Abstract:
In 1942, in order to execute the genocide of Jews in Belarus, along with carrying out mass executions, the Nazis began to use gaswagens. In June 1942, a «special vehicle» appeared at the disposal of Einsatzkommando 8 in Mogilev. Based on the trials’ recordings and protocols, it can be assumed that at least 2,500 Jews of the Mogilev region were poisoned in gas vans (gaswagens). Details of the crimes committed by the Nazis with the use of gas vans became known in the 1960s, when lawsuits were held in the Federative Republic of Germany against former members of Einsatzkommando 8: A. Garnishmacher, G. Richter, G. Haase, G. Schlechte, K. Strohammer. The paper sets the goal, using the example of trials against the members of Einsatzkommando 8, to determine what legal assessment West Germany justice gave to the Nazi atrocities associated with the extermination of Jews in gaswagens. On the one hand, the trials against former members of Einsatzkommando 8 testified to the desire of German justice to critically rethink Germany’s recent past, to ensure the principle of inevitability of criminal responsibility for Nazi criminals. On the other hand, the outcomes of the trials under consideration indicated that West German Themis, as well as the overwhelming majority of the citizens of the Federal Republic of Germany, refused to treat the former members of Einsatzkommando as criminals. In German society, the prevailing opinion was that the blame for the Holocaust and other crimes of National Socialism lay exclusively with A. Hitler and his entourage (G. Himmler, R. Heydrich, etc.). The rest of the Germans were only «hostages of the regime» who «due to special life circumstances» were forced to perform the criminal orders of the Fuehrer. In juridical practice, that approach took shape in the theory of complicity, based on which the German courts assigned minimal punishments to Nazi criminals, and often the courts completely exempted them from criminal liability.

Abstract:
The paper is devoted to the legacy of Fritz Bauer — the Prosecutor General of the Land of Hesse in West Germany — and analyzes his understanding of the possibility of building the rule of law in Germany, understanding the criminal past of Germany and realizing the responsibility of the German citizens for the genocide of the Jewish people. Fritz Bauer was one of the most consistent supporters of the criminal prosecution against Nazi criminals in the Federal Republic of Germany (FRG). In Bauer’s view, the Nuremberg trials were supposed to witness the desire of the German state to restore the rule of law, preserve the memory of millions of victims of Nazism, celebrate the triumph of justice and human rights. In the course of the court proceedings, Fritz Bauer sought to show that millions of German citizens who supported the Hitler regime and shared the ideology of National Socialism were responsible for Nazi atrocities. The merit of Fritz Bauer’s goal was to recognize the Third Reich as an illegitimate State and rehabilitate the participants of the Anti-Hitler Resistance Movement. In his articles and court speeches, Bauer justified the right of citizens to resist the criminal authorities, argued that disobeying criminal orders was the only possible option for lawful behavior in an illegitimate State. Fritz Bauer was convinced that it was possible to prevent the repetition of the past and prevent the neo-Nazis from coming to power only through the democratic education of the younger generation of the Germans, ensuring universal respect for human rights and dignity.

Background: In 2020, the COVID-19 pandemic led to an unprecedented volume of almost 3,000 clinical trials registered worldwide. We aimed to describe the COVID-19 clinical trial research agenda in Germany during the first year of the pandemic. Methods: We identified randomized clinical trials assessing interventions to treat or prevent COVID-19 that were registered in 2020 and recruited or planned to recruit participants in Germany. We requested recruitment information from trial investigators as of April 2021. Results: In 2020, 65 trials were completely (n=27) or partially (n=38) conducted in Germany. Most trials investigated interventions to treat COVID-19 (86.2%; 56/65), in hospitalized patients (67.7%; 44/65), with industry funding (53.8%; 35/65). Few trials were completed (21.5%; 14/65). Overall, 187,179 participants were planned to be recruited (20,696 in Germany), with a median number of 106 German participants per trial (IQR 40 to 345). From the planned German participants, 13.4% were recruited (median 15 per trial (IQR 0 to 44). Conclusions: The overall German contribution to the worldwide COVID-19 clinical trial research agenda was modest. Few trials delivered urgently needed evidence. Most trials did not meet recruitment goals. Evaluation and international comparison of the challenges for conducting clinical trials in Germany is needed.

Abstract:
Building on Ralph Giordano's narrative of the Germans' “second guilt”, the author presents and analyses four patterns of treatment of Nazi criminals in post-war Germany and their reflection in historiography. With regard to the Soviet practice of their legal prosecution, the author critically examines the theses about its “propaganda orientation” and “excessive rigidity” of the sentences handed down, while the actions of the Western occupation authorities are characterised by an arbitrary and politically motivated approach. Much of the article is devoted to a comparative analysis of how the problem of punishment for Nazi crimes was, or was not, addressed in the two German states and in unified Germany. The consistent efforts of the GDR authorities to identify and prosecute Nazi criminals have been duly highlighted and recognised. The author traces the winding path of “mastering the [Nazi] past” in West Germany: from the first wave of (largely ineffective) trials in the 1940s to the complete stagnation in the mid-50s and the relative growth of war crimes and crimes against humanity cases opened in subsequent years. The shortcomings of this judicial practice and the acquittal patterns reflected in German historiography are discussed and evaluated drawing on a broad source base.

Abstract:
West Germany had to come to terms with its wartime past in order to function on the international arena. This topic was also widely commented on in Polish press. Poland, which was one of the countries most affected by the extermination policy of Nazi Germany, was inevitably interested in holding the Nazis accountable for their crimes. Moreover, the authorities of the People’s Republic of Poland wanted German crimes to be exposed all the time. In this way, the topic of Soviet crimes was avoided. Hence, the theme of punishment for Nazi war crimes was often discussed in the press. Many articles emphasised the pathological system of prosecuting the Nazis in West Germany, pointing to the post-war careers of the war criminals. Reluctance to face the past, exhibited primarily by the older generation, was also emphasised. The young generation of Germans, untouched by the war past, was to strive for moral renewal. It should be stressed that the post-war trials concerned only a small number of actual criminals, and the penalties were often disproportionate to the crimes committed.

Abstract German-American relations have been impacted by the war in Ukraine for reasons that have to do with domestic and foreign policy challenges. Germany is struggling with its responsibilities to increased expectations in Washington and within the European Union. The responses in Berlin to the Russian invasion of Ukraine have resulted in tensions within Europe as Germany tries to shape its policies around what Chancellor Olaf Scholz has called the Zeitenwende (turning point) of German foreign policy. The u.s. has also signaled its expectations that Germany needs to be a partner in sharing the burden of confronting Russian threats in Ukraine and Europe. Another challenge for German-American relations is emerging around relations with China, which may generate friction across the Atlantic as the United States seeks to confront China on the global stage while Germany remains tightly connected to China as its largest trade partner. How and why Germany and the United States need each other is in transition.

Abstract:
Carl Schmitt is usually perceived as the theorist of total state, total war and total hostility. In the article, the author however tries to show that from 1937 to 1944, Schmitt was arguing that total war and total hostility were dangerous for Germany (as well as for the rest of Europe) and warned against perpetuation of all efforts to totalize enemy that started in 1914. In his theoretical endeavors in this period there was place for the total state only - and especially for the total state strong enough to resist temptation of declaring total war on total enemy. The total state he recommended Hitler and his Nazi comrades was German Reich, as a part of Europe ordered and divided in the huge spaces (Grossraumordnung). Positioned in the centre of Europe, between the rest of the powers (France, Italy, USSR as well as the Scandinavian states), Germany should be careful enough to wage war only against its Eastern enemies (Poland and maybe USSR) and only in order to achieve 'just' borders. Occupying in this way its huge space Germany should devote itself to the task of exploitation of various peoples such as Poles, Chechs and Slovaks, which were perceived as incapable of having their states and doomed to serve the master race - the Germans.

Abstract:
The author tries to analyse the picture of a German as emerging from biographical interviews with the oldest generation of the new inhabitants of an ex-German town (Krzyż, German Kreuz Ostb.), the first post-war settlers in the “recovered territories”. The author shows how people coming from the Polish Eastern Borderland, Great Poland and Central Poland remember their pre-war German neighbours, the German invaders and the Germans expelled from Krzyż. The reason for the predominantly favourable picture of a German may be found in the experiences of the interviewees’ lives, who during the war and in the post-war period suffered the greatest wrongs not on the part of the Germans, but the Soviets. It is also noteworthy that the repatriates from the Eastern Borderland perceive a similarity between the fate of the Poles and Germans expelled from their homes, though they do not deny the Germans’ guilt and responsibility for starting World War II.

Sports have always been used to promote the nation state and the invention of national traditions with national symbols such as flags and national hymns playing an important role. This article looks at the peculiar situation of the post-war period when two Germanys established themselves also in the field of sports, yet cooperated in some athletic disciplines, and, most important of all, at the Olympic Games until 1968. This raised a great number of delicate political questions, particularly the politics of the nonrecognition of the GDR which strove hard to establish itself internationally by way of the international sports movement. Konrad Adenauer and the German Sports Organization clashed on this issue which brought to the fore the question of a German and an emerging West-German identity. In order to describe this negotiation of the nation state in the realm of sports, this article tries to make fruitful use of the term postnationalism in order to understand the ambiguities of identity of Germans towards their nation state. It also takes a brief look at the Olympic Games of 1972, which epitomizes more than anything else the peculiar postnationalism of the Federal Republic.

Abstract This study investigates the translational practices of far-right activists in Germany through content analysis of storytelling about the January 6 storming of the US Capitol in influential German alternative news websites. Findings reveal how far-right commentators used their intermediary position to re-narrate, translate, and convert ‘mainstream’ accounts of an exceptionally contentious event into stories supporting far-right- wing and extremist identities. Re-narrations of January 6 events characterized protesters as victim-heroes and contrasted them with the true villains responsible for the chaos and violence, which included a broad spectrum of political actors on the ideological left writ large.

Abstract:
In the aftermath of World War II the United States embarked on the largest-scale war crimes punishment program in its history. In addition to the well-publicized trials of the Nazi leadership at Nuremberg the U.S. Army prosecuted 1,676 lesser war criminals in the American zone of occupation in Germany. The Dachau trials, as they later became known, were the culmination of the Army's concentrated effort to investigate, apprehend, and interrogate suspected war criminals in the last months of the war. The trials revived the American tradition of war crimes prosecution in military courts. Their purpose was to punish the perpetrators, educate the public about the crimes of the Nazi regime, and help democratize the Germans. The defendants included Nazi military and state officials, concentration camp personnel, as well as German civilians accused of killing and mistreating allied nationals in violation of the laws of war. The trials provided the earliest glimpse into the identity of individual perpetrators, life in the Nazi concentration camps, and the attitudes of the German population toward captured American prisoners of war. This study examines the role of the U.S. Army in bringing war criminals to justice in Germany. It explores the historical, political, legal, and military origins, implementation, and significance of the Dachau trials. It argues that through a systematic judicial response to Nazi crimes, the Army helped punish the perpetrators, protect its troops, and advance American occupation goals in Germany. Yet legal limitations prevented the Army from addressing certain Nazi-perpetrated crimes or presenting a coherent historical narrative that could have assisted in reshaping German collective memory. Nevertheless, through the Dachau trials the Army provided some degree of retribution; created a symbolic separation of Germany's past from its future; and promoted an early discussion on individual guilt and acceptance of history.

Abstract:
This thesis is a study of the problem of subjectivity and prostitution in the Middle Ages. Three legal case studies of unpublished archival material and one chapter focussing on fictional texts from late mediaeval Germany and Switzerland are used to investigate the conditions of prostitutes' subjectification in law and literature. The thesis takes impetus from Ruth Karras's recent articulation of the problem of prostitution and sexuality, seeking to engage critically with her notion of “prostitute” as a medieval sexual identity that might be applied to any woman who had extra-marital sex. In dealing with trial records, it also aims to make a methodological contribution to the study of crime and the problem of locating the individual. Chapters I-III examine the records of criminal cases featuring the testimony of prostitutes, or women who risked such categorisation, to consider the available subject positions both within and outwith the context of municipal regulation. Whilst acknowledging the force of normative ideas about prostitutes as lustful women, these chapters argue that prostitutes' subject positions in legal cases were adopted according to local conditions, and depended upon the immediate circumstances of the women involved. They also consider trial records as a form of masculine discourse, arguing that an anxious masculine subject can be seen to emerge in response to the phenomenon of prostitution. Chapter IV expands this discussion by drawing on literary texts showing how prostitutes prompted concern on the part of male poets and audiences, for whom their sexual agency was a threat which belied their theoretical status as sexual objects. Note: Transcriptions of the legal cases making up chapters I-III are provided in Appendices A, B, and C.

The aim of this study1 is to investigate cultural similarities and differences in the transmission of general and domain-specific value orientations (individualism/collectivism, and value of children) within German and Indonesian families. Supposing that both cultures differ with respect to developmental pathways of independence and interdependence, we asked if the extent of intergenerational transmission of values within families differs between Germany and Indonesia, and we studied possible cultural differences in intergenerational transmission with respect to different value contents. More precisely, we asked if there is a difference in transmission of values that are highly versus not highly endorsed by the members of the respective culture. The sample is part of the cross-cultural study “Value of Children and Intergenerational Relations” and included altogether 610 German and Indonesian motheradolescent dyads as well as altogether 200 triads of maternal grandmothers, mothers, and adolescents. Results showed intergenerational transmission of values between adjacent generations both in the German and the Indonesian sample, but transmission of individualistic values was higher in the Indonesian sample. The results are discussed under a theoretical framework of cultural specifics of intergenerational transmission.

Abstract:
Despite the increasingly deteriorating international situation in 1938 and despite the increasingly tense domestic political situation in Czechoslovakia (which we briefly described above) and despite the evident evidence that armed conflict in Central Europe is increasingly inevitable, the optimistic mood prevailed in Czechoslovak society. If we look at the given situation through the lens of the time, it is clear to us that Czechoslovak society could not afford defeatism at that time. Even though the parliamentary and political system of the Czechoslovak Republic suffered a major blow due to the critical events of September 1938, this did not mean that the government of the Czechoslovak Republic planned to completely surrender to the dictates of Germany and its allies. As the mood of the time shows, the society of Czechoslovakia was actively prepared to defend its democratically elected government and its democratic Masaryk political system, which was the basic pillar of democracy throughout the existence of the first Czechoslovakia. The government of the Czechoslovak Republic tried in every possible way to solve the nationality problem that arose in the Czechoslovak Republic. It can be said, however, that this political struggle to solve this problem was already lost, since Henlein‘s Sudeten German Party and even the German politicians themselves were not interested in solving the minority problem in Czechoslovakia, but rather in the destruction of Czechoslovakia as such, either through a peaceful diplomatic or political by way of or through the Fall Grünn, i.e., the military liquidation of Czechoslovakia. I am aware that the issue described above is only a short excursion that points to a much more complex topic that deserves a separate, more detailed, and especially extensive treatment. The internal political situation in Czechoslovakia before the Munich Agreement is a topic that I will certainly focus on in more detail in my rigorous work, and in this work, I plan to point out in more detail why the solution to the nationality problem in Czechoslovakia was a lost political as well as diplomatic battle of the Czechoslovakian government.

The storming in Berlin of the Reichstag in August 2020, the US Capitol in January 2021, and the Brazilian Supreme Court in Brazil in January 2023 were all violent events where individuals and groups attempted to overthrow or challenge democratically elected governments. While the specific circumstances and motivations of each case differ, there are common action triggers, including: the widespread presence of conspiracy theories; the successful misuse of social media for anti-government mobilisation; and the mainstreaming of extremist and antidemocratic rhetoric through political legitimisation. With these three variables in mind, this policy brief conducts a comparative analysis of the elements that allowed for insurrection to happen in Germany, the US, and Brazil. This paper aims to help understand whether there are elements that make democracies especially vulnerable to violent insurrections and, in identifying them, propose ways forward to make counter-terrorism and prevention policies stronger.

Additionally, we considered additional sources to identify trials that may not have been identified through electronic search. Two reviewers independently selected included studies, extracted data, and assessed risk of bias. We performed a quantitative synthesis (meta-analysis) and prepared summary tables of findings as recommended by the GRADE group. The results of this review were presented to a team of clinical experts from the medical clinic service of the German Hospital of Buenos Aires, who analyzed and made judgments for each of the proposed criteria within the framework of the evidence for the decision. After making judgments for each criterion, the experts formulated the clinical recommendation for the problem of interest. Result Through the search strategy, 514 references were identified and examined by title and abstract. Of these, 17 references were included for full-text evaluation. Finally, 2 randomized clinical trials were included. The evidence on the use of CT or venous Doppler to determine the duration of anticoagulation in patients with thromboembolic events of any type is very uncertain. The evidence on the use of tomography or venous Doppler to determine the duration of anticoagulation in patients with idiopathic thromboembolic events secondary to transient and/or chronic risk factors (patients with cancer) is very uncertain. Abstract:
Cruise SO268 is fully integrated into the second phase of the European collaborative JPI-Oceans project MiningImpact and is designed to assess the environmental impacts of deep-sea mining of polymetallic nodules in the Clarion-Clipperton Fracture Zone (CCZ). In particular, the cruise aimed at conducting an independent scientific monitoring of the first industrial test of a pre-protoype nodule collector by the Belgian company DEME-GSR. The work includes collecting the required baseline data in the designated trial and reference sites in the Belgian and German contract areas, a quantification of the spatial and temporal spread of the produced sediment plume during the trials as well as a first assessment of the generated environmental impacts. However, during SO268 Leg 1 DEME-GSR informed us that the collector trials would not take place as scheduled due to unresolvable technical problems. Thus, we adjusted our work plan accordingly by implementing our backup plan. This involved conducting a small-scale sediment plume experiment with a small chain dredge to quantify the spatial and temporal dispersal of the suspended sediment particles, their concentration in the plume as well as the spatial footprint and thickness of the deposited sediment blanket on the seabed.

Additionally, we consider additional sources to identify referencias that could not have been identified through electronic search. Two reviewers independently selected the studies included, extracted data and evaluated the risk of bias. We perform a quantitative synthesis (meta-analysis) and prepare summary tables of findings as recommended by the Grade Group. The results of this review were presented to a team of clinical experts of the internal medicine department of Hospital Alemán of Buenos Aires who analyzed and issued judgments for each of the criteria proposed within the framework of evidence to the decision. After issuing the judgments for each criterion, experts formulated the clinical recommendation for the problem of interest. Result Through the search strategy, 331 references were identified that were examined by title and summary. Of these, 14 references for the evaluation by full text were included. Finally, 2 randomized clinical trials were included. The bivalent vaccine against RSV in pregnant women probably decreases the risk of respiratory infection, severe respiratory infection and hospitalization by RSV in the newborn. The bivalent vaccine against RSV in pregnant women probably does not increase the risk of presenting serious adverse events in the mother and does not generate an increase in non -serious adverse events (both in the mother and in the newborn). The bivalent vaccine against RSV in pregnant women could generate a slight increase in serious adverse events in the newborn (13 more events for 1,000 newborns), however the certainty of evidence is low. Clinical recommendation Based on this body of evidence, the German Hospital of Buenos Aires conditionally recommends the use of the bivalent vaccine for RSV in pregnant patients (32 to 36 weeks of gestation) (CONDITIONAL RECOMMENDATION IN FAVOR, LOW CERTAINTY IN THE EVIDENCE). Conclusions The bivalent vaccine against RSV in pregnant women presents significant benefits by reducing the risk of severe respiratory infections in newborns, supported by overall safety in pregnant women.

This report summarizes the findings of a study carried out to evaluate the agronomic performance and sensory acceptance by small holder farmers of six biofortified orange-fleshed sweetpotato (OFSP) varieties that were first introduced from CIP’s sweetpotato breeding hub for Southern Africa in Mozambique. The study was participatory and carried out under different agroecological environments in Zimbabwe. The six OFSP varieties, namely Alisha, Victoria, Delvia, Sumaia, Namanga and Irene were planted in the 2019/20 agricultural season along with two non-biofortified white-fleshed local varieties, namely Chingova and German II, at seven DR&SS research stations (Kadoma, Marondera, Harare, Henderson, Gwebi, Makoholi and Panmure) and 120 farmer managed on-farm trial sites in 12 LFSP districts of Bindura, Gokwe North, Gokwe South, Guruve, Kwekwe, Makoni, Mazowe, Mount Darwin, Mutasa, Mutare, Shurugwi and Zvimba. At all but one of the research stations, two trials were set up, one under irrigation and the other under rain-fed conditions. On-farm trials were established following the Mother-Baby Trial approach with 2 mother trials and 8 baby trials per district. In each of the districts, one mother trial was planted under irrigation while the other was rain-fed. All the baby trials were rain-fed.
