Abstract:
Figures of mobility appear prominently in US-foundational narratives of ‘discovery,’ the ‘Puritan errand,’ and westward expansion; the protagonists of these hegemonic tales of settlement and nation-building are (mostly) European travellers, pioneers, and colonists. By contrast, figures such as pirates, drifters, and fugitives are for the most part absent from canonical narratives of new world beginnings and may be considered as expressing/representing alternative mobilities. Their stories and their representations raise questions of legitimacy and legality – often from a transnational perspect

Abstract:
After 9/11, American officials authorized numerous contentious counterterrorism practices including torture, extraordinary rendition, indefinite detention, trial by military commission, targeted killing, and mass surveillance. While these policies sparked global outrage, the Bush administration defended them as legally legitimate. Government lawyers produced memoranda deeming enhanced interrogation techniques, denial of habeas corpus, drone strikes, and warrantless wiretapping lawful. Although it rejected torture, the Obama administration made similar claims and declined to prosecute abuses. T

Abstract:
After 9/11, the Bush administration and, to a lesser degree, the Obama administration authorized controversial interrogation, detention, trial, lethal targeting, and surveillance practices. At the same time, American officials frequently invoked legal norms to justify these policies. This chapter introduces the book’s central questions: how can we make sense of these attempts to legalize human rights abuses and how does law influence state violence? As initially outlined in this chapter, the book argues that national security legal cultures shape how political actors interpret, enact, and evad

Abstract:
Successive transformations have resulted in the emergence of a total technological world where old separations about ‘nature’ and ‘culture’ have declined. With this, the tendency towards technicity within modern law has flourished. There has often been identified a mechanistic essence to modern law in its domination of human life. Usually this has been considered an ‘end’ and a loss, the human swallowed by the machine. However, this innovative book sets out to re-address this tendency By examining science fiction as the culture of our total technological world, Living in Technical Legality jou

Abstract:
Abstract From Law and Literature to Legality and Affect represents a sustained argument for the continued vitality of Law and Literature. It argues that the traditional methods of Law and Literature can be combined with work in critical media studies, affect theory, and cultural narratology to address topics such as ethnonationalism, anti-immigration sentiments, and systemic racism in nations like Germany and the United States. Taking stock of the pluralization and diversification of the field at 50 years from a comparative standpoint, the book understands Law and Literature as a political pro
