Además, en consonancia con lo anterior, será pertinente analizar la acción preventiva que puede proceder ante la violación de normas del artículo 18 de la ley ya citada.

Actualmente, los procesos que versan sobre el artículo 18 de la Ley 256 de 1996 no tienen un análisis juicioso sobre la significatividad de la ventaja ilegítima tomada por el infractor de una norma, ya que se han desarrollado argumentos que no se sustentan con una base científica y permiten cuestionar los resultados condenatorios. Así, este trabajo se permite postular una solución por medio de la teoría de juegos, lo cual hace caso a un análisis económico que se sustenta en la participación de competidores dentro del mercado.

En el artículo 18 de la Ley 256 de 1996 se previó que se considera desleal la violación de normas jurídicas, siempre que dicha violación le conceda una ventaja competitiva y significativa al infractor.
