Article 8 EIR covers the third parties’ rights in rem. It states that the opening of insolvency proceedings does not affect the rights in rem of creditors or third parties in respect of tangible or intangible, moveable or immoveable assets which are situated in another Member State. It also describes specific assets and collections of indefinite assets that change from time to time, belong to the debtor, and are situated within the territory of another Member State at the time of the opening of proceedings. The commentary emphasises that Article 8 is the first exception to the general rule of application of the lex concursus. It highlights the essence of certain rights in rem that entitles the creditor to have control and recourse to the property covered by the security ahead of the claims of other unsecured or lower ranking creditors.

Abstract The quality of modern legal writing is often diminished by prolixity. The temptation is always to submit long papers. From this fault of verbosity Bernard Rudden’s writing is exempt. One distinguishing quality of his compositions is undoubtedly conciseness. Some legal literary genres do demand that quality. The Clarendon Law Series is one such. There the Ruddenian mastery is unsurpassed.1 It might not be the best tribute to a master of compact writing to attempt to expand his published thought. However, to abstain would some¬ times contradict another Ruddenian tenet, namely that one must write to explain things to oneself, and, only should that explanation have proved credible, offer it to others, too.

Abstract If we wish to compare modern systems of contract, we can probably start with a rough trans-systemic conception of what a contract is, although we may then argue about the true rationale for enforcing contracts. The same applies to the notion of a civil wrong as the basis for comparing systems of tort/delict; or to the idea of a nuclear family, around which we can contrast various systems of family law. ‘Property’ is more elusive, precisely because the rationales invade the concept at its core in ways I shall explore. No one has contributed more effectively to this problem than Bernard Rudden, principally in two seminal essays: ‘Economic Theory v Property Law: the Numerus Clausus Problem’;2 and ‘Things as Thing and Things as Wealth’. What emerges, as we shall see, is that we cannot proceed to any advantage in comparative property law without inventing theoretical constructs that transcend local legal dogmatics.
