AbstractDecriminalisation recognises sex work as work; it provides opportunities for promoting the health of sex workers and therefore goes a long way to addressing health and human rights inequities for this sector of the population. This chapter focuses on three scenarios (among many) where decriminalisation of sex work in New Zealand has been successful in promoting sex workers’ health, safety, and wellbeing and, in so doing, provides a blueprint for best practice in working with sex workers.Although services for sex workers are available in many countries, they tend to focus on street-based sex workers, who are perceived as the most vulnerable and thus most in need. A decriminalised context provides greater access to peer support (Harcourt 2010), which is much better positioned to address the complex needs of all sex workers. It also allows for sex workers to engage with others in the community for more effective policy as well as service provision (O’Neill and Pitcher, Sex work matters: exploring money, power and intimacy in the sex industry, Zed Books, London, 2010). In this chapter, we discuss: How access to police has been improved for sex workers who wish to report sexual assault How decriminalisation has enabled interagency collaboration when working with sex workers who have concerns about practices within certain brothels How new sex workers access information on safe practices in a decriminalised environment We use the research literature from New Zealand and elsewhere to expand on the real-life stories of the engagement between New Zealand Prostitutes Collective and sex workers, agencies, and individuals to illustrate the three scenarios.

Reflecting broader trends in cities that had elected black mayors in the 1970s, Tom Bradley’s politics rested on a belief that law enforcement could provide equitable police service by committing to pluralist policies that were responsive to all city residents. As this chapter shows, however, reforms, such as diversifying the department, enhancing human relations training, and adopting community-oriented policing, provided only a semblance of civilian control of the police. As the police continued to aggressively police communities of color, it produced a new phase of anti–police abuse organizing, led by the Coalition against Police Abuse (CAPA), calling for an end to police crimes and power abuses. Some of the most notable demands were for an end to the use of the chokehold and for a police civilian review board.

This chapter analyzes how “the militants” turned to autonomous action and imposed their own strategy while conserving their close connection with the Pakistani secret services (ISI). In order for the militants to regain their influence over the jihadi groups, the ISI had to orchestrate a split in their ranks or create new, rival groups. The chapter discusses the radicalization of the Deobandi movements, which can be traced to the policy of conservative re-Islamization instituted by General Zia ul-Haq. It also mentions the way in which mainstream parties patronized the movements without consideration of the strategies that played a decisive role in the rise of sectarianism in Pakistan, and describes the impact of state actors with foreign powers and local players in a multi-scalar approach.

This chapter discusses the corruption that paralyzed both the Labor Battalion and the Guard that functioned as part of it since the first weeks of their existence. It examines how the horror of forced labor and the power that the Labor Battalion held over the individual fate of Warsaw Jews inevitably provided ample opportunity for abuse. It also recounts corruption in the form of brutal forcing of contributions for the battalion, which took place at all its levels — from its leader, Maurycy Halber, to its rank-and-file members. The chapter talks about the intervention of SS-Untersturmführer Gerhard Mende to the widespread corruption in the Labor Battalion at the beginning of June 1940. It emphasizes how the newly established Jewish Order Service initially offered hope for the end of the corrupt practices.

Contemporary police organizations benefit from technological advances not only for preventing and fighting crime and criminals but also for training their officers for better service. Likewise, the Turkish police organization has established an e-learning portal to enable managers to attain required managerial competencies and to learn modern policing concepts in a cost-effective training environment. This research examines the perceptions of participants who attend management-training courses conducted via e-learning. Five factors of trainees’ e-learning perceptions are examined through a combination of qualitative and quantitative methods, consisting of a questionnaire, one-to-one and focus group interviews, and observation. SPSS program and quantitative methods are used to analyze and interpret the findings. Research has indicated some positive perceptions, such as place and time flexibility, enjoyment of learning, becoming acquainted with modern learning methods and technologies, being able to participate in training without leaving work and personal life. Conducting a management-training course via e-learning is positively perceived by the majority of course participants, and they recommend e-learning for upcoming management training courses, specialized training, and professional development courses. However, research has also revealed that some technical and administrative problems affect negatively the trainees’ perceptions of e-learning. Based on the findings in this chapter, recommendations are offered for similar projects.

Fixated threat assessment centers (FTACs) have been established in the United Kingdom, Australia, and New Zealand. The model was developed to assess and manage risk from isolated loners who write concerning communications or make problematic approaches to politicians or the British royal family. It has recently been expanded to encompass risks of lone actor grievance-fueled violence more broadly. The essential feature of FTACs is that they are police units jointly staffed by police officers and psychiatric staff from the health service. Given the central role that mental state and motivation play in the assessment of risk, the presence of psychiatric personnel greatly enhances the power of risk assessment and catalyzes multiagency interventions with fixated loners, a population with high psychiatric morbidity. This chapter describes the function, structure, and operating methods of FTACs. The FTACs deal with forms of psychotic pathology rarely seen in psychiatric services, but well described by 19th-century phenomenologists.

Abstract:
This chapter analyzes the drivers that are reshaping the prosecution service in both jurisdictions, which rest neither on adversarial nor inquisitorial procedural values, nor on broader concerns with fair trial, but on the processing of large numbers of cases with the minimum of cost and delay in order to demonstrate the effectiveness of criminal justice responses to crime. The center of gravity has shifted further toward the pretrial phase, drawing power away from the judiciary toward the public prosecutor and, in some instances, the police. This has been achieved in part through the routine delegation of work and a process of deprofessionalization, in which procedures for the treatment of cases are standardized and simplified, becoming almost automatic. This recasting of the prosecution function has implications for the independence of the prosecutor, for her autonomy and professional standing, and for the balance of legal and constitutional power in the criminal process.

Abstract:
This chapter evaluates the constitutional framework of the United Kingdom, revealing a disturbing new settlement of State power. In particular, it hones in on the ‘Westminster Model’ of government which advertises a strict separation of powers supposedly insulating judges from direct executive influence. An altogether different reality emanating from the archival trove of intergovernmental files is found; one which challenges the grundnorm of judicial independence embedded within the Westminster model of governance. Although Executive dominance of the judiciary runs contrary to basic texts and beliefs, this chapter lays out an alternative perspective which implicates the senior judiciary in subterranean policymaking that has led to the steady erosion of procedural due process. It examines where the Civil Service fits into this picture, and draws attention to its servants’ inherent shortcomings as ‘bureaucrats of the law’ having assumed responsibility in large part for the body of sub-standard work distributed under the misnomer: ‘Judges’’ Rules. It explains how, on the critical issue of an individual’s vulnerability when confronted by police power, civil servants, tasked with furthering the ‘public interest’, were far more adept at bolstering ‘police interests’, with backing from the then Head of the Judiciary (Lord Chancellor) and his Law Officers (the Attorney-General and Solicitor-General). By documenting key historical events that impacted upon the criminally suspected or accused, awareness of which has been muted or unknown, this Chapter explains how the doctrine of the Separation of Powers is contravened and the principle of judicial independence muddied to the point of non-recognition.

This chapter describes the UK’s main constitutional bodies or offices and their roles. The state’s institutions and offices are linked to the three main powers at work within it: executive power, legislative power, and judicial power. The Queen is the head of state for the United Kingdom of Great Britain and Northern Ireland, and heads the three branches of the state, although she is a constitutional monarch and her power is subject to constitutional limits. The executive is an umbrella term that describes two different entities: the political executive and the wider machinery of the government. The political executive contains the Prime Minister and government ministers. The wider machinery of government involves the collection of people who keep the country running, which includes the civil service, the police, the armed forces, members of executive agencies such as the Prison Service and the welfare benefits system. Parliament is the body tasked with law-making, the scrutiny of Bills, and holding the executive accountable. The courts oversee the operation of the rule of law by reviewing actions, omissions, and decisions taken by the executive to ensure that they are legal, rational, and procedurally proper, and comply with the terms of the Human Rights Act 1998. The chapter concludes with a discussion of elections to the Westminster Parliament—the mechanism through which MPs are elected and other ways in which those elections could be run.
