee legal certainty to consumers, namely efforts to empower consumers to obtain or determine their choice of goods and/or services and to defend or defend their rights if business actors harm them. Legal norms to protect the interests of consumers are not sufficient. Therefore, to achieve a balance in protecting the interests of consumers and business actors, a clear legal order is needed so that a healthy economy can be realized. Consumer protection norms in the Consumer Protection Law System, as a fundamental norm, become the criteria for determining alleged violations of consumer rights. The aim of this study is to provide an alternative for resolving cases, a form of embodiment of the implementation of consumer rights protection policies. The approach method used in this research is juridical sociological. However, there are still legal loopholes that often occur. May harm the interests of consumers. The existence of regulations that still have to be synchronized and harmonized between the Consumer Protection Act and the rules governing Arbitration and Alternative Dispute Resolution issues because the Consumer Protection Law formulates rules for resolving consumer disputes by separate arbitration, which is relatively different from the basic concept of the arbitration mechanism which generally accepted so that the settlement of consumer disputes becomes legal uncertainty.

Cette thèse porte sur le régime de protection des consommateurs qui vise à prévenir les ventes abusives dans les services de conseil en investissement. Elle examine les conflits d'intérêts dus au comportement des conseillers financiers qui peuvent entraîner des ventes abusives. Le fait que la rationalité du consommateur puisse être limitée signifie que les consommateurs financiers traditionnellement considérés comme des clients de détail ou des investisseurs de détail sont en effet exposés au risque de conflits d'intérêts dans le processus de conseil en investissement et nécessitent donc une protection accrue. La directive MIF a récemment renforcé son dispositif afin de protéger plus efficacement les consommateurs contre le problème persistant des ventes abusives. La modification de la réglementation de la protection des consommateurs est significative en ce qu'elle renforce le régime général de protection des consommateurs de la directive MIF en mettant l'accent sur la vulnérabilité réelle des consommateurs. Elle contribue en outre à la promotion du système de protection du consommateur en imposant des devoirs de comportement aux sociétés financières qui doivent gérer des conflits d'intérêts spécifiques dans le cadre du grand principe de la protection des consommateurs. Cependant, même si l’intention à l’origine de son introduction est largement reconnue, la mise en place et la mise en œuvre pratiques de certains règlements devraient rencontrer des difficultés et donc nécessiter que des mesures supplémentaires soient prises
The thesis deals with the consumer protection scheme which aims to prevent mis-selling in investment advice services. It examines the conflicts of interest which appear in the behavior of investment advisors which may ultimately cause mis-selling scandals. The research findings of behavioral economics that the consumer’s rationality can be bounded indicate that financial consumers who are traditionally considered as retail clients or retail investors are indeed vulnerable to the risk of conflicts of interest in investment advisory processes and thus need enhanced consumer protection. MiFID I has recently strengthened its scheme with a view to protecting consumers more effectively from persistent problems of mis-selling. The amendment of the consumer protection regulation is meaningful in that it strengthens the overall consumer protection scheme within the MiFID with a focus on the actual vulnerability of consumers. Furthermore, it contributes to the fostering of the consumer protection system by imposing behavioral duties on financial firms which manage specific conflicts of interest under the important principle of consumer protection. However, even though the intention at the origin of its introduction is widely recognized, it is expected that some difficulties will arise when some of the regulations are virtually introduced and implemented, and thus supplementary measures will have to be established

Abstract:
This research focuses on online payment methods which are premised on electronic funds transfer. It is a general discourse that the use of online payment methods is risky. It is held that the fear of fraud and abuse of a payment system is at the focal point of such risk. Banks which provide these payment systems are usually not prepared to negotiate with their prospective customers. Resultantly, banks contract out of the risk associated with online payments, specifically the liability for unauthorized electronic funds transfers. This culminates in bank’s customers bearing the majority of that risk as a result of the bank-customer contract. Some of the laws applicable to this relationship also ascribe to the notion above. They burden bank’s customers solely with the liability of the use of their cards until notification to the bank of its theft or misuse. This shows a completed disregard of the nature of how online payment methods operate. Such imposition of liability is excessively one-sided in favour of the banks and detrimental to the bank’s customers. Ultimately, the scope of application of the current applicable consumer protection laws is limited by factors such as non-applicability to juristic persons or limitation based on asset value for those that do. This thus denotes a large segment of online payment methods users who cannot avail themselves to measures of protection provided for by the current applicable consumer protection laws. The research aims to avert the issues as demonstrated above, provide clarity in pursuit of equity and compliance, plus a comprehensive consumer protection approach for online payment methods users.

Abstract:
The fundamental consumer rights granted to consumers by the Consumer Protection Act 68 of 2008 (hereinafter referred to as the CPA) would be without meaning if no avenues of redress were available to enforce them. The National Consumer Commission as well as the National Consumer Tribunal and the consumer courts will enforce the Act. One of the more central and important aims of the CPA (section 69) is to ensure that an aggrieved consumer has access to redress, this also being one of the European Union’s consumer protection rights. The CPA therefore empowers the consumer by setting out redress options where a consumer believes that his or her right has been infringed. There is a wide range of options available to consumers if they have a complaint in terms of the CPA. Sections 68 to 76, which are found in Chapter 3 Part A to C, are the provisions that deal with the protection of Consumer Rights. In terms of the CPA, consumers are not obliged to approach the supplier against whom they have a complaint before first going somewhere else. In terms of section 69 of the Act, the category of persons listed in section 4(1) can enforce a right in terms of the Act or in terms of a transaction or agreement, or resolve a dispute with a supplier by: Referring the matter directly to the National Consumer Tribunal; referring the matter to the applicable recognised ombud with jurisdiction over the supplier and if the matter does not concern the supplier contemplated in s 69(b), referring the matter to the applicable accredited industry ombud with jurisdiction. The consumer may also apply to the relevant consumer court of the province with jurisdiction (subject to the provincial legislation governing it). A dispute may also be referred to an alternative dispute agent, filing a complaint with the National Consumer Commission or approaching a court with jurisdiction over the matter (only when all the other remedies available to that person in terms of national legislation have been exhausted). The main focus of the research will be the role of consumer courts in particular and their possible enforcement and execution shortcomings. The consumer courts are regulated on a national level in terms of the CPA and on provincial level in terms of provincial legislation of the various provinces. I will illustrate these shortcomings in a discussion of two relevant cases. A short discussion of the other options available to the consumers for redress in terms of the CPA will also be included. Other avenues of redress that will briefly be discussed are complaints lodged to the National Consumer Tribunal, the National Consumer Commission and alternative dispute resolution. Since the CPA became fully effective on the 31 of March 2011 and is more in line with international trends in consumer protection law, a short comparative study is necessary. I will be looking at the consumer law in Scotland, which is affected, by the UK consumer law in the United Kingdom.

Abstract:
In the last decade, the digitalization of the consumer market has given opportunities to performer of commercial practices to effectively influence the autonomy of the consumer’s decision. The digital economy has developed many different types of commercial practices that nudge consumers to make transactional decisions that are contrary to their interests, such as dark patterns. Currently, the most important legal instrument for the protection of consumer decision autonomy in the European Union is the regulation of the prohibition of unfair commercial practices. However, the new challenges reduce the effectiveness of regulation. The article analyses one of the current legal problems – the compliance of the burden of the proof model with the reality of the digital environment. The article argues that the model is not suitable for ensuring a high level of protection of consumer decision autonomy in the digital economy, therefore the regulation of the unfair commercial practices’ prohibition should be changed radically.

Consumer as a term in the in law of EU is not regulated in one place. It can be found in the most different places in the primary law of EU, in the secondary law of EU, as well as within the legal regulations of collision law of EU. From the view point of the secondary law,primarily, it is possible to claim that there is mainly formulated unique term of consumer in the law of EU. In the harmonization of the term of consumer the essential role was played by the judicial practice of the European Court of Justice. The subject and questions addressed to this Court were, among others whether the consumers status have also small non-profit legal persons, whether in application of regulations concerning consumers protection, in addition to objective criteria are also used subjective ones like knowledge, skill, information possessed by the physical person, whether the legal protection is available also to the persons concluding a consumer agreement with double purpose (within and outside a professional activity), whetter the consumers protection is privided also for the persons represented in the case by a lawyer, whether this protection is also provided for the communities of physical persons who do not possess the capacity of legal person, and others.

Однако вопросы изучения и совершенствования правой базы защиты прав потребителей не теряют своей актуальности по сегодняшний день. С развитием науки, техники, совершенствованием человека как индивидуума, появляется необходимость совершенствования и правовых основ охраны и защиты человека, как потребителя тех или иных товаров и (или) услуг, а потому законодательные акты Российской Федерации в указанной сфере постоянно совершенствуются (в них вносятся изменения). При этом, несмотря на вышесказанное, нередко на практике встречаются пробелы в законодательстве, приводящие к ухудшению качества оказания услуг потребителю, среди которых можно назвать неурегированность вопроса употребления продуктов в торговом зале до их оплаты. О целесообразности внесения в законодательные акты России подобных изменений (о плюсах, минусах и практической обоснованности) и пойдет речь в настоящей статье. In Russia, the protection of consumer rights has always been and continues to be given great attention. However, the issues of studying and improving the legal framework for protecting consumer rights do not lose their relevance to this day. With the development of science, technology, and the improvement of man as an individual, there is a need to improve the legal framework for the protection and protection of man as a consumer of certain goods and (or) services, and therefore the legislative acts of the Russian Federation in this area are constantly being improved (amendments are made to them ).At the same time, despite the above, in practice there are often gaps in the legislation that lead to a deterioration in the quality of services provided to the consumer, among which is the unresolved issue of using products on the sales floor before paying for them. The advisability of introducing such changes to the legislative acts of Russia (the pros, cons and practical feasibility) will be discussed in this article.

Abstract:
This paper is primarily focused onto the legal framework analysis in the Republic of Serbia, as well as the measures undertaken in order to ensure the protection of the electric-energy vulnerable customers. The acceptance of the protective mechanisms’ relocation from the competitive environment – necessitated by the free market circulation of this energy resource – has initiated their implementation within the social protection system, given the crucial importance of electricity in fulfilling some of the basic needs in the standard of living. Although duly recognized as an adequate protective environment to this consumer category, social protection faces the usual problems (lack of resources and the sustainability issues), as well as the new challenges in regard to the energy poverty and its relation to the established definitions of social vulnerability. The rules that manage contractual relations between consumers and energy providers cannot be eliminated by delegating the concerns about a sufficient energy provision to the certain consumer categories. The domestic energy is being regulated through a rigid legal framework where the public provider guarantees service under de facto preferential conditions that often result in consumer rights’ violations; therefore, the legal system is being additionally challenged in its efforts to ensure a thorough protection to the energy- vulnerable customers.

From the beginning of the 20th century it has been observed that detailed studies have been carried on consumer protection and consumer rights by countries, civil society organizations, private sector companies and universities. A harmonious co-operation between these units is of great importance in terms of ensuring effective consumer protection. Because the informing, education and protection of the consumer is accepted as a necessity of modern society. Consumer education is seen as a prerequisite for long-term social and cultural development. Tourists can experience various problems in purchasing goods and services in the regions they travel and do not know which way to apply in such a situation. In this context, youth who are educated tourism management should be knowledgeable about consumer rights are important in terms of resolving the expectations of consumers. In this context, the main purpose of the research is to reveal the knowledge level and behavior of consumer rights of tourism students. The questionnaire prepared for this purpose was applied to the students of Selcuk University Tourism Faculty. As a result of the research, it was determined that the students who participated in the survey know the consumer rights law. However, it has been determined that they do not know the contents of the basic rights provided in this law and the ways of utilization at the desired level.

Abstract:
In the work, the author pays attention to the administrative and legal aspects of consumer rights protection in Serbian law. Namely, the protection of consumer rights can be divided into public law and private law forms. In that division, administrative legal protection of consumer rights is included in public law forms. It is pointed out the already stated position in theory that one of the differences between administrative and judicial protection of consumers is the fact that the administrative authority has greater freedom in interpreting the protection goals, and at the same time, greater responsibility for the implementation of the goals. However, the views on the shortcomings of the administrative legal protection of consumer rights were also pointed out. In the Serbian legal system, the protection of the collective interests of consumers is entrusted to the administrative body in a special administrative procedure. This procedure shows quite a few deviations from the general administrative procedure. The advantage of the administrative procedure compared to the civil procedure should be efficiency and economy. Once established, the trader's behavior as a violation of the collective interest affects all consumers, so in case they repeat such practice, the others can join the already established violation, which is now directly sanctioned with the help of inspection supervision, without the need to be examined in a specific case. Inspectional supervision is reduced to the totality of activities of state administration bodies by which they examine the implementation of laws and other regulations, through direct insight into the operations and actions of natural and legal persons and, depending on the results of the supervision, pronounce the measures for which they are authorized. It is regulated by a special law and is a form of legal supervision, which is carried out with administrative powers by state administration authorities over non-authoritative activities of controlled subjects. The paper indicates that inspection supervision is an institutional form of consumer rights protection.

Abstract:
Commercialization of consumers’ personal data in the digital economy poses serious, both conceptual and practical, challenges to the traditional approach of European Union (EU) Consumer Law. This article argues that mass-spread, automated, algorithmic decision-making casts doubt on the foundational paradigm of EU consumer law: consent and autonomy. Moreover, it poses threats of discrimination and under- mining of consumer privacy. It is argued that the recent legislative reaction by the EU Commission, in the form of the ‘New Deal for Consumers’, was a step in the right direction, but fell short due to its continued reliance on consent, autonomy and failure to adequately protect consumers from indirect discrimination. It is posited that a focus on creating a contracting landscape where the consumer may be properly informed in material respects is required, which in turn necessitates blending the approaches of competition, consumer protection and data protection laws.

In 2022 and 2023 there was a profound debate in the European Union about the design of the electricity market and its suitability to deal with stress situations in the energy markets, protect consumers and incentivize the necessary investments in renewable energies. The debate was structured around two visions: (1) an interventionist position (e.g., the one defended by the Spanish Government), which emphasized the control of market prices and generators' revenues, largely invalidating the current design, and (2) a reformist position, which sought to complement the current design with elements to improve market resilience and consumer protection and embodied in the European Commission's proposal of March 2023. This report analyzes the development of that debate and discusses the final agreement reached by the European Parliament and the European Council in December 2023, which maintained the essential elements of the European Commission's reform proposal and proposed changes aimed at completing the development of the internal energy market, protecting the most vulnerable consumers, increasing the stability and predictability of the cost of energy and generating incentives for investments in renewable energies and flexibility.
